If the remaining budget is exceeded because of time necessary for field inspection and office support, one option to provide additional monies is to deduct our additional inspection time in November and December ($20,500) from payment to Terry Contracting & Materials, Inc., to pay for any additional costs above our current remaining budget. The cost estimate presents the estimated costs for the work specified on the existing contract drawings and specifications. The estimated costs of the work related to landfill closure and work related to development of the yard waste composting facility at the landfill are shown separately. In addition, on the enclosed, we have identified items of work that are part of the presently planned landfill closure construction which were not included in the original Closure Plan cost estimate prepared in December 1998. This includes, for example, perimeter fencing, landscape work (i.e., plantings), installing a new water supply well and relocating the fire department siren. The estimated total cost for closure excluding the new items is $5,294,000 which is approximately $1.5 million less than the Closure Plan cost estimate. This cost savings is due to the work which has been completed by the Town (such as filling in of the former lagoon with alternate materials), and the planned use of on-site soil from the sand pit to construct the landfill cap. Please note that with regard to the on-site soil from the sand pit, the pre-qualification geotechnical testing of the material is complete. The testing indicates that in general, the material satisfies the requirements of the specifications as currently approved by NYSDEC. However, in some locations the material exceeds the currently specified maximum size. The exceedances, however, will not impact the performance of the material or damage the geomembrane liner since the larger size stones are rounded and not angular. We will prepare a letter to NYSDEC presenting the test results and revisions to the specifications to allow for the use of the material as is, without the need to remove the stones. The enclosed cost estimate is based on the assumption that NYSDEC will approve this revision and not place any restriction on the use of the on-site sand. The estimated cost related to the yard waste compost facility development work is $596,000. I would like to take this opportunity to thank you for your input and to summarize the issues we talked about, as follows: L The Town Board should vote to authorize either the Supervisor or a member of the Board to issue the Request for Proposal. 2. I will add language to the RFP advising bidders that they must comply with regulatory issues from the New York State Department of Environmental Conservation(Long Island office). 3. The Town of Southold shall identify the most appropriate location for the golf parking lot(20-30 cars), as well as a miniature golf course(1 acre). 4. Any proposed fencing shall be no higher than four feet, with footings not to exceed twelve inches. 6. Irrigation of the driving range shall be permitted, and fertilization materials shall be approved by the Town of Southold. 7. The proposed developer will be encouraged to use organic construction methods and to maintain the turf organically. 8. The proposed date of issuing the RFP is June 2003. 9. The Town of Southold shall construct the parking area as part of its capital improvement program to ensure its compatibility with the site. 10. The construction of the driving range shall be done in consult with the development of the new transfer station. 11. Add language to the RFP suggesting experience in developing golf related facilities on former landfill sites is desirable. 12. It is important to put this proposal out to bid as soon as possible, as it will probably take a year from start to finish to open a driving range. Box 962 Cutchogue, New York 11935 Re: Beneficial use of Landfill Dear Mr. Bunchuck: The New York State Department of Environmental Conservation is in receipt of your letter dated January 22, 2002, regarding the beneficial use of the Southold Landfill. The Department concurs with your concerns with allowing the landfill to be used by a remote control model airplane club. The safety of the public and landfill personnel, and the integrity of cap and its components must be taken into consideration when evaluating a post closure use for the landfill. With respect to your letter the Department offers the following: As you are aware, post closure landfill operations include a new yard waste composting facility and the ongoing operation of a residential solid waste drop off facility, that are both directly adjacent to the landfill. The daily operations of these two facilities consists of heavy pedestrian and vehicle traffic. Due to the close proximity of the two operations to the landfill and the amount of people associated with the operations, the Department believes that there could be a potential for inadvertent model air plane accidents. The design of the landfill was not initially intended for any future use and therefore its construction has not been engineered to withstand the amount of traffic and type of activity associated with this sort of recreation. Several important key components of the landfill cap can be jeopardized in the occurrence of a model air plane crash. New York State regulations indicate that a landfill must be constructed with a Barrier Protection Layer(BPL) not less than 24 inches thick. One of the main reasons for the placement of the BPL is to protect the geomembrane from being punctured or torn, which can both occur if the landfill is impacted by an outside force. As you know, the Southold Landfill was granted a variance from this regulation to only use a 12 inch thick BPL in-order to save the Town a considerable amount of money. In addition, the landfill consists of a vast gas venting system that entails large plastic piping protruding several feet from the landfill surface. These pipes are not designed or constructed to withstand any sort of blunt or harsh collision. Therefore, if this activity is being considered the Department will require a redesign to the BPL, gas vents, and any other potentially vulnerable components, making them suitable to handle such an activity. There are over 150 land fills in the USA now being used for this purpose, . eight of which are located in New York State including one in Suffolk County and one in Nassau County. We propose that such use would bring together the adults and youth of the town in a unique way. Young people would be encouraged to learn new skills and find new uses for the skills already acquired in the school academic programs by applying them in a practical manner to aeromodeling. These skills will be beneficial to our youth throughout their adult lives . These skills, scientific, electrical , chemical, mechanical and communicative to name a few, would be developed through the sponsorship of the Town of Southold and the use of the able talents of the members of the North Star Flying club who stand ready to work with all who wish to reap the rewards of this very satisfying sport/hobby. Parents would be encouraged but not required to participate. A program such as this is not limited to males only. There are many fine female aeromodlers who bring their own special talents to this sport . Aeromodeling is more inclusive than other sports because projects can be executed by individuals or teams as each sees fit. Unlike other sports , where the best become the participants and the rest become spectators, aeromodeling encourages participation at all levels and welcomes both the least and • the most talented. Activities can be for fun or for competition within the group or with other clubs , and can be as simple as flying self-designed paper planes to radio controlling seven-foot winged models . Liability issues are addressed by enrollment of each participant in the Academy of Model Aeronautics , a not-for- profit national aeromodeling organization which provides, among other things, insurance, youth programs, safety training and other technical and supportive materials as well as oversight . Activities would require few resources from the town and would be completely self-supporting. The value of such a program is attested to by many celebrities including Robert "Hoot" Gibson, Neil Armstrong and Buzz Aldren to name a few. Film stars such as Henry Fonda and Jimmy Stewart can also be included. Joseph Beshar, Vice-President of the Academy of Model Aeronatics is the National Flying Site Coordinator and supports our efforts . There are many positive attributes of this program which could benefit our young people, our general population and our senior citizens as well . In fact, I have been approached by fathers who are active in Boy Scouting who have informed me that this program would allow scouts to earn merit badges relating to aviation . These goals can • only be realized through acquiring a permanent flying site. The land fill would be an ideal location. We request that the town council petition the DEC for permission to use the site for this purpose. I would be glad to work with your designated spokesperson to compose a letter and/or to discuss this issue with the powers that be to gain such • approval . Along with other club members, I would be most willing to appear before you to present our case as well . For our town and its youth, this would be a golden opportunity for a postive learning experience as well as being an exciting hobby/sport for both young and old. Corcoran, Assistant Town Attorney Date: June 14, 2004 Subject: Land Swap at Transfer Station To follow up on my recent Memo, at our request, counsel for the Town, who.has been handling this matter, Frank Isler, has forwarded a draft contract to counsel for Mr. Coral%ni, Bill Goggins, in order to effectuate the exchange of title of the two parcels of land/at the Town's transfer station. (As previously noted, the Town will also make ce�rtain already-budgeted payments to Mr. Corazzini for grading of land and location of utilities on the parcels.) The way the agreement has been drafted, and if agreed to by Mr. Corazzini, once it is executed Mr. Corazzini will have fifteen (15) days to clear his land of debris, etc. and grade it suitable for ingress and egress. If he does not, the Town may do so and offset its costs from the agreed upon payment to Mr. Corazzini. Fifteen days later, or thirty (30) days from contract signing, the parties are intended to exchange the deeds to the properties. With the current access on County Route 48, it is not possible adequately to queue vehicle traffic, or to provide for the separation of commercial and residential vehicles. Relocation of access to the land to be acquired will permit the accomplishment of these objectives. 4. Relocation of access to the land to be acquired will provide the ability to coordinate traffic to and from the facility with the existing traffic signal at Cox Lane and County Route 48, and provide for an efficient, orderly and safe access to the facility. 5. Use of the strip of land presently owned by the District on the north of the Corazzini's Asphalt Plant is not suitable as an alternative access to the property to be acquired. Due to its configuration,the turns required to bring auto and truck traffic to and from the Commercial and Residential Recycling Collection Facility would require significant roadway construction on the capped landfill, which is prohibited by the State. Moreover,providing access from this property would require the navigation of an extreme turning radius, creating a dangerous condition and impairing the public use of the facility. The use of the District-owned strip would also bring traffic further north on Cox Lane,bringing the vehicle flow closer to the Matthews Lane residential community,which is not a desired result. In addition, the route to and from the facility by this means would be cost prohibitive. Conversely, use of the property to be acquired for access would place the access straight into the facility,would limit traffic to the area of commercial/industrial zoned properties, and would not impact on the capped landfill. 6. The acquisition of this strip constitutes an unlisted action under the State Environmental Quality Review Act without a significant impact on the environment. WHEREAS Corazini owns property commonly known as Cox Lane, Cutchogue, New York, which property is bordered on the north and west by property owned by the District; and WHEREAS the parties hereto are desirous to swap strips • of land having equivalent square footage and value. Within sixty (60) days from the date hereof, Corazzini shall remove all debris, equipment, tank (s) , trailer (s) and other items of personal property from Parcel 2 and shall do such site work on Parcel 2 as is necessary to prepare Parcel 2 for paving for a roadway to service the District ' s adjacent properties . 4 . Upon Corazzini ' s timely and satisfactory performance of the items described in paragraph 3 above, the Town shall pay him the sum of $ 30, 950 to reimburse him for relocation of water and electrical service to his • property and for the cost of performing the work specified in paragraph 3 above . . 5 . In the event that Corazzini fails to complete the work described in paragraph 3 above, the District shall perform the work and shall offset its costs to do so from the $ 30, 950 otherwise due Corazzini under paragraph 4 above. 6 . The total comes to $37,950 (for an • RCA road -paving would cost an extra$21,824). However, these are clearly separate tasks to be done by at least 3 different companies. The actual road construction to be done by Corazzini is $17,700 - $9,200 for site work (re-location of stockpiled materials, surface preparation, grading, etc.)to prepare for the construction and$8,500 for the construction itself. This is UNDER the $20,000 bid level for public works projects, as are the other portions of the project($11,500 for water service and $8,750 for electric). It seems to me we could pay Corazzini for this work, and deal with the utility contractors separately. Even if additional price quotes are required for the water and electric work, it still should not require formal bidding.
