James W.Milton,residing at 1201 Turtle Beach Road,North Palm Beach,Florida 33408,as
Personal Representative pursuant to probate proceedings filed in the Circuit Court for Palm
Beach County Florida in Case No.50 2013 CP004650,and as Executor pursuant to Ancillary
Probate in the Suffolk County Surrogate's Court under File No.2014-1562 of the Estate of Mary
Jane Milton a/k/a Mary J.Milton,who died a resident of Palm Beach County,Florida on
September 16,2013.
party of the second part,
WITNESSETH,that the party of the first part,in consideration of TEN DOLLARS($10.00),
lawful money of the United States,paid by the party of the second part,does hereby grant and
release unto the party of the second part,the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot,piece or parcel of land,situate,lying and being in the Town of
Southold,County of Suffolk and State of New York,bounded and described as follows;
BEGINNING at a point on the Southwesterly side of New Suffolk Avenue which point is the
division line between lands now or formerly of the Estate of Henry V.Downs and land now or
formerly of Martha Leibell and from said point;
RUNNING THENCE South 14 degrees 07 minutes East 626 feet 9 inches to the true point or
place of beginning;
THENCE North 75 degrees 53 minutes East 109.24 feet to lands now or formerly of Walker;
THENCE along said lands of Walker South 14 degrees 07 minutes East 90.49 feet to a point;
THENCE still along lands of Walker South 38 degrees 13 minutes East 129 feet to a timber
bulkhead;
THENCE in a general Southwesterly direction along said timber bulkhead and the high water
line of Peconic Bay for a distance of 192 feet;
THENCE north 15 degrees 28 minutes 40 seconds West along Peconic Bay and land now or
formerly of Rushmore for a distance of 145 feet;
THENCE continuing along said land of Rushmore North I degree 26 minutes 20 seconds
East a distance of 99.77 feet;
THENCE continuing along said lands North 14 degrees 07 minutes West a distance of 31.04
feet to the point or place of BEGINNING.
TOGETHER with a right of way for ingress and egress over a certain roadway out to New
Suffolk Avenue which right of way was more specifically recited in deed to Frank J.Seaman and
Madalyn B.Seaman recorded in Liber 3362,page 297.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
by deed dated December 7,2006,recorded December 14,2006 in Liber 12483,Page 120.
TOGETHER with all right,title and interest,if any,of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part
in and to said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part,covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever,except
as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants
that the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word"party"shall be construed as if it read"parties"whenever the sense of this
indenture so requires.
