BE IT ENACTED, by the Town Board of the Town of Southold as follows:
I. Chapter 92, Section 92-41 (Vehicles & Traffic') of the Code of the Town of Southold is hereby
amended as follows:

STOPPING ANYTIME AT THE INTERSECTION OF ROCKY POINT ROAD AND AQUAVIEW
AVENUE, EAST MARION".

COUNCILMAN MOORE: "NOTICE IS ItEREBY GIVEN that there has been presented to the
Town Board of the Town of Southold, Suffolk County, New York on the 4th day of December, 2001, a
Local Law entitled "A Local Law in Relation to No Parking, Standing and Stopping anytime at
the intersection of Rocky Point Road and Aqnaview Avenue, East Marion", now, therefore, be it
NOTICE IS ItEREY FURTHER GIVEN that the Town Board of the Town of Southold will hold a
public hearing on the aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold,
New York on the 18th day of December, 2001 at 4:35 p.m., at which time all interested persons
will be given an opportunity to be heard.
This proposed "A Local Law in Relation to No Parking, Standing and Stopping anytime at the
intersection of Rocky Point Road and Aqnaview Avenue, East Marion", which reads as follows:

BE IT ENACTED, by the Town Board of the Town of Southold as follows:
I. Chapter 92, Section 92-41 (Vehicles & Traffic) of the Code of the Town of Southold is
hereby amended as follows:

II.
Severability. If an section or subsection, paragraph, clause, phrase or provision of this
law shall be judge invalid or held unconstitutional by any court of competent
jurisdiction, any judgment made thereby shall not affect the validity of this law as a
whole or any part thereof other than the part or provision so adjudged to be invalid or
unconstitutional.
III. This Local Law shall take effect immediately upon filing with the Secretary of State.

local paper, and proof that it was posted on the Town Clerk's Bulletin Board, and there is no
correspondence.
SUPERVISOR COCHRAN: You have heard the reading of the public notice in relation to a Local
Law, No Parking, Standing, Stopping at the intersection of Rocky Point Road, Aquaview Avenue, East
Marion. Is the anyone that would like to address the Town Board? Yes, ma'am?
NANCY SAWASTYNOWlCZ: Good evening. Nancy Sawastynowicz fi:om East Marion. I would like
to know exactly what you mean by what you are going to stop parking because first of all when it is
bluefish season the people that use that are really nice elderly men, and they have no other public
access to the beach down there, and I would like to know what you intend to do? How far are you
going to stop them from parking?
COUNCILMAN MOORE: This is Aquaview Avenue both sides of the street, both sides from the
intersection of Rocky Point Road easterly approximately fifty feet.
NANCY SAWASTYNOWICZ: Right, because they use that, that one time of year, and is there
anyway that we can help these guys that do nothing wrong, but go down there and enjoy the heck out
of that beach?
COUNCILMAN MOORE: Absolutely. We have a separate provision in the Code where they can
come down to the Town Clerk, and get a fishing permit.
NANCY SAWASTYNOWICZ: Okay, good, that is my only concern, because they do not abuse it. I
walk there every day twice a day, and the fish are really hot down there.
COUNCILMAN MOORE: Now, everybody knows.
SUPERVISOR COCHRAN: Is there any other comments? (No response.) If not I will close the
heating.
