HomeMy WebLinkAboutLL-2000 #05LOCAL LAW NO. 5 - 2000 A Local Law in Relation to Establishing a Transportation Commission of the Code of the Town of Southold. Be it enacted by the Town Board of the Town of Southold as follows: CHAPTER , TRANSPORTATION ACCESS MANAGEMENT -11 TITLE. This chapter shall be known and may be cited as the "Transportation Access Management Law of Southold Town". &-2. PURPOSE. The Town Board finds that each year thousands of seasonal residents and tourists visit the North Fork of Long Island seeking to enjoy coastal waters, beaches, and the pastoral landscape of agricultural lands, gardening centers, wineries and horse farms. Tourism provides a stimulus to local business economy which increases the quality of life for local residents. Over the past five years, however, appreciation as well as concern for local resources and rural ambiance has grown among the majority of citizens. People are anxious to see their rural way of life preserved, but at the same time allow for growth in the local economy. As locally-targeted tourism becomes a more important industry, there is substantially increased need for more efficient, convenient, cost-effective forms of transportation. With a 3-fold increase in the population base during six months of the year, North Fork roadways are moving toward the saturation point. Therefore, it is the purpose and policy of this chapter to establish a Transportation Commission to assist Southold Town and its residents in finding solutions to increase transportation efficiency and create attractive alternatives to individual automobile travel while preserving the scenic and historic attributes of the Town's State, County and Local roadways. ~x 31 DEFINITIONS. As used in this chapter, the following terms shall have the meanings indicated: COMMISSION -- The Transportation Commission established pursuant to this chapter. HISTORIC SIGNIFICANCE -- The quality of a place, site, building, district or structure based upon its identification with historic persons or events in the Town of Southold. SCENIC SIGNIFICANCE - The quality of viewsheds from State, County and Town roads based upon its identification with unique attributes in the Town of Southold. RURAL SIGNIFICANCE - The quality of environment based upon its identification with open space, farming, fishing and quaint hamlets. & -4. TRANSPORTATION COMMISSION. The purpose of the Southold Transportation Commission is to develop and implement a Transportation Access Management Plan which addresses the use and protection of local resources for recreational and economic benefit through an innovative road-rail-trail-ferry network while maintaining the scenic, historic, and rural characteristics of the Town as well as guide their subsequent implementation. The Commission shall consist of nine (9) members to be appointed by the Town Board, to serve without compensation. The term of office of each member appointed to said Commission shall be two (2) years. If a vacancy occurs other than by expiration of a term, it shall be filled by the Town Board by appointment for the unexpired term. In developing and implementing a Transportation Management Strategy, the Commission will work with the Planning, Highway and Police Departments, but shall report to the Town Board. The Commission shall consist of representatives of the Planning, Highway and Police Departments; civic groups, residents and different sectors of the business community. & -5. DUTIES OF COMMISSION. The Commission shall advise the Town Board with respect to the following: A. Create a framework to coordinate transportation plans and programs for the Town among all related local and regional transportation agencies, groups, service providers and the private sector. B. Develop innovative transportation strategies through improvements in transit options; linkages between transportation modes; travel demand management techniques; enforcement mechanisms; public and private transit operations; and, vehicle occupancy. Improve transportation service and efficiency within the Town through improvements in traffic flow; speed limits; traffic safety; pedestrian and bicycle safety; parking design and location; and, roadway lighting, signage and traffic signals. Maintain and improve the rural quality of life through reductions in impacts on water quality and noise; vehicular trip generation; and, excessive lighting, signage and roadside litter while keeping NYS Route 25 a "scenic route" and County Road 48 a "through-route" within the Town. Develop a fiscally feasible, acceptable integrated capacity/mobility/safety plan for the Town as well as formal evaluation monitoring and update procedures to be presented to the Town Board for incorporation in the Town Master Plan and funding by related agencies. Promote use of alternative transportation solutions through educational activities and solicit public input on an ongoing basis in discharging the above duties. Coordinate these alternative transportation solutions with other East End towns and villages through the East End Transportation Council to effect a unified regional transportation strategy. H. Perform such other duties and functions as may, from time to time, be directed by the Town Board. &-6. WHEN EFFECTIVE. This chapter shall take effect immediately. Is there anyone that would hke to speak pro or con? We have with us, Neb, who is Chairman of~the Transportation Committee. I am sure you want to say a few words. We also have Valerie Scopaz, who is .our Planner, Senior Planner, and they will share some of what we are doing here. NEB BRASHICH: I think that most of you know that the town is in the throes of working on a transportation study in cooperation with the Department of Transpo~ation, and it became extremely clear to us in the course of doing this over doing this over the last year:and ahalf that we had to have some permanence, addressing.and facing on the Department of Transportation on a number of issues, to wit, we came to the conclusion that it was important that we set a permanent Transportation Commission in place under the Town Code. This will be a permanent sitting body, which would be incorPorated With;; sittinr, representatives from the 'Police;-Ptanning and Highway Departments, and it ~ill be a specific c~a,-gc ~within the document that was cited, rather than what. the Committee has been wanting to follow in the terms of the Board, and that ~ortation, .and place. This will be a vehicle which will enable us to and building on census that is requested from the of the east end, and frankly speaking:this will make it more attractive for volunteers · their time to the TransPortation Commission. Anyone else like to address the Town Board? ALICE HUSSIE: Alice Hussie, Southold. I didn't intend to say anything about this, because I did not find it in the newspaper last Thursday. Although I saw that we were going to have this hearing, and I looked for the public notice, I couldn't find it. I think that is something that is going to have to be ahead of time, inevitably, I presume. It was not in last week's paper. SL~ERVISOR COCHRAN: We can look at the paper. ALICE HUSSIE: That is not my problem. SUPERVISOR COCHRAN: What is your problem? ALICE HUSSIE: I just heard Mr. Brashich say that they were going to develop a plan, and present it to the Board, which is in direct conflict with what you just told me, Bill. I asked what the Commission was going to do? I said, who is going ride in front? You said it was going to be sort of a cooperative thing, but that is not what I just heard. COUNCILMAN MOORE:~ One of theihlngs, you may remember~ Alice, was back in December when we saw the first draft of that law. It was January. In any event we changed some language in there, they shall have the following duties, they are going to advise on the series in all points on that Local Law. On various topics they are going to advise the Town Board in respect to. The concern that we had was that we weren't sitting there, and handing off Town Board responsibilities to an empowered autonomous commission that we had no control :over, and I think the language, it was just a matter of semantics, and the Board felt comfortable with the suggestion that you had made, and we threw in a Catchall at the bottom, and any other item in regard to transportation the Town Board assign to that committee. They have a pretty good nmning charge of what they are doing. ALICE HUSSIE: Is the Town Board going to give them some direction. I mean, you are going to hand them a list of things that you wanted to look into, but are you going to give them some way that you. some hint as how you expect, or would like to see this come out? COUNCILMAN MOORE: I think we akeady had it. The idea that they are going to work within the context of the Transportation Council for the five east end towns, we just address regional transportation issues of importance to the five east end towns. We had things that, you know, you saw on the Board, you get a request for a stop sign, or a speed limit change, or a traffic light, or something. ALICE HUSSIE: I was Chairman of that committee. I put up one light. COUNCILMAN MOORE: No, that is streetlights. I have streetlights now, and I put up no lights. No, when we had requests in the community to put up a stop light at an intersection we used to send it right off to the State. Now we send it to our Transportation Committee, and say, hey, is this going to fit within the overall plan for community travel as we see it? Usually it we put a policy in place before I was on the Board, you were probably on the Board at the time, Route 48 is a thoroughfare through town, not meant to be chopped up with a bunch traffic lights, and a lot of curb cuts, and retail stuff. So, those are statements, and the community Master Plan is the driving force. SUPERVISOR COCHRAN: And this now involves the Highway Department, and the Police Department, so we have their input in relation to any of these requests that we get.
