SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 16, 2014, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated May 30, 2014. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. However, given that the subject shed replacement is incidental to a legally established gazebo and deck, is located in the X flood zone, and conditions imposed herein limit use to minimal seasonal storage only,the Board finds the action CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The Applicant's property is a 30,953 Sq. ft. waterfront parcel in the R-40 Zone. The northerly lot line measures 75 feet along Peconic Bay Blvd. The easterly lot line measures 354.23 feet along an adjacent residential parcel, the southerly lot line measures 100.92 feet along Great Peconic Bay and the westerly lot line measures 357.46 feet along another residential parcel. The property is improved with a single family dwelling, an accessory garage, a nonconforming wood frame gazebo, and "as built" nonconforming shed and decking, as shown on the survey drawn by Nathan Taft Corwin III, Land Surveyor, dated Nov. 8, 2013. BASIS OF APPLICATION: Request for Variance from Article XXII Section 280-116B and the Building Inspector's March 17, 2014 Notice of Disapproval, amended July 1, 2014, based on an application for building permit for"as built"accessory structures(shed/deck), at; 1) less than the code required bulkhead setback of 75 feet. RELIEF REQUESTED: The applicants request a variance to laJalize an"as built" accessory structure, specifically a +/- 40 sq. ft. shed with a bulkhead setback of 20 ft. 3 inches instead of the Code required 75 feet. The deck is determined to be on-grade. Page 2 of 3—October 16,2014 ZBA#6753—Ranson SCTM#1000-126-5-2.1 ADDITIONAL INFORMATION: The property was the subject of prior ZBA decision #5658, dated March 10, 2005, in which the applicant was granted a 3.5 foot side yard setback, a 33.4 foot combined side yard setback and a 64 foot bulkhead setback. The file contains a letter submitted by a neighbor expressing support for the applicant's project. A pre-CO was issued in August 1994 #z-23167 for a single family dwelling, accessory garage and wood platform roofed over, bulk-headed property. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held public hearings on this application on June 5, 2014, adjourned on July 10, 2014, adjourned on Aug. 7, 2014, and a public hearing on October 2, 2014, at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Although this shed was not included in the Pre-CO, the shed was not, and will not be uncharacteristic of the neighborhood. The shed will enable the applicant to continue to remove beach items like chairs from the beach when not being used, and store them in a nearby enclosure. This type of storage will enhance the overall appearance of the beach and shoreline. 2. Town Law k267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The "as-built" shed was constructed without benefit of a permit, and it is not feasible to move it to a conforming location and still reasonably retain its functionality as an accessible beach equipment storage area adjacent to the nearby beach. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 73%relief from the code. However,the shed is only 10.4 ft. long x 4 ft. deep x 5.4 ft. high at the front. A person cannot stand inside the shed and at 40 sq. ft. +/- the Board finds that this shed is incidental to the legally established accessory gazebo and deck. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a storage shed, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Horning, seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variance as applied for, and shown on survey drawn by Nathan Taft Corwin III, Land Surveyor, dated Nov. 8, 2013, and the drawings labeled sheet number A 10 1 by James J. Subject parcel prior to construction of structures. Policy 4.1. "Minimize losses of human life and structures from flooding and erosion hazards." The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended: specifically A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The accessory structures were constructed following Tropical Storm Sandy. Due to their placement seaward of the top of bank they are located within a vulnerable area that has developed as a result of bank erosion associated with Tropical Storm Sandy. The erosion has lowered the elevation of the property in this location. Since the elevation has been lowered, it is unclear if the Flood Zone X designation still applies where the accessory structures (shed) have been constructed. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for.- a. or:a. structures which functionally requires a location on the coast or in coastal waters. The accessory structures do not functionally require a location on the coast and are not water dependent. A� A Figure 2. Manage development in floodplains outside of coastal hazard areas so as to reduce adverse environmental effects, minimize the need for future structural flood protection measures, or expansion of existing protection measures and to meet federal flood insurance program standards. A portion of the accessory structures are located within the VE FEMA Flood Zone EL 11 (Figure 3). However, note that the grade elevations in this area have been altered following Tropical Storm Sandy. Accessory structures located within these areas have the potential to suffer high, repetitive loss and pose hazards to life and property during storm surge events. It is recommended that accessory structures be located outside of the hazard areas prone to storm surge and erosion to the greatest extent practicable. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. I remember the Broadview Lodge located on the bay at Peconic Bay Blvd, Laurel, New York, which offered weekly summer rentals. I remember that the Broadview Lodge had a sitting area at the top of the bluff with a solid roof. Under the sitting area and built into the bluff was a bathroom, a shower and dressing room. This property is currently owned by James Abbott. Mr. Goggins called it a gazebo. When I was a boy, we called it a boathouse. 4. The property to At $ of the Broadview Lodge was owned b g Y Spenser Hoag and his wife and described as 8740 Peconic Bay Boulevard, Laurel, New York. I believe they inherited the house. They were both deaf. The Hoag's house also had a boathouse, but it was about half the size as the one at the Broadview. I was informed by Mr. Goggins that this property is currently owned by Michael Ranson. 5. Mr. Goggins brought me to the property located at 8740 Peconic Bay Boulevard, Laurel, New York to determine what, if anything, was different regarding the boathouse and the other beach side structures since before I went into the Army in 1952. I observed the following: a. The Boathouse looks the same. b. The steps going down to the level at the top of the bulkhead looks the same c. The steps down to the beach from the top of the bulkhead looks the same. d. There was a compartment under the boathouse, but I don't remember the size. However, I am sure that the compartment that exists today is about the same size that I remember, but it appears to be newly built. e. I do not remember there being any retaining walls like the cement ones that I saw. f. I do not remember there being any bluestone or slate between the compartment and the top of the bulkhead,just a wooden deck. ROBERT T.
