Chapter 77 (Shellfish) of the Code of the Town of Southola is hereby
amended as follows:
1. Section 77-204 (Scallops) is hereby amended as follows:
Only scallops measudngmore than two and one-fourth (2-1/4)
inches from the middle of the hinge to the middle of the bill may
be taken from town v~aters except as provided below:.
Scallops measuring less than two and one-fourth (2-1/4)
inches with an annual growth line may be taken from town
waters only by resolution of the Southold Town Board of
Trustees.
11. This local taw shall take effect upon filing with the Secretary of State.

REGULATIONS".

We will now have a hearing on a "Local Law in
Regulations", which will be read by Councilwoman
COUNCILWOMAN HUSSIE: "Public Notice is hereby given that there has
been presented to the Town Board of the Town of Southold, Suffolk County~
New York, on the 7th day of January, 1997, a Local Law entitled, "A
Local Law in Relation to Scallop Size Regulations". Notice is further
given that the Town Board of the Town of Southold will hold a public
hearing on the aforesaid Local Law at the Southold Town Hall, 53095 Main
Road, Southold, New York, on the 21st day of January, 1997, at 5:02
P.M., at which time all interested persons will be heard. This proposed
"Local Law in Relation to Scallop Size Regulations" reads as follows:
BE IT ENACTED, by the Town Board of the Town of Southold as follows:
I. Chapter 77 (Shellfish) of the COde of the Town of Southold is hereby
amended as follows:
1. Section 77-204 (Scallops) is hereby amended by deleting and
adding the following:

SUPERVISOR COCHRAN: · Thank you. You've heard the reading of the
Local Law in Relation to Scallop Size Regulation. Is there anyone in the
audience, that would llke to address this topic, either pro or con? Is there
anyone t~hat would like to address the Board in relation to scallop size
regulation, a Code change?
TOM SAMUELS: Tom Samuels. I would just like to take the opportunity to
recognize that the purview of these regulations is where it should be, in
the Trustees' hands. They are the best Board to regulate it. They have
the most knowledge, and they are very diligent. It's a good move.
SUPERVISOR COCHRAN: We agree. Thank you, Tom. Is there anyone
else that would like to address the Board? (No response.) If not, the
hearing is closed.
