Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. Straw Bales or Other at Tidal Wetland A row of staked straw bales or approvable erosion control devices shall be placed at the landward edge of the buffer area or 75 linear feet fr&n the tidal wetland boundary,or as per the NYSDEC-approved plan,prior to commencement of any regulated activities and remain in place and in good, functional condition until the project is completed and all disturbed areas are stabilized with vegetation. 10. Contain Exposed, Stockpiled Soils All disturbed areas where soil will be temporarily exposed or stockpiled for longer than 48 hours shall be contained by a continuous line of staked haybales/silt curtains(or other NYSDEC approved devices)placed on the seaward side between the fill and the wetland or protected buffer area. Clean Fill Only All fill shall consist of clean sand, gravel, or soil (not asphalt, slag, flyash,broken concrete or demolition debris). 13. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activities. 14. No Construction Debris in Wetla Adjacent Area , debris or excess material from construction of this project shall be`eompletely removed from the aWjhcen area(upland)and removed to an approved upland area for disposal. The most recent survey determined that the driveway is, at it's closest point, 135 ft from the wetland delineation and therefore out of Trustees jurisdiction. The house, garage, pool and pool house are 425 ft or further from the wetland delineation. Any other proposed accessory structures are to the east or south of the driveway. We request that you issue a letter of non-jurisdiction, so that they can proceed to building permits. I believe you have received the authorization letter from them and will submit the $50 fee later today. The Cohens have assured me that there will be no construction North or East of the driveway. In fact, the driveway serves as an excellent dividing line to halt further invasive plant incursion and will support the discussed future efforts to restore the area.
