The Board again considered the application of Richard Guy Miller,
presented on August 5th, and held fo~ investigation.
On motion of Mr. Bird, seconded by Mr. Gordon, it was
RESOLVED that Richard Guy Miller, c/o Floyd F. King, Orient, New
York, be denied permission to place an anchor and bo~y mooring in
Mattituck Creek. Mr. Miller is not a resident of Southold Town,
and the boat, a 31 ft. Seafarer sailboat, is too large to be moored
in the area requested.
Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Gordon, Mr. Bird.
The Board again considered the application of Hallock N. Young,
presented on August 5th, and held for investigation.
On motion of Mr. Gordon, seconded by Mr. Horton, it was
RESOLVED that Hallock N. Young, A~70 Reeves Park, Riverhead, New
York, be denied permission to place a mushroom moorzng in Jockey
Creek, Southo~d. Mr. Young is not a resident of Southold Town,
and he has had his s&ilboat moored in Jockey Creek without permission~
and the Board has received several complaints as to its hazardous
location, and neglect.
Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Gordon, Mr. Bird.

On motion of Mr. Robertson, seconded by Mr. Gordon, it was
RESOLVED that Dr. Maxwell Y. Simkin, 4 Hen Hawk Road, Great Neck,
New Yorkf be granted permission to construct a bulkhead 155 ft. in
length on his own property at Gull Pond, Off Snag Harbor~Road, and
attach a platform 6 ft. by 8 ft., ramp 4 ft. by 6 ft., floating dock
6 ft. ~y 45 ~t., and three mooring piles thereto, _all in accordance
with the detailed specifications as presented in~ the originating
application. Fee: $~7~0.
Vote of the Board: Ayes: Mr. Goldsmith, Mr.. Robertson, Mr. Horton,
Mr. Gordon, Mr. Bird.
On motion of Mr. Robertson, seconded by Mr. Horton, it was
RESOLVED that the application of Frank, Bisk, 2940 Mott Avenue, Far
Rockaway, New York, for permission to build a lamp and float at his
property ~ Gull Pond Road on the Fordham Canal, Greenport, New
York is outside the jurisdiction of the Town Trustees, as it is
located on a man-made canal, and not considered Town waters, 'and
therefore the Board waives objection to the construction of this
ramp and float.
Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Gordon, Mr. Bird.
On motion of Mr. Bird, seconded by Mr. Robertson, it~was
RESOLVED that Thomas J. Fitzmaurice, 345 ~Sn~g Harbor Road, Greenport,
New York be granted permission to place a mushroom mooring in Gull
Pond, off the end of Gull Pond Road, Greenport, all in accordance
with the detailed specifications as presented in the originating
application. Fee: $5.00.
Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Gordon. Mr. ~ird.
The Board received-two applications from Robert W. Foster, 315 South
Street, Greenport, for onshore~offshore moorings at3the foot of
Pine Neck Road, Southold, in Town Creek, and in Richmond Creek, off
Indian Neck Lane, Peconic. The Board will investigate the locations.
Moved by Mr. Bird, seconded by Mr. Horton, it was
RESOLVED that the August 5, 1974 minutes of the Board of Southold
Town Trustees be approved as .submitted.
Vote of the Board: Ayes: Mr. Goldsmith, Mr. Rober%son, Mr. Horton,
Mr. Gordon, Mr. Bird.
On motion of Mr. Robertson, seconded by Mr. Hor%on,
BE IT~ RESOLVED that this- Board approves,~ a~. of August ~2, 1974,
the retention,a~ special counsel to th~s Board3 of Gerard A~ Dupuis,
~sq. and his firm of Miller & Summit, Es~s~, 90 Br~ad $~reet~_~e~
York, New York 10005, for the purpose of filin~ a Brief, as amicus
curia on behalf of this Board, with the New York Court of Appeals
in a matter entitled "The State of ~ew York vs. James H. ~ambo, Inc."
and that said Brief shall set forth an argument opposing the position
taken in the matter by the State of New York; and

BE IT FURTHER RESOLVED, that the said special counsel are hereby
authorized, as of August 12, 1974, to..proceed by appr~opriate
motion to the Court of Appeals seeking leave for this Board to
as amicus curia in the abo~e-stated action;
BE IT. , that the Chairman ~oard is hereby
authorized e, on behalf of this~rd, any and all
documents necessary ~.~ e opinion ~/s~id Specia~l counsel to
effectuate and properly ~cute~s Board's appearance, as
amicus curia, in the action stated before the Court of
Appeals.

received fro~he~Southwood Civic Association oppos ~O7 further
moorings~ the foot of Wood .End Way. It is crowded and boats are
i~terf~ring with the public beach. A further complaint was received
