WITNESSETH, that the party of the first part, to whom ancillary letters
testamentary were issued by the Surrogate's Court, Suffolk County, New York
on October 13, 1995 and by virtue of the power and authority given in and by said last will
and testament, and/or by Article 11 of the Estates, Powers and Trust Law, and in consideration of
NONE (-0-) dollars,
paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and
being at Horton's Point, near Southold, in the Town of Southold, County of Suffolk and State of New York, bounded
and described as follows:
BEGINNING at a concrete monument placed for a bound at the southeast corner of premises herein described on the
westerly side of a 30 foot Right of Way which is also on the westerly line of land now or formerly of George Lewis
and which point of beginning is at the northeast corner of land of Edna T. Haman;
Dist. RUNNING THENCE along said land of Haman, North 61 degrees 14 minutes West a distance 236.87 feet to a
1000 monument and land of Betty Parsons;

050.00 RUNNING THENCE along land of Betty Parsons, North 28 degrees 46 minutes East a distance of 82.68 feet to
Block land of the Southold Park District;

Lot RUNNING THENCE along said land last mentioned the following three (3) courses and distances:
012.000 1. South 73 degrees 24 minutes 10 seconds East a distance of 231.72 feet to a monument;
2. South 58 degrees 34 minutes 40 seconds East a distance 25.57 feet to a monument;
3. South 40 degrees 41 minutes 20 seconds East a distance of 21.64 feet to the 30 foot Right of Way
and said land now or formerly of Lewis;
RUNNING THENCE along the westerly side of said Right of Way and the land now or formerly of Lewis, South
44 degrees 52 minutes 20 seconds West a distance 127.76 feet to the point or place of beginning.
TOGETHER WITH the use, in common with others, of a Right of Way, 30 feet in width from the easterly corner
of the premises and adjacent thereto for the full extent thereof, southwesterly about 250 feet, together with the right
to the use, in common with others, of a right of way 30 feet in width overland of Walter E. Hyatt, extending from
the northerly line of the above mentioned right of way southeasterly abut 900 feet to Sound View Avenue.
SUBJECT to right of way and easements now granted or to be granted to the Long Island Lighting Company for the
purpose of erecting public utility lines on the surface or below the surface of aforesaid rights of way.
SUBJECT to the following covenants and restrictions:
1. That neither the party of the second part, nor heirs shall or will manufacture, or sell or cause or permit to
manufactured or sold,
on
any portion of the premises hereby conveyed, any goods or merchandise or any kind, and

will not carry on, or permit to be carried on, on any part of said premises, any trade or business whatsoever, or any
boarding house.
2. That no outside toilets or waterclosets will be erected on any part of said premises.
3. That no trailers or tents will be kept, used or allowed upon said premises except when kept within an
enclosed building or garage.
4. That said covenants are declared to be and shall be covenants attached to and running with the land. The
said restrictions may be released or altered by Edna Rochford Bennett part at any time.
BEING AND INTENDED TO BE the same premises described in the deed of Virginia Bennett Moore Moss
herein by deed from Edna Terry Harnan and Virginia Bennett Moore Moss dated December 3, 1976, recorded in the
Suffolk County Clerk's Office on December 7, 1976, in Liber 8153, Page 392.
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof,
TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's
death in said premises, and also the estate therein, which the party of the first part has or has power to convey or
dispose of, whether individually, or by virtue of said will or otherwise,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of improvement before using any part of the total of the same for any other purpose. The word
"party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
