The above parcel is the subject of a conservation subdivision pending before the Southold Town Planning Board (a copy of the subdivision map prepared by the office of Fox Land Surveying is annexed hereto). 4. The conservation subdivision includes three (3) proposed residential lots, where Lot 1 equals 2.6 acres, Lot 2 equals 2.7 acres and Lot 3 equals 1.8 acres, and a preserved area of 53.9 acres of preserved subdivision open space. 5. The Petitioners seek the right to obtain future approval of the lots on the annexed map and issuance of permits for the erection of structures thereon in accordance with the designated use district(A-C) and the density and minimum lot size for the subject property in effect upon the approval of a Resolution of the Town Board establishing this requested Open Development Area. 6. The preserved area will have direct access from Old Middle Road, as shown on the annexed map. 7. The Petitioners seeks to have this conservation subdivision recognized and approved as an Open Development Area(ODA). WHEREFORE, Petitioners petition this Board pursuant to Article VIII, § 240-26 of the Code of the Town of Southold and pursuant to § 280-a(4) of the New York State Town Law, to hold a hearing and to approve this petition by declaring the site to be an Open Development Area with full authority of the Petitioners to complete the subdivision at a later date.
