please rise, I was remiss at the beginning of the meeting, and I am asking for a moment of
silence for the passing of Paul Stoutenburgh, former Trustee and a man that everyone in this
community knew for his greatness. Thank you.

MS. FRANKE: It is for the rec department. Have you changed your protocol for instructors for
the recreation department?
SUPERVISOR RUSSELL: Meaning?
MS. FRANKE: Well, when I worked in the recreation department and my husband and I both
were doing teen night, we were told that we couldn't do it because we were double dipping
because I was a secretary for the town and I see for the last four years you have the secretary for
the recreation department running a digital photography program for$30 an hour.
SUPERVISOR RUSSELL: That is an issue that should be addressed, you are right. And I will
address that with Ken Reeves tomorrow.
MS. FRANKE: Okay. Thank you.
COUNCILMAN DINIZIO: Wasn't that, didn't Judy McCleery teach that course before she
worked for the town?
SUPERVISOR RUSSELL: I don't know.

Management".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The purpose of this Amendment is to remove an unnecessary, burdensome requirement
for inspections of erosion and sediment control practices following heavy rain to be
consistent with similar provisions of the Environmental Conservation Law and to correct
certain definitions and typographical errors.
II. Chapter 236 of the Code of the Town of Southold is hereby amended as follows:
§236-5. Definitions.

4) Activities involving land disturbance of 5,000 square feet or more including
disturbances of less than 5,000 square feet that are part of a larger common plan
of development that will ultimately disturb 5,000 or more square feet of land,
excluding routine maintenance activity that is performed to maintain the original

STORMWATER MANAGEMENT OFFICER (SMO)
An employee or officer designated by the Town to accept and review stormwater
management control plans and stormwater pollution prevention plans, forward the plans
to the applicable municipal board and inspect stormwater management practices
§236-7. Performance and design criteria for stormwater management and erosion
and sediment control.
All land development activities shall be subject to the following performance and design
criteria:
A. All land-disturbing activities or the addition or replacement of impervious
surfaces shall provide temporary and permit permanent construction controls and

shall be required to contain a two-inch rainfall on site, even where approval of the
Stormwater Management Officer is not required under this Chapter.
X236-9. Maintenance, inspection and repair of stormwater facilities.
A. Maintenance and inspection during construction.
(1) The applicant or developer of any land development activity proposed under
this chapter, as set forth in Articles II and/or III, or their representative shall,
at all times, properly operate and maintain all facilities and systems of
treatment and control (and related appurtenances) which are installed or used
by the applicant to achieve compliance with the requirements of this chapter.
Sediment shall be removed from any sediment traps or sediment ponds
whenever their design capacity has been reduced by 50%.
(2) For land development activities as defined in Article III, §236-19, the
applicant shall have a qualified professional conduct site inspections and
document the effectiveness of all erosion and sediment control practices every
seven days. a-a within, 24 hours of any stei:f event r odueing 0.5 ineh of
pr-eeipitation or-more. Inspection reports shall be maintained in a site log
book.
§236-19. Activities covered.
B. Construction activities that discharge or potentially discharge stormwater to
surface waters, whether directly or indirectly via an MS4, and that meet any one
of the below thresholds, shall also include water quantity and quality controls
(post-construction stormwater runoff controls) as set forth in §236-20(C)(2) as
applicable:
(1) Stormwater runoff from land development activities discharging a
pollutant of concern to either an impaired water identified on the New
York State Department of Environmental Conservation's §303(d) list of
impaired waters or a Total Maximum Daily Load (TMDL) designated
watershed for which pollutants in stormwater have been identified as a
source of the impairment.
(2) Stormwater runoff from land development activities disturbing five or
more acres.
(3) Stormwater runoff from land development activity disturbing between one
acre and five acres of land during the course of the project, exclusive of
the construction of single-family residences, construction of single-family
residential subdivisions with less than 25% impervious cover at total site
build-out and construction activities at agricultural properties.

If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by
any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this

SUPERVISOR RUSSELL: At this point, I would ask anybody that would like to address the
Town Board on any issue to please feel free?
Jill Franke
JILL FRANKE: Jill Franke, Southold. I had FOIL'd the medical information from John
Cushman and it says on here, family plan is $1,714.19 cost to the town per month per family.
Does that include the dental and the vision or is that an extra cost?
SUPERVISOR RUSSELL: That would be a separate cost. The dental and the vision are a
separate plan. Unless he has consolidated both costs to you but we pay two separate bills to two
separate entities for that coverage.
JILL FRANKE: Okay, so these two new positions that you just created, the justice court
position and the network systems specialist position, that would bring, if the person had a family
plan, it would be $21,568.32 for a family plan, so that would bring that salary starting at
$101,568.32 and above because now you are going to be adding vision and dental onto it. and for

the network system specialist for a family plan would be over $102,000. How do you expect us
to continue to live out here? Because I am struggling to stay here and I doubt very much my kids
will be able to stay somewhere where we were all born and grew up and our grandparents were
born and grew up. It is sad.
SUPERVISOR RUSSELL: I should point out that the network system administrator is a
promotional position for someone who is already employed by the town. He is already covered
under the town's insurance policy.
MS. FRANKE: It doesn't make much of a difference.
COUNCILMAN DINIZIO: We are filling another position of a lower amount in the court
justice. They were $60,000 or whatever they were, so there is a little more but we are asking
more of those people.
MS. FRANKE: It is quite a bit more.
COUNCILMAN DINIZIO: Well, we are asking for more of those people, responsibility in there
that we need, a hole we need to fill. And we need to fill that with a management position.
SUPERVISOR RUSSELL: The position that we are filling had already received medical
benefits and the insurance benefit package that you talked about, medical and dental, we are not
adding any additional cost to the town as a result of establishing the justice court director
position.
MS. FRANKE: Right because the woman who was in there already had a family plan.
SUPERVISOR RUSSELL: Right.
MS. FRANKE: So the medical is the same but the salary is like a $30,000 jump.
SUPERVISOR RUSSELL: I believe the salary would go from $67,000 to about $80,000. And
you are acting like we spent the money, we haven't yet. We haven't filled the position. If we
don't find a candidate that is going to meet our qualifications, we will not fill the position.
MS. FRANKE: And I also, you are the one that brought it up, but I wasn't going to mention it. I
had also FOIL'd the list of people to sit on the test in zone 1 from the town and it tells me that
there are 10 people on this list and it's funny that there's only 9 names on the list.
SUPERVISOR RUSSELL: Yes, you can take that up with civil service. I believe that that was a
misunderstanding as to one person they had on the list that didn't....
MS. FRANKE: I already FOIL'd them and I am waiting for their answer.

SUPERVISOR RUSSELL: I believe there actually was one person that didn't check zone I as
part of her application.
MS. FRANKE: And I missed the plastic bag meeting but the yellow bags should be
biodegradable. If you are going to ban plastic bags in the grocery store, you should look into
biodegradable town bags because everybody puts their garbage into a regular plastic bag and
then they cram that into a yellow town bag.
SUPERVISOR RUSSELL: Thank you. Who else would like to address the Town Board?
Dave Markel
DAVID MARKEL: David Markel, Southold. Supervisor Russell, ladies and gentlemen of the
Board, thank you very much for this opportunity to speak before you. the other day, about a
week ago or a week and a half ago, I was riding my bicycle on Bayview Avenue and to and
behold, I saw my old friend, Morris the turtle, by the side of the road. You remember him, Scott,
he was the one that initiated, well we did, to save the tall pines oak complex. So I said, Morris
how are you doing? He said, fine Dave. I saw you on TV at the Town Board meeting. I said,
wait a minute Morris, how was a turtle watching TV? I got triple play. But the installation
charge was a killer. I said, Morris, that's not important. He said, I know what's important and
what's not important and what's important is that you protect my brethren the sea turtles, do
what you can to stop them from using those plastic bags. He said I watched that meeting, at the
end of the meeting I got the impression from Supervisor Russell that he was going to look for a
regional approach, he was going to reach out to the business community and it seemed to me that
what was the purpose, he said what was the purpose of that meeting, to placate the environmental
people so they don't show up at the meeting en masse or was there some pandering to the
business, I said, Morris, wait a minute, I am sure the Town Board has the best interest of the
people at heart. Perhaps they don't agree with what we are doing but I think they really, they all
care about this community, they all want what's best for the community. He said, that might be
Dave but please, keep up the pressure, keep them knowing that the people want this ban on
plastic bags. So to that effect, I started going out and getting some more petitions and I would
like to, if I may....
SUPERVISOR RUSSELL: Please, by all means.
MR. MARKEL: Present to the Board, we made copies, I am giving you the copies.
SUPERVISOR RUSSELL: Copies are fine.
MR. MARKEL: Inaudible. I wasn't at the beginning of the meeting, do any of the Board
members have any idea how many petitions were handed in at the last meeting that we had, that
open meeting?
SUPERVISOR RUSSELL: No, I don't think we have tabulated them yet.

SUPERVISOR RUSSELL: I just talked to Anna Throne-Holst Friday. She is working
Southampton, looks like she is getting some momentum there. We have been focused on
Riverhead which I believe is split between a 2-2 vote for the ban. I am reaching out to the
supervisor Walter to see if he is going to go on board, it looks like he is going to be the swing
vote on that issue.
MR. MARKEL: He didn't return Newsday's call when they had the article about the bags.
SUPERVISOR RUSSELL: Who didn't? I didn't?
MR. MARKEL: The Supervisor...
SUPERVISOR RUSSELL: Oh, Sean Walter?
MR. MARKEL: And reaching out to the business community? Has any of that been done?
SUPERVISOR RUSSELL: Yes, we reached out to business owners. You know, I have to tell
you that to their credit, they recognized the necessity of doing something but they raised that
same issue which is adding 8 times their operational cost of going from plastic to paper. It is a
concern to them. It is a concern we have to listen to and I think you said something that was
probably, certainly something very wise and I took it to heart after the meeting when I had
suggested that we needed to reach out to others that might not be as supportive of the ban. You
had said to me well, Scott, you had a public forum, where were they? They weren't here to
speak and I think your point is well taken.
MR. MARKEL: Well, thank you for your consideration and keep working. Thank you.

Benja Schwartz
BENJA SCHWARTZ: Good evening, Scott, members of the Board. I got a couple of new pair
of glasses but none of them seem to work very well. Just a quick mention, there was an article
published and posted online July 4th, the east end beacon.com described me as a perpetual town
board critic, Benja Schwartz. I would just like to point out that educators use the term critical
thinking to describe clear thinking as opposed to confused thinking. I don't mind being called a
critic. I think we need some more critical thinkers. The issues in town, the deers, deer issues,
the ticks, helicopters, master plan, what to do about Goldsmiths inlet, there's a lot of different
opinions. But it was very obvious to me that there's a clear public consensus on the issue of
disposable plastic grocery bags. There wasn't a single person attending the public meeting on
the issue who supported this decision made by the Town Board to wait for a concerted action by
the five east end towns. Except for a few panel members that Supervisor Russell specifically
invited to the meeting. But the general public who showed up were 100 % against that idea.
You know, I am all for Peconic county but I am not holding my breath. I think the voice of the
public was unequivocal, it was unanimous, Southold Town should ban disposable plastic grocery
bags. One of the librarians happened to see me in the video at the forum and mentioned to me,
she said why don't you mention the reading program? I don't know if it's only at the Cutchogue

library or the other libraries are doing this also but if you sign up for the reading program, take
out four books during the summer, they will give you a free reuseable bag. Now it's not really a
shopping bag, it's a book bag but it is close enough. Anyway, it's a very nice bag, the book bag
there. It's free to everyone who, in addition to that, you get to be entered into a raffle. There's
not that many people in the book club so you have a pretty good chance of winning one of these
gift certificates and I am not going to name them all, I mean, I could read them. Touch of
Venice, Blooms by Design, Braun's seafood, Cutchogue pharmacy, Epic Nails and Spa, Flowers
Edge, Legends, Lieb Cellars, King Kullen grocery is sponsoring this too, thank you. Peconic
liquors, Pellegrini vineyard and Trendsetting salon. So anybody that wants a free bag can just
sign up for the book club. I had a couple of questions. Who is currently enforcing the parking
regulations in Greenport Village?
SUPERVISOR RUSSELL: I believe that would be, is it a village ordinance that's the parking?
Was it created by village code or by town code? If it is a town code violation it would be our
traffic control officers.
MR. SCHWARTZ: I believe it's the village code...
SUPERVISOR RUSSELL: That would fall under their bailiwick.
MR. SCHWARTZ: That controls most of the 30 minute parking regulations.
SUPERVISOR RUSSELL: Right.
MR. SCHWARTZ: However, parking in the middle of the street, I think is something that
might...

MR. SCHWARTZ: Come into the jurisdiction of the Southold Town police. And I had several
people complaining to me today to get to the place of business where I was working they had
trouble negotiating the Main Road and Front street and indeed, on my way home I went that way
and there was a Porsche parked about 1 '/2 foot over the lines on an angle in one place and
several other cars that, they have lines, they have designated parking on the side.
SUPERVISOR RUSSELL: I will try to park my Porsche better the next time. I know what you,
I hear you Benja. We get a lot of that.
MR. SCHWARTZ: Inaudible.
SUPERVISOR RUSSELL: We get a lot of that in the summer. Love Lane is another problem
spot. We get a lot of that, I agree 100%.

MR. SCHWARTZ: I want to compliment you on your new vehicle. Very nice vehicle. I would
love to have one. I noticed on the way in today that it doesn't have a registration sticker on the
windshield.
SUPERVISOR RUSSELL: Mine?
MR. SCHWARTZ: Yes. I mean, is that because of the...
SUPERVISOR RUSSELL: Town issued vehicle.
MR. SCHWARTZ: Town plates. It doesn't need to be registered? Doesn't need a registration.
Well, you had the inspection there. looks like a nice vehicle, so, anyway, well, speaking of the
new positions, isn't there another new position that you are filling or creating? The stormwater
management officer?
SUPERVISOR RUSSELL: We have established the position but we haven't filled the position
yet. That's, we are looking in house. We have three people that work on storm water
management now. we would look to probably promote from within if we were going to fill that
position but no decision has been made.
MR. SCHWARTZ: Have you established a salary for that position?
SUPERVISOR RUSSELL: I believe we have, yes. Salary scale and everything.
MR. SCHWARTZ: What is it?
SUPERVISOR RUSSELL: I want to say in the $60's range but I am not 100% sure. We did
that some time ago, so I don't recall that exactly. $60's to $70 probably escalating after 5.
MR. SCHWARTZ: Well, the justice court director's position, you know that if that is filled,
then you all will get new duties too. Right? So are you going to get raises also?
SUPERVISOR RUSSELL: Any position in town government is ultimately going to fall under
the supervision of the town board, that's how government works. There are immediate
supervisors, department heads and then there is ultimately the town board. We are the personnel
directors for the town. Whether we want to be or not, we are. That's the reality. A justice court
director will be reporting to both judges, three judges, I am sorry Louisa, and the town board.
But again, that's a position we have yet to fill.
MR. SCHWARTZ: According to the civil service specification, it specifies that the justice court
director reports primarily not to the town board even but specifically to the supervisor and also to
the judges and the town board but the chief clerk specifically...
SUPERVISOR RUSSELL: We rely very heavily on our department heads for day to day
oversight.

MR. SCHWARTZ: So but by switching from a chief clerk to a justice court director, you are
shifting the responsibilities away from the judges and to the supervisor and the town board.
Correct? Am I correct?
SUPERVISOR RUSSELL: Yes, we would assume some more oversight, absolutely. Given the
circumstances, I don't think that's inappropriate.
MR. SCHWARTZ: Well, I think there are many ways of approaching the problems that arise.
What was the discussion about this morning? I am sorry I couldn't be here to listen but there's
no video so the only way that I have to learn what happened in the work session is to ask you,
what the discussion this morning was regarding the, according to the agenda, it says elimination
of local authority over police discipline.
SUPERVISOR RUSSELL: There's legislation that has been passed, the Senate and the
Assembly that sits on the Governor's desk and it has to do with the authority of town's to
negotiate for disciplining officers within the collective bargaining agreement. There's some
legal components to this, I am going to have to defer to Martin on but....
MR. SCHWARTZ: So it's not an initiative of Southold Town Board?
SUPERVISOR RUSSELL: No. It's basically a memo looking for whether towns support it or
don't support it. I think the towns have generally all opposed it. And we are lending our voice
of opposition.
MR. SCHWARTZ: Well, one more thing, that this storm water management officer, if one is
appointed, I would ask if the officer would be directed to stop the free car washes. On the way
here, my car was washed by one home in particular on Pequash Avenue. They had about six
lawn sprinklers that were not pointed at the lawn at all. They were just spraying all over the
road. Well, okay. It's kind of funny, stop the free car washes. But the North Fork
Environmental Council and the Group for the East End and the town has been working for many
years on trying to, the average water use in the United States per person is 100 gallons a day. In
Suffolk County, that's 150 gallons a day. So Suffolk County in the winter, Suffolk County use
50% more water than most of the people in the United States. In the summer, according to this
document issued by the North Fork Environmental Council, the water use of Suffolk County
residents averages 350 gallons a day. I don't know if that is true. I find it hard to believe. But I
know that in my home we are very careful about water, we wash the dishes and put the water in a
bucket and take it out and water the garden with it. We try to conserve water and I wish
everybody would but I also would hope that our local government can do what they can and I
know there's a lot they can do. But in recent past when I made reports of excessive water use,
they have fallen on deaf ears. We have a road in my neighborhood which floods regularly, not
only when it rains but because of all the sprinklers which are sprinkling on the driveways which
are draining down into the lower area of the road, the water travels over 1,000 feet on the road.

SUPERVISOR RUSSELL: Thank you. Would anybody else like to address the Town Board?

MR. MARKEL: Just a short comment. I am not, (inaudible) 84 year old lady, wonderful lady
who according to the Suffolk Times was handcuffed at the police department for an hour. Just
an idea, I am just wondering if I put out my Mel tag sale signs, and Benji decided to, on public
property and Benji decided he didn't like the signs, if he took those signs, would he have been
subject to arrest? Because in my mind, once you put something on public property, you abandon
it. And so that is just a comment.
COUNCILMAN DINIZIO: Well, Dave, you know, I thought about that when I saw that and
Bob Wahl says that non-profits have a right to put signs on the right of way, like elected people
like we do, when we run for elections, fire departments....
MR. MARKEL: That's in the town code? That non-profits have the right to put signs up on...
COUNCILMAN DINIZIO: Yes. So, I thought it was a little odd too but evidently, they, if the
fire department or something like that has an event, they have a right to be there. Evidently, that
place was occupied....
MR. MARKEL: What is the definition of a right of way? Is that just any public property or is
that some specific....
COUNCILMAN DINIZIO: Well, the town right of way is 50 feet....
MR. MARKEL: On any three feet, oh, okay. Well, thanks for answering my question.
SUPERVISOR RUSSELL: Would anyone else like to ....

MR. SCHWARTZ: On that subject, I would just like to say that the law is not very clear.
COUNCILMAN DINIZIO: I agree with you there too.
MR. SCHWARTZ: I am not arguing that non-profits and municipalities should not be able to
put up signage but I would like to see maybe a requirement for registering the signs or something
so they get a little number or something. But really we all need the police and we depend on the
police but for them to number one have arrested her without just giving her a warning, that's all
that would have been required to prevent that from reoccurring in this case.
COUNCILMAN DINIZIO: Alright, wait Benja. Someone filed a complaint and the chief of
police has to follow the laws. I mean, I am sure he didn't want to lock up an 84 year old woman,
I am sure the guy that actually did it is feeling very poorly about that but there are procedures
that have to be followed.

MR. SCHWARTZ: Look, whether I support the circus or the fire department, its' irrelevant.
One of them I support. The appearance in this case is very clear, that it was because was the sign
was the fire departments, at the discretion of the police. Yes, I have been told many times that
they have to respond to complaints but I also know very well that they many times do not you
know, enforce the laws. They use their discretion whether or not to ticket people, to arrest
people, to fine people, to require bail and I am very sad what happened in this case, I think is
shame on the Southold Town police. I think its shame on the Greenport fire department, shame
on the circus. I don't think it's doing them any good. I think they don't need to be going around
arresting old ladies. Next thing you know, they will try to train the old ladies to put on a show
like the elephants.
