LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject parcel is 19,341 square feet in an R-40 Zone District. The parcel is improved with a one story single family dwelling. It has 150 feet of frontage on Deerfoot Path, 113.42 feet along its southern property line, 152.94 feet along its western property line and 143.24 feet along its northern property line as shown on the survey dated August 27, 1980 prepared by Frank J. Barylski, LS. BASIS OF APPLICATION: Request for Variance from Article III Section 280-15 and the Building Inspector's August 18, 2014 Notice of Disapproval based on an application for building permit for accessory in-ground swimming pool, at; partial location other than the code required rear yard. RELIEF REQUESTED: The applicant requests a variance to construct an in-ground swimming pool partially in a side yard location, where the code requires only a rear yard location, as shown by the sketch of the proposed pool on a survey prepared by Frank J. Barylski, L.S., dated Aug. 27, 1980. ADDITIONAL INFORMATION: The adjoining property owner to the rear yard testified, at the public hearing, in support of the variance relief requested. Two letters were received in support of the requested variance relief. At the public hearing the applicant was asked to supply information from the pool company regarding backwash and sound level of the mechanicals. In a letter dated October 7, 2014 from Dunrite Pools it states the filter does not require backwashing so no drywell is needed. Additionally, the company provided the decibel levels for the pump and filters and stated they are virtually silent at 10 feet away. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 2, 2014, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property Page 2 of 3—October 16,2014 ZBA46795—Nichols SCTM 1000-103-4-4 and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. In-ground swimming pools are characteristic of residential properties in this neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing rear yard is insufficient in depth in order to locate an in-ground swimming pool completely in a conforming rear yard location. 3. Town Law &267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, the in-ground pool is proposed partially in a rear yard with conforming side yard and rear yard setbacks. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing an in-ground swimming pool partially in a side yard location, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Weisman (Chairperson), and duly carried, to GRANT, the variance as applied for, and shown by the sketch of the proposed pool on a survey prepared by Frank J. Barylski, L.S., dated Aug. 27, 1980. CONDITION: 1. Pool mechanicals shall be placed is a sound deadening enclosure. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Please be advised of the folto`wing. The pool filter to be used is a Hayward 04030 425 square foot cartridge filter. This filter is designed to hotel all of the dirt for the season and requires no backwashing. The cartridges are simply hosed off at the end of the season. Since this filter does not need to be backwashed, no drywell is required, The pool pump is a Hayward SP3200VS Tri Star VS Pump. The pump is a 1.85thp pump which performs at 50-60 decibels when the pump is running on high speed (34$0rpfn). Thepump is sized to run for 20 hours per day at a speed of 1750rpm. This speed is sufficient to circulate the water comple-fely in a 24 hour period and is enough to operate the salt system and heat pump. At 1750 rpm the pump is virtually silent. The pool heat pump is an AquacaI SQ155 Super Quiet heat pump. This heat pump utilizes a large slow rotating fan blade and a completely insulated Scroll compressor. The heat pump operates at 55 decibles which is virtually silent at 16 feet away. In short,care has been taken to assure that no sound from the pool equipment is heard from any neighboring properties.
