ZBA FILE: 6777 NAME OF APPLICANT: Andrew Keating and Colleen Sharp PROPERTY LOCATION: 700 Ruch Lane(adj.to Arshamomoque Pond) Southold,NY. SCTM#1000-52-2-28.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 5, 2014, stating that this application isconsidered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 28, 2014. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The applicants' property is a 15,600 sq. ft. parcel in the R-40 zone. The northerly lot line measures100 feet along Ruch Lane, and the easterly lot line measures 156.50 feet along an adjacent residential property. The southerly lot line measures 100 feet along Arshamomoque Pond, and the westerly lot line measures 156.50 feet along another residential parcel. The property is improved with a single family dwelling with attached decks, and an accessory garage, as shown, with the proposed new garage, on the survey drawn by John C. Ehlers, Land Surveyor, dated 5-30-2013, last revised 6-25-2014. BASIS OF APPLICATION: Request for Variance from Article XXIII Code Section 280-124 and the Building Inspector's June 3, 2014 Notice of Disapproval based on an application for building permit to construct accessory garage, at: 1)less than the code required front yard setback(for waterfront property)of 35 feet. RELIEF REQUESTED: The applicant requests a variance to demolish an existing accessory garage with a 1 foot front yard setback, and construct a new accessory garage with the same dimensions, (20ft.x 16.4 ft.), located in the front yard area with a setback of 5 feet where the Code requires 35 feet. ADDITIONAL INFORMATION: The applicant submitted two letters from neighbors who support the applicant's proposed construction. Page 2 of 3—August 21,2014 ZBA#6777—Keating/Sharp SCTM#1000-52-2-28.1 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on August 7, 2014, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant provided many photos of neighboring homes with accessory garages in the front yard close to the road. This long established neighborhood has a significant number of accessory structures in non-conforming locations similar to the applicant. A reasonably accurate estimate determines that 50%-60% of the accessory garages in the neighborhood are within non-conforming locations. The applicant has a valid CO for the existing garage which was built prior to the zoning code. However, due its age and condition it is in danger of structural failure. This garage currently has a 1 foot front yard setback from Ruch Lane. The proposed garage will be the same size as the existing garage. . 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. It is not practical for the applicant to attach the garage to the house because it would require redesigning the interior bedrooms in order to provide access to the garage. Because the applicant's house has a +/- 36 feet front yard setback, any location within the front yard for the proposed accessory garage requires an area variance. 3. Town Law &267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing +85% relief from the code. However, the applicant's existing garage has a 1 foot front yard setback. There is approximately 5 feet of turf in the right of way before the edge of the asphalt of Ruch Lane, producing a de facto setback for the proposed garage of 10 feet. The proposed garage will be the same size (20ft. x16.4 ft.) as the existing garage. Ruch Lane is a narrow residential street normally only traversed by persons living within the immediate neighborhood. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a replacement accessory garage, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Horning, seconded by Member Weisman (Chairperson), and duly carried, to GRANT, the variance as applied for, and shown on the survey drawn by John C. Ehlers, Land Surveyor, dated 5- 30-2013, last revised 6-25-2014. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals.
