PEDESTRIAN EASEMENT
THIS INDENTURE, made as of this 8' day of August, 2014, between MARK
TWEEDIE, residing at 95 Carley Avenue, Huntington, NY 11743, Executor under the
Will of Donna Stephenson Tweedie, deceased, hereinafter the "Grantor", ADAM
IRVING and LYDIA N. WORTHINGTON, a/k/a LYDIA IRVING, his wife, both
residing at 75 Stephenson Road, Orient, New York 11957, hereinafter the "Irvings", and
FREDERIC C. SCOFIELD, Trustee of the Frederic C. Scofield Jr. Trust, residing at
11305 Spaulding Street, Omaha, Nebraska 68164, hereinafter the "Scofield Trust", the
said Irvings.and Scofield Trust hereinafter collectively referred to as the "Grantees".
WITNESSETH:
WHEREAS, the Grantor is the owner of a parcel of improved real property located
at 825 Stephenson Road, Orient, Town of Southold, County of Suffolk and State of New
York, identified on the Suffolk County Tax Map as District 1000, Section 017.00, Block
01.00, Lot 011.005, herein referred to as "Grantor's Property"; and
WHEREAS, the Irvings,are the owners of a parcel of improved real property
located at 75 Stephenson Road, Orient, Town of Southold, County of Suffolk and State of
New York, identified on the Suffolk County Tax Map as District 1000, Section 017.00,
Block 01.00, Lot 011.004, herein referred to as the "Irvings' Property"; and

WHEREAS, the Sdofield Trust is the owner of a parcel of improved real property
located at 19915 Main Road, Orient, Town of Southold, County of Suffolk and State of
New York, identified on the Suffolk County Tax Map as District 1000, Section 017.00,
Block 01 A0, Lot 013.000, herein referred to as the "Scofield Trust's Property", the said
Irvings' Property and the Scofield's Trust Property herein collectively referred as the
"Grantees' Property"; and
WHEREAS,.the Grantor wishes to convey to the Grantees a Pedestrian Easement,
in common with others, over a portion of the Grantor's Property as shown on the copy of
the annexed survey (herein "Survey") and identified as "Pedestrian Easement" on said
Survey which Pedestrian Easement abuts and runs from the northerly side of a private
road known as Stephenson Road in a northerly direction through the Grantor's Property to
the beach of the Long Island Sound,
NOW THEREFORE, the Grantor, in consideration of the sum of One ($1.00)
Dollar lawful money of the United States, and other good and valuable consideration,
paid by the Grantees, does hereby grant and convey unto the Grantees, their successors
and assigns, forever:
A Pedestrian Easement, in common with others, (herein "Easement") to use, pass
and re-pass on foot, bicycle or other non-motorized recreational vehicle over that portion
of the Grantor's Property, (herein referred to as the "Easement Area"), as more
particularly bounded and described in Schedule "A", annexed hereto and made a part
hereof and as shown on thep Survey, identified as Schedule "B", annexed hereto and
made a part hereof.

TO HAVE AND TO HOLD, the rights and easements herein granted unto the
Grantees, their successors and assigns, forever.
The Grantor covenants as follows:
FIRST: As a covenant to run with the land, the Grantor shall not plant or erect,
without the written consent of the Grantees, their successors and assigns, over any portion
of said Easement Area, any trees, structures, or the like, which will, in any way, obstruct
said Easement Area;
SECOND: That said Grantor is seized of the said premises in fee simple, and has
good right to convey the same;
THIRD: That said premises are free and clear of encumbrances, except recorded
declarations, covenants, restrictions, easements and agreements;
FOURTH: That the Grantor will execute or procure any further necessary
assurances of the title to said rights and easements; and
FIFTH: That said Grantor will forever warrant the title to said rights and
easements.
