SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 19, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 21, 2014. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. However, there is a large stone hill on top of the bluff. The hill's elevation is higher than the proposed pool's elevation. Therefore any water over flow from the pool will not run toward the bluff and will not affect the bluff s stability. Additionally, with the re-positioning of the proposed in-ground swimming pool and the conditions placed on the property, the Board finds the action consistent with the LWRP policy because the amended application locates the proposed pool as far from the top of the bluff as practicable. PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 27,926 square foot waterfront parcel located in an R-40 zone. The property has 19,306 square feet of buildable area. The property has 101.16 feet bordering the Long Island Sound. The property runs 283.68 feet on the East side, 100.00 feet along Sound Drive, and 273.95 feet on the West side. The parcel is developed with a 2 story frame dwelling and an accessory shed. There is a set of wood stairs going from the top of the bluff down to the bottom of the bluff. The highest natural point of the property is on the top of the bluff. From the top of the bluff the property elevation decreases as the property gets closer to the house and street. All is shown on a survey by Kenneth M. Woychuk L.L.S. dated July 15, 2011, last revised 9-13-14. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124, Article XXII Section 280-116 and Article III Section 280-15 and the Building Inspector's July 30, 2013, renewed May 23, 2014, July 30, 2014, Amended August 8, 2014 Notice of Disapproval based on an application for building permit for additions Page 2 of 4—October 16,2014 ZBA#6787—Sadik SCTM#1000-33-1-15 and alterations to an existing single family dwelling and "as built"accessory shed, at; 1) less than the code required side yard setback of 15 feet, 2) more than the code permitted lot coverage of 20%, 3) less than the code required bluff setback of 100 feet, 4) Accessory shed in location other than the code required rear or front yard on waterfront property. RELIEF REQUESTED: The applicant requests variances to construct a swimming pool and raised deck at 40 feet from the top of the bluff. Code requires all structures to be set back at least 100 feet from the top of the bluff. Following construction the applicant requests a variance to build a deck and accessory shed at 5 feet from the property line where code requires 15. The applicant also requests a variance for lot coverage of 22.7 percent where code permits a maximum of 20 percent. Finally,the applicant requests a variance to put an accessory shed in a side yard when code requires accessory sheds to be in a rear yard or front yard for water front properties. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on September 15, 2014 submitted a plan replacing the raised wooden deck with a brick patio, and increasing the proposed set back from the bluff to 48 feet. The proposed side yard setback for the pool is increased to a code conforming15 feet, and the proposed lot coverage was reduced to a code conforming 17.9 percent. This eliminates the need for two variances and increases the applicant's proposed set back from the bluff thereby bringing the plan into more conformity with the codes. ADDITIONAL INFORMATION: Site inspection showed that there is a large hill on top of the bluff. Therefore storm water run off from the pool will slope away from the top of the bluff towards Sound Drive and the proposed pool will not affect the stability of the bluff. There was a prior variance on this property under ZBA file #3502 in 1986. The Board granted a variance to locate a new single family dwelling, attached decks, pool areas, etc. no closer than 65 feet from the top of the bluff, and no disturbance of the land area within 50 feet of the top of bluff and no fill or materials deposited over the bluff. In August 1986, under appeal#3546, the applicant asked for relief to re-grade the area within 50 feet of the bluff,this application was denied. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 4, 2014 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b M. Grant of the variance for the proposed setback from the bluff for a swimming pool and for the as built accessory shed's side yard location will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of water front homes many of which have swimming pools on the seaward side of the homes and with non-conforming bluff setbacks. The accessory shed is located behind a fence and is not visible from the street. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant for the set back from the bluff cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Due to the location of the house the applicant would need a variance to build a pool anywhere in the rear yard. Further, the house's location makes it difficult to build the swimming pool in the front yard without the benefit of an area variance. The benefit sought by the applicant for the as built accessory shed in the side yard can be achieved by some method feasible for the applicant to pursue. The shed can be moved to a conforming location. The benefit sought by the applicant for the accessory shed's side yard setback can be achieved by moving the shed to a conforming side yard setback. 3. Town Law X267-b(3)(b)(3). The variance granted herein for the bluff set back is mathematically substantial, representing 52% relief from the code. However, a swimming pool on the bluff side of the house is typical in this neighborhood and the location of this house makes it difficult to have a swimming pool in a conforming location. The variance granted for the side yard location of the as built accessory shed is mathematically substantial Page 3 of 4—October 16,2014 ZBA#6787—Sadik SCTM#1000-33-1-15 representing 100% relief from the code. However, the accessory shed is set back more than 100 feet from the bluff and its location behind the fence is not visible from the street. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and install leaders and gutters and a drywell for pool dewatering. Moreover, the natural grade of the subject property on the seaward side includes a large stone hill located at the top of the bluff. The hill's elevation is higher than the proposed pool's elevation. Therefore any water over flow from the pool will not run toward the bluff and will not affect the bluff's stability. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of relief as amended is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Schneider, and duly carried, to DENY the in-ground swimming pool as applied for and GRANT the variance relief as amended for the in-ground swimming pool, and shown on the survey prepared by Kenneth M. Woychuk and dated July 15, 2011, last revised 9-13-14, and DENY the accessory shed side yard setback of 0.6' and GRANT, the side yard location for the accessory shed with a conforming side yard setback. Subject to the following conditions: Conditions: 1. Pool mechanicals shall be placed is a sound deadening enclosure. 2. Drywell for pool de-watering shall be installed. 3. The accessory shed shall have a conforming side yard setback. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the actions are INCONSISTENT with the below denoted Policy Standards and therefore are INCONSISTENT with the LWRP. The "as built" accessory shed was constructed without Zoning Board of Appeals review, however, all proposed development should be evaluated in consideration of the past conditions placed on the property. As indicated below, a past Zoning Board of Appeals decision prohibits construction to "not closer than 65'from the top of bluff'. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. The Zoning Board of Appeals granted a variance (Appeal No 3502) in 1986 that conditioned that all construction "shall be permitted not closer than 65' from the top of bluff' (see figure 1 below). The proposed action does not comply with the decision. Aerial analysis shows that the bluff surface is heavily vegetated and relatively stable at this time, however, with consideration of the recent intensity of storm events that have caused the Town's shoreline to experience severe erosion (even when hardened). Figures 2 and 3 below show the subject parcel. The subject premises consists of a total area of 32 ,007 sq. ft. , lot width of 100 feet, and lot depth of 322. 7± feet. The shortest distance from the southerly property line along Sound Drive to the top of the bank/bluff area, as scaled on the April 1 , 1981 survey prepared by Roderick Van- Tuyl , P. C. is shown to be 195± feet. 5. By prior action of this Board , appellant was granted permission to locate a new single-family dwelling with a setback at its closest point from the edge of the top of the bluff/bank at 65 feet. Article XI , Section 100-119. 2, subparagraph A(1 ) requires all buildings proposed on lots adjacent to the Long Island Sound to be set back not less than one-hundred (100) feet from the top of the bluff or bank. 6 . Condition #2 of the Board ' s prior action stipulated as follows : " . . . 2 . There shall be no disturbance of land area within 50 feet of the top of bank, except for maintenance of vegetation , shrubs , etc. . . . " 7 . In the application, it is stated that without permission to regrade this area, the property would be nearly worthless as waterfront property. No evidence has been submitted as required by the Courts to support this claim. 8. It is the position of this Board that it is the intent of Article XI , Section 100-119. 2 , subparagraph A(1 ) of the Zoning Code to prohibit any and all construction within 100 feet of the bluff; and that the relief condi - tionally granted under the prior Appeal , No. 3502 , is an alternative to that initially applied for. Such condi- tions must be adhered to . Construction commenced and has and continued without consideration of possible alternatives for the dwelling construction during the process of this pending application. Removal of an eight-foot high berm in an area 50 feet deep by 100 feet is extensive, and the existence of this berm area was relief upon in granting the prior variance. 91: It is the position of this Board not to allow alterations of this bluff area to remove an eight-foot (dirt) berm of an area 100 feet wide by 50 feet deep for. waterview purposes , as applied herein . The premises in question is located along the north side of Sound Drive, Greenport, is identified on the Suffolk County Tax Maps as District 1000, Section 33, Block 1 , Lot 15, and is more particular- ly referred to as Lot 117, "Map of Section Four-Eastern Shores," filed in the Suffolk County Clerk's Office as Map No. 4586. 2. The subject premises is vacant and consists of a total area of 32,007 sq. ft. , lot width of 100 feet and lot depth of 322.70± ft. The shortest distance from the southerly property line along Sound Drive to the top of bank as scaled on the April 1 , 1981 survey prepared by Roderick VanTuyl , P.C. is shown to be 195 feet. 3. Article XI, Section 100-119.2, sub-paragraph A(1 ) requires all buildings proposed on lots adjacent to Long Island Sound to be set back not less than one-hundred (100) feet from the top of the bluff or bank. 5. As noted in the June 11 , 1986. Report received as requested from the Suffolk County Soil and Water Conservation District, it was noted as follows: _ (a) that this parcel is vegetated with herbaceous and woody plant materials with the general slope of the land to the south; (b) that the bluff face is well vegetated from approximately 12 to 15 feet below the top of .bluff toe, which appears stable at this time, which may be contributed to numerous large boulders along the beach. 6. It is the opinion of the board members that: (a) construction should be located as far back from the bluff's edge as possible; (b) water runoff (including lawn sprinklers, etc. ) be piped toward the south of the bluff, not to drain over the bluff areas and to reduce saturation of the bluff face; (c) no alteration of the land within 50 feet of the bluff should occur. In considering this appeal , the board also finds and determines: (a) that sufficient practical difficulties have been shown to warrant a granting of a variance; (b) the circumstances of the property are unique; (c) there will be no substantial change in the character of the area or detriment to adjoining properties; (d) the relief as stipulated below is not substantial in relation to the requirements; (e) the variance will not in turn case a substantial effect of increased population density or be adverse to the safety, health, welfare, comfort, convenience and order of the town; (f) the interests of justice will best be served by allowing a variance, as noted below. The subject premises has previously been vacant and is presently improved with a single-family .dwelling, constructed under Building Permit #15255Z issued September 10, 1986, and pending at this time. 4. The subject premises consists of a total area of 32,007 sq. ft. , lot width of 100 feet, and lot depth of 322.7± feet. The shortest distance from the southerly property line along Sound Drive to the top of the bank/bluff area, as scaled on the April 1 , 1981 survey prepared by Roderick Van- Tuyl , P.C. is shown to be 195± feet. 5. By prior action of this Board, appellant was granted permission to locate a new single-family dwelling with a setback at its closest point from the edge of the top of the bluff/bank at 65 feet. Article XI, Section 100-119.2, subparagraph A(1 ) requires all buildings proposed on lots adjacent to the Long Island Sound to be set back not less than one-hundred (100) feet from the top of the bluff or bank. 6. Condition #2 of the Board's prior action stipulated as follows: . .2. There shall be no disturbance of land area within 50 feet of the top of bank, except for maintenance of vegetation, shrubs, etc. . . . " 7. In the application, it is stated that without permission to regrade this area, the property would be nearly worthless as waterfront property. No evidence has been submitted as required by the Courts to support this claim. 8. It is the position of this Board that it is the intent of Article XI , Section 100-119.2, subparagraph A(1 ) of the Zoning Code to prohibit any and all construction within 100 feet of the bluff; and that the relief condi- tionally granted under the prior Appeal , No. 3502, is an alternative to that initially applied for. Such condi- tions must be adhered to. Construction commenced and has and continued without consideration of possible alternatives for the dwelling construction during the process of this pending application. Removal of an eight-foot high berm in an area 50 feet deep by 100 feet is extensive, and the existence of this berm area was relief upon in granting the prior variance. 91. It is the position of this Board not to allow alterations of this bluff area to remove an eight-foot (dirt) berm of an area 100 feet wide by 50 feet deep for waterview purposes, as applied herein. In considering this appeal , the Board also finds and determines: (a) the relief requested is not the minimal necessary; (b) the difficulties claimed are not sufficient to warrant the relief as requested; Page 3 - Appeal No. 3546 Matter of GREGORY FOLLARI Decision Rendered June 18, 1987 (c) the information submitted is not sufficient to support a granting of this application; (d) the circumstances are unique; (e) to grant the relief as applied is not within the spirit or intent of the zoning ordinance; (f) there are alternatives available other than a variance; (g) in view of the manner in which the difficulties arose and in view of all the above factors, the interests of justice will be served by denying the application, as applied.
