Section 4. EXCLUSIONS is hereby amended as follows:
This Local Law shall not apply to:
1) any person or entity who has, prior to the effective date of this
Local Law, obtained all permits required for construction of a building
on any property located in the Route 48 corridor including later
applications to repair or alter, but not enlarge, any such building other-
wise prohibited during the period.of this temporary moratorium; and
2) parcel(s) of land currently improved with a building or buildings so
long as the application is not: a) seeking, in whole or part, a change
in the use of the land, premises or buildings; and b) and so long as
the application does not require any applications to, or approvals,
special exceptions, variances from, the Zoning Board of Appeals of the
Town of Southold.

EXCLUSIONS OF THE LOCAL LAW ADOPTED ON SEPTEMBER 1,1998,
ENTITLED "TEMPORARY MORATORIUM ON THE ISSUANCE OF APPROVALS
AND/OR PERMITS ON BUSINESS ZONED PROPERTY ALONG THE COUNTY
ROUTE 48 CORRIDOR IN THE TOWN OF SOUTHOLD".

SUPERVISOR COCHRAN: We will go to the next Local Law, and I believe
Louisa has that to read.
JUSTICE EVANS: "Public Notice is hereby given that there has been
presented to the Town Board of the Town of Southold, Suffolk County, New
York, on the 15th .day of September, 1998, a Local Law entitled, "A
Local Law in Relation to Amending Section 4. Exclusions of the Local Law
adopted on September 1, 1998 entitled "Temporary Moratorium on the
Issuance of Approvals and/or Permits on Business Zoned Property along the
County Route q8 Corridor in the Town of Southold". Notice is further
given that the Town Board of the Town of Southold will hold a public
hearing on the aforesaid Local Law at the Southold Town Hall, 53095 Main
Road, New York, on the 13th day of October, 1998, at 8:10 P.M. as
the time and place for a public hearing on this Local Law, which reads as
follows:
A Local Amending Section 4 of the Local Law entitled "A Local Law in
Relation to Temporary Moratorium on the Issuance of Approvals and/or
Permits for Business Zoned Property Along The Route q8 Corridor in the
Town of Southold" adopted by the Town Board of the Town of Southold on
September 1, 1998.
BE IT ENACTED BY, the Town Board of the Town of Southold as follows:
Section 4. EXCLUSIONS is hereby amended as follows:

1) any person or entity Who has; prior to the effective date of this Local
Law. obtained all permits required for construction of a building on any
property located in the Route ~t8 corridor including later applications to
repair or alter, but not enlarge, any such building otherwise prohibited

DONNA DZUGAS-SMITH: My name is Donna Dzugas-Smith. I live on
Tuckers Lane' in Southold. I am not sure I understand it or not. so I just
want. to ask a question. Does that mean that someone that buys an existing
piece of pr~oPerty in $oUtl~old, On [[8, business zoned, they then can g~
apply for ne~v work pe~rmit. In other words, they buy it, it is zoned light
business, they want to use it for light business use, but they can go apply
for any building permits to adjust it to their use. Is that what we are
addressing?
TOWN ATTORNEY YAKABOSKI: Do you have a copy? What it did is that
the change moratorium that was in place from the Southold-Riverhead line
out to the intersection of State Road 2~ and ~8 is amended to exclude
properties, parcels of land, which are currently improved with a building
or buildings, so long as a application involving any of those properties
does not seek in all, or part, a change in the use of the land, premise for
the buildings, and so,~ long the application ~s required any applications to
or approvals. Special Exemptions, variances from the ZOning Board of
Appeals. Does that answer the question? I believe the parcel you were
talking, is that improved, or unimproved property?
DONNA DZUC;AS-SMITH: I don~t have any particular one in min~i. There
are many you can think of along ~8, that are in transition. I am just asking
a question so after this is past, if this is passed, we know what we are
dealing with. That's all. I just want to know if someone has bought, or is

going to buy a business property, and it has building on it, and they want
to change it, or they want to use it for something different, but it all
fits into this. They are not going in front of the ZBA, but say they have
to go in front of the Planning Board, or they have to go for a Building
permit, they can do that as long as they don't have to go to the ZBA.
Correct?
JUSTICE EVANS: As long as you don't change your use.
DONNA DZUGAS-SMITH: Right. If it is Light Business, they stay Light
Business, but I mean they can still go in front of the Planning Board or
the Building Department for permits, just not the ZBA?
JUSTICE EVANS: When you say, business, a certain type of business, you
have to stay that type of business. We are basically talking about
businesses that are currently running a business. We did not want to
prevent them from being able to apply for certain permits, since they
already have their business going during the moratorium.
SUPERVISOR COCHRAN: An established business.
DONNA DZUGAS-SMITH: Which is great. I am just saying, how about the
ones that sell to new people?
JUSTICE EVANS: As long as the continue the same business.
SUPERVISOR COCHRAN: The same use.
TOWN ATTORNEY YAKABOSKI: Correct, what you said is correct.
DONNA DZUGAS-SMITH: They can still go to the Planning Department.
They can still go to the Building Department, and ask for permits as long
as they don't go to the ZBA, that are okay?
TOWN ATTORNEY YAKABOSKI: Correct.
DONNA DZUGAS-SMITH: That's what I wanted to know. Thank you.
SUPERVISOR COCHRAN: Anyone else like to address the Board? (No
response.) If not, I will close the hearing.
