I. Chapter 85 (Taxation) of the Code of the Town of Southold
is hereby amended as follows:
1 Section 85-1 (Partial exemption for senior citizens) is amended
as follows:
A. Amount of exemption.
(1) Real property owned by one (1) or more persons, each
of whom is sixty-five (65) years of age or over, or real property
owned by husband and wife, one (1) of whom is sixty-five
(65) years of age or over, shall be exempt from town taxes to
the extent provided, subject to the following income limitations:

(2) Such exemption shall be computed after att other partial
exemptions allowed by law have been subtracted from the total
amount assessed.
B. The real property tax exemption on real property owued by
husband and wife, one (1) of whom is sixty-five (65) years of
age or over, once granted, shall not be rescinded solely because
of the death of the older spouse, so long as the surviving spouse
is at least sixty-two (62) years of age.
C. The above income shall be calculated as described in
Real Property Tax Law §467, and shall include social security
and retirement benefits, interest, dividends, total gain from the
sale or exchange of a capital asset which may be offset by a
loss from the sale or exchange of a capital asset in the same
income tax year, net rental income, salary or earnings, and
net income from self-employment, but shall not include a
return of capital, gifts, inheritances, payments made to
individuals because of their status as victims of Nazi persecution,
as defined in P.L 103-286 or moneys earned through employment
in the federal foster grandparent program and any such ~ncome
shall be offset by all medical and prescription drug expenses
actually paid which were not reimbursed or paid by insurance.
This local law shall take effect upon filing with the Secretary of

SENIOR CITIZEN
SUPERVISOR COCHRAN: The third hearing scheduled for this evening is a
hearing on a" Local Law in Relation to Senior Citizen Exemption", and it
will be read by Councilman Romanelli.
COUNCILMAN ROMANELLI: "Public Notice is hereby given that there has
been presented to the Town Board of the Town of Southold, Suffolk
County, New York, on the 3rd day of February, 1998, a Local Law
entitled, "A Local Local in Relation to Senior Exemptions". Notice is
further given that the Town Board of the Town of Southold will hold a
public hearing on the aforesaid Local Law at the Southoid Town Hall,
53095 Main Road, Southold, New York, on the 19th day of February,
1998, at 5:0~ P.M., at which time all interested persons will be heard.
This proposed "Local Law in Relation to Senior Citizen Exemptions" reads
as follows:
BE IT ENACTED, by the Town Board of the Town of Southold as follows:
I. Chapter 85 (Taxation) of the Code of the Town of Southold
hereby amended as follows:
1. Section 85-1 (Partial exemption for seniors citizens) is
amended as follows:
A. Amount of exemption.
(1) Real property owned by one (1) or more persons, each
of whom is sixty-five (~65) years of age or over, or real property
owned by husband and wife, one (1) of whom is sixty-five

There are no correspondence. There is proof that it was in the
Traveler-Watchman, and it was also posted on the Bulletin Board of the
Town Clerk's Office.

SUPERVISOR COCHRAN: Thank you, John. Is there anyone that would
like to speak, or address the Town Board in relation to the change in the
Senior Citizen Exemption? Ed, would you like to say something?
ED SIEGMANN: Ed Siegmann representing East End Seniors. Since I have
heard nothing negative on this I think it would foolish for me to go over
everything I said at the Board meeting. At the Work Session I told you
the reasons for it, and what I thought. The only thing.I would ask you to
do is to try to vote on this as soon as you possibly can, because the time
is very limited for the people to submit their application.
SUPERVISOR COCHRAN: It is on the agenda. As soon as we close the
hearing we will be approving these hearing resolutions.
JUSTICE EVANS: I hope that you will spread the word since the television
is not here.
ED SlEGMANN: We spread it at our meeting already today telling them to
call here tomorrow to find out if it was passed, and if it was passed make
sure you get back here to take care of it.
SUPERVISOR COCHRAN: Thank you. Anyone else like to address the
Town Board in relation to the Senior Citizen Exemption? (No response.)
If not, I will close the hearing.
