Section 80-1 (Intent) is hereby added to read as follows: It is the intent of the Town Board to place the responsibility of keepincj sidewalks clean with the property owners adjacent to the sidewalk. Section 80-2 (Snow and Ice Removal; general maintenance) is hereby added to read as follows: Each owner or occupant of any house or other buildinc. SUPERVISOR WICKHAM: Thank you. Joe. The hearing is open to comments from people, who are here, up to ten minutes per person for those people, who are interested in making comments on this proposed Local Law dealing with sidewalks. GERTRUDE KOOP: i'm Gertrude Koop. Bay Avenue. Mettituck. on the side of the street with the sidewalk. I would like to have it clarified as to the maintenance of the sidewalk. If it is in need of repair, as far as cement work and etc., is this the property owners responsibility, or }s this the Town responsibifity? SUPERVISOR WICKHAM: Is there anyone who would like to resporjd to that? It is my understand that it is not the property owners responsibility. GERTRUDE KOOP: This is then. according to the newspaper article, a shift of insurance responsibility from you to me? SUPERVISOR WICKHAM: Let's let our insurance Town Councilman speak to that. COUNCILMAN TOWNSEND: I'm not an expert in law. I'm just a..I think it was an issue, that was raised, the issue was originally raised by the Highway Superintendent. He felt that the town had a problem, and a liability in that we were expected to clear all the sidewalks, and if somebody fell on the sidewalk, that was covered with snow and ice. we stood to be sued. The Town can not clean ail the sidewalks in town. and many other towns had an ordinance like the one we're considering, and therefore we decided to put it on our books, if the public can agree to it. If we can agree to it. I guess. GERTRUDE KOOP: So. what you're saying around the corner is, that it's now my responsibility. COUNCILMAN TOWNSEND: That's right. GERTRUDE KOOP: That ought do good on my biit. I have ar, other question. in what way are provided that the sidewalks must be kept clear? t speak of one on Bay Avenue. which last year evidently the Town Highway Department received a call. It took four large pieces of equipment, four men. almost two hours, to clean up that sidewalk. Unless there's a call put in. that sidewalk is not cleared of overgrowth, undergrowth, or what ever. I would descr'.be it. if you walked too slowly the poison ivy will come. out. and wrap itself around you. What's going to be done. if it's now the property owner's responsibility. and. again, the article in the newspaper said weLre not going to hand out tickets if you don't shovel every time. Well. if we don't clear up the sidewalk, who has the force, and what are you going to do about it? SUPERVISOR WtCKHAM: Laury. would you like to respond to that? Pg.3 q-/19/94 - PHLL 5.~ewalks ~' TOWN ATTORNEY DOWD: I anticipate that enforcement with be. as it has been in the past. on a complaint basis. If you have a prob~wn, you need to let the Town know, We will get in touch with the property owner, and advise him of his responsibility: GERTRUDE KOOP: And if he doesn't da anything? His attitude last year was. since he paid the greatest amount of tax on Bay Avenue. therefore he was deserving of that service. Now. if he isn't going to comply, and you know. clean up his act. then what are you going to do about it? TOWN ATTORNEY DOWD: Then if anybody should get injured, of course it would be his liabitlt¥, so it's in his best interest to take care of the situation.. GERTRUDE KOOP: And the rest of the time the rest of us walk in the street, becasue we can't pass that property comfortably on the sidewalk. TOWN ATTORNEY DOWD: We anticipate that with the proper notice will act responsibly. SUPERVISOR WICKHAM: This law is desigr~ed to put more pressure on people like that to do what they should do, GERTRUDE KOOP: There must be some clout in that Law. You haven't got it. Just advising somebody to be good usuaily doesn't work in our society. You've got to have some kind of clout. I grew up with this kind of a law. I'm not against it, but the law that ) grew up with also said that, if it is not maintained, then the Town comes in, and maintains, and it automatically is attached on to the bill. Now, ) think what you've got now is merely passing of the buck to the property owner. In other words. )f I'm going to maintain that sidewalk, and someone falls on it. it's going to be nitty-gritty. Did they fati because I left a leaf on that sidewalk, or did they fait because you have a crack in the sidewalk? SUPERVISOR WICKHAM: Mrs. Koop. the Board did consider the enforc~,nent question, and we discussed it several' times how far we wanted to go with enforcement proceedings. We, ultimately thought that at this stage, we'd be(Jin with a statement as to where responsibility lies. We feel that thatLs the first stage. We'll publicize it. We'll talk about it. and well) ask for people in the town to da what we think they should de, and I think what most people would like to do. If we find that people aren't responding, and that traditional measures are necessary, we'll address that. and we'd be open to you. and other people bringing to our attention, but we think that the first step in a town like Southotd. is to ask the people of the town to voluntarily come forward, and do what ~ think we all agree should be done, GERTRUDE KOOP: Now, also, is this reducing your liability, and increasing mine, show up on our tax, or do ) just pay the same amount of tax? SUPERVISOR WICKHAM: It would not be reflected directly on your taxes at alt. one way or another, because it's a liability. It's not an annual expenditure. However. if the Town were to be slapped with a major legal action, because of a sidewalk, and be held liable, and then have to make some payment, indeed, that would be reflected in your tax bill, and in mine. and everybody's. SUPERVISOR W]C'KH.AM: Anybody else. who would like to address the Board on this issue7 PAUL SPZARA: My name is Spzara from Matt}tuck. I have major problems with the snow. Everything else I don't mind about, you known, as far as keeping it up. One. after the first time I heard this come down. when the snow plow went by my house. I measured hew far the snow is thrown by the straw pi0w. Okay. from the point of the road into my yard was fourteen feet. Ali right? Now. i'm going to go out there, and I shove}ed my driveway t don't know how many t~mes, just to have the snow plow come in. and put all- that crap ,.ba~:k in my yard. Okay? I'm willing to put up with that. because that seems to be what you have to do. Now. if youLre going to te|l me. that i'm going to have to pay. because t don~t shovel my sidewalk, or something'. because the snow plow just came and put it att back. and unfortunately it's no' t like the fresh snow. TH~ fresh snow is easy to get rid of. That stuff thetis packed, and mushed in. and slopped, is extreme[y hard to remove. Second thing I have a problem with. is most of the time the sidewalks are. within, or on Town property. Why do I have a problem with that? Because t maintain my property for aiong time. and J had- a 'fence. Whal: happened is the Town came by. and backed into my fence, and des}raTed the. fence. When I called the Police to ~et peopl'e, it was Dike the ToWn was right there. ~he yettow truck, the. excuse me> that's not Sou}hold. Th:etas when I lived in another, town twenty years ago. Riverhead. Anyway. -they, were right there down the road. smashed my fence, and I'd been maintaining the property. keeping the grass cut. edging around the road. and' everything tlke, that. there alti,t, ude' when the Police came was like. well. that's tough~ It's our property. I said. okay. I lose a fence, move it back to the proper-L~y from the middle of the .line. ~ forget how wide they said they owne~, the p~operty, and then refused to mow the lawn anymore. Then t kept, catt.ing them up. come take care of your property. Okay? It seamed fair to me. Now. what's happening is I have a major problem with government, and: ~ga[ations. To regulate. people want to do what they should do anyway. Most of the prebtem oCr~Urs in downtown areas, where ther'e are businesses. Now. if i'm running a business. it would behoove ta clean out my sidewalk, so. one. I can get to business. two. I can keep that snow. and salt. and the rest ~.f the stuff, outside of my building. It only makes sense. The o{her thing is' that most of the time the snow plowing is dane it's also. again at night, when most of the cars are away. so they can clean those downtown areas eat. That's When the snow is then pat back into the sidewalks. Are the Townspeople naw:'going to come in. instead of plowing, come in with a backhoe, and clean it uio. and onto a truck, like 'they do in Riverhead. I hate to mention that word a~ain, but they don't Plow it up. It doesn't have an angled plow. it pusheS it to the side. t actuall,y come. pick it up. and on to the truck, and is carted at, aT. dumpe~ in the water. I don~t know what they do with it actually. Th~ other thln~ is. what about people in outlying' areas, that have sidewal~cs? }"rrr ~nat sure what thi~ ~Voman was talking about, but if the persons not there, or we have a lot of summer people, and stuff, are they responsibte for' maintain}rig, a sidewalk whe n they're not there? Most of the time, in some areas, it makes it hard for the pedestrian to navigate that. I think if they have something special like Mattituck has the sale day things, or whatever it's called what they're doing, I can see acceptance, but I suppose they have a permit to do that, or whatever it is when they close down the road it becomes a street fair. So, I'm against the snow part, unless there's going to be consideration made, with the snow plows, how the snow is going to be removed, what's going to happen, how people are going to be responsible. just don't think' that's-fair. Also. with knowing, that the property underneath the Sidewalk t don~t own anyway, it's owned by the Town. the Highway Department. whoever owns it. i'm not knowledgeable about that. I don't own it'. A lot of times..personally where I Jive right now. there are .no sidewalks, and I'm glad. 'because I d0n't want to have to deal with also shoveling" out sidewalks . but if it should come to a sidewalk. I don't know how we even get sTdewalks, what do I do? Come down. and say I'd like a si~lewalk, and theY just put one in? How does that happen? ~ can s~e that if I'm sayi.ng, oh gee. want a sidewalk. I'll shovel it. but. you know. but t think a lot of these this were put into p~ece' for other reasons by the Town government. SUPERVISOR WtCKHAM: Thank you. Paul. FRANK CARLIN: Frank Ceftin. This could be a two way street. Is the Town going to be willing to maintain it's sidewalk, whatever responsibility it has. on those sidewalks they have to maintain, being that you expect the people to maintain their sidewalks? It's a two way street here. right? The reason why I'm saying that is because in Laurel on the North side of that road. that highway Route 25 Ibm about, welt. it starts from about A&P all the 'way down throygh by my place there. That sidewalk there is pathetic. You can't even hardly see it, grass growing alt over it, leaves piled on it, and especially where the bridge is. The people- use that to walk. Instead of walking: on the road under the bridge, they walk on that sldewatk there, goes along there, and go under the bridge on the north side of the road. You know that. You measured it here 'last year to see how high it was. So. what I'm s~ying is that you're going to expect the people of this town to be responsible fdr the sidewalks, and Whatever. and I' don't really see too much. wrong, and we should make sure also that whatever sidewalks in the village in the town. that the town is responsible for. they al~o be maintained the same way. SUPERVISOR WICKHAM: I think that"s a good point. Frank. t think the Town does have that responsibility. FRANK CARLIN: i know I called up about two years ago. Ray Jacobs. and he came down there with a crew. and he cleaned the sidewalk all the way down. and took the grass out between them. because that sidewalk is pretty old already, and the grass growing in the middle of it all the way down there. That's very important where that bridge is. because even people with bicycles, instead of going under the bridge with the bicycles they tike to go up above there where the sidewalk is on the other side of the railing for safety reasons, and ills full with weeds, and whatever, and you canLt even see where the sidewalk is- It"s a very dangerous area in that area. I have no objections to helping keep the sidewalks clean, but I think the total liability responsibility should be yours, because if I-cleen then it makes it partly my liability, too. and really the sidewalks de belong to you.
