I. Chapter 100 (Zoning) of the Code of the Town of Southold is hereby
amended as follows:
1. Section 100-25 (Merger) is amended as follows:
C. Exceptions. Lots which are recognized under §100-24
and meet any of the following categories shall be exempt
from the merger provision set forth above and shall not
be deemed merged by operation of this chapter:
(4) If the lot is on the maps described in former
§100-12, the nonconforming lot has been held in
single and separate ownership from January 1, 1997
to date, or
(5) Each lot is currently developed with a one family.

feet which falls within the existing lot lines and which has
a certificate of occupancy or would qualify for one.

D. Proof of merger. The town shall require a person
seeking determination of merger to provide any or all of
the following documents for evaluation:
(1) Proof of the date when the lot was created and the
size of the lot, together with a copy of a legal description
of the parcel, all to the satisfaction of the town.
(2) A copy of the current tax map and survey of the lot.
(3) A copy of the original survey of the lot.
(4) A title search showing single and separate ownership
of the property from July 1, 1983, to the present time
prepared by a Suffolk County title insurance company
indemnifying the Town of Southold with twenty-five
thousand dollars ($25,000.) of insurance.
(5) Other additional information or documentation as may be
deemed necessary.
II. This local law shall take effect upon filing with the Secretary of State.

THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED BY THE
SOUTHOLD TOWN BOARD AT A REGULAR MEETING HELD ON MARCH 4, 1997:
WHEREAS, there was presented to the Town Board of the Town of Southold, on the
4th day of February, 1997, a Local Law entitled, "A Local Law in Relation to
Merger"; and
WHEREAS, this Local Law was referred to the Southold Town Planning Board and
Suffolk County Department of Planning for recommendations and reports; and
WHEREAS, a public hearing was held on this Local Law on the 4th day of March,
1997, at which time all interested persons were given an opportunity to be heard
thereon; now, therefore, be it
RESOLVED that the Town Board hereby enacts Local Law No. 4 - 1997, which reads
as follows:

BE R ENACTED, by the Town Board of the Town of Southold as follows:

SUPERVISOR COCHRAN: The proposed "Local Law in Relation to Merger" will
be presented by Justice Evans.
JUSTICE EVANS: "Public Notice is hereby given that there has been
presented to the Town Board of the Town of Southold, Suffolk County, New
York, on the 20th day of February, 1997, a Local Law entitled, "A Local
Law in Relation to Merger". Notice is further given that the Town Board of
the Town of Southold will hold a public hearing on the aforesaid Local Law
at the Southold Town Hall, 53095 Main Road, Southold, New York, on the
4th day of March, 1997, at 8:00 P.M., at which time all interested persons
will be heard. This proposed "Local Law in Relation to Merger" reads as
follows:
1. Chapter 100 (Zoning) of the Code of the Town of Southold is
hereby amended as follows:
1. Section 100-25 (Merger) is amended as follows:
C. Exceptions. Lots which are recognized under §100-24
and meet any of the following categories shall be exempt
from the merger provision set forth above and shall not
be deemed merged by operation of this chapter.
(4) If the lot is on the maps described in former
§100-12, the nonconforming lot has been held in
single and separate ownership from January 1, 1997
to date, or

(5) Each lot is currently developed with a one family
dwellino with a minimum eight hundred fifty (8501 square
feet which falls within the existing lot lines and which has
a certificate of occuoancv or would qualify for one.
D. Proof of merger. The town caay shall require a person
seeking determination of merger to provide any or all of
the following documents for evaluation:
(1) Proof of the date when the lot was created and the
size of the lot, together with a copy of a legal description
of the parcel, all to the satisfaction of the town.
(2) A copy of the current tax map and survey of the lot.
(3) A copy of the original survey of the lot.
(4) A title search showing single and separate ownership
of the property from July 1, 1983, to the present time
prepared by a Suffolk County title insurance company
indemnifying the Town of Southold with twenty-five
thousand dollars ($25,000.) of insurance.
(5) Other additional information or documentation as may be
deemed necessary.

Board, and we have correspondence from the Suffolk County Department of

Signed by Stephen M. Jones, Director of Planning. We have correspondence
from Bennett Orlowski from the Planning Board, Town of Southold. The
Planning Board members reviewed the above mentioned Local Law at the
February 10, 1997, work session. The Planning Board is in favor of amending
Section 100-25 as set forth in the proposed local law. Due to the Timing of
the Planning Board and Town Board meetings, the Planning Board was unable
to make the recommendation to adopt the Local law at a public meeting, and

instead did so at a work session so that if possible, it could be scheduled for
the February 20th Town Board meeting. Please let Melissa Spiro know if the
Planning Board's recommendation must be formally adopted at the next Planning
Board meeting which is scheduled for March 10, 1997. There is no other
correspondence.
SUPERVISOR COCHRAN: At this time we will entertain comments from the
audience.
MIKE ZEVITS: Cood evening, ladies and gentlemen. My name is Mike
Zevits. I am a property owner over in Cedar Beach, specifically on West
Lane, and this merger law specifically applies to my property, as well as Joe
Zevits, who is here too. I'm speaking on his behalf, my father Joe
Zevits, Jr., and also, certain people that couldn't make it this evening,
specifically my sister, Joyce Zevits Kacell, Tresha Kelly, and Lotty
Zevits. All these people have interests in that particular property, and the
merger law does, in fact, affect them. What I am addressing at this point is
that as far as the law is concerned I think there should be an additional
section to the law, and in this case a specific exception should be to include
those properties, which have already been approved by the Planning Board in
the past, and where the owners of those properties have abided by all the
merger law requirements, specifically subject to the properties that have all
been deeded into separate names prior to 1995, and that is what we call
within. 1 would ask that that particular exception be included. The reason
why I say that is because at this point what is happening is more or less if we
don't put that exception in, we are more or less penalizing people, who have
acted in good faith throughout the period that they have owned this land. In
our case we have owned it for over thirty years. My father. here has owned it,
and he had the foresight in 1971 to go before John Wickham, Sr., and get the
Planning Board approval, and throughout this period of time he has had this
approval. He has been assured by the Town Board, that we are, in fact, have
subdivided lots, and all of sudden the Merger Law hits. We complied with the
deeds, separate deeds, for each individual person, and now, all of a sudden
we have to hire an attorney. It cost additional money for people in our
position to go ahead, and go to the Zoning Board of Appeals. This is why I'm
saying that this specific exception should be included within the new Zoning
Code exception. I see number five. We should have a number six, and
should apply to all the people left in good faith.
COUNCILMAN MOORE: Number five, what we did with this, I'll explain real
quickly what number five is. There was a sense that there were applications
coming to the Zoning Board of Appeals to undo the effect of the Merger Law
from the Zoning Board, and we asked the Zoning Board to give us examples of
cases that were coming in before them. Everyone logically said, it doesn't make
any sense being here, and what this exemption, as it was drafted, number
five deals with is a case when you have Bob Jones owns lot A, and Bob Jones
owns lot B, and each lot has a house on it of 850 square feet, and could get a
CO, or a pre-CO. The way the law was written said, this law puts those
two together, and that didn't make any sense. People came in with two houses
on one piece of property then. It was just illogical, so this exception dealt
with that. This is the only exception that there was consensus in the Zoning
Board, was a ridiculous application that citizens had to make to undo the
effects of this law, and you are suggesting something which isn't the subject

of the public hearing, but I would like to hear if you can generically spell
out, is it vacant, is it improved land? What have you got?
JOE ZEVITS: What we have here is a parcel of land that was acquired in
1964 by my father. At that time it was deeded into two separate lots. They
were two one acre lots. In that particular area all the homes are on one half
acre lots, and what he did in 1971 was to conform to the rest of the area, and
he got the Planning Board to have this subdivided into four individual lots.
Now, he has owned this particular property until 1995, when it was
subdivided, not subdivided but deeded into individual names to comply with
the Merger Law provisions. That is essentially what we have here. We have
a situation where we complied with every law. We have gone through the
Zoning Board..not Zoning Board, Planning Board, and now all of sudden we
are up against a situation where we have to defend our rights, and 1 think
the rights here are obvious. I mean it's almost like the unconstitutional
taking of land, and that's the reason why it's important. As an aside, we
traveled two and a half hours to be here at this meeting, over a hundred
miles, and we have to travel back tonight, but it could show you the extent
and the seriousness that we find in this particular exception that we are
requesting. I hope I addressed your question to me.
COUNCILMAN MOORE: You did. Thank you. Just so you know, there is
nothing that we can do tonight with respect to your particular situation. This
law is written as it is, and published in this fashion. I would be happy it
you could leave something with us, or mail it to us after you have returned
home, giving us a short summary..) jotted it down as quickly as I could while
you were giving it to us. We can take it to the Code Committee, and discuss
it with the Zoning Board, and see if this type of situation similarly warrants
an exception to it. We can't act upon it tonight, but we would be happy to
take a look at it, if we have our facts right to talk that over.
JOE ZEVITS: Actually I have copies of everything that I have spoken
about, and I would give that to you now. The cover letter is there also
giving the history of the entire property, when it was purchased, whom it was
purchased from, etc.
SUPERVISOR COCHRAN: We are going to move along, and see if there are
any others that would like to make comments, and then you can bring it up at
your leisure. It is nice we have the Chairman of the Code Committee right
next to you here. Is there anyone else that would like to address the Board
in relation to the Merger Law? (No response.) If not, we will close the
hearing.

THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED BY THE
SOUTHOLD TOWN BOARD AT A REGULAR MEETING HELD ON FEBRUARY 20, 1997:
WHEREAS, there was presented to the Town Board of the Town of Southold, on
the 4th day of February, 1997, a Local Law entitled, "A Local Law in Relation to
Merger"; and
WHEREAS, this Local Law was referred to the Southold Town Planning Board and
the Suffolk County Department of Planning for recommendations and reports; now,
therefore, be it
RESOLVED that the Town Board hereby sets 8:00 P.M., March 4, 1997, Southold
Town Hall, 53095 Main Road, Southold, New York, as time and place for a public
hearing on this Local Law, which reads as follows:

A Local Law in Relation to Merger
BE IT ENACTED, by the Town Board of the Town of Southold as follows:
I. Chapter 100 (Zoning) of the Code of the Town of Southold is hereby
amended as follows:
1. Section 100-25 (Merger) is amended as follows:
C. Exceptions. Lots which-are recognized under §100-24
and meet any of the following categories shall be exempt
from the merger provision set forth above and shall not
be deemed merged by operation of this chapter.
(4) If the lot is on the maps described in former ~
§100-12, the nonconforming lot has been held in
single and separate ownership from January 1, 1997
to date, or

dwelling with a minimum eight hundred fifty feet (850'1
which falls within the existing lot lines and which has
a certificate of occupancy or would aualifv for one

The Planning Board members reviewed the above mentioned Local Law at
the February 10, 1997, work session.
The Planning Board is in favor of amending Section 100-25 as set forth in
the proposed local law.
Due to the timing of the Planning Board and Town Board meetings, the
Planning Board was unable to make the recommendation to adopt the Local
Law at a public meeting, and instead did so at a work session so that if
possible, it could be scheduled for the February 20th Town Board meeting.
Please let Melissa Spiro know if the Planning Board's recommendation must
be formally adopted at the next Planning Board meeting which is
scheduled for March 10, 1997.
