SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 30, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. BASIS OF APPLICATION: Request for a Lot Waiver under Section 280-11 to immerge a vacant land area of 22,451 square feet(SCTM 1000-122-5-23.4) from an adjacent land area of 20,313.32 square feet (SCTM 1000-122-5-23.5), based on the Building Inspector's Notice of Disapproval pursuant to Section 280-10A, determining the properties have been merged. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 2, 2014 at which time written and oral evidence were presented. Pursuant to § 280-11 the Applicant has submitted documentation, to the satisfaction of the Board that these lots were merged consequent to the death of the owners. There have been no transfers of ownership outside the family since the time merger was effected. Pursuant to §280-11, the Zoning Board finds that; Page 2 of 2—October 16,2014 ZBA#6796—Wilsberg SCTM#1000-122-5-23.4 (1) The waiver would recognize a lot that is comparable in size to a majority of the lots in the neighborhood. A majority of the lots in the neighborhood are improved with single family homes. The un-merged lot would be larger than all of the lots across the street and larger than most of the lots in the immediate block in which it is located. (2) The waiver would recognize a lot that is vacant and has historically been treated and maintained as a separate and independent residential lot since the date of its original creation because the lot remains unimproved and ownership has remained within the applicant's family. Further, this lot was approved by the Southold Town Planning Board in 1985. The Suffolk county Department of Health has approved the lot as a separate buildable lot. (3) The proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or district because the applicant's plan on building a single family home on the lot and the neighborhood consists of single family homes. Any new dwelling would be connected to county water supply and any new septic system would have to meet current standards according to the Suffolk County Board of Health. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. RESOLUTION OF THE BOARD: In considering and balancing the above factors and pursuant to the Waiver Provisions of the Town of Southold Merger Law, Section 280-11, motion was offered by Member Dantes, seconded by Member Weisman (Chairperson), and duly carried to, GRANT the waiver of merger as applied for as shown on the survey by John C. Ehlers dated August 8, 2011 and last updated June 19, 2014, with the following condition: CONDITION 1. Proof that waiver of merger is effected by way of a deed from the applicant to a separate individual or entity conveying title to that portion of the property known as 1000-122-5- 23.4 be provided to the ZBA within 2 years of the date of this decision. The waiver of merger to create the lot in question ("Lot") should be approved because: 1. History of the property shows Town considered the Lot as a valid building lot: a. In 1981, The ZBA in Appeal No 2811 approved division of the adjoining lot tax lot 13, now 13.3 ("Barbara's lot") from what was then tax lot 12 (Westerly Lot), both of which ran from street to street.. The northerly part of the Westerly Lot is now part of the Lot. See Exhibit 1. b. In 1985, the Planning Board approved a subdivision/lot line change to re-arrange existing smaller lots, the former tax lot 12 (Westerly Lot) and an appendage to the West(tax lots 23.2 and 23.3) into two lots, one fronting to the South on Ole Jule Lane ("Paul's Lot"), on which Paul's residence was located, and this current Lot, vacant. Thus, this exact Lot was approved by the Town Planning Board in 1985. See Exhibit 2. c. For many years, there were actually FOUR separate tax map numbers for the Lot and Paul's Lot: 23.2, 23.3, 13.5 and 13.6. So the Wilsbergs certainly paid more than their fair share of property taxes, and the Town Assessor's office recognized these lots as all separate. See Exhibit 3. d. The Lot was SINGLE AND SEPARATE when the merger law passed in 1995-97. 2. The Suffolk County Health Dept. has approved the Lot as a separate buildable lot. 3. The Lot is larger than all of the lots across the street, and larger than most of the lots in the immediate block in which is is located, and in fact, in the Ole Jule Lane area. See Exhibit 4 ' 4. Section 280—9 recognizes a lot if it was a. Not merged; b. Recognized by the Planning Board, which the Lot was in 1985 (280-9A(2)). Section 280-10 provides for an exception to merger if a) the lot is recognized under 280-9, which it was by the Planning Board's 1985 approval, and b) the ZBA granted a lot size variance. Since the Planning Board did not require a lot variance in order to accomplish the lot line change in 1985, this is a de facto recognition by the Town that it is an approved lot and a ZBA variance was not required. The applicant should not be penalized because the Planning Board, in 1985, did not go back to the ZBA to get approval for the subdivision it apprg4ed. 5. The conditions of 280-11 are met by this Lot: a. There is no significant increase in the density of the neighborhood. See Exhibit 4. b. The Lot is consistent with the size of lots in the neighborhood. See Exhibit 4. c. Applicant will sustain economic hardship as he cannot afford to buy another lot. d.
