SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions,without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 25, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject property is located in the R40 Zone District and is non- conforming with 15,000 sq. ft. It is improved with a one story framed dwelling with attached garage, three sheds, a hot tub and attached decks. It has 100.00 feet of frontage on Osprey Nest Road, 150.00 feet along Harbor Road, 100.00 feet on the northern property line and 150.00 feet along the eastern property line as shown on a survey prepared by John T. Metzger, LLS, dated January 16, 2014, revised June 10, 2014. BASIS OF APPLICATION: Request for Variances from Article III Section 280-15 and the Building Inspector's July 18, 2014 Notice of Disapproval based on an application for building permit for `as built' accessory sheds and hot tub/deck, at; 1) proposed location other than the code required rear yard, 2) 10X10 shed located at less than the code required minimum side and rear yard setback of 5 feet. RELIEF REQUESTED: The applicant requests variances for a 10 ft. x 10.3 ft. `as built' shed located 4.8 feet from the rear property line where the code requires 5 feet and a side yard setback of 4.3 feet where the code requires 5 feet, a hot tub/deck in the side yard where the code requires a rear yard location and a 6' X 7.6' shed in the front yard where the code requires a rear yard location. Page 2 of 3—October 16,2014 ZBA#6784—Pelletier SCTM#100035-6-17 ADDITIONAL INFORMATION: The subject property is a corner lot and has two front yards. This property was the subject of a prior variance #1268 in 1969 for permission to locate an accessory building in the side yard which was granted for the existing 8.3' X 12.2' shed on the subject property. During the public hearing there were several neighbors that expressed concerns regarding the horse, donkey and chickens on the property. The animals are secured in a fenced in area that is the designated rear yard on this property with two front yards. The 6' X 7.6' shed noted in the disapproval is a plastic bin for storing animal feed. The 10 ft. x 10.3 ft shed has a dirt floor and contains no doors, loft, electric, or water. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 2, 2014 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The 10 ft. x 10.4 ft. accessory shed is in the designated rear yard of the subject property and is setback approximately 80 feet from the front property line on Harbor Road and 135 feet from Osprey Nest Road on this 100 ft. x 150 ft. deep lot. The hot tub/deck are common accessories to dwellings and are located in an area on the subject property that is the most private from street views. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance for the shed in the rear yard since the applicant can move the shed to achieve a conforming 5 foot setback from the rear and side property lines. . However, the applicant testified that the shed was placed in its current nonconforming location in order to line up with the adjacent neighbor's shed to reduce any visual impacts, and the cost to move the shed 9 inches in one direction and 4 inches in the other would be substantial with little gained. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance for the hot tub/deck because the property is a corner lot and has two front yards which substantially reduces the ability to locate them in a conforming location. Also,, the hot tub/deck are located on the side of the dwelling where they are the least visible from the road. The 6' X 7.6' "shed" is actually a plastic bin used for storage and is not a permanent structure. 3. Town Law 4267-b(3)(b)(3). The variance granted herein for the accessory shed is not mathematically substantial, representing 1.4% relief from the code. The variance granted herein for the accessory hot tub/deck is mathematically substantial, representing 100% relief from the code. However,they are located behind the dwelling on a conforming at grade patio and are not visible from the road. The deck referred to in the disapproval is only a step up to the hot tub. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive Page 3 of 3—October 16,2014 ZBA#6784—Pelletier SCTM#100035-6-17 knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory shed, storage bin, and hot tub/deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Weisman (Chairperson), seconded by Member Dantes, and duly carried,to GRANT, the variances as applied for, and shown on the survey prepared by John T. Metzger, LLS, dated January 16, 2014, revised June 10, 2014. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
