Box 566 East Marion, NY 11939 Dear Mr. Strohmeyer: This communication follows the September 10, 2014 Southold Trustees pre-submission inspection with Commissioner, Walter Strohmeyer, of the Orient-East Marion Park District to remove vegetation: 1) It is likely that the entirety of vegetation removal activities the District proposes are within the 300' Tidal Wetlands jurisdiction.of the NYSDEC(DEC). To avoid regulatory "Ping-Pong" it would be advisable to secure a DEC permit first for the activities the District proposes and return to the Town Trustees, applying for an Administrative. Wetland Trustee Permit for the activities allowed by DEC. The District should consider requesting 10 year maintenance for both DEC and Town Trustee Permits to continue invasive plant removal activities and reduce the likelihood that they will re-sprout/re- seed. 2) Because the basis of your request involves maintaining vistas and views important to the community, you may wish to check with the Town Planning Department to see if there are any Town studies or planning references that can be used in the District's permit applications. 3) A cautionary: It may be unwise to apply to the DEC to remove any native vegetation such as Sumac as it may complicate or delay your application with that agency. The several small clumps of Sumac I saw do not appear to seriously impede views of the "Crab Shack" and they are typically fragile and short lived. 0 4) Because fall and winter are fast upon us, the District may wish to have a tree expert/arborist label, by species, each of the non-native plants to be removed, to facilitate inspection by DEC should they come out to inspect after leaf fall in the winter. 5) The proposed clearing at the park entrance was found to not need a Town Wetland Permit as it is beyond the Board's jurisdiction. The Inspection Visit by the Southold Town Trustees on Sept 10, 2014 A) Contrary to the Southold Town Map, none of the Old State Highway is a Private Road. A review of current official publications of Southold Town indicates the Old State Highway (replaced by the Causeway across the wetlands) is a private road for its full length. This error was corrected on September 8, 2014. In accordance with land records in the Tax Assessor's Office, the eastern portion is still a public highway. It was never abandoned by the State. It ends at 18603 Main Road(the house on the beach)which now owns the middle portion of the Old State Highway. The western portion leading from 18603 Main Road to the Causeway is now part of the Orient East Marion Park District. It is not a Private Road. I understand from Carol in the Town Clerk Office s that this error will be corrected shortly and all appropriate town, etc agencies will be so advised. B)The Causeway is a Special Road The North Fork Trail has been desigated a Scenic ByWay of the State of New York. The Causeway (from East Marion to Orient)which is part of it, is certainly the gem of its eastern end. Though the section that fronts on what was formerly called"Crook's Island" is now structurally in far better shape than in the past, vegetation has been allowed to grow amidst its reinforcing rocks and to the east, sections of private land bordering the Bay have also been allowed to morph into dense wooded areas especially across from the old Fisher's House (English Tudor with pseudo thatched roof) and around the "Old Crab Shack" and mostly solid woods in the upland area north of what is now called Tuthill's Creek all the way east to Danny Latham's Farm Stand, also on Tuthill land. So what was once a beautiful uninterrupted view from one end of the Causeway to the other has been allowed to degenerate into an ugly mess and will continue to degenerate further unless something is done now! Further all this unsavory growth is inhibiting the growth of Cedar trees. indigenous to the area. The Town Trustees could be very helpful if they use their considerable influence to reverse this trend and help return the Causeway to its original pristine beauty. Section Al & B I The Causeway, Marsh and the Creek Going east along the Bay side of the Causeway, one notices many small trees and bushes that in time will become large trees. Moving along one comes upon a group of Sumac trees (10 in no.) which in time can become quite large also.Next are another group of trees/bushes (about 5 in no.)These are followed by a Crab or Thorn Apple tree which in time will become not only tall but extremely wide: four somewhat dead trees: two more Crab or Thorn Apple trees: a Cedar tree overwhelmed by a vine (probably Poison Ivy) crawling up a cable to a utility pole. These non-native trees tend to crowd out all Cedar trees. Going west on the north side, we start off with another Thorn Apple tree wrapped around a utility pole: behind it a huge Norway Maple Tree (two in fact): a number of dead trees and a group of four or more Thorn Apple trees. Section A 2 & B 2 The Eastern Part of the Old State Highway( not a private driveway) leading to 18603 Main Road Starting on the western side heading north, one comes on a tangle of Norway Maples, Crab Apple trees, Poison Ivy and a lot of dead trees.This area is apparently heavily used as a dumping ground by a number of landscapers obviously saving a lot of time and money by dumping brush and trees here rather than in Cutchogue.The area is well hidden from the Causeway and the only way to stop its use as a dumping ground in the future will be to keep that whole corner clear of all growth at least 100' deep up this Road. Other than a lot of Thorn Apple trees, many small Norway Maple and dead trees to the north, the area is a haven for Poison Ivy, some of which has seemed to morph into small trees, all of which prevent the growth of Cedar trees. Starting on the east side and going north, one comes on all sorts of trees , mostlyThorn Apple and Norway Maples all growing right in the middle of the road, now a north spur of the State Highway.. Section A 3 &B 3 The portion of the Old Concrete Sea Wall (OCSW)that fronts the Beach Parking Lot Immediately to the west of the entrance on the inside of the OCSW is a Thorn Apple tree overburdened with an Asian Bitter Sweet Vine which in time will overwhelm the nearby utility pole Elsewhere between the parking lot is another garden of Poison Ivy intersperced with at least fourteen trees mostly Black Locust and then the fence with the Boat Ramp site is so overburdened with branches that they interfere with the full use of the parking lot. Outside the wall is grass that can be trimmed. To the east of the entrance on the inside again we have a garden of Poison livy, etc but on the wall itself and in front of the wall,we have a number of Black Locust, dead trees and a mass of Asian Bitter Sweet vines that are overwhelming and undermining the wall itself and drowning everything in their way. Section A 4 & B 4 Along the Creek Uplands from the Crab Shack to Properties East of the OEMPD Starting just west of the Crab Shack we come on huge Black Locust trees,Norway Maples and probably Crab Apple trees which overshadow the Old Crab'Shack(an Icon), and almost completely obscure its presence from the road. These are followed by more trees, same variety, along the highway and further down to the Creek also as we go further east, it is so loaded with invasive species, not there years ago,that a Gazebo down at the edge of Tuthill's Creek cannot be seen from anywhere on the Main Road west of the Crab Shack SEP 1 1�.:n SCS1Jr.0 0 0 John Bredemeyer, President h�o\ps�FFot,rcoG� Town Hall Annex 54375 Route 25 Michael J. I President j' SEP - 5 201 Dear Mr. ,����lyl r �?, —5-77 The Orient East Marion Park District respectfully requests a pre-submission inspection and determination of the need for a Town Wetland Administrative Permit to remove non-native vegetation, prune and reshape trees damaged in careless power-line trimming and to remove vegetation at the park entrance to improve the appearance and more clearly deliniate the dimensions of the entrance for those entering and leaving the Parking Lot or driving on State Route 25. The proposed activities are further detailed on an attached Exhibit detailing A.1,2,3,&4 and B 1,2,3&4 A 1 and B 1 refer primarily to the Causeway as it bisects the marsh A2 and B2 refer to the Old State Road to the Beach House or 18603 Main Road, East Marion A3 and B3 refer to the Sea Wall and the Beach Parking Lot A4 and B4 refer to the Creek Uplands to the South of the Main Road west of the Crab Shack v' Other than red surveying tape will be placed at the foot of all trees or bushes for which permission to cut down is requested and it will be placed in the branches of those for which permission to trim only is sought. We further respestfully request if the project requires an Administrative Permit, that the $50 fee associated with the pre-submission inspection be applied to the Permit Fee.
