I L-1 -L J WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by said last will and testament, and in consideration of ---------------------------------------------- NINETY—FOUR THOUSAND DOLLARS and 00/100 ($94,000.00) ---------------------dollars, paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being near the Village of Southold, Town of Southold, County of Suffolk and State of New York, known and designated as Lots Nos. 21 and 22 as shown on a certain map entitled, "Map of West Creek Development", filed in the Office of the Clerk of the County of Suffolk on July 6, 1937 as Map No. 1236, which said lots, when taken together, are bounded and described according to said map as follows: BEGINNING at a point on the northwesterly side of Bayberry Road, distant 127.29 feet Northeasterly from the corner formed by the intersection of the northeasterly side of Main Bayview Road with the northwesterly side of Bayberry Road; RUNNING THENCE North 48 degrees 15 minutes 50 seconds West, along the northwesterly line of Lots Nos. 19 and 20 according to said map, 124.57 feet to land now or formerly of Dooley; THENCE North 43 degrees 09 minutes 00 seconds East along said land and land now or formerly of Jacques, 100.04 feet to the division line between Lots Nos. 22 and 23 according to said map; THENCE South 48 degrees 15 minutes 50 seconds East along said division line, 122. 11 feet to the northwesterly side of Bayberry Road; THENCE South 41 degrees 44 minutes 10 seconds West, along the northwesterly side of Bayberry Road, 100.0 feet to the point or place of BEGINNING. TOGETHER with an easement for ingress and egress over Bayberry Road to the nearest public highway. BEING AND INTENDED TO Be the same premises conveyed in Deed dated 6/12/87, recorded 6/29/87 in Liber 10352 cp 375. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's death in said premises, and also the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ- ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND topether with the right of free access and approach to the creek along extension of the said Bayberry Road a width of fifteen (15) feet as shown and laid down on said map. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby thersaid premises have been incumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Sectien 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this convey ince and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties' whenever the sense of this indenture so requires.
