BOUNDARY LINE AGREEMENT
This Agreement is made this 4r�l day of August, 2014, by and between
TARA LANE ASSOCIATES, INC., with an address of 400 Eagle Nest Court, Laurel,
New York 11948 (the "OWNER"), and WILLIAM BREWER and NICOLE BREWER,
residing at 80 Silver Colt Road,Cutchogue,New York 11935 (the "NEIGHBORS").
A. OWNER is the owner of real property commonly known as 240 Silver
Colt Road, Cutchogue, Town of Southold, Suffolk County, New York 11935 (Suffolk
County Tax Map No. 1000-095.00-04.00-018.038),more particularly described in a Deed
dated October 17, 2013, and recorded in the Suffolk County Clerk's Office on October
25, 2013, in Liber 12750 at page 075 (the "OWNER'S PROPERTY) and on Schedule
"A", annexed hereto, which property is shown on the attached Survey, dated July 30,
2013, made by John C. Ehlers, Land Surveyor (the "SURVEY"), which SURVEY is
made a part of this Agreement and annexed hereto as Schedule "C".
B. NEIGHBORS are the owners of real property commonly known as 80
Silver Colt Road, Cutchogue, Town of Southold, Suffolk County, New York 11935,
(Suffolk County Tax Map No. 1000-095.00-04,00-018.039), more particularly described
in a Deed dated January 24, 2002,and recorded in the Suffolk County Clerk's Office on
February 4, 2002, in Liber 12167 at page 121 (the "NEIGHBORS' PROPERTY") and on
Schedule "B",annexed hereto, which property adjoins the OWNER'S PROPERTY.
C. The Southeasterly Boundary Line of the OWNER'S PROPERTY and the
Northwesterly Boundary Line of the NEIGHBORS' PROPERTY is the common
boundary line between the subject properties (the "COMMON BOUNDARY LINE").
D. According to the SURVEY, there is a fence (the "FENCE") that runs
along part of the COMMON BOUNDARY LINE, which such fence encroaches up to 6.6
feet northwesterly of the COMMON BOUNDARY LINE onto the OWNER'S
PROPERTY, and which such fence encroaches up to 1.0 feet southeasterly of the
COMMON BOUNDARY LINE onto the NEIGHBORS' PROPERTY.
E. The parties wish to establish the true common boundary line between
OWNER'S PROPERTY and NEIGHBORS' PROPERTY.
NOW THEREFORE, in consideration of the premises and mutual promises made
in this Agreement, and the sum of One Dollar ($1.00) and other good and valuable
consideration by each of the parties to the other in hand paid, the receipt and sufficiency
of which is hereby acknowledged,the parties covenant and agree as follows:
I. The NEIGHBORS hereby convey, release and quit claim unto the
OWNER,and OWNER'S successors and assigns forever,all of NEIGHBORS' right, title
and interest in and to all lands lying between the southeasterly boundary line of the
OWNER'S PROPERTY,the COMMON BOUNDARY LINE,and the FENCE,as shown
on the SURVEY.
2. The OWNER hereby conveys, releases and quit claims unto the
NEIGHBORS, and NEIGHBORS' successors and assigns forever, all of OWNER'S
right, title and interest in and to all lands lying between the northwesterly boundary line
of the NEIGHBORS' PROPERTY, the COMMON BOUNDARY LINE, and the
FENCE,as shown on the SURVEY.
3. The placement of the FENCE upon OWNER and NEIGHBORS' property
does not and shall never ripen into nor become a right to use any portion of the
OWNER'S PROPERTY by the NEIGHBORS or the NEIGHBORS' PROPERTY by the
OWNER, but is and shall continue to be only a use by sufferance of that portion of the
OWNER'S PROPERTY and NEIGHBORS' PROPERTY.
4. The parties agree that this Agreement will inure to the benefit of the
mortgagees,current or future,of their respective properties.
IT IS MUTUALLY COVENANTED AND AGREED by the parties that this
Agreement shall run with the land and inure to the benefit of and be binding upon the
parties,their heirs,distributees,legal representatives,successors and assigns.
IN WITNESS WHEREOF, this Agreement has been signed as of the date and
year first above written.
