City To~vn of ViII:G: SOUTHOLD LOCAL LAW NO. 9 2001 A Local Law in relation to A Local Law in relation to Amending the Fees in Section 45-8 (Building Code) of the Town Code: BE IT ENACTED by the Town Board of the Town of Southold, as follows: Chapter 45, Article VIII, Fire Prevention and Building Code, Uniform of the Code of the Town of Southold is hereby amended as follows: § 45-8. Building permit required; application for permit. [Amended 5-30-1995 by L.L. No. 11-1995] L. Permit fees. (1) The following fees shall be paid upon the filing of an application with the Building Inspector for a building permit, which fees shall be paid into the general fund if the application is approved or returned to the applicant if the application is denied: (a) Single-family dwellings: [1] New dwellings and alterations or additions to existing dwellings: one hundred fifty dollars ($150.), plus thirty cents ($0.30) for each square foot of floor area in excess of eight hundred fifty (850) square feet. [2] Accessory buildings and additions or alterations to existing accessory buildings: seventy-five dollars ($75.), plus thirty cents ($0.30) for each square foot of floor area m excess of five hundred (500) square feet. (b) Farm buildings and additions or alterations to existing farm buildings: one hundred fifty dollars ($150.) for each building. (c) Hotel, motel, multiple dwellings and business, industrial and all other buildings, including wineries: (If additional space is needed, attach pages the same size as this sheet, and number each.) DOS-239(Rev. 11/99) (1) (d) (e) il ] New buildings and additions and alterations to existing buildings: two hundred dollar~ ($200.), plus thirty cents ($0.30) for each square foot of floor area in excess of one thousand (1,000) square feet. [2] Accessory buildings and additions and alterations to existing accessory, buildings: seventy-five dollars ($75.) plus thirty cents ($0.30) for each square foot of floor area in excess of five hundred (500) square feet. Foundations constructed under existing buildings: one hundred dollars ($100.). In-ground swimming pools, together with required enclosure fench~g: one hundred fifty dollars ($150.). Aboveground swimming pools, together with required enclosure fencing: one hundred fifty dollars ($150.). (f) The permit fee for all signs shall be fifty dollars ($50.) per permit. (g) Demolition and/or removal of any building: thirty-five dollars ($35.) mira'mum and fifteen cents ($0.15) for each square foot in excess of three hundred (300) square feet of floor area. (2) If an application is denied and a notice of disapproval is issued, the applicant shall pay a fee of thirty-five dollars ($35.). (3) For the purpose of this Subsection L, cellars, decks, attached garages and any habitable area shall be included in the calculation of floor area. (4) Pre-construction fee. If any land clearing or excavation or building or conm~encement of any construction activity is without the benefit of applicable town permits, all fees associated ~vith any land clearing or excavation or building or construction activity will be equal to double the otherwise applicable fee for all permits as provided by this Chapter. (5) Notwithstanding the foregoing, no fee shall be required of or paid by taxing entities or districts, including but not limited to fire districts, school districts, park districts and the like. I am an attomey in Mattituck. I don't have an objection to raising fees where the people using the services are now going to be beating more of the cost, but I do think personally that the increase in the fee for the pre-CO from $100 to $300 is excessive ifI read the proposed correctly. I think if you are doubling the fees perhaps that should go to $200 rather than $300, because that does affect a lot of people these days. Thank you.
