WITNESSETH,that the party of the first part,in consideration of Ten Dollars($10.00)and other valuable
consideration paid by the party of the second part,does hereby grant and release unto the party of the second
part,the distributees or successors and assigns of the party of the second part forever,
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,situate,
lying and being on Fishers Island, in the Town of Southold,County of Suffolk and State of New York,
more particularly bounded and described'as follows:
BEGINNING at a stone monument set on the northerly side of a road 40 feet wide,said monument being
6,538 and 47/100 feet west of a point which is 124 and 42/100 feet north of another monument marking the
U.S. Coast & Geodetic Survey Triangulation Station "Chocomount 2" (which said "Chocomount 2"
monument is located on the summit of the highest hill on Fishers Island New York about 2'/,miles west of
the eastern end of Fishers Island and lies south 79 degrees 29 minutes and 46 seconds east of north
Dumpling Light in Fishers Island Sound);and running thence westwardly along the northerly side of said
road(and following the are of a curve to the left whose radius is 976 and 40/100 feet and the direction of
whose radius at that point is south 12 degrees I minute and 42 seconds east)288 and 4/100 feet to an iron
pipe;thence still along the northerly side of said road,south 61 degrees 4 minutes and 10 seconds west 15
and 48/100 feet to an iron pipe;thence north 26 degrees 2 minutes and 45 seconds west 174 and 45/100
feet to an iron pipe,thence north 54 degrees and 9 minutes west 122 and 73/100 feet to an iron pipe;thence
north 15 degrees 57 minutes and 20 seconds east 147 and 28/100 feet to an iron pipe on the shore of Fishers
Island Sound;thence with the meanders of said Sound,south 48 degrees and 26 minutes east 83 and 62/100
feet;north 82 degrees 52 minutes and 30 seconds east 80 and 62/100 feet;north 44 degrees 18 minutes and
40 seconds east 58 and 70/100 feet;north I I degrees 7 minutes and 40 seconds east 62 and 17/100 feet;
and north 76 degrees 20 minutes and 50 seconds east 193 and 7/100 feet to an iron pipe;and thence south
5 degrees 26 minutes and 20 seconds east,passing 2 iron pipes 367 and 6/100 feet to the monument at the
place of beginning;containing approximately 2.98 acres.
Said premises are also known as 6180 Clay Point Road,Fishers Island,NY 06390 and designated as District
1000,Section 002.00,Block 01.00 and Lot 006.000.
TOGETHER with all land if any,between the meander lines above mentioned and the highwater line of
Fishers Island Sound,to the land under the waters of Fishers Island Sound and in and to any land which
may lie between the meander lines as aforesaid and the actual shore line.
TOGETHER with an easement for ingress to and egress from the premises above described over and along
such private road connecting the said premises to the nearest public highway.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated
June 26, 2002, recorded in the Office of the Clerk of the County of Suffolk on July 20, 2002, in Liber
D00012198 at Page 456.
TOGETHER with all the right,title and interest,if any,of the party of the first part in and to any streets
and roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said
premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the distributees
or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose.
AND the parties hereto acknowledge that the premises transferred by operation of law on June 26,2012
from the party of the first part to the party of the second part pursuant to the terms of that certain Thomas
W.Cashel Qualified Personal Residence Trust Agreement dated as of June 26,2002 and that this deed is
being recorded to confirm and evidence such transfer in the real estate records of the Office of the County
Clerk of Suffolk County.
