BARGAIN AND SALE DEED
THIS INDENTURE, made as of October 25, 1996, between Adam
W. Tourtoulis and his wife Eleftheria Tourtoulis, having an address
at 21-69 38th Street, Astoria, New York, NY 11105 (collectively re-
ferred to as "Grantors" ) , and Dennis Barbarito and his wife Iris
Barbarito, having an address at 211-09 42nd Avenue, Bayside, New
York, NY 11361 (collectively referred to as "Grantees" ) .
WITNESSETH, that Grantors, in consideration of Ten
Dollars and other valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, do hereby grant and
release unto Grantees, as tenants by the entirety, and their heirs,
executors, administrators, successors and assigns forever,
THAT CERTAIN condominium unit, more fully described in
Exhibit aC hereto, designated as Unit 42 in the building
known by the street address South View Avenue and North
Road, Town of Southhold, the County of .Suffolk, and the
State of New York, in the condominium known as North Fork
Beach Condominium (the "Condominium" ) , TOGETHER with the
2, 83% percent percent interest in the common elements of
the Condominium allocated to the Unit, as described in
the declaration recorded on July 12, 1985 in the Office
of the Clerk of Suffolk County at 9829 cp 142, TOGETHER
with all right, title and interest, if any, of Grantors
- — in and to any streets and roads abutting said premises to
the center lines thereof, TOGETHER with the appurtenances
and all the estate and rights of Grantors in and to said
premises,
TO HAVE AND TO HOLD the premises herein granted unto as
IjIS� tenants by the entirety, and their heirs, executors, administra-
tors, successors and assigns forever.
Grantors are the owners of said premises . Said premises
is not located in an agricultural district .
Grantors covenant that Grantors have not done or suffered
anything whereby said premises have been encumbered in any way
whatever, except as set forth herein.
G� Grantors, in compliance with Section 13 of the Lien Law,
covenant that they will receive the consideration for this convey-
ance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost
of the improvement before using any part of the total of the same
for any other purpose.

SCHEDULE C
ALL that certain Unit of Real Property, situate, lying and being at
Southold, Town of Southold, Suffolk Country, New York, being known as
Unit Number 42 as shown on Condominium Plan entitled "North Fork Beach
Condominium" filed in the Suffolk County Clerk's Office on July 12,
1985, as Map No. 119 and "Amended Map of North Fork Beach Condominium"
filed December 11, 1985, as Map No. 119 together with an undivided 2.83%
interest as tenant in common in the common elements of the Condominium
described in the Declaration of Condominium entitled, "North Fork Beach
Condominium" recorded in the Suffolk County Clerk's Office in Liber 9829
page 142 amended by Liber 9933 cp 468. The premises on which said
Condominium has been created is situate, lying and being in the Town of
Southold, County of Suffolk, and State of New York, being bounded and
described as follows:

ALL that certain plot, piece or parcel of land, situate, lying and being
in the Town of Southold, County of Suffolk and State of New York, known
and designated as and by Lot No. 5 on a certain map entitled,
"Subdivision of property owned by Nathan Goldwin, situate at Southold,
Suffolk County, New York" filed in the Office of the Clerk of the County
of Suffolk on 11/22/32 as Map No: 1106.
PARCEL II•
ALL that certain plot, piece or parcel of land, situate, lying and being
near the Village of Southold, Town of Southold, County of Suffolk and
State of New York, bounded and described as follows:
BEGINNING at a point on the southerly side of Southview Avenue at the
northeasterly corner of land formerly of Leo Goldin and now of Samuel A.
Main (which point is the northwesterly corner of the premises herein
described:
RUNNING THENCE in an easterly direction along the southerly side of
Southview Avenue, a distance of 45 feet to the land of Francis W. RHINOW;
RUNNING THENCE in a southerly direction along other land of Francis W.
Rhinow a distance of 125 feet;
RUNNING THENCE in a southwesterly direction still along other land of
Francis W. Rhinow and parallel with Southview Avenue, a distance of 45
feet to land formerly of Goldin;
RUNNING THENCE along said land formerly of Goldin, a distance of 125
feet to the point or place of BEGINNING.

ALL that certain plot, piece or parcel of land; situate, lying and being
near the Village of Southold, County of Suffolk, and State of New
York, bounded southerly by Southview Avenue, a distance of 25 feet
westerly by land now or formerly of Goldin, northerly by high water
mark of Long Island Sound a distance of 25 feet, more or less, and
easterly by land of Francis W. Rhinow.

ALL that certain plot, piece or parcel of land, situate, lying and being
near the Village of Southold, County of Suffolk, and State of New York,
bounded and described as follows:
BEGINNING at the southeasterly corner of lands heretofore conveyed by
Edward Pike and Elizabeth Schneider Pike, his wife, to Francis W.
Rhinow, and being the southwesterly corner of the premises herein
described.
RUNNING THENCE in a general northerly or northwesterly direction along
the easterly side of said Francis W. Rhinow to the mean high water mark
of Long Island Sound.
RUNNING THENCE in a general easterly direction along high-water mark of
Long Island 'Sound 25 feet, more or less.

land of Mary A. Mulvaney on a line parallel to the easterly side of
said land of Francis W. Rhinow and 25 feet easterly therefrom
