HomeMy WebLinkAboutLL-1992 #30LOCAL LAW NO. 30 , 1992 A Local Law in Relation to Permit Fees BE IT ENACTED. by the Town Board of the Town of Southold as follows: Chapter 100 (Zoning) of the Code of the Town of Southold is hereby amended as follows: Section 100-274 (fees) of the Code of the Town of Southold is hereby amended to read as follows: Applications to the Board of Appeals for any relief herein shall be accompar~ied by a fee as hereinafter provided: For applications involving fences, accessory structures or accessory buildings, alterations or additions containing less than two hundred (200) square feet in floor area, the fee shall be one hundred fifty dollars ($150.00). For all other applications, including those involving commercial property, containing a single request [for example, an application requesting one (1) variance or an application request a special exception], the fee shall be bhree htrnd~cl d'c~'l"~'~-'~$308'~88~' four hundred dollars ($~oo.oo). I have affidavits from The Suffolk Times, and The Traveler-Watchman, that it was published, and a notice that it was posted on the Town Bulletin Board by Judith Terry. I have some communcation. I have one. The following resolution was adopted by the Southold Town Planning Board at its meeting bled on Monday, November 2, 1992. Be it resolved that the Southold Town Planning Board has reviewed this proposed legislation which calls for the amendment of the application fees of theZoning Board .of Appeals and of the Building Department and has no comment or objection to same. Bennet Orlowski. SUPERVISOR HARRIS: Is there any member of the audience, that would like to speak in reference to this Local Law change? MARGARET BROWN: Margaret Brown. I just had a question. D, E, and F under Section 1, I have the paper here, did you decide not to put those..they look like new? COUNCILMAN LIZEWSKI: I just went back and read them. MARGARET BROWN: Not D, E, and F. SUPERVISOR HARRIS: Yes, he did. MARGARET BROWN: Not for application for interpretations. SUPERVISOR HARRIS: Yes, he did. He inadvertently skipped over those, Margaret in the original reading, went back, and added those sections. Pg 4 - PH LL Permit f~ MARGARET BROWN: Okay, then I have a question on wineries. You include wineries, now. You don't mention anything about farms. Are wineries considered separate from farms, or other agriculural businesses? I was wondering why then thinking that farms, and wineries, and grapes, it's a different name for a grape farm, and a fruit farm. COUNCILWOMAN HUSSIE: You're thinking of vineyards. Vineyards, and farms, are the same, but a winery is different. MARGARET BROWN: A winery.. COUNCILMAN PENNY: They require a site plan. MARGARET BROWN: Okay. And a in-ground swimming pool? You have a very different fee for inground, and above-ground pool, and it's almost as if you're encouraging obove-ground pools with the little fee, which I think ~re not as attractive as inground pools. You added above ground pools. Before that it didn't seem to matter what kind of swimming pool it was, no matter what you had to pay, $150.00 to get an application. COUNCILMAN PENNY: The above ground was added. This was a recommendation from the Building Department, because the inspection requirements of an inground pool are a lot more strigent. It takes a lot more time. There is a lot more fencing involved. You have electric services. It's a much more intensive thing, then just coming and looking at something that you can buy at K-Mart, and install yourself in the backyard. It's an entirely different program all together.
