In accordance with your letter of July 13, 1984, the Southold Town
Board at their regular meeting held on July 17, 1984 adopted a resolution
authorizing the Board, of Commissioners of the Fishers Island Ferry District
to accept the bid of Eastern Marine, Inc., for the construction of a new
ferry vessel for the Fishers Island Ferry District, in the gross amount of
$1,171,612.00, and a trade-in value of MV Olinda in the amount of $125,000.00,
making the net bid price of $1,046,612.00, and authorized the Board of
Commissioners to reserve the right to defer the acceptance of the alternative
proposal for a period of sixty (60) days from the date of the award of the
Contract,; in accordance with paragraph 13 of Instructions To Bidders For
Construction Of Double Screw 132 Ferry. Vessel.

At a meeting of the Board of Commissioners of the Fishers
Island Ferry District held on the 12th day of July, 1984.
Moved by Commissioner Evans, seconded by Commissioner Doherty,
WHEREAS, the Board of Commissioners received bids for the
construction of a new ferry vessel for the Fishers Island
Ferry District on June 6, 1984; and
WHEREAS, Eastern Marine, Inc. of P. 0. Box 1009, Panama
City, Florida submitted a bid for the construction of an alter-
native vessel in the amount of $1,171,612.00, and a trade-in
value of the MV OLINDA in the amount of $125,000.00, making
a net bid price of $1,046,612.00; and
WHEREAS the Commissioners wish to exercise the option to
defer the accpetance of the alternative proposal for a period
of sixty (60) days from the date of award of the Contract in
accordance with paragraph 13 of Instructions To Bidders for
Construction of Double Screw 132 Foot Ferry Vessel;and
WHEREAS, said bid of Eastern Marine, Inc. was the lowest
bid submitted, and said bidder has been determined to be a
responsible bidder.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Com-
missioners of the Fishers Island Ferry District does hereby
accept the bid of Eastern Marine, Inc. in the gross amount
of $1,171,612.00, and a trade-in value of MV OLINDA in the
amount of $125,000.00, making a net bid price of $1,046,612.00,
and it is further resolved that the acceptance of the bid of
Eastern Marine, Inc. is subject to the apporval of the Town
Board of the Town of Southold; and
BE IT FINALLY RESOLVED that the Board of Commissioners
reserves the right to defer the acceptance of the alternative
proposal for a period of sixty (60) days from the date of
award of the Contract in accordance with paragraph 13 of
Instructions To Bidders for Construction of Double Screw 132
Ferry Vessel.
Vote of the Board of Commissioners: Ayes: Commissioner du -
Pont, Commissioner Baker, Commissioner Doyen, Commissioner
Evans, Commissioner Doherty. Nays: None.
Number of calendar days shall be so noted in the place provided for
same in the Form of Proposal.
13. TRADE-IN OF MV OLINDA
Each bidder is required to submit an alternative proposal which shall
require the bidder to take in trade the MV OLINDA presently owned and
operated by the Owner as partial payment of the construction cost of the
new Vessel. If such alternative proposal is accepted by the Owner, the
successful bidder will be required to accept the MV OLINDA in an "as is
where is" condition at the date of delivery of the new Vessel. The
Owner reserves the right to defer the acceptance of this alternative
proposal for a period of sixty (60) days from the date of award of the
Contract. In the event that the Owner is unable to deliver said Vessel to
the Bidder by reason of destruction thereof or any other cause, the
Owner will pay the successful Bidder the trade-in value thereof as set
forth in Bidders proposal.
14. ALTERNATES
Bidders shall be required to submit costs for the following alternate:
Construction of a double screw 162 foot Ferry Vessel.
15. INSURANCE
a. Contract Security
The Builder shall furnish and pay for Surety Bonds each in an
amount at least equal to 1000 of the contract price as security for
the faithful performance of this contract and for the payment of all
persons performing labor and furnishing materials in connection
with this Contract.

b. Contractor's Insurance
The Builder shall not commence any work under this Contract until
he has obtained from responsible insurance companies all insurance
required herein, and the Builder shall maintain this insurance in
full force and effect until the work under this contract has been
accepted by the Owner.
(1) Compensation Insurance
The Builder shall take out compensation insurance as required
by the Contract.
(2) Public Liability Insurance
With limits of not less than $250,000.00 for any one person
injured, and $1,000,000.00 for each accident or occurrence.
(3) Contractor's Protective Public Liability
With limits of $250,000.00 and $1,000,000.00 covering
operations of subcontractors.
(4) Property Damage Insurance
With minimum limit of $1,000,000-00 each accident.
(5) Automobile Insurance
(a) Public liability with limits of not less than $250,000.00 for
any one person injured, and $1,000,000.00 for any one
accident or occurrence.
(b) Property damage insurance with minimum limit of
$1,000,000.00.
(c) Same protection for hired vehicles, if any.
(6) The Fishers Island Ferry District and the Town of Southold
shall be named as coinsured under each and all such policies
subject to the approval of the Owner's Legal Advisor.
(7) Policy Provisions
If the Builder shall procure or maintain any insurance upon
any property in which the Owner has or may acquire an
interest or upon which he has or may acquire a lien under
this Contract or otherwise, such policies shall, in the
following language, make formal disclosure of the diversity of
interest: "Notice is hereby given and accepted that the
Owner has or may acquire an interest in the subject matter
of this insurance". Such policy or policies shall also contain
a loss payable clause reading as follows: "Loss, if any, under
this policy shall be adjusted with the named insured and be
made payable to the Owner". Any payments thereunder shall
inure to the benefit of the Owner to the extent of any loss
suffered by the Owner and to the Builder as to any
remaining balance.
(8) Evidence of the above coverage, represented by certificates
issued by the insurance carrier, must be furnished to the
Owner at the time of execution of the contract. Certificates
of insurance shall state that the Owner will be notified in
writing ten (10) days prior to cancellation or renewal of this
insurance.
16. APPROVAL OF CONTRACT
This contract shall be subject to written approval of the Town Board
of the Town of Southold and shall not be binding until so approved.

CONTRACT FOR CONSTRUCTION OF A
DOUBLE SCREW 132 FOOT VEHICULAR
PASSENGER FERRY VESSEL FOR THE
FISHERS ISLAND FERRY DISTRICT,
FISHERS ISLAND, SUFFOLK COUNTY,
NEW YORK
THIS AGREEMENT, made and entered into this day of ,
1984, by and between the FISHERS ISLAND FERRY DISTRICT, a corporation
of the State of New York, in the County of Suffolk (hereinafter called the
Owner) , party of the first part, and
of
(hereinafter called the Builder) , party of the second part.
WITNESSETH, that the parties of these presents, each in consideration
of the agreement on the part of the other herein contained, have agreed and
hereby agree, the party of the first part, for itself, its successors and
assigns, and the party of the second part, for itself, himself, his heirs,
executors, successors and assigns, as follows:
1. Immediately after the execution of this Contract, the Builder will
provide and furnish a suitable location on its premises at
for the construction of a ferry vessel (hereinafter
called the Vessel) hereinafter described, and to provide and furnish all
tools, labor, materials and equipment, not expressly agreed upon in this
Contract to be provided and furnished by the Owner for said construction.
2. The Builder will build and deliver afloat, after trials and
acceptance, to the Owner at Fishers Island, New York, or at such other
location designated by the Owner, the following described Vessel under the
terms and conditions described herein, in accordance with the following
documents, to wit:
(a) The following drawings prepared by the Builder and submitted
with his proposal.
(1) Midship and Type Sections (simple type drawing) Drawing No.
(b) Sparkman and Stephens Design No. 2476-1, Alt. A entitled
"Fishers Island Auto/Pass. Ferry - Profile and Deck
Arrangements" dated November 19, 1983, revised March 9, 1984.
(c) Sparkman and Stephens Specifications No. 2476 dated March 19,
1984, (or "Supplement to Specifications No. 2476" dated March 19,
1984) .
(d) Bidding documents consisting of the Notice to Bidders, Instruction
to Bidders and Form of Proposal and this form of Contract.
3. Said Vessel to have the principal characteristics set forth at page 1
of the Specifications No. 2476 or Supplement to Specifications No. 2476.
4. Neither the Owner nor any of its officers, agents or employees shall
in any manner be answerable or responsible for any loss or damage that shall
or may happen to the said work or to any part or parts thereof, or to any
materials, equipment or any property that may be used or employed therein,
or placed upon the premises during the progress of the work, nor shall it
be in any manner answerable or responsible for any injury done or damage
or compensation required to be paid under any present or future law, to any
person or persons whatever, whether employees of the Builder or otherwise,
or for damages to any property whether belonging to the Owner or to

others,
appearing during or resulting
from the said work. Against
all such
injuries,
damages and compensation,
the Builder shall and will
properly
guard.
The Builder shall also, at all
times, indemnify and save the Owner
and its
officers, agents and employees
harmless against all such
injuries,
damages
and compensation arising or
resulting from causes other
than the
Owner's
negligence.
5.
The Builder agrees that it
shall, pursuant to the Workman's
Compensation Law of the State wherein the work is being performed, secure
the payment of compensation for the benefit of all employees who may be
injured or suffer disability in the work contracted to be performed under
this Contract, and for the benefit of the dependents of such employees. The
Builder shall continue to secure the payment of such compensation during
the life of this Contract. In the event of the failure of the Builder to secure
compensation to the employees and their dependents as aforesaid, or in the
event of the failure to continue the securing of such compensation during
the life of this Contract, the Contract shall be and become void and of no
effect, and the Builder shall forfeit to the Owner all payments made under
the Contract and the value of all work done and materials rendered
thereunder.
6. Upon completion of said Vessel, the Builder shall procure and deliver
to the Owner at the time of delivery of the Vessel, the documents which may
be required to give the Owner title to said Vessel, clear of all liens and
encumbrances, together with such other documents required by any and all
governmental agencies having jurisdiction thereof.
7. In the event that the work contemplated by this Contract is
performed in the State of New York the Builder covenants and agrees that

he will comply with the applicable provisions of Article 8 of the Labor Law
(wages, hours, statements showing amounts due for wages, discrimination,
preference in employment, minimum rate of wages, etc.) and Article 5-A of
the General Municipal Law (Public Contracts) .
8. The Builder and each subcontractor or other person doing or
contracting to do any work contemplated by this Contract shall comply with
all laws, ordinances, rules and regulations in any manner affecting the work
or performance of this Contract whether or not such laws, ordinances, rules
and regulations are mentioned herein and shall indemnify and save harmless
the Owner and its officers, agents and employees against any claim or
liability arising from or based upon the violation of any such law, ordinance
or regulation.
Each and every provision of law and clause required by law to be
inserted in this Contract shall be deemed to have been inserted herein, and
if through mistake or otherwise such provision is not inserted, then upon
the application of either party, this Contract shall be physically amended
forthwith to make such insertion.
9. The Builder shall secure and take out, at his own expense, all
necessary certificates and permits from the municipality or other public
authorities required in connection with the work contemplated by this
Contract or any part thereof, and shall give all notices required by law,
ordinance or regulation. He shall pay all fees and charges incident to the
due and lawful prosecution of the work contemplated by this Contract.
10. Neither the Owner nor any of its officers, agents or employees, nor
any order by the Owner for the payment of money, nor any payment for, or

acceptance of the whole or any part of the work by the Owner, nor any
extension of time, nor any possession taken by the Owner, its officers,
agents or employees, shall operate as a waiver of any provision of this
Contract, or of any power herein reserved to the Owner, or any right to
damages herein provided; nor shall any waiver of any other provision of this
Contract be deemed to be a waiver of any other or subsequent breach. Any
remedy provided in this Contract shall be taken and construed as in addition
to each and every other remedy herein provided, and in addition to all other
suits, actions or legal proceedings, the Owner shall also be entitled as of
right to a writ of injunction against any breach of any of the provisions of
this Contract.
11. In case of unnecessary or inexcusable delay in the general conduct
of the work or in the event of an actual or practical abandonment of the
work, the Owner or its representative will notify the Builder or his
bondsman in writing to that effect. If the Builder or his bondsman shall not
within six (6) consecutive days thereafter take such measures as will, in the
judgment of the Owner, insure a satisfactory completion of the work in the
time specified, the Owner may then notify the aforesaid Builder and his
bondsman to discontinue all work under this Contract, and it is hereby
agreed that the Builder and his bondsman shall immediately respect such
notice and stop work, and cease to have any right to possession of the
premises whereon said work is being performed. The Owner shall thereupon
have the power and authority to cancel the Contract and to relet the work
or any part thereof or to employ such persons and equipment as it may deem
advisable by contract or otherwise, to complete the work herein described,
and to use such material and equipment as it may find upon the premises,

and to procure other materials for the completion of said work. All expenses
of such completion of the work, including the additional payments to be made
to the persons completing the same, and any other claims arising under this
Contract, shall be deducted and paid by the Owner out of such moneys as
may then be due the said Builder or which may thereafter become due under
and by virtue of this agreement or any part thereof. In case such expense
is less than the sum which would have been payable for such work under
this Contract
if the same
has been fully
completed
by the Builder, he
shall
be entitled to
receive the
difference; in
case such
expense is greater,
the
Builder shall pay the amount of such excess so due.
12. Each and every employee of the Builder, and each and every
subcontractor engaged in said work, shall, for all purposes, be deemed and
taken to be the exclusive servants of the Builder and not for any purpose in
any manner in the employment of the Owner. The Builder shall in no manner
be relieved from responsibility or liability on account of any delay in the
execution of the said work, or of any part thereof, by the acts or omissions
of any such employee, or any subcontractor, or any materialmen whatsoever.
13. The Owner shall pay, and the Builder shall receive, the price
stipulated in the Builder's Proposal, to wit: the sum of
Dollars as full compensation for everything furnished and done by the
Builder under this Contract, said sum to be paid as follows:
10% thereof upon the execution of this contract.
20% thereof upon laying of Keel
15% thereof when hull is framed and plated.
25% thereof when superstructure is framed and plated.

20o thereof when machinery and all accommodations, ship systems
and outfitting are substantially completed.
5% thereof when vessel has completed successful trials and has
been accepted.
5% thereof when vessel has been fully completed, delivered and
accepted by the Owner.
14. The Builder expressly covenants and agrees that in undertaking to
complete the work within the time stated in his Proposal, the Builder has
taken into consideration and made allowance for all of the ordinary delays in
securing materials or workmen, or otherwise. Should the Builder, however,
be delayed in the prosecution and completion of the work by any change,
addition or omissions therein ordered in writing by the Owner or its
representatives, or by strike, acts of God, war or other causes beyond the
control of the Builder, then the Builder may within five (5) days after the
occurrence of the delay for which the Builder claims allowance, notify the
Owner in writing, and thereupon and not otherwise, the Builder shall be
allowed such additional time for the completion of the work as the Owner or
its representatives shall award in writing.
15. In case the Builder shall fail to complete the work hereunder in
accordance with the specifications and to the satisfaction of the Owner within
the time herein agreed upon, the Builder shall and will pay to the Owner,
One Hundred ($100.00) Dollars per day for each and every working day
(Sundays and legal holidays excepted) that the time consumed in said work
and completion may exceed the time herein allowed for that purpose, which
said sum is hereby agreed upon, fixed and determined by the parties hereto
as the liquidated damages (including extra cost of engineering) that the
Owner will suffer by reason of said delay and default and not as a penalty;

and the Owner shall and may deduct and retain the amount of such
liquidated damages out of any moneys which may be due from it to the
Builder.
16. The Builder shall not assign, transfer, convey, sublet or
otherwise dispose of this contract, or of his right, title or interest therein,
or his power to execute the same, to any other person or corporation
without the previous consent in writing of the Owner. In the event that the
Builder shall violate the provisions of this paragraph of the Contract, the
Owner shall revoke and annull the Contract and the Owner shall be relieved
and discharged from any and all liability and obligations growing out of
such Contract to such Builder, and to the person, or corporation to which
such Contract shall have been assigned, transferred, conveyed, sublet or
otherwise disposed of, and the Builder, and his assignees, transferees or
sublessees shall forfeit and lose all moneys, theretofore earned under this
Contract, except so much as may be required to be paid to his employees.
IN WITNESS WHEREOF, the Owner has caused its corporate seal to be
affixed hereto, and these presents to be signed by the Chairman of the
Board of Commissioners of said District, and to be attested by its Clerk,
both duly authorized so to do; and the Builder has hereunto set his hand
and seal the day and year first above written.

NOTICE TO BIDDERS
NOTICE is hereby given that separate sealed proposals for the
construction of a 132 foot Ferry Vessel for the Fishers Island Ferry District,
Fishers Island, New York, will be received by the Board of Commissioners of
the Fishers Island Ferry District at the Fishers Island Ferry District office,
Fishers Island, Suffolk County, New York on , 1984, at 10:30
A.M. Prevailing Time, and at said place and time publicly opened and read
aloud.
The Contract Documents, including all Drawings and Specifications may be
examined at the Ferry District office, Fishers Island, New York between the
hours of 9:00 o'clock A.M. and 4:00 o'clock P.M., Monday through and
including Friday and may be obtained upon deposit of One Hundred ($100.00)
Dollars for each combined set.
Any person or corporation proposing to submit a bid must take out a
minimum of one (1) combined set of Drawings and Specifications.
Bidders submitting proposals desiring to obtain more than the minimum of
one (1) set of Drawings and Specifications may obtain additional sets on the
deposit of $50.00.
Checks for deposit for Drawings and Specifications shall be made payable
to the Fishers Island Ferry District and may be uncertified.
Any person or corporation duly submitting a proposal accompanied by a
bid security in accordance with the requirements of the Instructions to Bidders,
will,
upon return
of
the Drawings and Specifications in good condition and
within
thirty (30)
days
after the award of Contract or the rejection of the bids,
receive the deposit in full.
Persons
or corporations
obtaining
sets of Drawings and Specifications but
do not submit
a proposal,
one-half
the deposit will be returned to such
non -bidders
upon the return
of the Drawings and Specifications in good
condition and
within thirty
(30) days
after the award of the Contract for the
project.
Each Contract
will be
awarded
to the lowest responsible bidder or the
proposals will be rejected within forty-five (45) days of the date of opening
proposals, subject, however, to the discretionary right reserved by the Board
of Commissioners of the Fishers Island Ferry District to waive any informalities
in, reject any or all proposals and to advertise for new proposals, if, in its
opinion, the best inerest of the District will thereby be promoted. Contract or
Contracts will not necessarily be awarded on Base Bid Proposals but may be
awarded upon acceptance or rejection of Alternates requested in the Form of
Proposal.
Each bidder must deposit with his bid, security in the sum of $500.00 in
the form and subject to the conditions stipulated in the Instructions to Bidders.
No bidder shall withdraw his bid within forty-five (45) days after the
formal opening thereof. Thereafter, a bidder may withdraw his bid only in
writing and in advance of the actual award.

Re: Bid Documents for Fishers Island Ferry Boat
Dear Mr. Gilbert:
I have prepared the proposed bid documents consisting of the
Proposal; the Instruction to Bidders; the Notice to Bidders and the
Contract. The above, together with your specifications No. 2476 and
supplement thereto, and the profile and deck arrangement will
constitute all of the bid documents.
If the enclosed bid documents meet with your approval, then I believe
that when the commissioners determine the date of the publication of
the Notice to Bidders and the date for the opening of bids and the
question of what other notice, if any, is to be given, we will be in a
position to then proceed to advertise for bids. I have prepared ten
copies of the enclosed document which can be sent to Phil Knauff at
Fishers Island for interested bidders. He, of course, will need sets of
the specifications and the profile and deck arrangements. I would
appreciate if you would arrange to send ten copies of the
specifications, supplement thereto, and the profile and deck
arrangements so that he will then have ten sets of all the documents
to be used to send to interested bidders.

FOR THE FISHERS ISLAND FERRY DISTRICT,

The undersigned declares that he has carefully examined and fully
understands the "Notice to Bidders"," Instruction to Bidders", the "Form of
Contract", the "Plans and Specifications", and this form of Proposal, and that
he hereby proposes to furnish all the materials, implements and incidentals and
to furnish labor and do all the work required to construct a ferry vessel for
the Fishers Island Ferry District, Suffolk County, New York, in accordance
with the prices named in this proposal at his own proper cost and expense, all

INSTRUCTIONS TO BIDDERS
for
CONSTRUCTION OF DOUBLE SCREW 132 FOOT FERRY VESSEL
for the
FISHERS ISLAND FERRY DISTRICT
1. DEFINITIONS
a. The term "Owner" means the Fishers Island Ferry District and/or
the Town of Southold.
b. The terms "Architect" or "Representative" mean the firm of
Sparkman & Stephens Incorporated, with offices at 79 Madison
Avenue, New York, New York 10016, or any duly authorized
representatives of the Fishers Island Ferry District.
C. The term "Bidder" shall mean any party or parties submitting in
proper form a proposal to perform the work hereinafter specified to
be performed. The successful Bidder selected by the Owner to
perform the work hereinafter specified will thereafter be known as
the "Builder".
d. The term "Work" is used to designate the work, equipment,
materials, and things required to be done, furnished or performed
by the Builder under the specifications attached hereto.
2. RECEIPT AND OPENING OF BIDS
a. The Fishers Island Ferry District, Fishers Island, Suffolk County,
New York (hereinafter called the Owner) invites sealed bids for the
construction of a double screw 132 foot Ferry Vessel, and as an
alternate for the construction of a double screw 162 foot Ferry
Vessel.
b. Bids will be received by the Owner on
at Prevailing Time, at the office of the Fishers
Island Ferry District, Fishers Island, New York, and then at said
time and place publicly opened and read aloud.
C. Bidders will not be allowed to withdraw their proposals within 45
days after the formal date of opening proposals. Bidder may
withdraw his bid only in writing and in advance of the bid opening.
3. PREPARATION OF PROPOSAL
a. Proposals must be submitted upon the prescribed Form of Proposal.
All blank spaces on the form must be appropriately filled in in ink
or typed in both words and figures. Each bidder shall submit as
his bid a copy of the executed Form of Proposal and shall retain a
copy of the Form of Proposal for his records.
b. Each bidder is required to bid on the Base Bid, or all Alternates,
and all other items called for in the Form of Proposal.
C. Erasures or other changes on the Form of Proposal submitted as a
bid must be explained or noted over the signature of the bidder.
Bids containing any conditions, omissions, unexplained erasures,
alterations, irregularities of any kind, or items not called for in the
Proposal, may be rejected by the Owner as being an informal and
incomplete bid.
d. All Proposals must be submitted in sealed envelopes, bearing on the
outside, the name of the bidder, his address, and the name of the
project.
e. Proposals so enclosed shall be delivered to the Owner on or before
the date and hour of bid opening.

f. Each bidder shall prepare a simple Midship and Type Sections
drawing and submit the same with his proposal. Bidders are advised
that the Midship and Type Sections will be examined and reviewed
by the Owner's representative. The Owner reserves the right to
reject the proposal of any Bidder whose Midship and Type Sections
are not approved by the Owner's representative.
4. EXPLANATION TO BIDDERS
a. No oral explanation in regard to the meaining of the Drawings and
Specifications will be made and no oral instructions will be given
during the bidding period or before the Award of Contract.
Discrepancies, omissions, or doubts to the meaning of the Drawings
and Specifications must be communicated in writing to the Owner's
representative for interpretation. Bidders shall act promptly to
allow sufficient time for a reply to reach them before the submission
of their bids. Any interpretation made will be in the form of an
Addendum to the Specifications and/or Drawings which will be
forwarded to all bidders.
5. AWARD
a. The Contract will be awarded to the lowest responsible bidder or
the Proposals will be rejected within 45 days from the date of
opening Proposals, subject, however, to the discretionary right
reserved by the Owners to waive any informalities in the Proposals,
reject any or all Proposals and to advertise for new Proposals,
accept or reject any Alternates if, in their opinion, the best
interest of the Owner will thereby be promoted. The Contract will
not necessarily be awarded on Base Bid Proposals, but may be

awarded upon acceptance or rejection of Alternates requested in the
Form of Proposal.
6. BID SECURITY
a. Each bid must be accompanied by a Bid Bond duly executed by the
bidder as Principal and having a surety thereon by a Surety
Company acceptable to the Owner, and in an amount of $500.00.
Such Bid Bond for bid security will be returned to all except the
three lowest bidders within fifteen (15) days after the formal
opening of the bids, and the remaining Bid Bonds for bid security
will be returned to the three (3) lowest formal bidders within
forty-eight (48) hours after the Owner and the accepted bidder
have executed the Contract, provided their Performance and
Payment Bonds are in effect or if no Contract has been executed
within forty-five (45) days after the date of opening of the bid,
upon demand of the bidder, or anytime thereafter, so long as he
has not been notified of the acceptance of his bid.
7. QUALIFICATION FOR BIDDERS
a. Within eight (8) days after the date of bid opening, and prior to
signing Contracts, each bidder who is being considered for Award
of Contract will be required to submit a detailed financial statement
showing assets, liabilities and his net worth. Such statement shall
be in the ordinary form as usually required by banks from persons
applying for a loan and showing financial condition as of the end of
the month preceding the time of opening of bids, or later.

I . A list of work of the same general character as that specified
in connection with which the bidder has performed a Contract
within the last five (5) years.
2. The name of a bank or other financial institution as reference
to the financial responsibility of the bidder.
8. SECURITY OF FAITHFUL PERFORMANCE
a. Simultaneously with his delivery of the executed Contract, the
successful bidder must deliver to the Owner an executed
Performance Bond of a corporate surety licensed to do business in
the State of New York in the amount of One Hundred Percent
(100%) of the accepted bid for the faithful performance of the
terms, covenants, and conditions of the Contract and a further
separate Labor and Material Payment Bond of a corporate surety
licensed to do business in the State of New York in the amount of
One Hundred Percent (1000) of the accepted bid guaranteeing the
prompt payment of all indebtedness incurred by the Builder or his
Subcontractors, for supplies, materials or labor furnished, used or
consumed in connection with, in or about the construction of the
project, including fuels, lubricants, power, etc., used or consumed
directly in furtherance of such construction.
b. The premium of these bonds shall be paid by the Builder.
9. OBLIGATIONS OF BIDDERS
a. At the time of
opening of bids, each bidder will
be presumed
to
have examined
and to be thoroughly familiar with the
Conditions
of
the Contract,
the Drawings and Specifications
(including
all

addenda thereto) . The failure of or ommission of any bidder to
receive or examine any form, instruction or document shall in no
way relieve any bidder from any obligations in respect to his bid.
b. Each bidder shall satisfy himself as to the character, the quality
and quantity of the work to be performed and the materials to be
furnished, the character of equipment and facilities needed
preliminary to and during prosecution of the work, the general and
local conditions and all other matters which in any way affect the
work specified herein.
C. After the Contract has been entered into, no consideration will be
given for any misunderstanding as to the work and materials shown
on any of the accompanying Drawings, Details and Schedules, it
being mutually understood that the tender of a bid carries with it
an agreement to this and other obligations set forth in the Contract
and Specifications, and further implies a full understanding of the
Specifications, Drawings and Details, Notes, indications and
requirements.
10. ADDENDA AND INTERPRETATION
Bidders are expressly notified
that their Proposals
shall be
based upon
the materials, products and
methods specified.
For the
purpose of
estimate, no deviation from the Drawings and Specifications will be
considered, except
whenever a
material or
a method of
some
particular
manufacturer or a
process is
specified,
substitution
may
be made,
provided, that they are approved by the Architect. The substituted

material, method, or process, in the considered judgment of the
Architect, must be suitable for the purpose intended, considering
quality, workmanship, service, maintenance, economy and reliability of
operation. No interpretation of the meaning of the Drawings,
Specifications or other Contract Documents will be made to any bidder
orally. Every request for such interpretation should be in writing
addressed to Sparkman 6 Stephens, 79 Madison Avenue, New York, New
York 10016, and to be given consideration, must be received at least
five (5) days prior to the date fixed for opening of bids, and all such
interpretations and any supplemental drawings, which, if issued, will be
mailed to all prospective bidders (at respective address furnished for
such purposes) not later than three (3) days prior to the date fixed for
the opening of bids. Failure of any bidder to receive any such addenda,
or interpretation shall not relieve any bidder from any obligation under
his bid as submitted. All addenda so issued shall become part of the
Contract Documents.
11. LIQUIDATED DAMAGES FOR FAILURE TO ENTER INTO CONTRACT
The successful bidder, upon failure or refusal to execute and deliver the
Contract and Bonds required within eight (8) days after he has received
acceptance of his bid, shall forfeit to the Owner as liquidated damages
for such refusal, the security with his bid as stipulated in the executed
Bid Bond.
12. TIME FOR COMPLETION
Each bidder will be required to stipulate the number of calendar days
required to complete his work in the event he is awarded the Contract.

NOTICE TO BIDDERS
NOTICE is., hereby given that separate sealed proposals for the
construction of a 132 ,foot Ferry Vessel for the Fishers Island Ferry District,
Fishers Island, New York, will be received by the Board of Commissioners of
the Fishers Island Ferry, District at the Fishers Island Ferry District office,
Fishers Island, Suffolk CoWnty, New York on 1984, at 10:30
A.M. Prevailing Time, and at said place and time publicly opened and read
aloud.
The Contract Documents, inc*ing all Drawings and Specifications may be
examined at the Ferry District offi 'Fishers Island, New York between the
hours of 9:00 o'clock A.M. and 4. 0 o'clock P.M., Monday through and
including Friday and may be obtained Ligon deposit of One Hundred ($100.00)
Dollars for each combined set.
Any person or corporation proposing to submit a bid must take out a
minimum of one (1) combined set of Drawings and Specifications.
Bidders submitting proposals desiring to obtain more than the minimum of
one (1) set of Drawings and Specifications may .obtain additional sets on the
deposit of $50.00.
Checks for deposit for Drawings and Specifications shall be made payable
to the Fishers Island Ferry District and may be uncertified.
Any person or corporation duly submitting a proposal accompanied by a
bid security in accordance with the requirements of the Instructions to Bidders,
will, upon return of the Drawings and Specifications in good condition and
within thirty (30) days after the award of Contract or the rejection of the bids,
receive the deposit in full.

Persons or corporations obtaining sets of Drawings and Specifications but
do not submit a proposal, one-half the deposit will be returned to such
non -bidders upon the return of the Drawings and Specifications in good
condition and within thirty (30) days after the award of the Contract for the
project.

proposals will be rejected within forty-five (45) days of the date of opening

NEW YORK
THIS AGREEMENT, made and entered into this 304day of ,
1984, by and between the FISHERS ISLAND FERRY DISTRICT, a corporation
of the State of New York, in the County of Suffolk (hereinafter called the
Owner) , party of the first part, and Eastern Marine, Inc. , P. 0. Box
1009, 2200 Nelson Street of Panama City, Florida 32402
(hereinafter called the Builder) , party of the second part.
WITNESSETH, that the parties of these presents, each in consideration
of the agreement on the part of the other herein contained, have agreed and
hereby agree, the party of the first part, for itself, its successors and
assigns, and the party of the second part, for itself, himself, his heirs,
executors, successors and assigns, as follows:
1. Immediately after the execution of this Contract, the Builder will
provide and furnish a suitable location on its premises at Panama City.
Florida for the construction of a ferry vessel (hereinafter
called the Vessel) hereinafter described, and to provide and furnish all
tools, labor, materials and equipment, not expressly agreed upon in this
Contract to be provided and furnished by the Owner for said construction.
2. The Builder will build and deliver afloat, after trials and
acceptance, to the Owner at Fishers Island, New York, or at such other
location designated by the Owner, the following described Vessel under the
terms and conditions described herein, in accordance with the following
documents, to wit:
(a) The following drawings prepared by the Builder and submitted
with his proposal.
(1) Midship and Type Sections (simple type drawing) Drawing No.
52384-01-001 and 52384-01-002.
(b) Sparkman and Stephens Design No. 2476-1, Alt. A entitled
"Fishers Island Auto/Pass. Ferry - Profile and Deck
Arrangements" dated November 19, 1983, revised March 9, 1984.
(c) Sparkman and Stephens Specifications No. 2476 dated March 19,
1984, (or "Supplement to Specifications No. 2476" dated March 19,
1984) .
(d) Bidding documents consisting of the Notice to Bidders, Instruction
to Bidders and Form of Proposal and this form of Contract.
3. Said Vessel to have the principal characteristics set forth at page 1
of the Specifications No. 2476 or Supplement to Specifications No. 2476.
4. Neither the Owner nor any of its officers, agents or employees shall
in any manner be answerable or responsible for any loss or damage that shall
or may happen to the said work or to any part or parts thereof, or to any
materials, equipment or any property that may be used or employed therein,
or placed upon the premises during the progress of the work, nor shall it
be in any manner answerable or responsible for any injury done or damage
or compensation required to be paid under any present or future law, to any
person or persons whatever, whether employees of the Builder or otherwise,
or for damages to any property whether belonging to the Owner or to

others,
appearing during or resulting
from the said work. Against
all such
injuries,
damages and compensation,
the Builder shall and will
properly
guard.
The Builder shall also, at all
times, indemnify and save the Owner
and its
officers, agents and employees
harmless against all such
injuries,
damages
and compensation arising or
resulting from causes other
than the
Owner's
negligence.
6. Upon
completion of said Vessel,

The Builder agrees that it
shall, pursuant to the Workman's
Compensation Law of the State wherein the work is being performed, secure
the payment of compensation for the benefit of all employees who may be
injured or suffer disability in the work contracted to be performed under
this Contract, and for the benefit of the dependents of such employees. The
Builder shall continue to secure the payment of such compensation during
the life of this Contract. In the event of the failure of the Builder to secure
compensation
to the employees and their dependents as
aforesaid, or in the
event of the
failure to continue the securing
of such
compensation during
the life of this Contract, the Contract
shall be and become void and of no
effect, and the
Builder shall forfeit to
the Owner all payments
made under
the Contract
and the value of all
work done and
materials rendered
thereunder.
6. Upon
completion of said Vessel,
the Builder shall
procure and deliver
to the Owner at the time of delivery of the Vessel, the documents which may
be required to give the Owner title to said Vessel, clear of all liens and
encumbrances, together with such other documents required by any and all
governmental agencies having jurisdiction thereof.
7. In the event that the work contemplated by this Contract is
performed in the State of New York the Builder covenants and agrees that
he will comply with the applicable provisions of Article 8 of the Labor Law
(wages, hours, statements showing amounts due for wages, discrimination,
preference in employment, minimum rate of wages, etc.) and Article 5-A of
the General Municipal Law (Public Contracts) .
8. The Builder and each subcontractor or other person doing or
contracting to do any work contemplated by this Contract shall comply with
all laws, ordinances, rules and regulations in any manner affecting the work
or performance of this Contract whether or not such laws, ordinances, rules
and regulations are mentioned herein and shall indemnify and save harmless
the Owner and its officers, agents and employees against any claim or
liability arising from or based upon the violation of any such law, ordinance
or regulation.
Each and every provision of law and clause required by law to be
inserted in this Contract shall be deemed to have been inserted herein, and
if through mistake or otherwise such provision is not inserted, then upon
the application of either party, this Contract shall be physically amended
forthwith to make such insertion.
9. The Builder shall secure and take out, at his own expense, all
necessary certificates and permits from the municipality or other public
authorities required in connection with the work contemplated by this
Contract or any part thereof, and shall give all notices required by law,
ordinance or regulation. He shall pay all fees and charges incident to the
due and lawful prosecution of the work contemplated by this Contract.
10. Neither the Owner nor any of its officers, agents or employees, nor
any order by the Owner for the payment of money, nor any payment for, or

acceptance of the whole or any part of the work by the Owner, nor any
extension of time, nor any possession taken by the Owner, its officers,
agents or employees, shall operate as a waiver of any provision of this
Contract, or of any power herein reserved to the Owner, or any right to
damages herein provided; nor shall any waiver of any other provision of this
Contract be deemed to be a waiver of any other or subsequent breach. Any
remedy provided in this Contract shall be taken and construed as in addition
to each and every other remedy herein provided, and in addition to all other
suits, actions or legal proceedings, the Owner shall also be entitled as of
right to a writ of injunction against any breach of any of the provisions of
this Contract.
11. In case of unnecessary or inexcusable delay in the general conduct
of the work or in the event of an actual or practical abandonment of the
work, the Owner or its representative will notify the Builder or his
bondsman in writing to that effect. If the Builder or his bondsman shall not
within six (6) consecutive days thereafter take such measures as will, in the
judgment of the Owner, insure a satisfactory completion of the work in the
time specified, the Owner may then notify the aforesaid Builder and his
bondsman to discontinue all work under this Contract, and it is hereby
agreed that the Builder and his bondsman shall immediately respect such
notice and stop work, and cease to have any right to possession of the
premises whereon said work is being performed. The Owner shall thereupon
have the power and authority to cancel the Contract and to relet the work
or any part thereof or to employ such persons and equipment as it may deem
advisable by contract or otherwise, to complete the work herein described,
and to use such material and equipment as it may find upon the premises,
and to procure other materials for the completion of said work. All expenses
of such completion of the work, including the additional payments to be made
to the persons completing the same, and any other claims arising under this
Contract, shall be deducted and paid by the Owner out of such moneys as
may then be due the said Builder or which may thereafter become due under
and by virtue of this agreement or any part thereof. In case such expense
is less than the sum which would have been payable for such work under
this Contract if the same has been fully completed by the Builder, he shall
be entitled to receive the difference; in case such expense is greater, the
Builder shall pay the amount of such excess so due.
12. Each and every employee of the Builder, and each and every
subcontractor engaged in said work, shall, for all purposes, be deemed and
taken to be the exclusive servants of the Builder and not for any purpose in
any manner in the employment of the Owner. The Builder shall in no manner
be relieved from responsibility or liability on account of any delay in the
execution of the said work, or of any part thereof, by the acts or omissions
of any such employee, or any subcontractor, or any materialmen whatsoever.
13. The Owner shall pay, and the Builder shall receive, the price
stipulated in the Builder's Proposal, to wit: the sum of One Million
Forty Six Thousand Six Hundred Twelve Dollars ($1,046,612.00 )
Dollars as full compensation for everything furnished and done by the
Builder under this Contract, said sum to be paid as follows:
10% thereof upon the execution of this contract.
20% thereof upon laying of Keel
15% thereof when hull is framed and plated.
25% thereof when superstructure is framed and plated.

20o thereof when machinery and all accommodations, ship systems
and outfitting are substantially completed.
5% thereof when vessel has completed successful trials and has
been accepted.
5% thereof when vessel has been fully completed, delivered and
accepted by the Owner.
14. The Builder expressly covenants and agrees that in undertaking to
complete the work within the time stated in his Proposal, the Builder has
taken into consideration and made allowance for all of the ordinary delays in
securing materials or workmen, or otherwise. Should the Builder, however,
be delayed in the prosecution and completion of the work by any change,
addition or omissions therein ordered in writing by the Owner or its
representatives, or by strike, acts of God, war or other causes beyond the
control of the Builder, then the Builder may within five (5) days after the
occurrence of the delay for which the Builder claims allowance, notify the
Owner in writing, and thereupon and not otherwise, the Builder shall be
allowed such additional time for the completion of the work as the Owner or
its representatives shall award in writing.
15. In case the Builder shall fail to complete the work hereunder in
accordance with the specifications and to the satisfaction of the Owner within
the time herein agreed upon, the Builder shall and will pay to the Owner,
One Hundred ($100.00) Dollars per day for each and every working day
(Sundays and legal holidays excepted) that the time consumed in said work
and completion may exceed the time herein allowed for that purpose, which
said sum is hereby agreed upon, fixed and determined by the parties hereto
as the liquidated damages (including extra cost of engineering) that the
Owner will suffer by reason of said delay and default and not as a penalty,-

and the Owner shall and may deduct and retain the amount of such
liquidated damages out of any moneys which may be due from it to the
Builder.
16. The Builder shall not assign, transfer, convey, sublet or
otherwise dispose of this contract, or of his right, title or interest therein,
or his power to execute the same, to any other person or corporation
without the previous consent in writing of the Owner. In the event that the
Builder shall violate the provisions of this paragraph of the Contract, the
Owner shall revoke and annul) the Contract and the Owner shall be relieved
and discharged from any and all liability and obligations growing out of
such Contract to such Builder, and to the person, or corporation to which
such Contract shall have been assigned, transferred, conveyed, sublet or
otherwise disposed of, and the Builder, and his assignees, transferees or
sublessees shall forfeit and lose all moneys, theretofore earned under this
Contract, except so much as may be required to be paid to his employees.

vehicle and passenger ferry, for operation between New Lon-
don, Connecticut and Fishers Island, New York for the Fish-
ers Island Ferry District.
We would appreciate your best fixed price, soonest possible
date for the start of construction, and delivery, not later
than four weeks from the receipt of this letter. This ap-
plies to both the 132 foot version as well as the 162 foot
version. We would also appreciate your immediate reply as
to whether you will bid.
Please note that the Specifications require a shipyard design
and that a Midship and Type Section (which may be a simple
type drawing) typical of the vessel you would build should

INSTRUCTIONS TO BIDDERS
for
CONSTRUCTION OF DOUBLE SCREW 132 FOOT FERRY VESSEL
for the
FISHERS ISLAND FERRY DISTRICT
1. DEFINITIONS
a. The term "Owner" means the Fishers Island Ferry District and/or
the Town of Southold.
b. The terms "Architect" or "Representative" mean the firm of
Sparkman & Stephens Incorporated, with offices at 79 Madison
Avenue, New York, New York 10016, or any duly authorized
representatives of the Fishers Island Ferry District.
C. The term "Bidder" shall mean any party or parties submitting in
proper form a proposal to perform the work hereinafter specified to
be performed. The successful Bidder selected by the Owner to
perform the work hereinafter specified will thereafter be known as
the "Builder".
d. The term "Work" is used to designate the work, equipment,
materials, and things required to be done, furnished or performed
by the Builder under the specifications attached hereto.
2. RECEIPT AND OPENING OF BIDS
a. The Fishers Island Ferry District, Fishers Island, Suffolk County,
New York (hereinafter called the Owner) invites sealed bids for the
construction of a double screw 132 foot Ferry Vessel, and as an
alternate for the construction of a double screw 162 foot Ferry
Vessel.
b. Bids will be received by the Owner on
at Prevailing Time, at the office of the Fishers
Island Ferry District, Fishers Island, New York, and then at said
time and place publicly opened and read aloud.
C. Bidders will not be allowed to withdraw their proposals within 45
days after the formal date of opening proposals. Bidder may
withdraw his bid only in writing and in advance of the bid opening.
3. PREPARATION OF PROPOSAL
a. Proposals must be submitted upon the prescribed Form of Proposal.
All blank spaces on the form must be appropriately filled in in ink
or typed in both words and figures. Each bidder shall submit as
his bid a copy of the executed Form of Proposal and shall retain a
copy of the Form of Proposal for his records.
b. Each bidder is required to bid on the Base Bid, or all Alternates,
and all other items called for in the Form of Proposal.
C. Erasures or other changes on the Form of Proposal submitted as a
bid must be explained or noted over the signature of the bidder.
Bids containing any conditions, omissions, unexplained erasures,
alterations, irregularities of any kind, or items not called for in the
Proposal, may be rejected by the Owner as being an informal and
incomplete bid.
d. All Proposals must be submitted in sealed envelopes, bearing on the
outside, the name of the bidder, his address, and the name of the
project.
e. Proposals so enclosed shall be delivered to the Owner on or before
the date and hour of bid opening.

f. Each bidder shall prepare a simple Midship and Type Sections
drawing and submit the same with his proposal. Bidders are advised
that the Midship and Type Sections will be examined and reviewed
by the Owner's representative. The Owner reserves the right to
reject the proposal of any Bidder whose Midship and Type Sections
are not approved by the Owner's representative.
4. EXPLANATION TO BIDDERS
a. No oral explanation in regard to the meaining of the Drawings and
Specifications will be made and no oral instructions will be given
during the bidding period or before the Award of Contract.
Discrepancies, omissions, or doubts to the meaning of the Drawings
and Specifications must be communicated in writing to the Owner's
representative
for
interpretation.
Bidders shall act promptly to
allow sufficient
time
for a reply to
reach them before the submission
of their bids.
Any
interpretation
made will be in the form of an
Addendum to
the
Specifications
and/or Drawings which will be
forwarded to all bidders.
5. AWARD
a. The Contract will be awarded to the lowest responsible bidder or
the Proposals will be rejected within 45 days from the date of
opening Proposals, subject, however, to the discretionary right
reserved by the Owners to waive any informalities in the Proposals,
reject any or all Proposals and to advertise for new Proposals,
accept or reject any Alternates if, in their opinion, the best
interest of the Owner will thereby be promoted. The Contract will
not necessarily be awarded on Base Bid Proposals, but may be

awarded upon acceptance or rejection of Alternates requested in the
Form of Proposal.
6. BID SECURITY
a. Each bid must be accompanied by a Bid Bond duly executed by the
bidder as Principal and having a surety thereon by a Surety
Company acceptable to the Owner, and in an amount of $500.00.
Such Bid Bond for bid security will be returned to all except the
three lowest bidders within fifteen (15) days after the formal
opening of the bids, and the remaining Bid Bonds for bid security
will be returned to the three (3) lowest formal bidders within
forty-eight (48) hours after the Owner and the accepted bidder
have executed the Contract, provided their Performance and
Payment Bonds are in effect or if no Contract has been executed
within forty-five (45) days after the date of opening of the bid,
upon demand of the bidder, or anytime thereafter, so long as he
has not been notified of the acceptance of his bid.
7. QUALIFICATION FOR BIDDERS
a. Within eight (8) days after the date of bid opening, and prior to
signing Contracts, each bidder who is being considered for Award
of Contract will be required to submit a detailed financial statement
showing assets, liabilities and his net worth. Such statement shall
be in the ordinary form as usually required by banks from persons
applying for a loan and showing financial condition as of the end of
the month preceding the time of opening of bids, or later.

1. A list of work of the same general character as that specified
in connection with which the bidder has performed a Contract
within the last five (5) years.
Z. The name of a bank or other financial institution as reference
to the financial responsibility of the bidder.
8. SECURITY OF FAITHFUL PERFORMANCE

a. Simultaneously with his delivery of the executed Contract, the
successful bidder must deliver to the Owner an executed
Performance Bond of a corporate surety licensed to do business in
the State of New York in the amount of One Hundred Percent
(100%) of the accepted bid for the faithful performance of the
terms, covenants, and conditions of the Contract and a further
separate Labor and Material Payment Bond of a corporate surety
licensed to do business in the State of New York in the amount of
One Hundred Percent (1000) of the accepted bid guaranteeing the
prompt payment of all indebtedness incurred by the Builder or his
Subcontractors, for supplies, materials or labor furnished, used or
consumed in connection with, in or about the construction of the
project, including fuels, lubricants, power, etc., used or consumed
directly in furtherance of such construction.
b. The premium of these bonds shall be paid by the Builder.
9. OBLIGATIONS OF BIDDERS
a. At the time of
opening of bids, each bidder will be presumed
to
have examined
and to be thoroughly
familiar with the Conditions
of
the Contract,
the Drawings and
Specifications (including
all

addenda thereto) . The failure of or ommission of any bidder to
receive or examine any form, instruction or document shall in no
way relieve any bidder from any obligations in respect to his bid.
b. Each bidder shall satisfy himself as to the character, the quality
and quantity of the work to be performed and the materials to be
furnished, the character of equipment and facilities needed
preliminary to and during prosecution of the work, the general and
local conditions and all other matters which in any way affect the
work specified herein.
C. After the Contract has been entered into, no consideration will be
given for any misunderstanding as to the work and materials shown
on any of the accompanying Drawings, Details and Schedules, it
being mutually understood that the tender of a bid carries with it
an agreement to this and other obligations set forth in the Contract
and Specifications, and further implies a full understanding of the
Specifications, Drawings and Details, Notes, indications and
requirements.
10. ADDENDA AND INTERPRETATION
Bidders are expressly notified that their Proposals shall be based upon
the materials, products and methods specified. For the purpose of
estimate, no deviation from the Drawings and Specifications will be
considered, except whenever a material or a method of some particular
manufacturer or a process is specified, substitution may be made,
provided, that they are approved by the Architect. The substituted

material, method, or process, in the considered judgment of the
Architect, must be suitable for the purpose intended, considering
quality, workmanship, service, maintenance, economy and reliability of
operation. No interpretation of the meaning of the Drawings,
Specifications or other Contract Documents will be made to any bidder
orally. Every request for such interpretation should be in writing
addressed to Sparkman 8 Stephens, 79 Madison Avenue, New York, New
York 10016, and to be given consideration, must be received at least
five (5) days prior to the date fixed for opening of bids, and all such
interpretations and any supplemental drawings, which, if issued, will be
mailed to all prospective bidders (at respective address furnished for
such purposes) not later than three (3) days prior to the date fixed for
the opening of bids. Failure of any bidder to receive any such addenda,
or interpretation shall not relieve any bidder from any obligation under
his bid as submitted. All addenda so issued shall become part of the
Contract Documents.
11. LIQUIDATED DAMAGES FOR FAILURE TO ENTER INTO CONTRACT
The successful bidder, upon failure or refusal to execute and deliver the
Contract and Bonds required within eight (8) days after he has received
acceptance of his bid, shall forfeit to the Owner as liquidated damages
for such refusal, the security with his bid as stipulated in the executed
Bid Bond.
12. TIME FOR COMPLETION
Each bidder will be required to stipulate the number of calendar days
required to complete his work in the event he is awarded the Contract.

Number of calendar days shall be so noted in the place provided for
same in the Form of Proposal.
13. TRADE-IN OF MV OLINDA
Each bidder is required to submit an alternative proposal which shall
require the bidder to take in trade the MV OLINDA presently owned and
operated by the Owner as partial payment of the construction cost of the
new Vessel. If such alternative proposal is accepted by the Owner, the
successful bidder will be required to accept the MV OLINDA in an "as is
where is" condition at the date of delivery of the new Vessel. The
Owner reserves the right to defer the acceptance of this alternative
proposal for a period of sixty (60) days from the date of award of the
Contract. In the event that the Owner is unable to deliver said Vessel to
the Bidder by reason of destruction thereof or any other cause, the
Owner will pay the successful Bidder the trade-in value thereof as set
forth in Bidders proposal.
14. ALTERNATES
Bidders shall be required to submit costs for the following alternate:
Construction of a double screw 162 foot Ferry Vessel.
15. INSURANCE
a. Contract Security
The Builder shall furnish and pay for Surety Bonds each in an
amount at least equal to 1000 of the contract price as security for
the faithful performance of this contract and for the payment of all
persons performing labor and furnishing materials in connection
with this Contract.

b. Contractor's Insurance
The Builder shall not commence any work under this Contract until
he has obtained from responsible insurance companies all insurance
required herein, and the Builder shall maintain this insurance in
full force and effect until the work under this contract has been
accepted by the Owner.
(1) Compensation Insurance
The Builder shall take out compensation insurance as required
by the Contract.
(2) Public Liability Insurance
With limits of not less than $250,000.00 for any one person
injured, and $1,000,000.00 for each accident or occurrence.
(3) Contractor's Protective Public Liability
With limits of $250,000.00 and $1,000,000.00 covering
operations of subcontractors.
(4) Property Damage Insurance
With minimum limit of $1,000,000.00 each accident.
(5) Automobile Insurance
(a) Public liability with limits of not less than $250,000.00 for
any one person injured, and $1,000,000.00 for any one
accident or occurrence.
(b) Property damage insurance with minimum limit of
$1,000,000.00.
(c) Same protection for hired vehicles, if any.

(6) The Fishers Island Ferry District and the Town of Southold
shall be named as coinsured under each and all such policies
subject to the approval of the Owner's Legal Advisor.
(7) Policy Provisions
If the Builder shall procure or maintain any insurance upon
any property in which the Owner has or may acquire an
interest or upon which he has or may acquire a lien under
this Contract or otherwise, such policies shall, in the
following language, make formal disclosure of the diversity of
interest: "Notice is hereby given and accepted that the
Owner has or may acquire an interest in the subject matter
of this insurance". Such policy or policies shall also contain
a loss payable clause reading as follows: "Loss, if any, under
this policy shall be adjusted with the named insured and be
made payable to the Owner". Any payments thereunder shall
inure to the benefit of the Owner to the extent of any loss
suffered by the Owner and to the Builder as to any
remaining balance.
(8) Evidence of the above coverage, represented by certificates
issued by the insurance carrier, must be furnished to the
Owner at the time of execution of the contract. Certificates
of insurance shall state that the Owner will be notified in
writing ten (10) days prior to cancellation or renewal of this
insurance.
16. APPROVAL OF CONTRACT
This contract shall be subject to written approval of the Town Board
of the Town of Southold and shall not be binding until so approved.

CONTRACT FOR CONSTRUCTION OF A
DOUBLE SCREW 132 FOOT VEHICULAR
PASSENGER FERRY VESSEL FOR THE
FISHERS ISLAND FERRY DISTRICT,
FISHERS ISLAND, SUFFOLK COUNTY,
NEW YORK
THIS AGREEMENT, made and entered into this day of ,
1984, by and between the FISHERS ISLAND FERRY DISTRICT, a corporation
of the State of New York, in the County of Suffolk (hereinafter called the
Owner) , party of the first part, and
of
(hereinafter called the Builder) , party of the second part.
WITNESSETH, that the parties of these presents, each in consideration
of the agreement on the part of the other herein contained, have agreed and
hereby agree, the party of the first part, for itself, its successors and
assigns, and the party of the second part, for itself, himself, his heirs,
executors, successors and assigns, as follows:
1. Immediately after the execution of this Contract, the Builder will
provide and furnish a suitable location on its premises at
for the construction of a ferry vessel (hereinafter
called the Vessel) hereinafter described, and to provide and furnish all
tools, labor, materials and equipment, not expressly agreed upon in this
Contract to be provided and furnished by the Owner for said construction.
2. The Builder will build and deliver afloat, after trials and
acceptance, to the Owner at Fishers Island, New York, or at such other
location designated by the Owner, the following described Vessel under the
terms and conditions described herein, in accordance with the following
documents, to wit:
(a) The following drawings prepared by the Builder and submitted
with his proposal.
(1) Midship and Type Sections (simple type drawing) Drawing No.
(b) Sparkman and Stephens Design No. 2476-1, Alt. A entitled
"Fishers Island Auto/Pass. Ferry - Profile and Deck
Arrangements" dated November 19, 1983, revised March 9, 1984.
(c) Sparkman and Stephens Specifications No. 2476 dated March 19,
1984, (or "Supplement to Specifications No. 2476" dated March 19,
1984) .
(d) Bidding documents consisting of the Notice to Bidders, Instruction
to Bidders and Form of Proposal and this form of Contract.
3. Said Vessel to have the principal characteristics set forth at page 1
of the Specifications No. 2476 or Supplement to Specifications No. 2476.
4. Neither the Owner nor any of its officers, agents or employees shall
in any manner be answerable or responsible for any loss or damage that shall
or may happen to the said work or to any part or parts thereof, or to any
materials, equipment or any property that may be used or employed therein,
or placed upon the premises during the progress of the work, nor shall it
be in any manner answerable or responsible for any injury done or damage
or compensation required to be paid under any present or future law, to any
person or persons whatever, whether employees of the Builder or otherwise,
or for damages to any property whether belonging to the Owner or to

others,
appearing during or resulting
from the said work. Against
all such
injuries,
damages and compensation,
the Builder shall and will
properly
guard.
The Builder shall also, at all
times, indemnify and save the Owner
and its
officers, agents and employees harmless against all such
injuries,
damages
and compensation arising or
resulting from causes other
than the
Owner's
negligence.
5. The Builder agrees that it shall, pursuant to the Workman's
Compensation Law of the State wherein the work is being performed, secure
the payment of compensation for the benefit of all employees who may be
injured or suffer disability in the work contracted to be performed under
this Contract, and for the benefit of the dependents of such employees. The
Builder shall continue to secure the payment of such compensation during
the life of this Contract. In the event of the failure of the Builder to secure
compensation to the employees and their dependents as aforesaid, or in the
event of the failure to continue the securing of such compensation during
the life of this Contract, the Contract shall be and become void and of no
effect, and the Builder shall forfeit to the Owner all payments made under
the Contract and the value of all work done and materials rendered
thereunder.
6. Upon completion of said Vessel, the Builder shall procure and deliver
to the Owner at the time of delivery of the Vessel, the documents which may
be required to give the Owner title to said Vessel, clear of all liens and
encumbrances, together with such other documents required by any and all
governmental agencies having jurisdiction thereof.
7. In the event that the work contemplated by this Contract is
performed in the State of New York the Builder covenants and agrees that

he will comply with the applicable provisions of Article 8 of the Labor Law
(wages, hours, statements showing amounts due for wages, discrimination,
preference in employment, minimum rate of wages, etc.) and Article 5-A of
the General Municipal Law (Public Contracts) .
8. The Builder and each subcontractor or other person doing or
contracting to do any work contemplated by this Contract shall comply with
all laws, ordinances, rules and regulations in any manner affecting the work
or performance of this Contract whether or not such laws, ordinances, rules
and regulations are mentioned herein and shall indemnify and save harmless
the Owner and its officers, agents and employees against any claim or
liability arising from or based upon the violation of any such law, ordinance
or regulation.
Each and every provision of law and clause required by law to be
inserted in this Contract shall be deemed to have been inserted herein, and
if through mistake or otherwise such provision is not inserted, then upon
the application of either party, this Contract shall be physically amended
forthwith to make such insertion.
9. The Builder shall secure and take out, at his own expense, all
necessary certificates and permits from the municipality or other public
authorities required in connection with the work contemplated by this
Contract or any part thereof, and shall give all notices required by law,
ordinance or regulation. He shall pay all fees and charges incident to the
due and lawful prosecution of the work contemplated by this Contract.
10. Neither the Owner nor any of its officers, agents or employees, nor
any order by the Owner for the payment of money, nor any payment for, or

acceptance of the whole or any part of the work by the Owner, nor any
extension of time, nor any possession taken by the Owner, its officers,
agents or employees, shall operate as a waiver of any provision of this
Contract, or of any power herein reserved to the Owner, or any right to
damages herein provided; nor shall any waiver of any other provision of this
Contract be deemed to be a waiver of any other or subsequent breach. Any
remedy provided in this Contract shall be taken and construed as in addition
to each and every other remedy herein provided, and in addition to all other
suits, actions or legal proceedings, the Owner shall also be entitled as of
right to a writ of injunction against any breach of any of the provisions of
this Contract.
11. In case of unnecessary or inexcusable delay in the general conduct
of the work or in the event of an actual or practical abandonment of the
work, the Owner or its representative will notify the Builder or his
bondsman in writing to that effect. If the Builder or his bondsman shall not
within six (6) consecutive days thereafter take such measures as will, in the
judgment of the Owner, insure a satisfactory completion of the work in the
time specified, the Owner may then notify the aforesaid Builder and his
bondsman to discontinue all work under this Contract, and it is hereby
agreed that the Builder and his bondsman shall immediately respect such
notice and stop work, and cease to have any right to possession of the
premises whereon said work is being performed. The Owner shall thereupon
have the power and authority to cancel the Contract and to relet the work
or any part thereof or to employ such persons and equipment as it may deem
advisable by contract or otherwise, to complete the work herein described,
and to use such material and equipment as it may find upon the premises,

and to procure other materials for the completion of said work. All expenses
of such completion of the work, including the additional payments to be made
to the persons completing the same, and any other claims arising under this
Contract, shall be deducted and paid by the Owner out of such moneys as
may then be due the said Builder or which may thereafter become due under
and by virtue of this agreement or any part thereof. In case such expense
is less than the sum which would have been payable for such work under
this Contract if the same has been fully completed by the Builder, he shall
be entitled to receive the difference; in case such expense is greater, the
Builder shall pay the amount of such excess so due.
12. Each and every employee of the Builder, and each and every
subcontractor engaged in said work, shall, for all purposes, be deemed and
taken to be the exclusive servants of the Builder and not for any purpose in
any manner in the employment of the Owner. The Builder shall in no manner
be relieved from responsibility or liability on account of any delay in the
execution of the said work, or of any part thereof, by the acts or omissions
of any such employee, or any subcontractor, or any materialmen whatsoever.
13. The Owner shall pay, and the Builder shall receive, the price
stipulated in the Builder's Proposal, to wit: the sum of
Dollars as full compensation for everything furnished and done by the
Builder under this Contract, said sum to be paid as follows:
10% thereof upon the execution of this contract.
20% thereof upon laying of Keel
15% thereof when hull is framed and plated.
25% thereof when superstructure is framed and plated.

20% thereof when machinery and all accommodations, ship systems
and outfitting are substantially completed.
5% thereof when vessel has completed successful trials and has
been accepted.
5% thereof when vessel has been fully completed, delivered and
accepted by the Owner.
14. .The Builder expressly covenants and agrees that in undertaking to
complete the work within the time stated in his Proposal, the Builder has
taken into consideration and made allowance for all of the ordinary delays in
securing materials or workmen, or otherwise. Should the Builder, however,
be delayed in the prosecution and completion of the work by any change,
addition or omissions therein ordered in writing by the Owner or its
representatives, or by strike, acts of Cod, war or other causes beyond the
control of the Builder, then the Builder may within five (5) days after the
occurrence of the delay for which the Builder claims allowance, notify the
Owner in writing, , and thereupon and not otherwise, the Builder shall be
allowed such additional time for the completion of the work as the Owner or
its representatives shall award in writing.
15. In case the Builder shall fail to complete the work hereunder in
accordance with the specifications and to the satisfaction of the Owner within
the time herein agreed upon, the Builder shall and will pay to the Owner,
One Thousand ($1,000.00) Dollars per day for each and every working day
(Sundays and legal holidays excepted) that the time consumed in said work
and completion may exceed the time herein allowed for that purpose, which
said sum is hereby agreed upon, fixed and determined by the parties hereto
as the liquidated damages (including extra cost of engineering) that the
Owner will suffer by reason of said delay and default and not as a penalty;

and the Owner shall and may deduct and retain the amount of such
liquidated damages out of any moneys which may be due from it to the
Builder.
16. The Builder shall not assign, transfer, convey, sublet or
otherwise dispose of this contract, or of his right, title or interest therein,
or his power to execute the same, to any other person or corporation
without the previous consent in writing of the Owner. In the event that the
Builder shall violate the provisions of this paragraph of the Contract, the
Owner shall revoke and annuli the Contract and the Owner shall be relieved
and discharged from any and all liability and obligations growing out of
such Contract to such Builder, and to the person, or corporation to which
such Contract shall have been assigned, transferred, conveyed, sublet or
otherwise disposed of, and the Builder, and his assignees, transferees or
sublessees shall forfeit and lose all moneys, theretofore earned under this
Contract, except so much as may be required to be paid to his employees.
IN WITNESS WHEREOF, the Owner has caused its corporate seal to be
affixed hereto, and these presents to be signed by the Chairman of the
Board of Commissioners of said District, and to be attested by its Clerk,
both duly authorized so to do; and the Builder has hereunto set his hand

0-2 GENFRAII CO 'DITIONS
It is the intent and spirit of the specifications that
the Builder shall construct, equip and furnish a vessel
complete in every respect and ready for service. 1=.11
articles of equipment furnished by the Owner shall be
specifically mentioned herein. Omission from the plans
or specifications, or both, of any items vhich, according
to generally accepted practice, are necessary, for the
proper operation of the vessel, shall not release the
Builder from supplying same.
The Gomer scall assign an agent- hereinafter called the
"Representative". He and the Owner shall have access to
the vessel at all reasonable times. Every facility will
be afforded inspectors for the prosecution_ of their work.
All 'candling of material necessary for purposes of inspec-
tion shall be at the expense of the Builder.
It is the intent of these specifications that the
Builder shall construct a vessel to meet the requirements
of these specifications. Furnishing of the vessel's
design and plans shall be the Builder's responsibility.
The specifications are in some cases sn_ecific as to
components, and in some cases call for functional require-
ments. In general, all equipment shall be readily available
U.S. manufacture.
All materials and manufactured articles of construction_
and. equipment are to be of the best quality for their
respective purposes. References to trade rarmes and catalog
numbers are generally intended to be descriptive rather than
restrictive and are indicative of the general type and grade
of articles that will be satisfactory. The Representative
will normally be prepared to approve substitutions if satis-
fied that there will be no sacrifice in quality, or
difficulty with procurement of spare parts or replacement.
However, in all cases, it is understood that the choice
shall rest with the Representative and changes from items
listed by trade name or number shall be made only with his
approval. This condition is to have effect whether or not
such terms as "or equal", "as selected", or "as directed"
are used. All equipment shall be readily available U.S. manu-
facre
�� shall be the responsibility of the Builder to carefully
check all purchase orders, whether originating with the Repre-
sentative or the Owner himself, and also to check all material
delivered to insure conformity with the details of the speci-
fications and with all normal working requirements, including
installation within the available space.

0-2 GENERAL CONDITIONS (Continued
Attention shall be given to the functioning of electrical
and mechanical equipment and to the reduction of noise and
vibration. The bow thruster,in particular,shall not produce
excessive noise and vibration. The correction of excessive
or localized vibration shall be the responsibility of the
Builder.
The Builder shall guarantee skilled workmanship, in keep-
ing with the best commercial practice, and in conformity
with plans and specifications. During construction any work
or material found defective or unsuitable by the Repre-
sentative shall be removed and replaced without extra charge,
regardless of the stage of construction.
Except for such items of equipment as are specifically
included in the list of articles to be furnished by and at
the expense of the Owner, the Builder shall furnish all
items which are appropriate or necessary for the proper
operation of the vessel.
The vessel will be launched at the Builder's yard. Delivery
will be according to the conditions of the contract.
The equipment and construction of the vessel, whether
specified or not, shall meet all requirements of the U.S.
Coast Guard (U.S.C.G.), U.S. Public Health Service (U.S.P.H.),
Environmental Protection Agency (EPA) and State of New York
as applicable to a vessel of this type, for operation on lakes,
bays and sounds. It must be certified for the ferry run,
year round between New London and Fishers Island. Construc-
tion, stability, subdivision as well as mechanical and
electrical equipment shall be such as to enable the procure-
ment of temporary certificates for operation to Newport, R.I.
or Block Island, R.I. in the summer time.
The vessel shall be built for the intended service to
requirements of U.S.C.G. and American Bureau of Shipping
unless U.S.C.G. requirements are less severe. ABS Classi-
fication is not required, but steel for hull, material for
shafting and propellers shall meet their requirements. The
vessel must have a gross tonnage of less than 100 and be
furnished by the U.S.C.G. with a Marine Document certifying
this.
These specifications have been prepared to cover equip-
ment and materials as accurately as possible prior to the
full development of building plans. The Builder's attention
is called to the fact that all items are subject to altera-
tion during such development, and firm orders for such equip-
ment or material must be coordinated with the progress of the
design.

i INSURANCE
The Builder shall keep the vessel and all materials
intended therefore, including all items furnished or
delivered by the Omer, and including Designing Fees,
fully covered under a standard Builder's Risk Policy of
insurance while ashore, during launching, afloat, on
trial or delivery trips and/or otherwise, until delivery
has been made. Indemnity for loss,if any, shall be made
payable to the Builder, and the Owner as their respective
interests may appear. A duplicate of said Policy of
insurance and any amendments thereto, shall be furnished
the Owner.
DAMAGED WORK
The Builder will protect all work at all times and be
responsible and make good any and all damage for whatever
cause, to any part of the vessel or its equipment or
furnishings, whether supplied by himself or by the Owner.

The Builder is at all times to keep the vessel reason-
ably clean throughout. Particular care is to be taken that
all chips, shavings and other foreign matter is removed and
all parts thoroughly cleaned before application of paint,
and that when the vessel is delivered, her bilges and
pockets throughout shall be entirely free from such matter.
ALTERATIONS & EXTRAS
Should the Representative deem it necessary or advisable
during the course of construction to make any changes in the
layout or details, so long as the general style and type of
the vessel and its arrangements are maintained, such changes
are to be made by the Builder without invalidating the
contract and without added expense, provided these altera-
tions are determined before the particular part of the work
to which they refer is commenced.
No charge for extra work will be allowed unless authorized
as such in writing by the Owner or his Representative with
the Owner's prior consent. No extra work is to be considered
as grounds for invalidating the contract or for delaying the
time of delivery and completion of the contract, except to
the extent that delays may have been accepted by the Owner
at the time of his approval of a stated alteration.

0-3 MISCELLANEOUS
• The following items will be furnished by the Owner and
such of it as is sent to the Builder will be installed by
the Builder with all necessary foundations, connections
and related equipment. Only those items specifically listed
below will be supplied by the Owner and anything else
required for a complete vessel of the type described shall
be provided by the Builder:

The Builder shall receive, store in a suitable manner
and install on vessel at proper times the above and any
other articles consigned to him for the Owner's account for
use in the vessel. Suitable lockers, drawers or chocks
shall be provided for dishes, utensils, tools and instruments
as required. No additional charge shall be made for this
service and the Builder will be responsible for the safe-
keeping of all such Owner furnished items.
Builder's Items
The following items shall be furnished and installed by
the Builder and shall conform to cognizant government agencies
where applicable.
Docking Lines - Four (4) 75 ft. lengths of 14" dia.
Polypropolene to be made up with eye
splices, one end as directed.
Bell - Size to comply with U.S.C.G. regulations.
To be Perko spun stainless steel, with
mounting bracket clapper and lanyard

reflectors, or equal, with stowage racks

0-8 LIMBER, LIGHTENING AND AIR HOLES
Drain holes or limber holes shall be of ample size and
arranged to drain lowest part of bilges.
Air holes shall be cut in tops of watertight floors or
longitudinals in tanks to facilitate complete filling.
Lightening and access holes shall be cut in girders and
other members, so as not to impair strength. Frames and
floors shall be coped out where they pass a seam or butt in
the shell or bulkhead plating.
0-9 ACCEPTANCE
After final inspection and satisfactory trials and
acknowledgement by the Representative that all. details of
the plans and specifications have been fulfilled, the vessel
will be formally delivered to the Owner, and upon payment
of the balance of money still due, the Builder shall deliver
to the Owner all documents showing clear title to the vessel.
All license fees in connection with these and any other
papers pertaining to this vessel shall be paid by the Builder.

SAFETY REQUIREMENTS
The vessel shall meet all applicable safety requirements
of the U.S.C.G. and New York State.
All life preservers are to be stowed in accordance with
U.S.C.G. requirements.
GUARANTF.F.
If, at any time, within six months after delivery of the
vessel to the Owner,any defect or failure in workmanship or
materials shall be discovered except for Owner furnished items,
or unless due to negligence or other improper act of the Owner
or any other user of the vessel during such period, the Builder
shall accept responsibility therefor. Under such circumstances,
the Builder shall make or authorize repairs as shall be neces-
sary to correct such defect or failure, including replacement
of parts or material found to be defective, except for machinery
or equipment and component parts thereof acquired by the
Builder for.installation in the vessel according to specifica-
tions, in respect of which, the Builder shall be responsible
only to the extent of the manufacturer's guarantee.
The above clauses shall not relieve the Builder of
liability for defects or failures occurring after the expira-
tion of the six months' warranty period, when such defects or
failures are due to the Builder;s substitution of material
other than the material specifically called for in the plans
or specifications, unless such substitution has been consented
to in writing by the Representative.
WEIGHT AND TRIM
Control of weights and centers and weight reduction where
feasible is important to effect the performance of the vessel.
Wherever in the specifications approved substitutions are
made for specified items of equipment or equipment specified
on an "or equal" basis the equivalent weights of the new
equipment shall not exceed the weight of the item specified
unless approved by the Representative.
The Builder shall carefully evaluate and determine various
loading conditions and changes in longitudinal trim, which shall
be submitted to the Owner and his Representative during all
phases of the design and construction. Fixed ballast shall not
be used for obtaining acceptable trim conditions. Fixed ballast
shall be installed if required by the U.S.C.G. for stability
purposes.

Agency shall be prepared by the Builder and submitted to
the applicable Agency for approval as part of the Contract.
DETAIL DRAWINGS BY BUILDER
Any additional detail drawings which are required by the
Representative or needed to properly construct this vessel
will be prepared by the Builder and submitted to the Repre-
sentative for approval before the work to which they refer
is begun. The Representative is to be furnished with one
copy of all such approved drawings prepared by the Builder.
Builder shall obtain from U.-S.C.G. approval of subdivision
and stability letter.
The Builder shall furnish instruction books for all
special items of equipment including plumbing, machinery
and electrical items.
The Builder shall furnish copies of purchase order data
for all mechanical and electrical components, such as engine,
pumps, blowers, circuit breakers, fixtures and deck machinery.
1-4 WELDING & RIVETTING
This shall be in accordance with ABS Rules both as to
layout and quality. The yard shall provide for non-destructive
testing by X -Raying and Dye -Penetrant testing of a limited
number of welds selected by the Representative. Proper
sequences of welding shall be followed to prevent undue
distortion.
5-2 LAYING DOWN
The lines are to be laid down full size .on the mold loft
floor from the Yard's offsets and carefully faired. Such
details of construction and arrangement are also to be laid

out full size as may be in the opinion of either the
Builder or the Representative necessary in order to insure
that interferences are eliminated and that matching or
fitting parts are properly installed.
8-0 TRIALS & TESTS
The Builder shall conduct an inclining test as directed
by the Coast Guard which shall also be witnessed by the
Representative. The Builder's Naval Architect shall pre-
pare instructions for this test and submit the calculations
(with copies to the Representative) to the U.S.C.G. for
approval. The U.S.C.G. approval letter shall provide for
the specified pay load capacity. Any permanent ballast for
trim or stability required by the U.S.C.G. shall be pro-
vided and installed by the ship builder.
Copy of U.S.C.G. Certificate shall be posted in glass
frame in Passenger Cabin, Stability letter shall be posted
in a similar frame in the Pilot House.
The Builder shall prepare a test Agenda which shall be
submitted to the Representative for approval.
In addition to the dock and sea trials described else-
where, the Builder is to test all installations to the
greatest extent possible and to conform to the regulations
and requirements of the U.S.C.G and of other regulatory
bodies governing such tests for new construction. All
auxiliaries and systems, such as pumps, electric plant,
anchor windlass, plumbing and fresh water system as well as
mechanical devices and gear shall be thoroughly tried and
operated under load to he satisfaction of the Architect and
to determine compliance with specifications.
All hydrostatic tests of tank and piping shall meet the
requirements of U.S.C.G. or A.B.S., whichever is greater,
and be witnessed by the Representative.
All trials shall be conducted by the Builder. These
trials shall demonstrate proper working alignment of all
items of machinery and equipment and indicate reasonable
absence of objectionable noise or vibration.

At Dock the following shall be tested:

Ventilation Systems
Heating Boiler, Plumbing and Domestic Hot Water
The main machinery is to be operated to the satisfaction
of the Owner or his Representative at the dock for two hours
at as much speed as is practical without undue heating.
After a satisfactory dock trial, a trial trip will be run
during which the runs shall be made in both directions over
an approved measured mile course over a range of at least
four sets of speeds including full speed. A set of runs
shall be made at maximum speeds with one engine operating.
The trials are to include maneuvering, steering and revers-
ing. The course should be in water having minimum depths
of 50 feet.
A four hour trial at maximum continuous power shall be
run.
The bow thruster shall be tested for a period of twenty
minutes at various speeds and directions.
Steering by bow thruster shall be checked at under way
trials, with engines at half speed ahead and astern. Time
to make a 3600 turn in each direction with engines stopped
shall be made. Operation shall also be checked with main
engines shut down.
Steering system shall be observed in ahead and astern
operation. Hand steering shall be tested. Emergency steering
tiller with block and tackle to be properly stowed and easily
available.
W.T. Bhds., hull, deck, hatches, etc. to be given hose
tests for watertightness.
For hydrostatic test of hull skeg see Section 11-4.
Ventilation system shall be checked for delivery.
All electronic equipment shall be tried out and
demonstrated to be in proper working order.

• The fresh water system shall be decontaminated, includ-
ing tanks. Fuel oil piping shall be flushed with diesel
oil, by-passing machinery.
The magnetic compasses shall be compensated.
The results of all tests and trials shall be recorded.
During trials, the vessel shall be at all times in
the care,custody and control of the Builder. Attendance
of the Representative (or the Owner) at the time of the
trials, or the carrying out of a request to make certain
runs or maneuvers whether informally arranged or according
to an established trial agenda, shall not serve to place
the vessel in the care or control of the Representative
(or the Owner) at any time, and the Builder agrees to hold
the Representative (and the Owner) harmless in the event
of loss or damage arising out of operation of the vessel
during trials.
9-0 ACCESS TO COMPARTMENTS
Arrangements for access and for cleaning out and paint-
ing shall be provided to all compartments and to all parts
of the vessel wherever practical.
Access to the engine, steering gear and all other equip-
ment that may require services of any kind shall be pro-
vided.
Care shall be taken in locating pipes and other parts
to avoid blocking of access. If access is required
removable sections shall be utilized.

HULL CONSTRUCTION
11-0 GENERAL
The Hull and Superstructure shall be welded steel in
accordance with the detail plans which the Builder shall
develop. The hull shall be a Vee -bottom (hard chine) shape.
MATERIALS
Unless the exact material specified is used, the Builder
is to submit to the Representative, well in advance, speci-
fications for any substitutions he may wish to propose,
giving all pertinent data such as chemical composition,
physical properties, glueing specifications and procedures
and such other information as the Representative may
require. The Representative reserves the right to require
specimens from which chemical or physical properties may
be verified by tests. The approval of any and all substitu-
tions for material specified shall rest with the
Representative.
All wood used in construction shall be sound, clear and
free from large knots, checks, shakes or sap, well seasoned
and of a kind and quality well suited for marine purposes.
However wood shall not be used where it is in conflict with
U.S.C.G. requirements for fire protection as outlined in
46 CFT Subchapter H and Subchapter T.
Steel shall be A.R.S. Grade A for normal shipbuilding
practice.
Stainless steels shall be 304, 314, 316 or 316L, depend-
ing on application, except where otherwise specified.
All galvanizing shall be by hot dipped process for small
assemblies, or by zinc spray process for large assemblies.
Aluminum alloy shall be 5083-H321 for structural plates
and 5083-Hlll for extrusions.
Fastenings
Non-ferrous fastenings shall be silicon bronze unless
otherwise noted. Stainless steel fastenings may be used
for the superstructure where required; elsewhere their use
shall be subject to the Representative's approval.

Fastenings for interior floorings, grounds, furring
• strips, joiner panelling and such other items shall be
galvanized.
Clips for attachment of insulation shall, where
required, be of the plastic cemented type.
11-1 PLATING
The shell plating shall have flush welded butts and
seams with welds reinforced on inside and ground flush on
outside. Fairness shall be consistent with good commercial
construction.
Doublers or insert plates of extra thickness shall be
fitted as directed in way of stern tubes, sea chests, rudder
posts, over propellers and other locations where reinforcing
is required. Cut-outs shall have large radii at corners.
Arrangement of seams and butts shall be subject to Repre-
sentative's approval.
Particular attention shall be given to the sequence of
welding in order to minimize shrinkage and distortion.
For construction of keel coolers see Sec. 48-5.
11-3 FRAMING
Web frames shall be fitted as required. All penetrations
of frames and longitudinals at watertight or oil tight bulk-
heads shall have welded stop waters.
11-4 STEM, KEEL, ETC.
To be as developed. Keel may be box or plate type. If
plate type a flat docking shoe must be incorporated. If
box type the keel is to have bulkheads same as hull and have
bronze sounding plugs. It shall be pressure tested to 5 PSI.
Limbers
Concrete shall be used only for purposes of limber
drainage.

11-5 BULKHEADS
• Watertight, oiltight and structural bulkheads are to
be located as shown. Cross flooding ducts as required
by U.S.C.G. to prevent unsymmetrical flooding shall be
installed between side compartments.
11-6 DECK, CABIN FLOORS, FLATS, ETC.
Decks may have straight line camber where required and
as developed. Main deck girders shall be as developed.
Vehicle deck shall be designed to carry truck tire loads
with factor of safety for impact. (See 0-1 PRINCIPAL
CHARACTERISTICS for truck capacity).
Suitable foundations shall include those in way of
anchor windlass, mooring fittings, and other highly stressed
foundations. On the vehicle deck curbs shall be installed
at sides of outer superstructure. and where required to pro-
tect ventilation boxes, etc., all as approved by the Owner.
Deck curbs are not required around the stair casing.
Strong beams shall be installed as required at main
openings.
Superstructure to be as shown on Contract Plan. In general
side plating on pilot house shall be 10 gage. Racking webs
shall be fitted as required on the side of the vehicle deck
and arranged to give minimum interference with traffic.
Flats and Flooring
All flooring shall have suitable traps or loose sections
arranged to provide ready access to the bilge. Traps shall
be fitted with flush plates with lifting holes.
Portable gratings of diamond plate shall be installed
as necessary in the fore peak, lazarette and stowage spaces.

11-9 STANCHIONS AND PILLARS
These shall be fitted in engine room, holds and under
• passenger decks as required.
Where necessary to facilitate machinery removal engine
room stanchions shall be made portable.
11-12 FOUNDATIONS
Foundations for main engines shall be as developed
with suitable structural floors. Auxiliary foundations
shall be weldments. Tops of auxiliary foundations for
pumps shall be flanged up 2" to provide drip pans.
Foundations for rudder ports and steering gear shall be
designed for stresses resulting from maximum rudder
torque.
12-1 MOORING FITTINGS
Double post bar Kitts shall be installed near the aft
end of the main decx, on the forward work deck, and end
of the upper deck, as shown on Contract Plan. Fittings
shall be of annealed cast steel or welded pipe structures
of ample strength and securely welded to the deck, suit-
ably reinforced with headers and doublers as necessary.
All rough surfaces shall be ground smooth to prevent undue
wear of lines.
Chocks with well rounded rims, either weldments or cast
steel, shall be installed as shown on Contract Plan.
Four 18." annealed cast steel or welded steel cleats
shall be installed on the forward work deck. Two similar
cleats shall be installed amidship on the main deck, near
an opening port, as shown.
Chocks located ar_n.idship at the main deck level shall be
provided with sliding steel water.Light covers .for use in
heavy weather.
Final location and arrangement of mooring fittings are
to be subject to Representative's approval.
12-2 BULWARKS AND RAILS
The stairways shall have strong pipe grab railings on
both sides.
Grab rods shall be fitted in the tunnel to the engine
room, access hatchways, and elsewhere as necessary. Grab
rods may be similar to horizontal ladder rungs,or equivalent.
Sun deck, aft end of upper deck and bridge deck railing
is to be of galvanized 1-1/4" pipe top rail and stanchions
and 1" galvanized pipe intermediate courses. Stanchions to
be located over a deck frame or other reinforcement below
deck. Railing on sun deck and aft end of upper deck to be
fitted with canvas covering. Rail on upper deck from Pilot
House forward to be 1-1/4" pipe attached to forward bulwark.
Top rails on upper and sun deck to be 42" above deck, and
. 392" on bridge deck.

One removable portable aluminum bulwark section, port and
• starboard for passenger embarkation, is to be installed in
the after end of the vessel as shown on the Contract Plan.
Each section to have pin connections to bulwark brackets,
to firmly lock in place.
Main deck aft, along the sides to be enclosed with 4.2"
high bulwark. Stern loading area at transom to have 5
removable stanchions with covered 7/8" stainless steel rope
rails. Main guards along side of hull shall be split pipe
6" Schedule 120 or equivalent.
The stern recess, ramp and removable railing together
with ramp, rubber guard and vertical stern fenders are
shown on the Contract Plan.
The rubber guard shall be B.F. Goodrich, Kitchener,
Ontario plant, Butyl rubber, 70 Durometer, Marine guard, or
equal, 4" x 8" solid bolted with horizontal galvanized steel
bolts with recessed heads spaced about 15".
The final arrangement and details of the stern ramp
railing and guard to be developed during construction to
suit the Owner, Representative and U.S.C.G requirements.
12-3 WINDOWS AND PORTS
All windows shall be 1/4" thick safety or heat treated
glass as per U.S.C.G. requirements.
Passenger cabin side and aft windows, and toilet room
windows, shall be Kearfott horizontal sliding weathertight
type K-100SS or equal, in rectangular frames. Only one
side of a window to slide. Stops shall be fitted to limit
opening to 12 to 14 inches. Passenger cabin front windows
shall be fixed Kearfott type K -325-F, 40" long x 32"
high.

The space between all pilot house windows shall be kept
to a minimum for maximum vision.
A Trico motor window wiper FPBP-85L for compressed
air operation, with Anco 800 blade shall be installed on
the forward center pilot house window.
The faying surfaces of all windows are to be flat
in way of window flanges so that windows are not
distorted when fastened.
Note: The fixed windows in the pilot house and passenger
cabin front may be to the Builder's design, subject to
approval by the Representative.

Windows shall be installed in accordance with manu-
facturer's recommendations. Fastenings shall be spaced
close enough to ensure a watertight seal between window
frame and structure.
Aluminum frames, if used, shall have "Alumilastic"
between the window frame and steel. The "Alumilastic" shall
be liberally applied so that the compound squeezes out all
around.
A total of 8-16" cast bronze Kearfott watertight port
lights shall be installed as shown. Four of these shall
be watertight hinged type with dogs. Covers are not
required.
All ports shall have spigots to extend 1/8" outside of
plating. No outside finishing ring or flange is to be
fitted. Heat treated plate glass is to be used.
12-4 HARDWARE
All doors and other equipment requiring knobs, latches,
locks, hinges, etc. shall be equipped with best quality
stainless steel or bronze marine hardware.
Hold back hooks shall be provided for exterior doors
to pilot house, passenger and crew cabins.
12-5 STERN TUBES & STRUTS
Stern tubes shall be extra heavy steel tube counter -
bored as required for bearings with flanges for stuffing
box. Provision for water service shall be fitted.
Propeller struts shall be double armed fabrications
counterbored, faced and drilled for flanged stern bearings.
Arms shall be solid steel with reasonable fairing on lead-
ing and trailing edge.
Intermediate single arm struts shall be fitted if
required. Arms shall be faired similar to the double arm
struts.

14-0 FLOOR & DECK COVERING
• All decks which are to receive deck covering shall be
tested for watertightness before covering is laid, and
be cleaned and dry. All rust, grease, oil, mill scale,
and other foreign matter must be removed. All decks must
be sandblasted free of mill scale.
Passenger cabin, rest rooms, pilot house and crew
cabin decks to be fitted with a layer of Magnesite of the
proper thickness to comply with USCG fire rating time
regulations. A 1/8" thick layer of Ascon "Uniflex II"
shall be applied over the Magnesite (The Ascon Products
Co., P.O. Drawer A, Niantic, CT 06357). Both layers shall
be installed by Ascon personnel or their sub -contractor.
This covering shall be flashed up 6" in the rest rooms,
and the magnesite shall be properly sealed by the Ascon
covering around all other boundaries. Color of Ascon
finish covering shall be selected by the Owner. Exterior
decks are to be painted in accordance with Section 19-0,
PAINTING.
Deck coverings are to be applied in strict accordance
with manufacturer's specifications and USCG requirements.
Engine Room Floor Plates
All areas in way of machinery and equipment and over
the bilge in the engine room and in the tunnel to the
engine room shall be covered with 1/8" diamond plates.
Floors shall be supported on 2-1/2" x 2" x 1/4" steel
angles and shall be secured with 1/4" countersunk flat
head, bronze or stainless steel machine screws. Rubber
strips, 1/8" thick, shall be cemented to faying face of
angles to eliminate noise.
The bounding edges of all floor plating in way of open-
ings and at the sides shall have a 1-1/2" high coaming.
Loose plates and openings shall be fitted for access to
valves, strainers and similar equipment requiring servicing.
16-2 DOORS, HATCHES & MANHOLES
Double weathertight sliding doors, Cornell -Carr Co.,
with glass panes, shall be located as shown on Contract
Plan for access to upper deck passenger cabin. Doors
to have adjustable friction brake to prevent slamming shut,
and a positive lock to hold open.

Suitable marine type latches with key locks shall be provided.
The same key shall fit both doors. The doors shall be fire-
resistant and meet U.S.C.G. requirements including glass panes.
Sills should be slightly sloped to prevent retention of water.
A hinged weathertight Cornell -Carr Co. door shall be in-
stalled for access to the crew cabin on the sun deck. The
door shall be fire-resistant and meet U.S.C.G requirements. Door
shall have a small fixed round glass port light. Sill shall be
slightly sloped to prevent retention of water.
Two hinged weathertight Cornell -Carr Co. doors, with lever
action dogs, radius corner, rectangular glass panels and marine
type hardware shall be installed at the forward end of the
passenger cabin. These are for emergency escape to the forward
work deck only, and shall be prominently labelled as such.
All of the above doors shall be of double wall construction,
with insulation similar to the cabins, and of heavy gage steel.
Frames shall also be of heavy gage steel. Door construction
must be toy quality marine standards and be suitable for severe
weather conditions, 77fe-a—tTier doors should be given a hose test
using a 1/2" nozzle at 25 feet at 30 PSI - a slight leakage only
will be permitted.
Watertight doors shall be fitted to the main engine access
casing and for access through the engine room bulkhead. To be

Pilot house door shall be wood, solid oak, with window, lock
set and marine hardware.
Toilet doors shall be steel with marine hardware and inside
latch.
All doors must have best quality marine hardware. See Section

Manhole hatches shall be marine type L.S. Baier galvanized
steel. Escape hatch from engine room and from forward end of main
deck overhead and access to bow thruster compartment shall be 24".
To open from above and below. Other manholes; should be similar
and 18", located as shown to open from above only. Wrenches and
stowage shall be provided as developed. All hatches shall be care-
fully welded to insure watertightness, and shall be given a hose
test.
Engine Room Hatches
Provision shall be made by means of "soft patches" in the main
deck for removal of any one of the main engines, generators or bow
thruster engine. Also, a 3 ft. x 4 ft. "soft patch" shall be
located on the center line, at the forward end of the engine room
to facilitate removal of other machinery equipment.
These "soft patches" shall be arranged to permit burning out
and re -welding with a minimum of work. Piping, wiring, and control
equipment shall be kept clear of these areas to the maximum extent
possible.

A pipe mast shall be mounted on top of pilot house to
support ship's horn, radar and lights.
A yard arm will be fitted to mast to fly ship's flag
and signals, with one small block fitted to each end of
yard arm for -3/16" cotton or synthetic line. Galvanized
cleats to be installed on aft side of pilot house to
secure lines.
Ladder rungs of steel tube shall be installed
on the mast. To be single 6" long rungs, alternating on
each side of the mast, as per plan.
A gaff shall be installed with necessary rigging to fly
an ensign, as per plan.

19-0 PAINTING
All surfaces to be painted are to be thoroughly clean
and completely dry before any painting is commenced. No
painting is to be accomplished in compartments or tanks
required to be tested until satisfactory tests are
accomplished. All parts and/or spaces not specifically
mentioned shall be finished to conform to the surrounding
or comparable spaces. All bright work and moving parts
of machinery, windows, wire, rope, sheaves, bearings,
lighting fixtures, mirrors, plumbing, fixtures, etc., are
to be completely and adequately protected during construc-
tion work, sandblasting and painting.
All exterior and interior paints and painting materials
shall be International Paint Co.,Inc., marine grades. No
substitutes are permitted without the approval of the
Owner and his representative.
All paints are to be applied as specified, under the
direction of the manufacturer's representative. All
paints and finishing materials are to be supplied by the
manufacturer ready for use and are not to be thinned or
modified in any way, except for special tinting, without
the approval of the manufacturer's representative, the
Owner or his representative.
All surface preparation and painting is to be done in
strict accordance with the paint manufacturer's recom-
mendations. The paint manufacturer is to serve as
consultant and advisor for all phases of painting, so that
the vessel will receive a first class paint job throughout.
Where more than one coat is specified to be applied
drying times as required by the manufacturer shall be
adhered to.
Before sandblasting the hull, the waterline shall be
marked off at intervals of five feet by horizontal punch
marks or weld beads, for guidance in application of the
bottom and side paints.

All aluminum shall receive at least one coat of zinc
chromate primer and two finish coats of color.
• All high temperature surfaces shall be painted with
fireproof paint.
All piping below engine room floor plates shall receive
same paints as bilges. All other piping shall be painted
simmlar to adjacent areas, except in some cases, color will be
different. Where piping is insulated, pipe and fittings shall
receive same paint as adjacent area and lagging sealed and
painted with two finish coats.
Machinery and equipment that has been painted by the manu-
facturer shall be thoroughly cleaned and touched up or repainted,
if necessary. Machinery and equipment that has been given only
a priming coat by the manufacturer shall receive two finish
coats of engine enamel. The last coat on all machinery is not
to be applied until after trials and tests have been accomplished.
All stairway treads, stringers, and front of back plates
shall be given two coats of primer and two coats of finish paint.
Name and Hailing Port
Name and hailing port are to be painted on the stern quarters,
port and starboard. Name to be painted on both sides of forward
bulwark or just below bulwark forward and on name board on sides
of crew cabin lust below the bridge deck railing, per Contract
Plan.
Draft Marks
Draft marks 6" high shall be painted at each side of the
bow and stern.
Bright Work
Hatches, deck lockers, rail caps, and other wood trim
shall be varnished as required by the Owner and as recommended
by the paint manufacturer.
Cabin & Pilot House Interiors
To be painted with 2 coats as recommended by'the paint
manufacturer.

22-0 RUDDERS AND STEERING GEAR
Two balanced rudders of single plate ribbed construc-
tion are to be installed in location and of size and shape
to provide best maneuvering and speed. Scantlings shall
conform to ABS requirements.
Rudder stocks shall be of the diameter required by ABS.
Lower stock if used shall be tapered in accordance with ABS
rules; if replaced by built-up structure the same taper
shall be used and equivalent strength provided.
Rudders in any operating position shall have a minimum
hull clearance of 3 inches.
Rudder stocks shall penetrate the hull through heavy
watertight trunks extending to an upper carrier bearing
below the.main deck. Carrier bearings are to have adequate
number of easily accessible grease fittings. Stuffing box
or effective 0 -ring shall be provided.
The lower bearings shall be rubber, bronze bushed, with
effective retainers, grease grooves, and grease fittings.
The upper bearings may consist of flanged bronze bush-
ings or equivalent anti -friction bearing designed for down-
ward withdrawal of stock; design shall incorporate adequate
safeguards against accidental loosening of carrier.Th
top of each stock shall be tapped for a lifting eye, ana
squared for the emergency tiller.

The upper end of the rudder trunks shall be properly
supported and braced to the structure. An internal doub-
ling plate shall be fitted at the shell.
Internal stops shall be fitted to prevent rudders from
travelling beyond 37 degrees port and starboard.
A flush watertight deck plate shall be fitted over each
rudder stock.
Tillers
Tillers to receive the connecting rod and steering rams
shall be installed. The stock may be keyed or squared and
the tiller hub split and fitted with clamp bolts.
One emergency tiller shall be provided, to operate
through the main deck plates over the rudder stocks. To
be equipped with block and tackle with attachments for
same on the main deck bulwark.
Steering Gear
Dual steering stations shall be provided, one in the
pilot house and one outside, aft of the pilot house. (See
Section 24-0, PILOT HOUSE).
Steering wheel to be wood spoke type, as approved by
Owner or Representative.
Steering gear shall consist of one or two hydraulic rams,
as developed, with hydraulic tank, directional valves and
an electric motor driven pump. Tubing shall also run to
the steering wheel head in the pilot house which will act
as a pump when emergency steering is required.
Operation shall be of the follow-up mode.
The entire hydraulic system shall be equipment of proven
quality and approved by the Representative.

The pilot house arrangement shall be furnished by the
Owner.

33-0 JOII4ER WORK
The sides, ends, and deckhead of the passenger and
crew cabins and pilot house are to be insulated and
sheathed for comfort and appearance. (For insulation
see Section 39-1).
Sheathing in the cabin and pilot house overheads
shall be textured metal panels painted in color selected
by the Owner. All exposed joints shall be neatly fitted
and finished. Sheathing on the cabin and pilot house
sides and deckhead shall be carried over the face of the
ordinary frames. (Web frames occurring in way of
partitions may be partially exposed).
Sheathing shall be installed on suitable furring,
spaced for adequate support of the sheathing. Corner
trim of approved type shall be installed.
Partitions for toilets, purser's office and stair
casings shall be 10 gage or 1/8" steel suitably stiffened.
Seating
The passenger space on the upper deck shall be
enclosed and fitted with seats for 123 persons. The
passenger space on the open sun deck shall be fitted
with seats for 100 persons.
Seating shall be U.S.C.G. approved.
Seats in the enclosed upper deck cabin shall be slatted
of a hard wood with fire-resistant cushions on the seat
portion. Seat backs do not require any upholstery and
shall be slatted wood. Seat frames and leg supports shall
be steel. Wood work to be varnished. Seats must be
U.S.C.G. approved.
Seats on the open sun deck shall be slatted wood with
steel frames and leg supports, all simile to the enclosed
cabin seats. However, no seat cushions are required.

38-1 VENTILATION AND HEATING
Mechanical Ventilation
• Engine Room
Shall have one (1) supply fan, Buffalo Forge, size 21,
Type B, 12 HP, 2 speed, 120 volts A.C., 1800 RPM vane -
axial fan, 6500 CFM at 3/4" (or as required) static pressure.
The fan shall be installed in a steel water trapped baffled
box, as shown, on the sun deck with 2" insulation in duct
to the engine room casing, and thence to the engine room.
The intake opening shall be covered with steel wire mesh
to prevent objects from being thrown in. A hin ed aluminum
cover of lightweight construction shall be provided as
shown, to cover the intake during winter to provide heat loss.
The final fan size is subject to further development by the
Builder, depending on the air consumption of the main engines,
generator and cooling air requirements.
Passenger Cabin (Exhaust)
The upper deck passenger cabin shall have one exhaust
fan with louver in Purser's office.

Correct fan size shall be subject to further development
by Builder.
Toilets (Exhaust)
There shall be one exhaust fan for each toilet room.
Each fan shall be Buffalo Forge Co. "Baby Vent", centri-
fugal, all aluminum, size E, 1140 RPM, 1/6 HP, 120 volts,
A.C., 460 CFM at 3/8 " (or as required) static pressure.
Exhaust outlets shall be outside on the upper weather deck,
overhead, as shown.
Natural Ventilation and exhaust trunks

• 38-1 VENTILATION (Continued
Heating System
Heating shall be by an oil fired Aldrich boiler
Model K360W with a normal rating of 324,000 BTU per hour
and U.S.C.G. approved. Current shall be 115v. A.C. The
boiler shall be fitted with a tankless hot water heater
with supply from the ship's fresh water system. A
mixing valve shall be installed. Boiler shall be in
engine room with flue pipe into engine room air exhaust
vent at after bulwark, as shown. Hot water supplies
shall be run to each wash basin.
Finned type baseboard heating elements to be placed
throughout passenger cabin, pilot house and crew cabin
to suit best heat distribution. The finned baseboard
heating elements shall be protected by a heavy gage hous-
ing that will prevent any possible damage. Engine room
to be heated with three unit heaters, Grinnell "Thermolier"
Mod. 28E9 or equal rated at 20,500 BTU with louvres and
electric fan for horizontal delivery.
Piping to be copper tubing Type L with silver
soldered joints throughout and insulated where running
through hull compartments. Stuffing tubes to be used
• at watertight bulkhead penetrations. Where run between
vehicle and upper deck, piping shall also be heavily
insulated. All piping shall be in accordance with
U.S.C.G. regulations.
System to be designed to raise temperature in heated
space 65 degrees F. over outside temperature of 100F.
A three zone system with thermostatic valves and
solenoid controlled zone distribution valves shall be
installed to serve the following areas:
Zone I Passenger Cabin
Zone II Pilot House and Crew Cabin
Zone III Engine Room
Three Bell and Gosset circulating pumps (one for each
zone) and necessary aquastat, expansion tank, feed valve,
mixing valve, relief valve, etc.shall be installed.
Entire heating system shall be subject to final develop-
ment by Builder.

39-1 INSULATION
• Insulation 2" fiberglass of 2 lb. per cu. ft. density
shall be secured to the sides, ends and overhead in pilot
house, passenger cabin and crew cabin. Insulation shall
be secured by plastic clips cemented to structure or as
approved. The same insulation with aluminum perforated
sheathing shall also be installed underneath the main
deck in the engine room. For sheathing, see Section
33-0 JOINER WORK.
93-1 FIRE EXTINGUISHING SYSTEMS
Fire Extirguislzers in accordance with U.S.C.G. shall be
installed as directed by them as follows:
Vehicular deck 4 - 15 pound dry chemical
Pilot house 1 - 4 pound dry chemical
Engine room 2 - 15 pound dry chemical
Passenger cabin 2 - 15 pound dry chemical
A manual sprinkling system shall be installed in the
vehicular space of the main deck, in accordance with
U.S.C.G. regulations. (See Section 47-0, PUMPS).
A fire main system, including fire main, hydrants,
hose and nozzles shall be installed in accordance with
U.S.C.G. regulations. (See Section 47-0, PUMPS) .

MACHINERY
40-0 GENERAL
All machinery and electrical equipment that could be
effected by freezing temperatures must be located in the
engine room and not in unheated compartments (such as the
bow thruster compartment) unless absolutely necessary.
41-0 MAIN ENGINES (OWNER FURNISHED)
There shall be two (2) main propulsion engines,
furnished by the Owner. These engines shall be Caterpillar
Model 3 1 T (turbocharged), with Twin -Disc Model MG518
2.47:1 reduction/reverse gears. Continuous rating is
540 B.H.P. at 1800 RPM. Engines are medium duty, with keel
cooling. The starboard engine shall turn aright hand
propeller when looking forward and port engine a left hand
propeller when looking forward.
The engines with accessories, as furnished by the Owner,
shall be delivered to the Builder as follows:
a) Output flanged coupling for connecting to the Builder
furnished propeller shaft coupling.
b) Remote and positive locking engine mounted governor control
(for cable control).
c) Overspeed shut-off including electronic speed switch and
rack solenoid.
d) Fuel and lube oil filters as well as dip sticks and
instrument Panels. all mounted on the inboard side of each
engine.
e) Electric starting motors, 30-32 volts (For Builder furnished
starting batteries see Section 62-4 BATTERIES).
f) Starting switch.
g) Digital electric self powered tachometers mounted on the
instrument panel.
h) Front crankshaft mounted stub shaft (The Builder shall
furnish and install the power take off mechanism and any
other equipment required to engage and drive the fire/
bilge/ ballast pumps. For controls to engage these pumps
see Section 47-0 PUMPS).

41-0 MAIN ENGINES (OWNER FURNISHED) Continued
• i) Torsional vibration analysis of the shafting system.
This will be calculated by Caterpillar in cooperation
with the Builder.
No sea water pump or heat exchanger is supplied, as keel
coolers are to be furnished and installed by the Builder.
The Builder shall also furnish and install expansion
tanks for the cooling system, with low water alarm, vents
and overflows.
Main engines shall be solidly mounted. (Also see Section
43-0 PROPELLER SHAFTS).
Main engine clutch and throttle controls and instruments
shall be furnished and installed in the pilot house by the
Builder. Clutch and throttle controls shall be Morse
Model MD -24. The same clutch and throttle controls shall
also be furnished and installed by the Builder at the out-
side control station on the bridge (see also Section 24-0
PILOT HOUSE). Provision shall be made to start and stop

41-1 BOW THRUSTER
The bow thruster shall be a water jet system driven
by a diesel engine. The thruster unit shall be a
hydraulic driven Omnithruster Model PV575-1 Horizontal
with a maximum input of 175 H.P. and a rated maximum
thrust of 3000 lbs. Nozzle inside diameter is 10.5".
The amount of thrust delivered by the thruster shall be
regulated by the engine throttle control, so that the
higher the RPM on the engine, the greater the thrust and
vice -versa. Thrust control to port or starboard is
actuated by pneumatic cylinders.
The engine shall be a GMC 6-71 rated at 257 SHP
@ 2300 RPM located off center in the engine room. Engine
to have standard alternator. No sea water pump or heat
exchanger is required as a keel cooler is to be installed.
Expansion tank with vents and overflow shall be furnished
and installed, also located off center of engine room.
Automatic shutdown in case of low oil pressure, high water
temperature or low water level in expansion tank shall be
provided.
The engine shall drive a hydraulic pump and in turn a
hydraulic motor shall drive the thruster impeller. This
pump and motor shall be supplied by the thruster manu-
facturer.
The bow thruster engine shall be provided with the
following gages.

The engine shall be started and stopped in the pilot
house. Engine shall have a 12 volt starter with a 24 amp.
12 volt alternator. (See Section 62-4 BATTERIES).
Thruster controls shall be as follows:

Bridge Deck- Omnithruster Model 200C (watertight)
The control levers must not be spring loaded. The
operator should be able to remove his hand from the lever
and the thruster will continue to operate at that setting
until it is once again moved manually to another setting.
The bow thruster nozzles shall be located as low and
as far forward as possible. Final installation shall be
subject to the approval of the Owner and his Representatives.
41-5 LIFTING GEAR
Padeyes for lifting of heavy equipment shall be
installed in the engine room as directed.

43-0 PROPELLER SHAFTS & BEARINGS
A torsional vibration analysis of the shafting with engines
• and propellers is to be made for operating conditions by the
engine manufacturer to make sure that there are not objection-
able torsional vibrations in the operating range.
Shafting shall be Armco "Aquamet 22"' stainless steel
3-3/4" diameter. Shafting shall be completely interchange-
able. Shafting shall be in one section and arranged to with-
draw aft. Shafting to be same length and machined identical
to the shafts on the present ferry "MUNNATAWKET" so that shafts
on both ferries are interchangeable. Shaft length is shown
approximately on the Contract Plan. A detail drawing of the
existing shafting on "MUNNATAWKET" is available to the Builder.
If this cannot be done the Builder should notify the Owner or
Representative prior to proceeding with any shafting work.
A flexible disc shall be provided between the propeller
shaft and the engine coupling.
Water lubricated bearings shall be B.F.Goodrich rubber type
with bronze shell and flange. Inboard bearings where required
shall be of the babbit type with oil reservoir in base, self -
aligning Dodge "Sleeve Oil" or equal.
Water service shall be provided to the stern tube bearing.
Stuffing box shall be of flanged type designed with gland for
square flax packing.
• 44-0 PROPELLERS
To be right and left hand as noted in Sect. 41-0. They
shall be 3 -blade. Material shall be nickle aluminum bronze
A.B.S. Type.4. Size to be approximately 44" diameter x 33"
pitch. Fairwater nuts with locking pins to be fitted.
Propellers shall be statically balanced.
45-0 LUBRICATING OIL
There shall be a separate steel lubricating oil tank of
aboutl20 gallons capacity. The tank shall have fill,
protected gage or sounding valves and draw off fitting.
47-0 PUMPS
Fresh Water Pressure Pump
Shall be Peabody Barnes Pump No. 10600, 2 stage, with
No. 70685 ejector, with cut in pressure at 40 p.s.i. and
cut-out pressure at 60 p.s.i., and 1 H.P., 115 volt A.C.
motor. A separate CP80-FS 80 gallon diaphragm type tank
shall be fitted with pressure gage and relief valve. This
pressure set pump and tank must be located in the engine
room.

47-0 PUMPS (Continued)
Salt Water Pressure Pump
The salt water pressure pump and tank shall -be same as
fresh water pump and tank. This pressure set pump and
tank must be located in the engine room.
Bilge, Ballast & Fire Pumps
Two (2) Gorman Rupp 82H3 -B self -priming 2" centrifugal
gray iron driven by PTO from each main engine and controlled
by an air operated clutch from the pilot house. At 1200 RPM
on the main engines the pump is to operate at 3000 at 3400
RPM with a capacity of 160-190 GPM at 60 PSI at the dis-
charge. A sign shall be mounted to limit the main engines
to 1200 RPM when operating these pumps. A pressure gauge
is to be fitted at this point. Both shall have an over-
board discharge and valves to permit operation of either
pump with sprinklers isolated. These two pumps shall be
cross -connected. (For sprinkler system see SECTION 93-1,
FIRE -EXTINGUISHING SYSTEMS).
Bilge & Ballast Pump
One (1) Burk 15WA6 self -priming 12" centrifugal, driven
by a 1-1/2 HP electric motor, 208V, 3 phase. Capacity of
55 GPM at 3450 RPM at 35 PSI.
48-0 PIPING SYSTEMS
Unless otherwise specified, piping, valves, fittings,
etc. are to be in accordance with the table. Basket
strainers and strainer plates on suction sea chests are to
have net area of at least 2.5 times that of pipe. Sea
chests shall be steel weldments. All piping in unheated
spaces shall be insulated.
All fresh and salt water piping connected to pumps shall
comply with suction and discharge sizes- of pumps. Lines
shall not be restricted to a smaller diameter on the dis-
charge side of the pumps.
Hose and plastic piping shall be used to the greatest
extent possible as described in the table. Connections to
all operating equipment, including main engines and
generators, shall be flexible.

48-0 PIPING SYSTEMS (Continued)
Piping shall be carefully located and arranged so that it
is easily accessible for cleaning and maintenance. Piping
Is should not be located very low on bulkheads where mainten-
ance could be difficult, particularly in the restrooms.
Where hose is used for water and exhaust lines, connec-
tions shall be by double hose clamps or "Aeroquip" unions,
or equal.
Fire hose with nozzles, spanners, and racks together with
hose valves shall be installed as required by U.S.C.G.
48-1 PLUMBING SYSTEMS
Plumbing drains shall be 4" from toilets and 1-1/4" from
lavatories. All upper deck fixtures shall be tied into a
single 4" drain to the holding tank. 3/4" vents to the Sun
Deck shall be fitted from the fixtures and may be combined
insofar as possible.
The holding tank shall have a 2-1/2" suction with connect-
ing flange for shore discharge line above the main deck on
the port side. In addition on the port side there shall be
a 4" overboard discharge running to a check valve and a gate
valve just below the waterline. The tank shall be coated as
specified in Section 19. To be fitted with 2-1/2" vent which
must lead above all decks and into unobstructed air. Fitted
with a watertight bolted manhole. Capacity shall be 1000
gallons.
48-4 FRESH WATER TANK
Shall be galvanized steel, with fill, overflow, sounding
pipe or gage and manhole for cleaning and coating, all to
U.S.C.G. and U.S. Public Health. Capacity shall be 500 gallons.
48-5 ENGINE COOLING SYSTEM
The main engines, generators and bow thruster engines
shall have keel cooling. Fresh water pumps, expansion tanks
and thermostatic valves shall be furnished by engine builders.
Ends of coolers shall be sled ended and fitted to internal
collectors with necessary vents. To simplify maintenance
when docked the bottom of assembly shall be a smooth plate

the pilot house. To have 120 PSI cut in and 150 PSI
cut out. To be installed in engine room.

Horn (Air)
Kahlenburg Model D-2, Fig. 212 pushbutton control
with solenoid valve shall be installed. Frequency must
comply with U.S.C.G. regulations.
Compressed air shall also be provided for bow thruster
controls, sea chest b lowdowns, air clutches and windshield
wiper.
52-10 EXHAUSTS
The main propulsion, generator and bow thruster engine
shall have dry exhausts with layout as'developed by the
Builder.
Pipes shall be steel with welded flanges in the larger
sizes. Flexible sections shall be 316L stainless steel.
Exhausts shall have high loop above main deck to discharge
above water line either through transom or quarter. All
hull penetrations shall be stainless steel pipe with
stainless steel doubler on outside.
Lagging shall be Mansville Corporation "Cerafelt" or
equal covered with fiberglass brattice cloth. Covers for
flexible sections shall be readily removable.
Silencers shall be dry type, Riley-Beaird, steel,spark
arrestor type, or equal, of size as required.
55-0 FULL OIL SYSTEM
Deck fills, overflow goosenecks and screened vents shall
be provided for the fuel oil system. Fill pipes must be
minimum of 4" diameter. Material shall be in accordance
with Piping System Table. Sounding pipes shall also be
fitted. Shut-off shall be provided at all tanks with remote
extensions to deck if required by U.S.C.G. Returns from
engines to be manifolded to tanks. Materials to be U.S.C.G
approved insofar as applicable.
Calibrated dip sticks or sounding rods shall be furnished
by the Builder.

ELECTRICAL
60-0 GENERAL
The ship's service electrical system shall be 4 -wire, 120
208 volt, 3-phase, 60 cycle A.C. with Y windings. The
neutral on the 4 -wire system may be grounded if required by
U.S.C.G.
There shall be a 32 -volt system for main engine starting
and navigating lights.
There shall be two 12 -volt systems, one for generator
starting and one for bow thruster starting. The entire
system shall be ungrounded. Emergency lighting shall be by
battery hand lanterns as required by U.S.C.G.
The system shall meet minimum applicable requirements of
AIEE45, U.S.C.G. and A.B.S.
61-0 GENERATORS
Two (2) generators are to be installed, Detroit Diesel 2-71,
20 KW at 1200 RPM, 120-208 volts, 3 phase, 60 cycle, with Y
windings. Units are to be resiliently mounted and modified
as required including proper thermostats and expansion tank
with vents and overflows for keel cooling. Automatic shut
down in case of low oil pressure, high water temperature or
low water in expansion tank shall be provided.
Each generator shall include the following gages:

62-0 SWITCHBOARD
The switchboard shall be dead -front, dripproof and of
steel construction and shall be arranged to provide ready
access to all devices for replacement and service. Meters,
switches, rheostats and indicating lights shall be mounnted
on hinged panels unless rear access can be provided. All
cables shall enter the switchboard from the bottom or shall
be arranged to prevent moisture from entering the enclosure.

Phenolic nameplates, black with white lettering shall
be provided for all units.
On the front of the switchboard there shall be painted
a single one -line diagram between units to indicate cir-
cuit and switching sequences which are critical.
All circuit breakers shall be two pole unless other-
wise noted. The following components shall be included
in the switchboard in addition to distrubtion Circuit
Breakers.
1 - Voltmeter - 0-300 volts
1 - 3 position voltmeter selector switch
1 - Ground Detecting Light System
1 - Shore power indicating light
2 - Generator power indicating lights
1 - Set disconnect links for each generator
Distribution Circuit Breakers are to be 2 pole or 3
pole, as required. Circuit breakers may be 240 volt pro-
vided they meet U.S.C.G. and A.I.E.E. requirements.
Generator Circuit Breakers are 3 pole, 600 volt A.C.
manually operated with thermal overload trip and instant-
aneous magnetic trip, Westinghouse or equal.
All circuit breakers are to be rated for 500C ambient
temperature and have moisture fungus treatment.
A minimum of two (2) 2 -pole and one (1) 3 -pole spare
distribution circuit breakers shall be provided.
Lighting distribution panels shall be provided as
rea fired.
A rubber insulating mat shall be provided to cover the
operating space in front of the switchboard.
Non -conducting guard and grab rails shall be installed
as required.
Mechanical interlocks shall be provided to:
1. Prevent shore current and generators being on bus
at same time.
2. Either generator can be on the line.

62-1 POWER & LIGHTING DISTRIBUTION PANELS
0 Distribution panels shall be furnished as required.
All panels shall be of the dripproof breaker type and
shall be door -in -door, dripproof construction. Cables
should enter the enclosure in a manner to prevent water
being led into the case.
62-2 WIRING
All cable construction, armor and insulation shall
be in accordance with requirements of A.B.S. or U.S.C.G.
Cables shall be protected from mechanical damage and
shall be sized to prevent excessive voltage drops.
Cables in living spaces shall be concealed. Water-
tight bulkhead penetrations shall be with plastic stuffing
tubes.
62-4 BATTERIES
Main Engine Starting Battery
Shall be two (2) sets, each set consisting of four (4)
Surrette 8 -HHG -29 rated 317 ampere hours at 20 hour rate to
give 32 volts. Batteries shall be in plastic trays with
plastic covers.
Generator Starting Batteries
Shall be one battery for each generator. To be 12 volt
Surrette 12XH230M rated 230 ampere hours at 20 hour rate in
trays as specified above. Jumpers shall be furnished for
emergency starting from bow thruster starting battery.
Bow Thruster Starting Battery
Shall be same as the generator starting battery.
62-6 RECTIFIER
One (1) 40 AMP battery charger, LaMarche - Model A -22-40-
32V, input 120V. A. C., output 32V. D.C., shall be installed
and connected to the A.C. switchboard for charging either
battery bank. Charger shall be complete with all U.S.C.G.
required accessories and a D.C. cranking circuit disconnect.

62-7 SHORE POWER SYSTEM
The shipyard shall furnish and install on the vessel in
a location approved by Owner, one (1) 60 AMP, 120/240 volt,
• 4 -pole, 3 -wire W.T. Russell & Stoll JRSA-633FR Receptacle
with JPS-633FR plug. Unit to be connected to A.C. switch-
board. A shore power cable shall be furnished. Length to
be such that it will extend at least 20 ft. beyond the
transom. The shore end of the cable connection shall have
Hubbell plug 460P9 to fit a Hubbell receptacle 460R9W.
62-9 NAMEPLATES
All distribution panels, alarm panel and switchboard
shall have black phenolic nameplates with white letters
to clearly identify the circuit or unit of equipment and
should include the fuse size or circuit breaker rating
where applicable. All push -buttons, switches and
receptacles shall be clearly labelled either on the mount-
ing plate or with a suitable label plate adjacent.
All cables shall be identified with cable tags at each
end of the cable and an identifying list made and put
aboard the boat.
64-0 LIGHTING SYSTEM
Ship's lighting shall be 115 volt A.C. and navigation
lights and certain electronic systems 32 -volt D.C. Inso-
far as possible circuits shall be split so failure on one
panel or one set of breakers will not extinguish all lights
in a specific section. Navigation lights (including bow
light when required) shall be installed in accordance with
U.S..G. regulations.
The ship shall be adequately lighted throughout with
marine fixtures of a style particularly designed for loca-
tion and service required.
All fixtures, boxes, switches and receptacles, etc.,
shall be constructed to meet the requirements set forth in
the current issue of the A.I.E.F.. No. 45 and shall be
approved by U.S.C.G.
All fixtures, boxes, switches and receptacles, etc
(unless otherwise noted) shall be constructed of cast
bronze and/or brass.
Lighting units shall be installed, number, size and
arrangements as necessary, to secure efficient illumination
throughout the ship. All receptacles shall be duplex
grounding type and all W.T. receptacles shall be complete
with plugs.

66-0 SEARCHLIGHT
• Shall be Carlisle -Finch Model BTP, 750 watts, 120V. A.C.
lever control, high type base (Fig. 5). To be mounted on
top of pilot house. Finish to be enamel.
Floodlights
Three (3) 500 watt adjustable floodlights shall be
installed on the after railing of the Sun Deck.
67-0 ELECTRONIC AND SPECIAL ELECTRICAL EQUIPMENT
The following shall be furnished and installed:
Radar
A Furuno Model FR240 MK.III radar with ranges of 1/2,
1-1/2, 3, 6, 12 and 24 nautical miles and variable range
finder, shall be supplied and installed. To have 32 volt
D.C. supply. A rectifier shall be supplied to furnish
current from the 115 volt A.C. system.
Depth Sounder
A Datamarine Model 2480 Sandpiper DL, 12V. D.C. Digital
Depth Sounder shall be furnished and installed. The
indicator shall be complete with depth alarm and shall be
mounted in wheelhouse in a location approved by Owner. To
operate from 32 -volt system.
Radio Telephone
A feeder from the 12 -volt engine room panel shall supply
the power supply for a Regency MT5500 radiophone located in
Pilot House. To operate from 32 volt system.
Converter
One (1) Newmar Converter Model 48-12-121 to serve the
Depth Sounder and the Radio Telephone (32 volts D.C. in,
12 volts D.C. out).
Public Address System
Five (5) speaker stations are to be installed as
directed. These are to be horn type, weather proof, ATLAS
SOUND AP 15T or equal. To be Pilot House controlled. Each
speaker must be capable of being isolated from all the
Ethers. Speakers to be located as follow:

:one in pilot house.
Burglar Alarm System
An Aqualarm, Inc. burglar alarm system shall be in-
stalled at access doors to the engine room, passenger
cabin, purser's office and pilot house. To operate on
12V. D.C.
INTERCOM SYSTEM
A standard 8 station sound powered telephone system,
Hose -McCann, shall be installed as follows:
Pilot House - Model SW, bulkhead mounted
Engine Room - Model SER with 6" bell and
Model RBWT rotating red beacon
Purser's Office - Model SW, bulkhead mounted, or
Model SD desk mounted,'depending
on Owner's choice.
After Starboard - Model SWT, outside watertight,
or Port Corner, mounted on bulwark.

GENERAL CONDITIONS
This supplement to Specifications No. 2476 is for
an alternate vessel having the addition of 30 feet to the
overall length.
Specifications No. 2476 and Dwg. No. 2476-1,Alt. A
for the 132 foot vessel shall apply to the 162 foot vessel
in their entirety, except for the following exceptions:
It is intended that the 30 foot extension would be
inserted between the forward end of the engine room and
the aft end of the ballast tanks and access tunnel to the
engine room. This 30 foot section would be a watertight
compartment for wing ballast tanks and would also result
in a 30 foot extension of the access tunnel to the engine
room. A watertight door is required in the forward bulk-
head of this new compartment for access through the tunnel.
The aft ballast tank/steering gear compartment, fuel oil
tanks and engine room remain in the same relative locations
and with the same lengths as on the 132 foot vessel, in
accordance with the attached sketch "Arrangement of
Compartments".

the strength ot the main deck must be calculated for
higher tire loads and impact.
26-0 ANCHOR & ANCHOR HANDLING
Anchors shall be two (2) Danforth, one 190 lbs, and
one 90 lbs.
0-9 WEIGHT & TRIM
This section in the original specifications shall
apply, but particular attention must be paid to various
loading conditions and trim since this can be consitter
ably affected by the additional 30 feet in length.
