A Local Law in Relation to Beach Parking
BE IT ENACTED, by the Town Board of the Town of Southold as follows:
Chapter 65 (Parking at Beaches) of the Code of the Town of Southold is
hereby amended as follows:
1. Section 65-1 (Policy) is here by amended by addin,q the following:
The Town of Southold provides bathing beaches and recreational facilities
and parking areas adjacent thereto at various locations within the town for the
use and enjoyment of residents of the Town of Southold. The Town also has
many road ends which provide access to the water. The use of such facilities
by persons other than residents has increased to such an extent that such
facilities have become overcrowded, with the result that residents are denied
the use thereof. The Town Board therefore declares it to be the policy of the
Town of Southold to restrict and regulate the parking of vehicles in the parking
areas adjacent to the bathing beaches, road ends, and recreational facilities
described in this chapter in accordance with the provisions hereof.
2. Section 65-2 is hereby amended as follows:
A. The following beach parking areas are hereby designated as Town of
Southold "Parking by Southold Town Permit Only" areas:
(1)
Parking area adjacent to the bathing beach located at the
terminus of Manhanset Avenue, Gardiners Bay, Greenport,
known as and referred herein as "Norman E. Klipp Marine Park."
(2)
Parking area adjacent to the bathing beach located approxi-
mately one hundred (100) feet east of the intersection of County
Route 48 and Sound View Avenue, Long Island Sound,
Southold, known as and referred to herein as "Southold Town
Beach."
(3)
Parking area adjacent to the bathing beach located at the
terminus of Horton Lane, Long Island Sound, Southold, known
as and referred to herein as "McCabe's Beach."
(4)
Parking area adjacent to the bathing beach located at the
terminus of Kenney Road, Long Island Sound, known as and
referred to herein as "Kenny's Beach."
(5)
Parking area adjacent to the bathing beach located adjacent to
North Bayview Road, Town Harbor, Southold (east of Goose

hereby amended as follows:
1. Section 65-1 (Policy) is here by amended by addinq the following:
The Town of Southold provides bathing beaches and recreational facilities
and parking areas adjacent thereto at various locations within the town for the
use and enjoyment of residents of the Town of Southold. The Town also has
many road ends which provide access to the water. The use of such facilities
by persons other than residents has increased to such an extent that such
facilities have become overcrowded, with the result that residents are denied
the use thereof. The Town Board therefore declares it to be the policy of the
Town of Southold to restrict and regulate the parking of vehicles in the parking
areas adjacent to the bathing beaches, road ends, and recreational facilities
described in this chapter in accordance with the provisions hereof.

SUPERVISOR WlCKHAM: This proposal adds a number of road ends to a list
that was already in existence, and it's just added on a substantial number
to that. Is there anyone in the audience, who would llke to address the
Town Board on this proposal.
DONALD VAN CLEEF: Ladies and gentleman, my name is Donald Van
Cleef, and I live at 530 Skippers Lane in Orient. Coincidentally, the road
end that we're concerned about is the first one in your listing, the one
that shown as number one under Sub-Section B, as State Street a/k/a
Skippers Lane, Orient Harbor, from the terminus north and east on Skippers
Lane to the intersection with Oysterponds Lane. A few points about this
street, as I've noted here, first there is an omission in the description of
the streets in the proposed ruling. The road leading away from Orient
Harbor is Harbor River Road, not Skippers Lane. The length of Harbor
River Road from the bay to it's end at Skippers Lane is approximately
feet. Two,the shore of Harbor River Road is a bulkhead, not a beach.
Three, large numbers of cars do not park at or near the bulkhead, as the
road end ~s not a beach. It is used primarily for fishing. People will
occasionally go down there, and drop a line in off the bulkhead. Those that
know Orient know that it is not a place that you would want to be. It's a
rocky rough bottom. The proposed restricted parking area on Skippers Lane
in addition to the ~20 feet on Harbor River Road is Lt00 feet long making the
length of entire restricted parking area over 800 feet from the water. While
there is some parking on summer days on the bulkhead end of Harbor River
Road, there is no beach related parking on Skippers Lane. I~ve talked to,
as I've noted, all the neighbors who were found in residence, and no one
has any recollection of beach related parking on Skippers Lane, on Harbor
River Road, yes, and Skippers Lane, no. There are six homes on the
portion of Skippers Lane in question, of which four are presently occupied
by year-round residents, namely, Henrietta Rackett, Paul McDermott,
William and Sheila Bachman, who are with us tonight, my wife, Mina, and
myself. I have talked to all these people personally, myself, in the last
day, and all of them are unanimous in their feeling that restricted parking
on Skippers Lane is fixing a problem that does not exist. If there is a
problem, it's on Harbor River Road. It is not on Skippers Lane. I note in
the list of 52 location twenty-eight on defined in terms of feet. Nineteen
of them have specified zones with 350 feet or less. The larger ones, the
five hundred foot lengths are on the end of Youngs Road, at the 67 Steps,
the popular bathing beaches, not a place like this. The only zones that
exceed 500 feet are those where the parking is parallel to the beach, which
is not the question here. This is up and at a right angle. So, our request

therefore as we~ve noted at the bottom, is that the wording be revised, so
that this restricted parking be limited to Harbor River Road, and that no
change be made to the parking on Skippers Lane. One other point I would
make in closing is that our street is occasionally used for parking for
Poquatuck Hall, and when they have occasions there with many attendees
our road is used for that, and this would create a problem for parking at
this sizable stretch here, would be eliminated for that use. Thank you very
much.
SUPERVISOR WlCKHAM: Harbor River Road doesn't seem to be listed here
anywhere.
COUNCILWOMAN OLIVA: No, it's actually because Skippers Lane goes down
like this, and makes a left hand turn, but actually Mr. Van Cleef is
absolutely correct. You would have the no parking on Harbor Road, and not
on Skippers Lane.
SUPERVISOR WICKHAM: Is there anyone else in the audience, who would
like to address the Town Board? Mr. Flynn?
F.M. FLYNN: My comment is more by way of the first. I believe this
legislation only pertains to dedicated Town roads. Is that correct?
COUNCILWOMAN OLIVA: Yes.
NATHAN HICKS: I'm Nathan Hicks, and I'm on Harbor River Road. As a
matter of fact, we have the entire frontage on the west side of Harbor River
Road, and there is a definite problem at the end of the street. I'm all in
favor of this resident only parking ban, but it's got to be moved back far
enough that it is effective. If it's moved back from the bottom of my front
lawn to my driveway, it's going to do nothing but provide a Town ordinance
that invites people to trespass over my property.
SUPERVISOR WICKHAM: I~m sorry. I don't understand. Could you run us
through that again.
NATHAN HICKS: Okay. Our property abuts the entire west side of Harbor
River Road from the waterfront to the intersection of what is know called,
Skippers Lane, which would be the right angle turn on Old State Street.
The entire west frontage, that clear? Okay, one of the major problems in the
area is the fact that people want to go from the street to the creek, or to
the harbor frontage, and what's in between is my property, and my front
lawn, and what you're proposing is going to be move a problem from the
foot of the street, back to where it's right in my driveway, right adjacent
to my front porch, and it will actually invite people to trespass on the
property where they have no right, right now. There's a serious problem in
that area, not only with the trespassing, but erosion. I hate to get into
that, but I see a nod there, that understands it. I met two years ago with
the then Town Attorneys. We have a creek frontage in there, that's an
angle that's sixty degrees. I~ve had people try to walk through there with a
bucket full of goldfish to take over, and dump them into the creek. At
ninety-two years of age, sooner of later there's going to be a serious
physical injury down there. I happen to be seventy-one years of age at this
time. The property is to go to my children, when I decease. Anything that I

would do that's remiss, you're not protecting against a potential liability
would be terrible. The only meeting I had with the Town Attorneys had to
be when you people were ruffling your feathers about the Adros Patent
type of thing, and somebody said, well, gee, we own more than the creek
bottom. I said, oh boy, that's great, because there's a serious problem up
here above the creek bottom, and I'd love to get out from the liability of
it. I'm carrying a million dollar liability policy right now to try to
protect against it, and the end result with the meeting of the Town
Attorneys at that time was, you got to keep your own liability policy,
because I don~t think the other thing is going to fly. Whether it does, or
not, is immaterial, anything that the town does to create an aggravation to
the trespass against my property, it's remiss. It shouldn't happen. People
complain that, gee, I might not be able to have people park in front of my
house on Skippers Lane, I'm going to have a church meeting. There's one
here, it has church meetings. He doesn't have the courtesy to call me. I
have the single largest piece of property on the highway. This gentleman
hasn't even tried to, as far as I know, he hasn't tried to call me, and he
certainly has not reached me. What happens if I call up my friend Stanley,
and I say, Stanley, and he cut my grass for a number of years, and I said,
remember the last time I gave you something for Island's End, and you took
ten dollars from me, now, I need a favor. Now, this bum up the street from
me, Van Cleef, has a church meeting going on up there, and there are
people parked on the street. Please send the East End sector car down, and
ticket them all. How far do you think I should hold the phone?
SUPERVISOR WlCKHAM: I don~t know. Look, I have one question for you.
The law as proposed would restrict parking along your frontage along that
road. It's going to restrict parking along your road frontage along that
road. Do you want that restriction, or do you not want that restriction
along your property, along Harbor River Road.
NATHAN HICKS: The restriction should be on the parking at the foot of
these streets that are accessible to public from out of town, that are
creating a problem in the area. The restriction has to go far enough back,
so that it's effective. If they move it from the foot of the street to the
front of my driveway, all they've done is move it from one end of my
property to the other, and you will not alleviate the problem at all.
SUPERVISOR WICKHAM: I think the Board understands your position. Is
there anyone else who would like to address the Board on these issues? Yes,
sir?
WILLIAM BACHMAN: I'm William Bachman. I live on Skippers Lane, also. I
am concerned about this. I have a short driveway. If we have visitors
coming, family driving their cars in, we have to park in the street. This
causes a problem. I did call, and talk to a very nice young lady the other
day about what we're going to do about this, about the parking permits.
What do we do with these cars? I have to put my own car out there. This
is no big deal, but if we have a party, or you have guests coming in, you
have to have a place to park. This is causing a great inconvenience, and I
think this is really making a mountain out of a mole hill. Don~t ever

I'm unaware of the circumstances that Mr. Hicks referred to in terms of
large meetings at our house. We do have people come. We're active in the
community, and the church, a number of senior organizations. People do
come for meetings. People stop by to drop things off. To my knowledge they
have never gone as far as Nat's house. You can park twenty cars on
Skippers Lane, and not go down to Nat's house, so I am frankly surprised
at what you had to say. I don't warrant this reference, so I would just like
to clear that up to the Board.
