You are directed to make the following changes in the Contract Documents:
Description: Removal and Consolidation of Vegetation
For each acre(or part thereof)of vegetation removed from and windrowed on the 17-acre parcel adjacent to the landfill,measurement and
payment shall be in accordance with Bid Item 3—Clearing and Grubbing at$1,200/acre(or part thereof).
Since the area of clearing and grubbing required on the landfill will be,at a minimum, 17 acres less than the estimated quantity in the bid
(i.e.,50 acres)there will be no increase in cost to the landfill closure project for clearing and grubbing the 17-acre parcel.
Removal and Stockpiling at Landfill
For each cubic yard(yd3)(in-place volume)of topsoil removed from the 17-acre parcel and stockpiled at the landfill,the Owner will pay
the Contractor $5 (Bid Item 4 — Unclassified Excavation and Relandfilling). Measurement for payment shall be based on surveys
furnished by the Contractor,before and after excavation of soil. The surveys shall be sealed and signed by a New York State licensed land
surveyor and shall be in accordance with the requirements specified for Bid Item 4.
The Contractor shall remove and stockpile approximately 12,700 yd (in-place volume)of topsoil at the landfill.
The Contractor shall use the topsoil to prepare vegetative growth medium for use on the landfill site. One part topsoil shall be mixed with
one part compost and one part sand to produce vegetative growth medium in compliance with NYSDEC's approval for use of topsoil from
the 17-acre parcel. Payment to the Contractor for mixing, processing and placement of vegetative growth medium shall be $7/yd3 (Bid
Item 13A—Vegetative Growth Medium Using On-Site Compost and On-Site Soil from Borrow Area).
There shall be no payment to the Contractor under Bid Item 13B—Contingency Topsoil from Approved Off-Site Sources
Removal and Windrowing Soil on 17-Acre Parcel
For each cubic yard(in-place volume)of soil windrowed on the 17-acre parcel,the Owner will pay the Contractor$2(New Payment Item
31— Topsoil/Loam Removal and Stockpiling). The Contractor shall stockpile the soil in windrows as directed by the Owner.
Approximately 9.1 acres of topsoil(1-foot deep)and 4.6 acres of loam(2 feet deep), collectively, approximately 29,500 cubic yards of
loam and topsoil,will be windrowed on the site. Measurement for payment shall be based on surveys furnished by the Contractor,before
and after excavation. The surveys shall be sealed and signed by a New York State licensed surveyor and shall be in accordance with the
requirements specified for Bid Item 4.
If directed by the Owner,the windrowed soil shall be used by the Contractor as fill material beneath the upper 6 inches of subgrade.The
fill material shall be compacted as specified for relandfilled waste and covered with a minimum of 6 inches of compacted General Fill in
accordance with the Specifications. Measurement and payment for this work shall be in accordance with Bid Item 6—Contour Grading
Material,General Fill and Daily Cover from On-Site Sources at$3/yd'.
Reason for Field Order: This field order is being issued to expedite removal of topsoil and loam from the 17-acre parcel to
relocate yard waste composting operations from the landfill and to avoid the need for contingency
topsoil for closure of the landfill at no additional cost to the Owner for the landfill closure project.

Dear Mr. Maher:
This letter is in response to your June 12,2001 letter to me regarding the Southold
Landfill Closure Project. The procedures detailed in your June 12, 2001 letter regarding
the processing of the manufactured topsoil layer for the Southold Landfill Closure
Project is compliant with the provisions of 360-1.15(b)(10). The approved landfill
closure plans and specifications should be appended with these procedures. We have
contacted Igor Sikirk of our Region 1 Office and he concurs with this modification of the
approved closure plans and he concurs with this approval. The final construction
certification documentation needs to note compliance with these approved procedures
and must be submitted to the Region for Department review and approval upon
construction completion.

Dear Mr. Phaneuf:
As requested, please find below additional information pertaining to the manufacture of
vegetative growth medium for closure of the Southold Landfill.
1. 13,000 cy of topsoil will be removed from the Town-owned 17-acre parcel located
adjacent to the landfill and transported to and stockpiled in the former borrow pit on
the landfill property.
2. Equal volumes of sand, yard waste compost and topsoil, as measured by the bucket of
a bucket loader, will be mixed to create a batch pile of vegetative growth medium.
The pile will be turned using the loader bucket for initial mixing.
3. Following initial mixing, the batch material will be put through a vibrating grizzly
into a hopper and through a soil shredder to a vibrating two-deck screen head. After
passing through two screens, the product will be stockpiled using a 60-foot radial
stocking conveyor ready to be loaded onto an off-road hauler to be placed on the
landfill cap.

Manufactured Topsoil
Dear Mr. Maher:
Below, I have outlined the procedure for mixing/blending topsoil for the above
referenced project. The appropriate percentage is batched together by bucket loader,for
example,if the component required 1/3 soil, 113 sand,and 1/3 compost than the loader
operator could make a batch by mixing an equal number of buckets of each material to
make a batch pile. That pile is then turned over with the loader for the initial mixing.
Next,the material is put through a vibrating grizzly into a hopper and exits the hopper
through a soil shredder on its way up the conveyor to the vibrating two (2)-deck screen
head.After passing through two(2)screens the product is stacked off a 60' radial
stacking conveyor and ready to be loaded on to an off road hauler.
The above process completely mixes the three soil components to create a well
graded, blended growing medium. If you would like to see this performed as described,
our pit on Roanoke Avenue does this on most dry days and I could arrange a site visit at
your convenience. Thank you.

after the date when the Contract Time commences to run as provided in Section 2 of the General Conditions,
and finally completed and ready for final payment in accordance with Section 14 of the General Conditions
within 30 consecutive calendar days after the date of Substantial Completion(Final Contract Time)."

Removal and Windrowing Soil on 17-Acre Parcel
For each cubic yard(in-place volume)of soil windrowed on the 17-acre parcel,the Owner will pay the Contractor$2(New Payment Item
31— Topsoil/Loam Removal and Stockpiling). The Contractor shall stockpile the soil in windrows as directed by the Owner.
Approximately 9.1 acres of topsoil (1-foot deep)and 4.6 acres of loam (2 feet deep), collectively, approximately 29,500 cubic yards of
loam and topsoil,will be windrowed on the site. Measurement for payment shall be based on surveys furnished by the Contractor,before
and after excavation. The surveys shall be sealed and signed by a New York State licensed surveyor and shall be in accordance with the
requirements specified for Bid Item 4.
If directed by the Owner,the windrowed soil shall be used by the Contractor as fill material beneath the upper 6 inches of subgrade.The
fill material shall be compacted as specified for relandfilled waste and covered with a minimum of 6 inches of compacted General Fill in
accordance with the Specifications. Measurement and payment for this work shall be in accordance with Bid Item 6—Contour Grading
Material,General Fill and Daily Cover from On-Site Sources at$3/yd'.
Reason for Field Order: This field order is being issued to expedite removal of topsoil and loam from the 17-acre parcel to
relocate yard waste composting operations from the landfill and to avoid the need for contingency
topsoil for closure of the landfill at no additional cost to the Owner for the landfill closure project.

Landfill Closure Project. The procedures detailed in your June 12,2001 letter regarding
the processing of the manufactured topsoil layer for the Southold Landfill Closure
Project is compliant with the provisions of 360-1.15(b)(10). The approved landfill
closure plans and specifications should be appended with these procedures. We have
contacted Igor Sikirk of our Region 1 Office and he concurs with this modification of the
approved closure plans and he concurs with this approval. The final construction
certification documentation needs to note compliance with these approved procedures
and must be submitted to the Region for Department review and approval upon
construction completion.

Dear Mr. Phaneuf:
As requested, please find below additional information pertaining to the manufacture of
vegetative growth medium for closure of the Southold Landfill.
1. 13,000 cy of topsoil will be removed from the Town-owned 17-acre parcel located
adjacent to the landfill and transported to and stockpiled in the former borrow pit on
the landfill property.
2. Equal volumes of sand, yard waste compost and topsoil, as measured by the bucket of
a bucket loader, will be mixed to create a batch pile of vegetative growth medium.
The pile will be turned using the loader bucket for initial mixing.
3. Following initial mixing, the batch material will be put through a vibrating grizzly
into a hopper and through a soil shredder to a vibrating two-deck screen head. After
passing through two screens, the product will be stockpiled using a 60-foot radial
stocking conveyor ready to be loaded onto an off-road hauler to be placed on the
landfill cap.

Manufactured Topsoil
Dear Mr. Maher:
Below,I have outlined the procedure for mixing/blending topsoil for the above
referenced project.The appropriate percentage is batched together by bucket loader,for
example,if the component required 1/3 soil, 1/3 sand,and 1/3 compost than the loader
operator could make a batch by mixing an equal number of buckets of each material to
make a batch pile. That pile is then turned over with the loader for the initial mixing.
Next,the material is put through a vibrating grizzly into a hopper and exits the hopper
through a soil shredder on its way up the conveyor to the vibrating two (2)-deck screen
head.After passing through two(2)screens the product is stacked off a 60' radial
stacking conveyor and ready to be loaded on to an off road hauler.
The above process completely mixes the three soil components to create a well
graded, blended growing medium. If you would like to see this performed as described,
our pit on Roanoke Avenue does this on most dry days and I could arrange a site visit at

State licensed land surveyor and shall be in accordance with the requirements specified for Bid Item 4. The work also includes removal of
vegetation. The vegetation shall be consolidated into windrows on the 17-acre parcel,as directed by the Owner.
The Contractor shall remove and stockpile approximately 13,600 yd (approximately 8.4 acres at a depth of 1 foot) of.topsoil at the
landfill. Payment for this work will be approximately$68,000.
The Contractor shall use the upper 1 foot of soil to prepare vegetative growth medium for use on the landfill site.One part topsoil shall be
mixed with approximately one part compost and one part sand,to produce the vegetative growth medium in compliance with NYSDEC's
approval for use of the material from the 17-acre parcel. Payment to the Contractor for mixing,processing and placement of the vegetative
growth medium shall be S7/yd3(Payment Item 13A-Vegetative Growth Medium Using On-Site Compost and On-Site Sand from Borrow
Area)which equates to$266,000 for mixing,processing and placement of the estimated 38,000 yd3(in-place volume)of vegetative irowth
medium required. This is an increase of$126,000 over the bid amount for this item based on the estimated quantity of 20,000 yd in the
bid.
There will be no payment to the Contractor under Payment Item 13B-Contingency Topsoil from Approved Off-Site Sources.Based on
the estimated quantity for this item in the bid this will result in an avoided cost for the Owner of$248,400.
Removal and Windrowing of Loam
For each yard(in-place volume)of the soil from the 1 to 3 foot depth-interval removed and windrowed on the 17-acre parcel,the Owner
will pay the Contractor$2(New Payment Item 31-Topsoil/Loam Removal and Stockpiling). The Contractor shall stockpile the soil in
windrows, as directed by the Owner.Measurement for payment shall be based on surveys,furnished by the Contractor, before and after
excavation of the 1 to 3-foot depth interval. The surveys shall be sealed and signed by a New York State licensed land surveyor and shall
be in accordance with the requirements specified for Bid Item 4.
The Contractor shall remove and windrow approximately 27,000 yd (approximately 8.4 acres at a depth of 2 feet)of loam. Payment for
this work will be approximately$54,000.
If directed by the Town, the windrowed loam will be used by the Contractor as contour grading material, general fill and daily cover.
Measurement and payment for this work will be in accordance with Bid Item 6(Contour Grading Material,General Fill and Daily Cover

As requested, we have prepared an accounting of the use of soil from the 17-acre parcel being
developed for a Yard Waste Compost Facility. Based upon the preconstruction topographic
survey and the design drawinglelevations, we estimate that 317,000 in-place cubic yards (cy)
will be removed from the 17-acre parcel for construction of the compost facility. As can be seen
on the following page, all of the material is accounted for and has been or will be used as fill
under the cap or in the Borrow Pit,or for construction of the cap.

Description: Removal and Consolidation of Vegetation
For each acre(or part thereof)of vegetation removed from and consolidated on the 17-acre parcel adjacent to the landfill,measurement
and payment shall be in accordance with Bid Item 3–Clearing and Grubbing at 51,200/acre(or part thereof).
Since the area of clearing and grubbing required on the landfill will be,at a minimum, 17 acres less than the estimated quantity in the bid
(i.e.,50 acres)there will be no increase In cost to the landfill closure project for clearing and grubbing the 17-acre parcel.
Removal and Stockpiling at Landfill
For each cubic yard(yd)(in-place volume)of topsoil removed from the 17-acre parcel and stockpiled at the landfill,the Owner will pay
the Contractor $5 (Bid Item 4 – Unclassified Excavation and Relandfilling). Measurement for payment shall be based on surveys
furnished by the Contractor,before and after excavation of soil. The surveys shall be sealed and signed by a New York State licensed land
survevor and shall be in accordance with the requirements specified for Bid Item 4.
The Contractor shall remove and stockpile 12,700 yd'of topsoil at the landfill.
The Contractor shall use the topsoil to prepare vegetative growth medium for use on the landfill site. Ont:part topsoil shall be mixed with
one part compost and one part sand to produce vegetative growth medium in compliance with NYSDEC's approval for use of topsoil from
the 17-acre parcel. Payment to the Contractor for mixing, processing and placement of vegetative growth medium shall be$7/yd'(Aid
Item 13A–Vegetative Growth Medium Using On-Site Compost and On-Site Soil from Borrow Area).
There shall be no payment to the Contractor under Bid Item 13B–Contingency Topsoil from Approved Off-Site Sources
Removal.and Windrowine Soil on 17-Acre Parcel
For each cubic yard(in-place volume)of soil windrowed on the 17-acre parcel,the Owner will pay the Contractor$2(New Payment Item
31– Topsoil/Loam Removal and Stockpiling) The Contractor shall stockpile the soil in windrows as directed by the Owner.
Approximately 9.1 acres of topsoil (1-foot deep)and 4.6 acres of loam(2 feet deep), collectively, approximately 29,500 cubic yards of
loam and topsoil,will be windrowed on the site. Measurement for payment shall be based on surveys fumished by the Contractor,before
and after excavation. The surveys shall be sealed and signed by a New York State licensed surveyor and shall be in accordance with the
requirements specified for Bid item 4.
If directed by the towner,the windrowed soil shall be used by the Contractor as fill materiul beneath the upper 6 inches of subgrade.The
011 material shall be compacted and covered with a minimum of 6 inches of compacted General Fill in accordance with the Specifications.
Measurement and payment for this work shall be in accordance with Bid Item 6–Contour Grading Material,General Fill and Daily Cover
from On-Site Sources at S3/yd3.
Reason for Field Order: This field order is being issued to expedite removal of topsoil and loam from the 17-acre parcel to
relocatt;yard waste composting operations from the landfill and to avoid the need for contingency
topsoil for closure of the landfill at no additional cost to the Owner for the landfill closure project.

Dear Mr. Howell:
We have reviewed the revised Construction Schedule, which was received by this office on June
15, 2001, for conformance with the requirements of the Contract Documents for the referenced
project. Our comments are presented below.
1. The schedule is difficult to read. Refer to Comment 3 of our letter dated June 11th
concerning the construction schedule format requirements. We are requesting that if
the schedule is to be furnished in 11" by 17" format, you use a larger font and
consider putting the schedule on 3 or more pages.
2. Notice to Proceed, Substantial Completion and Final Completion should be shown as
occurring on specific dates,not over an entire week.
3. Product delivery dates are not shown for several items including, drainage pipe, Swale
and anchor trench drains, materials for construction of roads, fencing and aggregates.
4. Note prior to excavating any Contour Grading Material, General Fill and Daily
Cover, submittal of a list of vehicles to be used to transport the materials, including
the water volume of the body of each vehicle, is required. Refer to 1.14(D)(6)(a) of
the Specifications. This submittal is required prior to initiating filling in the Cox
Lane access route.

5. In accordance with Comment 15 of our letter dated June 11, the time frame for
removal of existing fence to be disposed should be shown.
6. We note that we have not received a response to Comments 16, 17, 18 and 20 of our
letter dated Jlme 11.
7. The schedule shows Unclassified Excavation beginning the week of June 25, 2001
and Daily Cover beginning the week of July 16, 2001. As a result, we note paragraph
2.3(I)(3)(d) requires placement of 6 inches of Daily Cover over any exposed waste at
the end of each day of waste excavation.
8. The schedule shows installation of swale underdrains and anchor trench drains
beginning the week of July 16, 2001, several week prior to the scheduled start dates
for installation of the geomembrane (i.e., week of September 3, 2001) and installation
of the geocomposite (i.e., week of October 1, 2001). As a result, clarification is
requested regarding the planned sequence of installation of the swale underdrains and
anchor trench drains.
In light of the above, we have stamped the schedule "Approved as Noted," contingent on the
specific comments above being addressed in a revised schedule, which we are requesting that
you deliver to this office by June 20, 2001.

vegetation. The vegetation shall be consolidated into windrows on the 17-acre parcel,as directed by the Owner.
The Contractor shall remove and stockpile approximately 13,600 yd' (approximately 8.4 acres at a depth of 1 foot) of topsoil at the
landfill. Payment for this work will be approximately$68,000.
The Contractor shall use the upper 1 foot of soil to prepare vegetative growth medium for use on the landfill site.One part topsoil shall be
mixed with approximately one part compost and one part sand,to produce the vegetative growth medium in compliance with NYSDEC's
approval for use of the material from the 17-acre parcel. Payment to the Contractor for mixing,processing and placement of the vegetative
growth medium shall be$7/yd3(Payment Item 13A-Vegetative Growth Medium Using On-Site Compost and On-Site Sand from Borrow
Area)which equates to$266,000 for mixing,processing and placement of the estimated 38,000 yd (in-place volume)of vegetative rrowth
medium required. This is an increase of 5126,000 over the bid amount for this item based on the estimated quantity of 20,000 yd to the
bid.
There will be no payment to the Contractor under Payment Item 13B-Contingency Topsoil from Approved Off-Site Sources. Based on
the estimated quantity for this item in the bid this will result in an avoided cost for the Owner of$248,400.
Removal and Windrowing of Loam
For each yard(in-place volume)of the soil from the 1 to 3 foot depth-interval removed and windrowed on the 17-acre parcel,the Owner
will pay the Contractor$2(New Payment Item 31 -TopsoiVLoam Removal and Stockpiling). The Contractor shall stockpile the soil in
windrows, as directed by the Owner. Measurement for payment shall be based on surveys, furnished by the Contractor, before and after
excavation of the 1 to 3-foot depth interval. The surveys shall be sealed and signed by a New York State licensed land surveyor and shall
be in accordance with the requirements specified for Bid Item 4.
The Contractor shall remove and windrow approximately 27,000 ydl(approximately 8.4 acres at a depth of 2 feet)of loam. Payment for
this work will be approximately$54,000.
If directed by the Town, the windrowed loam will be used by the Contractor as contour grading material, general fill and daily cover.
Measurement and payment for this work will be in accordance with Bid Item 6(Contour Grading Material,General Fill and Daily Cover
from On-Site Sources)at S3/cy.

17-acre parcel,to relocate wood chips and to avoid the need for contingency topsoil for closure of

SUBJECT: Removal of Loam From 17-Acre Parcel
I am writing to confirm that Terry Contracting may resume the movement of loam from
the 17-acre parcel adjacent to the landfill for use under the landfill cap, as per Field Order
#1.
As you know, Terry was asked to suspend removal of the loam to allow time for the
Town to work out an agreement with the Town of Brookhaven to remove the material, at
a potentially significant cost-savings to the Town of Southold. However, Andrew Wilson
of Brookhaven has maintained that they are unable to pay anything toward the costs of
excavation and loading of loam, thereby eliminating the cost-savings potential. In
addition, Terry has indicated he would need to construct a special road for the
Brookhaven trucks at additional cost to the Town of Southold. He also said he would
need approximately 4 acres to stockpile the loam for Brookhaven, which would severely
restrict the Town's plans for use of the parcel for composting for a number of months.
Finally, I understand that our contract with Terry could allow for claims against the Town
should the loading of Brookhaven's vehicles result in any work delays for him.
For these reasons, it was determined by myself and Councilman Romanelli that the
Brookhaven option was not in the best interests of the Town of Southold and that the
excavation of loam from the 17-acres for incorporation under the cap should be delayed
no longer.

Dear Mr. Desmarais:
This is to confirm my understanding, based on our telephone conversation on July 17, 2001, that
your conceptual plan for development of the 17-acre parcel adjacent to the Southold Landfill for
yard waste composting is consistent with current plans for clearing of vegetation and removal of
topsoil and loam from the parcel. A description of work which has been performed to date, as
well as present plans for remaining work to be performed, is presented below.
Presently, vegetation has been cleared from the 17-acre parcel and windrowed along the eastern
and western perimeters of the parcel. In addition, topsoil has removed from an area of
approximately 12.5 acres. Topsoil has not been removed from an approximately 50-foot wide
buffer area along the eastern and western perimeters of the parcel.
The plans are to use all of the topsoil which has been removed for construction of the landfill cap
and also to remove all of the loam within the 12.5 acres for use in construction of the landfill
cap. The vegetation which has been windrowed on the eastern and western perimeters, as well as
the existing topsoil and loam in the 50-foot wide buffer areas along the eastern and western
perimeters would remain.

parcel. Payment for this work will be approximately$58,000.
5. The Contractor shall use approximately 13,000 yd3 (in-place volume) of the soil to
prepare vegetative growth medium for use on the landfill site. One part topsoil/loam
shall be mixed with approximately one part compost and one part sand, to produce
the vegetative growth rnedium in compliance with NYSDEC's approval for use of the
material from the 17-acres. Payment to the Contractor for mixing, processing and
placement of the vegetative growth medium shall be $7.00/yd3 (Payment Item 13A —
Vevetative Growth Medium Using On-Site Compost and On-Site Sand from Borrow
Area) which equates to $266,000 for mixing, processing ano piacemenr of M,
