A Local Law in Relation to Appearance Tickets
BE IT ENACTED, by the Town Board of the Town of Southold as follows:
I. Chapter 26 (Appearance Tickets) of the Code of the Town of Southold is
hereby amended as follows:
INTENT: The purpose of this local law is to include the position of Town
Investigator for Southold Town in the list of those permitted to write
appearance tickets.
1. Section 26-2-E (Certain public servants authorized to issue
appearance tickets) is hereby amended to read as follows:
E. Town Investi.qators, Ordinance Inspectors and Code Enforcement
Officers. Any statute, local law, ordinance, rule or regulation
regarding housing, building, zoning, fire safety, sanitation,
amusement, signs, peddling and any other areas concerning
public order and safety, including but not limited to all chapters of
the Code of the Town of Southold.
II. This Local Law shall take effect upon filing with the Secretary of State.

Chapter 100 (Zoning) of the Code of the Town of Southold is hereby amended
as follows:
1. Section 100-13B is hereby amended by adding the following definition:
FLEA MARKET - An out-of-doors market operated only during daylight hours
where new or used items are sold from individual locations, with each loca-
tion being operated independently from the other locations. Items sold
include but are not limited to household items, antiques, rare items, decora-
tions, used books and used magazines. This shall not include sales by a
nonprofit organization on an occasional basis.
2. Section 100-91B (10) is hereby amended by adding the following:
(10) Flea Markets.
3, Section 100-101B (17) is hereby amended by adding the following:

II. This Local Law .shall take effect upon filing with the Secretary of State.

COUNCILWOMAN OLIVA: "Public Notice is hereby given that there was
presented to the Town Board of the Town of Southold, on the 5th day of
September, 1995, a Local Law entitled, "A Local Law in Relation to Flea
Markets". Notice is further given that the Town Board of the Town of
Southold will hold a public hearing on the aforesaid Local Law at the
Southold Town Hall, 53095 Main Road, Southold, New York, on the 3rd
day of October, 1995, at 5:00 P.M., at which time all interested persons
will be heard. This proposed "Local Law in Relation to Flea Markets"reads
as follows:

mended as follows:
1. Section 100-13B is hereby amended by adding the following
definition:
FLEA MARKET - An out-of-doors market operated only during
daylight hours where new or used items are sold from individual
locations, with each location being operated independently from the
other locations. Items sold include but are not limited to
household items, antiques, rare items, decorations, used books and
used magazines. This shall not include sales by a nonprofit
organization on an occasional basis.

in the Suffolk Times, and that it has been posted on the Town Clerk's
pg 2 P.H.
Bulletin Board in the rear. We have piece of correspondence from the
Planning Board. Dear Mrs. Terry, The Planning Board has reviewed the
proposed Local Law in Relation to Flea Markets. This amendment defines the
for-profit Flea Market use and notes the zoning districts where this use will
be permitted. The use would be permitted within the Hamlet Business and
General Business zoning districts by Special Exception, and would require
Site Plan approval. The Board supports passage of this amendment as it is
advertized at this time. However, more needs to be done. We also
recommend that the Town Board through its Legislative Committee: 1. develop
and adopt conditions under which the Special Exception may be granted, 2.
determine appropriate minimum parking requirements for flea markets, 3,
review regulations governing the indoor flea market use. Sincerely, Richard

SUPERVISOR WICKHAM: You've heard the reading of the notice. Would
anyone in the audience like to address the Board on this proposed Local Law?.
(No response.) As the letter mentioned the purpose of it is to regulate that
flea markets would be allowed, as Special Exceptions, in two zone districts
in the town, Business and Hamlet Business. Hearing none, I declare this
hearing closed.
