A Local Law in Relation to Electrical Inspectors
BE IT ENACTED. by the Town Board of the Town of Southold as follows:
Chapter 43 (Electrical Inspections) of the Code of the Town of
$outhold is hereby amended as follows:
Section 43-2 (Designation of Inspectors) of the Code of the Town
of Southold is hereby amended to read as follows:
The Chief Inspector and each of the duly appointed inspectors
of the New York Board of Fire Underwriters are hereby
designated as Electrical Inspectors of the Town of Southold and
are authorized and deputized as agents of the Town of Southold
to make inspections and reinspections of all electrical
installations heretofore and hereafter described, and to approve
or disapprove the same, In no event, however, will the cost or
expense of such inspections and reinspections be a charge
against the Town of Southold. The Town Board may also
designate, by resolution, orqanizations other than the New York
Board of Fire Underwriters as Electrical Inspectors to make
inspections and reinspections of all electrical installations
heretofore and hereafter described, and to approve or
disapprove the same provided that said inspection orqanizations
annually submit proof of insurance in such form and amounts as
is deemed satisfactory by the Town Attorney. naming the Town
of Southold as a named insured,
Section 43-3(A) (Duties of Electrical Inspector) of the Code of
the Town of Southold is hereby amended to read as follows:
It shall be the duty of the Electrical Inspector to report
in writing to the Building Inspectors, whose duty it shall
be to enforce all provisions of this chapter, all
violations or deviations from or omissions of the
electrical provisions of the Building Code applicable to
the Town of Southold and all local laws. ordinances and the
Building Code as referred to in this chapter insofar as any
of the same apply to electrical wiring. The Inspector
shall make inspections and reinspections of electrical
installations in and on properties in the Town of Southold
upon the written request a Building Inspector of the Town
of Southold or as herein provided. The Inspector is
authorized to make inspections and reinspections leading to
the issuance of a certificate of compliance of the New York
Board of Fire Underwriters or any other orqanization duly
desic~nated by the Town Board of electrical wiring,
installations, devices, appliances and equipment, in or on
properties within the Town of Southold where a building
permit has been issued by the Building Department of the
Town of Southold or where a property owner or electrical
contractor requests such an inspection. Applications for
such inspections are to be made directly to the New York
Board of Fire Underwriters or any other organization duly
desiqnated by the Town Board. In addition, application for
a temporary certificate must be made directly to the New

change in electrical service. In the event of an
emergency, it is the duty of the Inspector to make
electrical inspections upon the oral request of an official

Relation to Electrical Inspectors", and Councilman Penny has proof of publication
and verification of such.
COUNCILMAN PENNY: "Public Notice is hereby given that there has been presented
to the Town Board of the Town of Southold, Suffolk County, New York, on
the 21st day of January, 1992, a Local Law entitled, "A Local Law in Relation

SUPERVISOR HARRIS: Are there any members of the audience, that would like
to speak either pro, or con, in reference to amending this Local Law? Yes,
step forward, and state your name, please.
JOHN LADEMANN: John Lademann. I'm a resident of Southold Town, and I'm
involved in electrical work, installations, or investigations, formerly been in
business. My family has been in the electrical line since 1945. There are a
few questions, that I'd like to ask the Board, and I am in favor of this Local
Law. One of the questions is, have the electrical contractors in the town been
notified, except by this public notice in the paper of this public hearing?
SUPERVISOR HARRIS: This is the standard procedure for notifying the public.
It is put in both papers. This is the procedure.
JOHN LADEMANN: It does affect our business. Another question, the electrical
inspections, they're going to be employees of the agency, or the coorporation,
doing the electrical inspections, correct? They're not going to be subcontractors?
SUPERVISOR HARRIS: The reason why we put this change forward for the
public to either reject it, or approve, and of course the Board ultimately, is
based on the fact that in other towns we have found that this is a restriction
of trade by allowing one private organization to have a license in the town,
and no others will be able to come in. We found to be as, I said, not only a
restriction of trade, but it's basically unconstitutional. Based on that, we have
put forth, as long as the State of New York certifies a company with the court
credentials, such as Underwriters has right now in our Code, private organiza-
tion, and the Town Board once authorizes this to this company to come into
the town to operate, they will do so once, and then after that the certification,
the creditation. In other words, the approval of the Town Board, but also
by the State of New York, originally and ultimately, and that is why the Board
has proceeded to make this minor change. It is a minor change. Before it
was exclusionary because there was one company, private company, and now
it opens it up to others, that there are other, such as Brookhaven Town has
done to other companies, that may have the same credentials, and qualifications,
certified by the State of New York.
JOHN LADEMANN: I'm worried, what happened five years ago, worked with
the Local 25 National Electrical Contractors Association. The people were losing
mortgage committments, because they couldn't get certifications to get mortgages,
and this was a big problem, especially when things were booming, you couldn't
get the inspections.
SUPERVISOR HARRIS: This was brought to our attention about a month ago,
and once it was brought to the Town Attorney's attention, it was made available
to the Town Board.
JOHN LADEMANN: In Islip Town, Babylon, and Smithtown, and Brookhaven,
it is working out, but a couple of questions. When violations are issued by
an inspector for any agency, even they go to the Building Department, and
not just to the electrician?
SUPERVISOR HARRIS: The standard procedure, as far as I know, is the Building
Department is the Code Enforcement Officer. We also have an Ordinance Inspector,
and violation that is found upon inspection of such, then notification goes out
as standard procedure. Maybe the Town Attorney would address that. We
didn't change anything in that respect at all.

JOHN LADEMANN: Do I understand that the violations he has twenty days to
correct them, and then the home owner is supposed to be notified, and I don't
know whether the town is notified, but it's something to look into, that the
Town is aware if there are violations on the property. Another thing, the Code
says that all inspectors are deputized, is this the case? I think they should
be. Your ordinance says they should be deputized, so they are like an official.
SUPERVISOR HARRIS: They are officials of the Town. Again, I refer to the
Town Attorney, if he has any response.
TOWN ATTORNEY ARNOFF: I don't. I believe they are at this point, and
assume it would apply to any agency, that came in.
SUPERVISOR HARRIS: You're talking about the Building Inspectors, am I right?
Are you talking about Underwriters and so on? Is that what you're talking
about? I misunderstood your question.
JOHN LADEMANN: I address the underwriters. The town should be informed
of these inspections.
COUNCILMAN PENNY: That was part of the public hearing notice, that I read,
the deputization. Individually, outside of what it says in the law?
JOHN LADEMANN: Individually, if they're going to make an inspection in town.
Also, I'd like to see a copy of all electrical applications be on file with the Building
Department.
SUPERVISOR HARRIS: Thank you for bringing these matter to our attention,
and I'm sure that Town Attorney will also look into some of this. Anybody else?
FRANK CARLIN: Frank Carlin. Just one question, will these inspections be
certified by New York State?
SUPERVISOR HARRIS: Yes, they have to be. Similar to what the organization
is in our Code now, Underwriters Laboratory. Is there any other members of
the audience, that would like to address this Board on this issue? (No response.)

expense of such inspections and
reinspections be a charge against
the Town of Southold. The
_Town Board may also designate,
by resolution, organizations
other than the New York Board
9f Fire Underwriters as Elec-
trical Inspectors to make inspec-
tions and reinspeetions of all
electrical installations heretofore
and hereafter described, and to
approve oi' disapprove the same
provided that said inspection
organizations annually submit
proof of insurance in such form
and amounts as is deemed
satisfactory by the Town At-
torney, naming the Town of
Southold as a named insured.
2. Section 43-3(A) (Duties of
Electrical Inspector) of thc code
of the Town of Southold is
hereby amended to read as
follows:
A. It shall be the duty of the
Electrical Inspector to report in
writing to the Building Inspec~
tors, whose duty it shall be to
enforce all provisions of this
chapter, all violations or devia-
tions from or omissions of the
electrical provisions of the
Building Code applicable to the
Town of Southold and all local
laws, ordinances and the
Building Code as referred to in
this chapter insofar as any of the
same apply to electrical wiring.

an emergency, it is the duty of
the Inspector to make electrical
inspections upon the' oral re-
quest of an official or an officer
of the Town of Southold.
II. This Local Law shall take
effect upon its filing with the
Secretary of State.
