There remains some additional work or changes ordered by the town which should be finished over the next two(2)weeks,weather permitting. I must object to any discussion of liquidated damages,the town or your engineer has impacted every item of work that is not completed.In addition,we were directed to install a berm and 584 trees as extra work just weeks ago and told to install everything now to address the concerns of the Church Lane community. We also were instructed in this area to remove galvanized chain link fence and put in black vinyl coated chain link fence. This work has been done. As far as the November 1, 2002 substantial completion date is concerned, I must remind you that the town decided to wait until spring to avoid purchasing topsoil and save money. I must also tell you that the contract has never been extended for weather delays. Our firm would vigorously oppose any assessment of liquidated damages. As far as the additional.costs are concerned I have been waiting since our meeting in January to get the town's position on this. I know you were waiting for others on this to decide if you had the money to pay us to complete our contract. It is unfortunate that the money is not available to finish the project. Today, I signed Change Order 13 with exceptions to allow us to get paid for work covered by that order. As stated previously,we have reserved all our claim rights under the contract. I suggest that we get together soon to hopefully resolve these items in a fair way. I spoke to Tom Maher today and he is ready to certify the project complete once the paving is done. The paving has been postponed by the town but should happen next week. We will move the rolls off the landfill today and cover them again. I suggest we inspect them in the spring to see if they are still in good condition. Some time ago,we sent you a letter explaining that we need to charge $3500 for the protection of this material this winter. We have yet to receive a response to this request. As you know, this road was added well after we started the project. In preparing our bid for this project we obviously could not have added in the costs of protecting work we did not have in our contact. We did however make reasonable efforts to protect this work with sand bags at no extra charge to the town. The work was damaged and the subsequent repair charged to the town. The cost of this repair is much less costly than had we protected this area with fabric and gravel and later removed it by hand to continue construction once the temporary road could be removed. Potable water supply source approval was to be the new well onsite as it was only for dust control and watering plants. As you know we bave been using the fire department well on Cox Lane for dust control and watering plants.Bottled water was provided in the office trailer for the Dvirka and Bartducci(D&B) inspectors. 2. Gas Veaotirzg Layer certification in accordance with Addendum 2 Item#13 Section 4.2. This item refers to prequaUed materials from the sand pit as anticipated by the bid documents. As you know, we did not use this source but instead were directed to remove and screen the materials from the adjoining compost site. This material was all tested as placed. All copies of the test results were presented to your site inspectors during the project. Dvirka and Bartilucci 330 Crossways Park Drive Woodbury,NY 11797-2015 RE: Southold Landfill Closure D&B 1314 Dear Mr. Maher: This is in response to your letter dated November 19, 2002 regarding additional costs that may be incurred due to delaying topsoil placement until Spring 2003. You have taken the position that this was our decision and, as such, any costs incurred are our responsibility. We camiot agree with this position. Under the Contract Documents, the Town of Southold is required to provide all organic material for manufacture of topsoil. As of the November 7, 2002 meeting, approximately 10,000 CY of organic,material had yet to be provided. If the material had been provided on time, we would have been responsible for completing the work prior to December 1, 2002. Had this organic material been provided and the topsoil manufactured, seeding would have occurred on time. Local weather conditions after the first of December are not often favorable for seed germination. The germination and growth of grass cover is the primary erosion control for topsoil and barrier protection material. If proper germination did not occur and erosion of the topsoil and barrier protection material did occur, additional materials and work would be required for repairs. This raises the issue of who is responsible for the costs associated with these materials and repairs. The fact stands that any damage is due to the late seeding time. The late seeding time is due to the lack of organic materials available for manufacture of topsoil. The Town of Southold is responsible for not provided enough organic material for manufacture of topsoil. We must therefore conclude that the Town of Southold would be responsible for any costs associated with erosion repair. r The Contract Documents assume that any delays to topsoil installation that may cause concern for seed germination and erosion control are the Contractor's responsibility. These changes are intended to eliminate potential erosion problems and eliminate the need to maintain turf in an inaccessible location. Additionally, concrete retaining wall blocks would be placed on both the northern and southern boundaries of the permanent road. These blocks would prevent any vehicle from straying off the road and traveling over lined area. If approved, performance of this work would result in no net increase to the contract price. The area would be billed as if it were constructed as shown on the contract drawings. Payment would be sought for all barrier protection material, topsoil,, hydroseeding, and erosion control fabric originally intended for the area. However, the area would be constructed as shown on the attached detail. Drawing#1 refers to the typical installation without the separate installation area and Drawing#2 is the estimated layout with the separate installation area. There are 24 additional patches(at"T"locations), 12 additional roll splice seams,and 640 linear feet of additional tie-in seam. Each of these items is in excess of the productivity related increases and requires additional time,setup, testing, and documentation. 4. Additional Quality Control and Engineering Services This item relates to documenting additional start-up welds,destructive seam testing,non- destructive seam testing,inputting the documentation into the computer and finalizing the report. The original bid quantity for transportation of contour grading material at a cost of $3.00 per cubic yard was 36, 000 yards. At this time, the transportation of 63,912 yards has been billed to this item. As such, the Contractor reserves the right to negotiate a higher price for transport of the remaining material, which is estimated at 20, 000 yards. 2. The Contractor's bid price of $3.00 per cubic yard is one half the Engineer' s estimate of $6.00 per cubic yard. I assume that the estimate was justified by a cost analysis. The remaining bidders average $5.67 per cubic yard, justifying the Engineer' s estimate. In seeking an additional $1.85 per yard, the Contractor' s price will still fall well below both the Engineer's estimate and the remaining bidders costs. 3. A cost analysis based on linear foot of material transport allows for a much greater additional charge. The average distance for transport from the borrow pit area to the Eastern side of the landfill is approximately 1300 feet. At a cost of $3.00 per cubic yard, this translates to $0.0023 per foot of transport. The average distance for transport from the 17-acre site to the Eastern side of the landfill is approximately 2700 feet. At a cost of $0.0023 per foot of transport, this equates to $6.23 per cubic yard, well above the total of $4.85 per cubic yard the Contractor seeks. 4. A cost analysis based on equipment rates is as follows: a. The Contractor will utilize two Terex TA40 haulers with a billable rate of $2200.00 per machine per day, one CAT D7 LGP bulldozer with a billable rate of $1800.00 per day, and one Daewoo 330 Excavator with a billable rate of $1800.00 per day. This totals $8000.00 per day for transport and placement of material. Please note that no allowance is made for watering and rolling the material. b. Assuming a production rate of 1400 yards per day when transporting material from the 17-acre site, this equates to $8000.00/1400 cubic yards = $5.71 per cubic yard. During the time in question (yesterday morning), I was in constant communication with Mike Jones (on site), Jim Mulligan (on site)and yourself. Tim Howell was delayed returning from Fishers Island. I do not feel your letter is justified as the intent of the specifications was fulfilled. The specifications are filled with items that if adhered to would cost the town much more money. We have easily saved the town in excess of$100,000 in daily cover alone by not using it. Item 2 in your letter is an issue that has come up periodically during the six (6) months that the material has been stored uncovered outside your on site office trailer. Due to surface conditions present in many test pit excavation areas, Terry Contracting & Materials, Inc. is recommending the use of a crawler excavator for this work. The charge for all equipment and labor associated with test pit excavation will be $1200 per day. Approximately three days of excavation is required to adequately complete the inspection. This is assuming the excavation of test pits at an interval of approximately every 50' - 1001 . This time period may vary depending un the amount of waste found outside the staked waste limits. Should large amounts of waste be discovered, additional time may be needed to effectively determine the extent to which it extends beyond the staked limits of waste. As you are aware, on Friday, August 10, 2001, Terry Contracting & Materials, Inc. commenced test pit excavation. This excavation was undertaken for four hours. During this time, waste was discovered extending beyond the staked limits of waste in the area abutting the sand pit borrow area. This waste vein appears to extend 35' beyond the staked limits of waste at a depth of approximately 13' . The charge for all equipment labor associated with test pit excavation will be $1200 per day. Approxinately three days of excavation is required to adequately complete the inspection. Should large amounts of waste be discovered, additional time may be needed to effectively determine the extent to which it extends beyond the staked limits of waste. I do not know why we were the only ones to come up with this,but certainly, we should not be penalized for it. Most days were spent working on the compost site and Dvirka and Bartilucci(D&B)was onsite for nothing. The town's decision to pay D&B when there was absolutely no activity on site can not be charged to us.Charging us for delays completely caused by the town is unfair. The project still cannot be completed because of the town's delay. This delay is costing money and these costs will be charged to the town. Ttem 16 of these minutes, Removal/Movement of Temporary Access Road to 17-Acre Parcel and Access from Depot Lane, is incorrect as recalled by Robert G. Terry and Timothy J. Howell . Specifically, it is our opinion that the statement, "If necessary during construction of the permanent road and cap, the temporary road would be relocated at no cost to the Town, " was never made. Specifically, vertical sidewalls to a depth of 10' are possible. The looseness of the soils in the areas of installation causes excessive collapse of these sidewalls. The resulting trench siopes from 3' wide at the base to approximately 13' at the top. is a best case scenario. Shoring of the trench is not possible due to he necessary installation of geotextile. We are unaware of any othe- methods that would maintain vertical sidewalls in the trench and allow for Installation of the geotextile. in response to these conditions, we propose that the Gas Migration Control Trenches be constructed as illustrated on the attached drawing. Such installation preserves the vital details of the trenches, i.e. m-Inimum depth of gravel, minimum width of gravel, and geotextile wrap. Additional work and materials necessary to construct the trenches as illustrated would be considered extras. The following quantities and prices should be considered. 1 . Additional Excavation - 4500cy @$2.76/cy $12, 420 2 . Additional Gravel Fill - 4500cy @$15. 00/cy $67, 500 3.
