Bergen Bay Constable Other Form filled out in the field by 9T, Mailed/Faxed to: Date: PETER BACCILE HAY HARBOR,FISHERS ISLAND NARRATIVE STATEMENT & SUPPLEMENTAL INFORMATION JULY 2014 GENERAL Peter Baccile owns parcel 1000-09-03-11 on Equestrian Avenue located along the south shore of Hay Harbor on Fishers Island. The site is generally moderately sloped, sandy gravel earthen materials, vegetated with grass, shrubs, ground cover and trees; the bank is overgrown with vines (bittersweet and the like). The frontage of the property is approximately 250 feet along Hay Harbor at the southerly end abutted by the Bonsal family to the west and the Crisps to the east. The waterfront consists of a sandy beach at the base of the steeply sloped coastal bluff and otherwise a vegetated eroding coastal escarpment. The beach host a fringe marsh of spartina alterniflora A 100 foot section of the bluff fronting on Hay Harbor has sloughed and several small areas have sloughed as well as a result of hurricane surges and wind induced waves destabilizing the bluff soils (sand) in the past couple of years. The Baccile home is at the top of the bluff. Mr. Baccile must restore the badly eroded toe of the bluff fronting on Hay Harbor from the east point over to the Bonsal property. The work will consist of placement of stone filled "Gabion" baskets and soil fill behind. This work is being kept landward of the apparent high water line (spring high water level) and the tidal wetlands vegetation. This supplemental narrative has been prepared in accordance with the requirements of Town of Southold, Ordinance No. 6, 2004, related to docks and shorefront improvements. In addition, various coastal policies under the New York State Coastal Management Act are addressed herein for review by the New York State Department of State. DESCRIPTION OF WORK As mentioned in the introductory paragraph, this project is to restore the badly eroded toe of a vegetated coastal bluff in accordance with existing guidelines set forth in the Town of Southold ordinance No. 6, 2004. It is envisioned that this toe stabilization will be built from west to east utilizing the following general sequence and methodology. ➢ This project will be built from land using small machinery and manual workforce. ➢ Stone fill products will be delivered to the site in bulk and transported down the path toward the dock facility using small machines and subsequently out onto the high beach between the toe of the bluff and the tidal wetlands vegetation. ➢ Gabion baskets will be assembled and in place filled with stone. At low tide, the beach above the apparent high water line will be excavated down to 1 foot above MLW and crushed stone on a geo-tech fabric will be placed in the trench as the gabion foundation. 1 i Materials will be placed by hand, shovel, wheel barrow and small backhoe machinery in the designated areas. Stone can be delivered down the bank and into the Gabions via chutes in some area. ➢ The fringe of spartina alterniflora north of the line of gabions will be marked off for preservation and be left untouched by the workers efforts. A silt fence will be placed between the tidal wetlands and the work area. ➢ Access to the beach will be from the path running north and west from the dock facility. ➢ The work is being prosecuted mostly with manual labor. The work and access area will be laid out to avoid existing vegetation on the shore and the roots of existing plants on the eroding bluff will also be preserved to the practical extent and avoided during the stone placement process. REQUIREMENTS OF SECTION 97-25 OF THE WETLANDS LAW 6,2004 The permittee acknowledges that the validity of this permit is subject to the approval of other governmental or municipal authorities. The permittee does, by the acceptance of this permit, assume all responsibility for operations undertaken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the permittee also agrees to indemnify and save harmless the Town of Southold and its officers. The permittee gives consent to the Town and its officers, employees and agents to enter upon the premises where such operations are being conducted to make such inspections to determine whether said operations are being conducted in conformity with the permit. The permittee will notify the Trustees in writing one week prior to initiation of any and all operations. The permittee will notify the Trustees in writing upon completion of operations such that the site can be inspected for issuance for a certificate of compliance. In response to Sub-section 2a and the General Rules for Standards of Residential and Commercial Docks, the Baccile' s have a dock and the following additional information is offered. 1. Permits for the work are being applied for through the Town, NYS DEC and a coastal zone consistency determination by the NYS DOS. This project is above (landward of)the USACOE spring high water jurisdiction line. 2. This project is to restore and help stabilize the badly eroded toe of a coastal bluff. No bulkhead structures will be built in this project. 3. Upon receipt of the permit for this project, appropriate permit numbers will be affixed to a sign on the beach for identification from the water. 2 4. There is em to walk under the existing pier on thast side of the point at low tide. Foot traffic in this area is rare, if at all. There is no pier construction or alteration in this project. NEW YORK STATE COASTAL MANAGEMENT PROGRAM These application documents already submitted to the Federal and State agencies including a copy of the Federal Consistency Assessment Form utilized for the New York State Coastal Management Program under the jurisdiction of the New York State Department of State. The following policies have been identified as pertinent to this application and the reason for consistency associated with this project is outlined in each respective case. Policy 2—Water Dependent Uses This project is to restore the stability of a coastal bluff and preserve shoreline vegetation on the bluff as well as preserving fringe growth of tidal wetland vegetation on the beach. This work is required because of wave induced scour undermining and destabilization of the toe of the bluff during Hurricane Sandy. Policv 5 —Use of Existing Developed Shorefront This project will restore a natural living shorefront at the site. The project scope of work is not really relevant to "Developed Shorefront" because vegetation can fro through the Gabions. Policv 7 — Significant Fish & Wildlife Habitat Protection of significant fish and wildlife habitat has been considered in the development of this project scope of work. The stone filled gabions will be placed at the toe of the bluff over un-vegetated shoreline fringe of exposed sand and gravel and will not jeopardize the integrity of existing two spartina fringe growth areas. Thus there should be an environmental benefit to the project because of the protection of the existing bluff vegetation including trees and shoreline vegetation without adverse affect on the spartina. Police 8 —Protection & Preservation of Habitat Protection and preservation of habitat has also been considered in this project and the stone fill is being kept to its minimal configuration consistent with standards and restrictions set forth in the Wetlands Law,No. 6, 2004 set forth by the Town of Southold and standards of the NYS DEC. This project will help to retain the existing balance of land, wetlands vegetation, trees, brush and other vegetation and habitat on the bluff. Policv 11 — Minimize Damage to Natural Resources The gabion retaining wall has been laid out in such a way so as to minimize damage to natural resources as identified in Policy 7 above. Gabions are porous and sand which sloughs down the hill into the gabions will continue to replenish beach sand, but the toe should stay stable. Police 14 — No Measurable Increase in Flooding This project does not adversely affect water flow and circulation in Hay Harbor or flooding potential of the area. Flood levels all around Fishers Island are dictated by coastal water levels in Long Island Sound and Block Island Sound and this gabion retaining wall will have no adverse influence on those tidal and flooding conditions. Policy 15—No Dredging—Dredging is not proposed or required in this project. Policv 19 — Impact on Public Access Public access will not be jeopardized or impeded as a result of this project. As a matter of fact, there is almost no public access usage of the public trust lands or waters at this site and the work being done exclusively on private property. The intertidal zone hosts only narrow fringes of tidal wetlands vegetation and the shallow sub-tidal waters do not present any opportunity or enticement for public access in the area. 3 Policy 20—Public Trust A Vatibility with Existing Adjoining Prope�'Cies and Land Uses- Public Trust compatibility with existing adjoining properties and land uses has also been considered in this project. Nearby properties have small docking facilities similar to this one and gabions at this site landward of the apparent high waterline will not interfere with existing facilities on immediately adjoining properties. Neither adjacent sites have the same need for shoreline protection and stabilization as the Baccile' s property since their properties are lower in height. Policy 21 —Water Dependent Recreation—This project is consistent with water-dependent recreational opportunities policies set forth in this section. None of the adjacent or nearby recreational boating facilities will be affected by the proposed bluff stabilization work. Policy 24—Scenic Resources. Impairment or Loss -This policy is designed to protect existing property and will not impair or cause loss of scenic resources. The work will barely be visible except from nearby, from the water in Hay Harbor. The reason gabions are being used is so that vegetation on the bank will grow into the gabions, taking on the same appearance as the bank and holding the gabions tight to the bluff,maintaining a living shoreline. Policy 25 — Enhance Overall Scenic Quality - The shoreline restoration will be consistent with the scenic quality of the area and prevent loss of scenic resources as described in Policy 24 above. Policy 44 — Preserve and Protect Tidal Wetlands — It is acknowledged that the fringe of tidal wetland vegetation along the Baccile shorefront below the bluff is a designated resource. The gabion placement location landward of the fringe growth utilizes the existing un-vegetated strip of the shoreline in order to avoid adverse wetlands impact. Placement of the stone fill using manual methods will also help to avoid adverse impacts. The placement of the Gabions may allow the wetlands vegetation to grow more extensively. SUMMARY Recent significant storms and hurricanes have caused significant damage to the coastal bluff at this site and it must be stabilized so the bluff vegetation can remain and re-establish to a reasonable extent. This project is designed to be a living shoreline to help stabilize the bank and protect the bluff characteristics. This project represents a restoration of a significant coastal feature and provides protection against erosion while maintaining existing tidal wetlands vegetation on the Baccile property on Fishers Island. A copy of the NYS DEC and Army Corps of Engineers applications are attached as substantiation for this project. This project is landward of the USACOE spring high water jurisdiction limit. The bluff is more than 30 feet high and is almost entirely homogeneously sand,based on the geotechnical analysis conducted late in 2013. The stable slope is dependent on enhancing the stability and scour protection as well as retainage characteristics of the toe. For that reason, gabions will be assembled to form a 10 foot high retaining wall around the entire face of the bluff.
