SUBJECT: Federal Tax Provisions: Excise Taxes on Gasoline and Diesel Fuel

Gasoline Tax - Local governments are still exempt from the excise tax on
gasoline. However, a provision in the Federal Tax Reform Act of 1986 re-
quires, starting January 1, 1988, local governments to pay the federal excise
tax when gasoline is purchased and then file for a refund of the tax from the
federal government using IRS Form 843. The federal government will not pay
any interest on these refunds.
For refunds of $1,000 or more the governmental unit can file quarterly;
for refunds of $1,000 or less it must file annually. Claims must be filed by
the last day of the calendar quarter following the calendar quarter for which
the claim is being filed. Each claim must include a statement showing:
° The total number of gallons of gasoline purchased during the period
covered by the claim, multiplied by the rate (currently 9.1 cents
per gallon) at which the tax was imposed.
° The purposes for which the gasoline was purchased and the amount
purchased for each purpose.
The payments of the tax should be recorded as a receivable in account
A410 "State and Federal, Other". When the refund is received it should be
credited to A410.
Diesel Fuel Tax - Local governments are still exempt from the excise tax
on diesel fuel. However, the Omnibus Budget Reconciliation Act of 1987,
Title 10, known as the Revenue Act of 1987, signed on December 23, 1987,
requires similar payment of the federal excise tax on diesel fuel at the
time of purchase starting April 1, 1988. However, the new law also includes
a provision which gives the U.S. Treasury Department (IRS) discretionary
authority to exempt state and local governments from paying the tax at the
time of purchase. The IRS will develop regulations prior to April 1 spelling
out whether states and local governments will be exempt from paying at the
point of purchase and thus eliminate the need to claim a refund. We will
keep you informed about these developments.

SPECIFICATIONS FOR DIESEL FUEL
FOR THE TOWN OF SOUTHOLD
Under these specifications the Town of Southold seeks bids for furnishing
all of the Diesel Fuel required for the Southold Town Highway Department and
Disposal Area for the calendar year 1988, which is 10,000 gallons, more or less
as may be needed. Deliveries are to be made to the Highway Department and
Disposal Area as and when required.
Bid prices shall be based upon Northville Industries Corporation's Long

Island tank car consumer rack price, to which has been added the delivery
cost per gallon. The lowest rack price within five (5) days of each delivery
will be used. The aforementioned tank car consumer rack price is published
daily in the Journal of Commerce, or may be obtained by calling Northville
Industries Corporation, Melville, New York (516) 293-4700.

The bid price shall not include any Federal, State or Local Tax from
which the Town of Southold is exempt.
The Southold Town Board reserves the right to reject any and all bids
