Box 1179 Southold,NY 11971 Re: Qualification Statement Question#12 Response Regarding Labor Law Violation To Whom It May Concern: This letter outlines the facts regarding Chesterfield Associates' past audit with the Department of Labor, Bureau of Public Works (DOL). The DOL determined that Chesterfield had underpayments on five projects from 1995-1998. Over 90% of these alleged underpayments are based on the DOL's recent interpretation of how prevailing wage benefit supplement payments are to be calculated. The new method is called "annualization." In sum, under annualization, even if a contractor pays every penny of benefits that they are required to on public work, the DOL will not "count" it unless that contractor pays prevailing rate on its private work, too. The net effect of this is to put every open shop contractor doing public work at risk. The only willful aspect of the case was for underpayments of wages due to clerical errors by the payroll clerk employed at the time. Although Chesterfield was charged with underpayments of wages on a willful basis, it was proved during the DOL hearings that both overpayments and underpayments were made to employees.
