That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized,or if,in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. WARDEN 2945 EQUESTRIAN AVENUE, FISHERS ISLAND SCTM# 9-3-14.1 Dear Mr. Fitzgerald: The Board of Town Trustees took the following action during its regular meetings held on Wednesday, August 20, 2014 regarding the above matter: WHEREAS, Samuel W. Fitzgerald on behalf of ROBERT G. & MARGARET S. WARDEN applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, and Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, application dated July 18, 2014, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application to construct a 408sq.ft. one-story addition with an open porch onto the landward side of the dwelling was found to be Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the LWRP Coordinator recommended that the proposed application for the existing two-story 48.39'x24.55' dwelling with a 24.4'x16.2' screened porch with deck above; a 13.59'x23.9' stone patio; 6.5'x23.9' stairs from stone patio down to grade with retaining wall; 6.91'x12.92' front porch was found to be Inconsistent with the LWRP, and, 2 WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: to establish and subsequently maintain a non-turf buffer between seaward side of paved driveway and top of bluff; and the issuance of a permit on structures, and WHEREAS, Public Hearings were held by the Town Trustees with respect to said application on August 20, 2014, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 and Chapter 111 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of ROBERT G. & MARGARET S. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the N neighborhood or a detriment to nearby properties. The existing two story single family dwelling has a rear yard u, setback of 16.63 feet. Although the new one story addition will have a setback of 15 feet, the distance from the addition to the neighbor's house is+/-200 feet,while a second neighbor's house will be+/- 110 feet from the side yard of the new addition. A well-established hedgerow effectively screens the applicant's house from the neighbors. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing house, which was built before the 1957 Zoning Code, was re-built after a fire in the late 1980's within the original footprint. Because the building has a non-conforming rear yard setback any construction in the rear yard area requires a variance. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 80%relief from the code.However,the property is at a lower elevation than the surrounding neighbors,and is screened in the rear and side yards by an established hedgerow. The two neighboring houses will be+/- 200 feet away from the new addition in the rear yard,and+/- 110 feet away from the side yard. I 4. Town Law 5267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. No construction will take place in the area immediately landward of Little Hay Harbor bay. The applicant's agent stated that no re-grading of the lawn area is necessary where the addition will be built,and there will be no removal of fill from the site. 5. Town Law 5267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 5267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new one story addition with a non-conforming rear yard setback, while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
