Wounded Warrior Project "Soldier Ride"
Financial Impact:
Police Department cost for Event = $704.00
RESOLVED the Town Board of the Town of Southold hereby grants permission to the Wounded
Warrior Project Soldier Ride to hold its Fifth Annual North Fork Soldier Ride and 5K on
Saturday, September 13, 2014 beginning at 8:30 AM in Greenport. The Kick-off Ceremony and
5K takes place in Greenport; the 12 and 30 mile rides begin in Greenport on Route 25 and heads
west using the following roads, then returns to Greenport: Ackerly Pond Lane, Old North Road,
Route 48, Moores Lane, New Suffolk Road, Grathwohl Road,New Suffolk Avenue, Reeve
Road, Wickham Avenue, Mill Lane, Oregon Road, Bridge Lane, Mill Road, Peconic Lane, and
Soundview Avenue provided they adhere to the Town of Southold Policy for Special Events on
Town Properties and Roads. Support is for this year only, as the Southold Town Board continues
to evaluate the use of town roads. All Town fees for this event, with the exception of the Clean-
up Deposit, are waived.

Create Capital Budget for Grove Road Stormwater Mitigation Project funded by NYS DEC grant
WHEREAS the Town of Southold has been awarded a$193,844 grant from the New York State
Department of Environmental Conservation Aid to Localities (C303426) for Stormwater Control
Infrastructure Upgrades and Mitigation on Grove Road that requires no match from the Town,

HHW Grant Application 2014-2015
WHEREAS, the State of New York provides financial aid for household hazardous waste
programs; and
WHEREAS the Town of Southold, herein called the Municipality, has examined and duly
considered the applicable laws of the State of New York and the Municipality deems it to be in
the public interest and benefit to file an application under these laws; and
WHEREAS, it is necessary that a Contract between the People of the State of New York, herin
called the State, and the Municipality be executed for such State aid;
NOW, THEREFORE, BE IT
RESOLVED by the Town Board of the Town of Southold:
1. That the filing of an application in the form required by the State of New York in conformity
with applicable laws of the State of New York including all understanding and assurances
contained in said application is hereby authorized;
2. That Supervisor Scott A. Russell or his designee is directed and authorized as the official
representative of the Municipality to act in connection with the application and to provide
such additional information as may be required and to sign the resulting contract if said
application is approved by the State;
3. That the Municipality agrees that it will fund the entire cost of said Household Hazardous
Waste Program and will be reimbursed by the State for the State share of such costs;
4. That five (5) certified copies of this Resolution be prepared and sent to the NYS
Department of Environmental Conservation together with a complete application.
5. That this resolution shall take effect immediately.

BOND RESOLUTION OF THE TOWN OF SOUTHOLD, NEW
YORK, ADOPTED JUNE 17, 2014, AUTHORIZING THE
REPLACEMENT OF THE BAY AVENUE BRIDGE, STATING
THE ESTIMATED MAXIMUM COST THEREOF IS $800,000,
APPROPRIATING SAID AMOUNT FOR SUCH PURPOSE,
AND AUTHORIZING THE ISSUANCE OF BONDS IN THE
PRINCIPAL AMOUNT OF NOT TO EXCEED $800,000 TO
FINANCE SAID APPROPRIATION
THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF
SUFFOLK, NEW YORK, HEREBY RESOLVES (by the favorable vote of not less than two-
thirds of all the members of said Town Board) AS FOLLOWS:
Section 1. The Town of Southold, in the County of Suffolk, New York (herein
called the "Town"), is hereby authorized to replace the Bay Avenue Bridge. The estimated
maximum cost thereof, including preliminary costs and costs incidental thereto and the financing
thereof, is $800,000 and said amount is hereby appropriated for such purpose. The plan of
financing includes the issuance of not to exceed $800,000 bonds of the Town to finance said
appropriation, and the levy and collection of taxes on all the taxable real property in the Town to
pay the principal of said bonds and the interest thereon as the same shall become due and
payable.
Section 2. Bonds of the Town in the principal amount of not to exceed $800,000
are hereby authorized to be issued pursuant to the provisions of the Local Finance Law,
constituting Chapter 33-a of the Consolidated Laws of the State of New York (herein called the
"Law"), to finance said appropriation.
Section 3. The following additional matters are hereby determined and declared:
(a) The period of probable usefulness applicable to the objects or purposes for
which said bonds are authorized to be issued, within the limitations of Section 11.00 a. 10 of the
Law, is twenty (20) years.
(b) The proceeds of the bonds herein authorized and any bond anticipation notes
issued in anticipation of said bonds may be applied to reimburse the Town for expenditures made
after the effective date of this resolution for the purposes for which said bonds are authorized.
The foregoing statement of intent with respect to reimbursement is made in conformity with
Treasury Regulation Section 1.150-2 of the United States Treasury Department.
(c) The proposed maturity of the bonds authorized by this resolution will exceed
five (5) years.
(d) The Town Board of the Town, acting in the role of Lead Agency pursuant
to the provisions of the New York State Environmental Quality Review Act ("SEQRA"), has
determined that the project described in Section 1 hereof is a Type 11 action pursuant to the State
Environmental Quality Review Act (SEQRA), constituting Article 8 of the Environmental
Conservation Law, and 6 N.Y.C.R.R., Regulations Part 617, and no further environmental

review is required pursuant to SEQRA.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of the sale of said bonds shall contain the recital of
validity as prescribed by Section 52.00 of the Law and said bonds and any notes issued in
anticipation of said bonds shall be general obligations of the Town, payable as to both principal
and interest by general tax upon all the taxable real property within the Town. The faith and
credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of
and interest on said bonds and any notes issued in anticipation of the sale of said bonds and
provision shall be made annually in the budget of the Town by appropriation for (a) the
amortization and redemption of the bonds and any notes in anticipation thereof to mature in such
year and (b)the payment of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and
pursuant to the provisions of Section 21.00 relative to the authorization of bonds with
substantially level or declining annual debt service, Section 30.00 relative to the authorization of
the issuance of bond anticipation notes and Section 50.00 and Sections 56.00 to 60.00 and
Section 168.00 of the Law, the powers and duties of the Town Board relative to authorizing bond
anticipation notes and prescribing the terms, form and contents and as to the sale and issuance of
the bonds herein authorized, and of any bond anticipation notes issued in anticipation of said
bonds, and the renewals of said bond anticipation notes, and as to the execution of agreements
for credit enhancements, are hereby delegated to the Supervisor, the chief fiscal officer of the
Town.
Section 6. The validity of the bonds authorized by this resolution, and of any
notes issued in anticipation of the sale of said bonds, may be contested only if:
(a) such obligations are authorized for an object or purpose for which the
Town is not authorized to expend money, or
(b) the provisions of law which should be complied with at the date of
publication of such resolution, or a summary thereof, are not substantially
complied with,
and an action, suit or proceeding contesting such validity is commenced within twenty days after
the date of such publication, or
(c) such obligations are authorized in violation of the provisions of the
constitution.
Section 7. This bond resolution is subject to a permissive referendum and the
Town Clerk is hereby authorized and directed, within ten (10) days after the adoption of this
resolution, to cause to be published in "The Suffolk Times, " a newspaper having a general
circulation within said Town and hereby designated the official newspaper of the Town for such
publication and posted on the sign board of the Town maintained pursuant to the Town Law, a
Notice in substantially the following form:

Southold, in the County of Suffolk, New York, adopted a bond resolution entitled:

BOND RESOLUTION OF THE TOWN OF SOUTHOLD, NEW
YORK, ADOPTED JUNE 17, 2014, AUTHORIZING THE
ACQUISITION OF A COMBINATION DUMP/PLOW/SANDING
TRUCK FOR USE BY THE HIGHWAY DEPARTMENT,
STATING THE ESTIMATED MAXIMUM COST THEREOF IS
$185,000, APPROPRIATING SAID AMOUNT FOR SUCH
PURPOSE, AND AUTHORIZING THE ISSUANCE OF BONDS
IN THE PRINCIPAL AMOUNT OF NOT TO EXCEED $185,000
TO FINANCE SAID APPROPRIATION
THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF
SUFFOLK, NEW YORK, HEREBY RESOLVES (by the favorable vote of not less than two-
thirds of all the members of said Town Board) AS FOLLOWS:
Section 1. The Town of Southold, in the County of Suffolk, New York (herein
called the "Town"), is hereby authorized to acquire a combination dump/plow/sanding truck for
use by the Highway Department. The estimated maximum cost thereof, including preliminary

costs and costs incidental thereto and the financing thereof, is $185,000 and said amount is
hereby appropriated for such purpose. The plan of financing includes the issuance of not to
exceed $185,000 bonds of the Town to finance said appropriation, and the levy and collection of
taxes on all the taxable real property in the Town to pay the principal of said bonds and the
interest thereon as the same shall become due and payable.
Section 2. Bonds of the Town in the principal amount of not to exceed $185,000
are hereby authorized to be issued pursuant to the provisions of the Local Finance Law,
constituting Chapter 33-a of the Consolidated Laws of the State of New York (referred to herein
as the "Law"), to finance a part of said appropriation.
Section 3. The following additional matters are hereby determined and declared:
(a) The period of probable usefulness applicable to the object or purpose for
which the said $185,000 bonds are authorized to be issued, is five years or longer; however, the
bonds authorized pursuant to this resolution and any bond anticipation notes issued in
anticipation of the sale of said bonds, shall mature no later than five (5) years after the date of
original issuance of said bonds or notes.
(b) The proceeds of the bonds herein authorized and any bond anticipation
notes issued in anticipation of said bonds may be applied to reimburse the Town for expenditures
made after the effective date of this resolution for the purpose for which said bonds are
authorized. The foregoing statement of intent with respect to reimbursement is made in
conformity with Treasury Regulation Section 1.150-2 of the United States Treasury Department.
(c) The proposed maturity of the bonds authorized by this resolution will not
exceed five years.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of the sale of said bonds shall contain the recital of
validity as prescribed by Section 52.00 of the Law and said bonds and any notes issued in
anticipation of said bonds shall be general obligations of the Town, payable as to both principal
and interest by a general tax upon all the taxable real property within the Town. The faith and
credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of
and interest on said bonds and any notes issued in anticipation of the sale of said bonds, and
provision shall be made annually in the budget of the Town by appropriation for (a) the
amortization and redemption of the bonds and any notes in anticipation thereof to mature in such
year and (b)the payment of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and
pursuant to the provisions of Section 21.00 relative to the authorization of the issuance of bonds
with substantially level or declining annual debt service, Section 30.00 relative to the
authorization of the issuance of bond anticipation notes and Section 50.00 and Sections 56.00 to
60.00 and 168.00 of the Law, the powers and duties of the Town Board relative to authorizing
bond anticipation notes and prescribing the terms, form and contents and as to the sale and
issuance of the bonds herein authorized, and of any bond anticipation notes issued in anticipation
of said bonds, and the renewals of said bond anticipation notes, and as to executing contracts for
credit enhancements and providing for substantially level or declining annual debt service, are
hereby delegated to the Supervisor, the chief fiscal officer of the Town.
Section 6. The validity of the bonds authorized by this resolution, and of any
notes issued in anticipation of the sale of said bonds, may be contested only if:
(a) such obligations are authorized for an object or purpose for which the

Town is not authorized to expend money, or
(b) the provisions of law which should be complied with at the date of the
publication of such resolution, or a summary thereof, are not substantially
complied with,
and an action, suit or proceeding contesting such validity is commenced within twenty days after

(c) such obligations are authorized in violation of the provisions of the
constitution.
Section 7. This bond resolution shall take effect immediately, and the Town
Clerk is hereby authorized and directed to publish a summary of this bond resolution, in
substantially the form set forth in Exhibit A attached hereto and made a part hereof, together
with a Notice attached in substantially the form prescribed by Section 81.00 of the Law in "The
Suffolk Times, " a newspaper published in Southold, New York, having a general circulation in
the Town and hereby designated the official newspaper of said Town for such publication.

II. Chapter 260 of the Code of the Town of Southold is hereby amended as follows:
§260-13. Stopping prohibited at all times.
The stopping of vehicles is hereby prohibited at all times in any of the following
locations and at any other location where signage indicates "no stopping":

COUNCILMAN RULAND: Please. Well, I guess I have lived in Mattituck a long time and
what we are seeing is growing pains probably more than anything. We have gone from a very

small, underutilized hamlet to a much invigorated very used hamlet with more people and more
cars. In light of recent developments, having made several visits to the site, I can't see that we
can come up with a better situation that is safe. The street just isn't wide enough to allow
parking and traffic to pass at the same time and someone either is going to get hurt or some
vehicle or car is going to get damaged. And that is certainly not what we want. I am certainly
not one that wants to impose additional restrictions because the business people there are
somewhat against it anyhow because parking is at a premium but at the same time, I think that
having it defined will let people know where they can and where they can't whereas now there
are some sections that aren't marked so people say they can when they really shouldn't and
probably now it is going to say they can't and the rest will be up to traffic control.

to go first? Peter?

PETER TERRANOVA: Good afternoon, thank god this meeting is shorter than the last one. It
was a long one. Tonight's presentation is a continuation of bringing relevant facts to the
attention of the Town Board regarding the proposal to shorten the Goldsmith's inlet jetty. I have
got some photos to help you visualize the concept. The Goldsmith's inlet jetty was constructed
50 years ago in 1964 by the County of Suffolk and New York State to address shoreline erosion
on the west side of the inlet. Under the New York State Department of Public Works, the work
was labeled as beach protection project 192. Now the jetty was built to the length of 300 feet
from the mean high water line, give or take 10 feet, with an additional 100 feet or so landward as
an anchor. So the proposed 125 foot reduction is actually a 42 percent reduction not 33 percent
as stated in the town's original project proposal. You can see a view of the jetty recently taken in
photo 1. Now most folks think that the jetty was built to protect the 10 beachfront homes of
Peconic Sound Shores. In fact, the jetty was built to its current length to also protect a section of
bluff to the immediate west and the homes that existed there at that time. The actual impact of
the jetty's protection extends about 1,600 feet to the west protecting a significant section of the
bluff and the 10 homes that are now located there. and you can see this in photo's 2, 3 and 4.
Just west of the protection made possible by the jetty, you can see the current bluff erosion.
That's in photo 5, 6 and 7. This is on the unprotected section of the bluff. So here is my
question, should the town proceed to shorten the jetty, will it be prepared to construct bulkheads
or install armoring to protect these bluff and homes that are now protected by natural vegetation
and sand dunes that were allowed to establish themselves because of the protection provided by
the jetty? A 42 percent reduction in jetty length will expose this section of bluff to the same
erosion that you see to the west in photo's 5, 6 and 7. As well as expose the lower lying homes
of Peconic Shores to flood damage. Now that 42 percent reduction amounts to almost 700 foot
section of bluff that is now protected by sand dunes and vegetation that would be wiped out. It is
noteworthy that prior to the construction of the jetty there was little if any, new construction or

significant investment in the properties in this area. Which includes the bluff and Peconic Sound
Shores. It was only after the establishment of the protection afforded by the jetty that the
community expanded and significant investment was made in existing properties. Now that
concludes really my presentation of facts which argue for preserving the jetty at its current
length. The Town Board has enough facts to make an intelligent decision. there are many more
facts, by the way, to support the argument but they all say the same thing, leave the jetty at its
current length. Now opponents of the jetty have presented no facts, no studies to support their
position. They have presented though, hard felt emotion which I am sure is genuine but it is
irresponsible to embark upon an irreversible project on the basis of emotion. Now the last two
meetings, I believe I heard twice, we need to restore the littoral drift from opponents of the jetty.
Do they even know what that is? Because even the coastal experts have no idea how much
sediment is actually being moved and where by the forces of mother nature. It has never been
studied. Even assume this 300 foot structure was altering the drift, I hear no calls to shorten
Mattituck inlet jetty, four and a half times the length of the Goldsmiths jetty with the Mattituck
jetty being 1,320 feet long. Perhaps it's because they can't see the Mattituck inlet jetty. But let
us say miraculously, you could drop a large amount of sand on Kenney's and McCabe's beach.
What would be the plan to keep it there? Just this past week I believe was an article in Newsday
about the plan to pump sand onto the beaches at Asharoken, further up island from us. They say
they may very well need groins and breakwaters to hold it there. There is no assurance that any
sand you put down on the beach even with pumping is going to stay there. If you are to believe
that the Goldsmiths inlet jetty is responsible for the erosion at Kenney's and McCabe's beach,
then you must also believe that the beach that they once had was due to someone else's erosion.
Not a good argument. As I said many weeks ago, folks deserve the truth. You have all the facts
you need to tell it. So that really pretty much concludes my presentation at this time regarding
the facts. I said I wanted to bring facts to the Town Board and I believe I have done so. Now
photo 8 by the way, is a view of the inlet mouth and I just need to add this. This is on the east
side of the jetty. Notice how the beach is attempting to rebuild itself following the suspension of
the high impact dredging two years ago. And that is a positive. I certainly hope the Town Board
does not embark upon these high impact, deep dredging projects which do nothing but cause
erosion, collapse the banks of the inlet channel. The last set of photographs is the aftermath of
the 12/26/10 nor'easter which did a tremendous amount of damage on the north fork, particularly
Town Beach, if you recall the parking lot was all torn up. But it demonstrates how critical the
jetty and the primary dune system that the jetty created is to the protection of this entire stretch of
shoreline. You have any questions regarding what I have presented in the past session or this
session, again, I am always open to questions, if you question what it is I am presenting, you
know, now's the time to talk about it. if you want to talk about it in private, I can do that also.

SUSAN GEITZ: My name is Susan Geitz and I am a resident of 1580 Leeton Drive. I am very
happy he comes and he presents all these photographs of what his beach looks like. If you would
like, I can present photographs at the next meeting of what our beach looks like due to the jetty.
We now have another inlet coming at the end of the last house that has a bulkhead. At high tide,
there's another inlet going into the dunes, almost up to the dunes. I don't understand why the
county hasn't gotten into this because they have lost so much property that they can't keep boats
down on the beach anymore. The other thing is to say that I'd be prepared to put bulkheads

along the cliff there to protect the houses up there, that's absolutely ridiculous. Nobody paid for
our bulkhead and we have had to replace them twice, at $10,000, $20,000 each time. So I mean
for him to say something like that, are you prepared to put bulkheads there, that's absolutely
ridiculous, alright? I wish that you would come down and see the damage, it's obvious what has
happened. We are now getting ready to present our side, we have 12 boxes of information that
we are going through from the time that we first started this about Goldsmith's inlet. We have
studies by the Army Corps of Engineers that say that the problem even all the way down to
Arshamomaque Cove is due to the Goldsmith inlet jetty. Now I don't know when you
appropriated money for another study at ARshamomaque Cove, have you got a date when that is
going to take place?
SUPERVISOR RUSSELL: The town hasn't allocated any money for a study of
ARshamomaque Cove, there is actually a study underway right now, a coastal study by the Army
Corps of Engineers.
MS. GEITZ: Okay.
SUPERVISOR RUSSELL: That's a pretty broad study. It actually goes to the west of
Goldsmiths all the way up to Arshamomaque. It is a pretty comprehensive, a pretty large study.
A whole coastal study of the whole region.
MS. GEITZ: But the last time they did one, they indicated that it was the Goldsmiths jetty that
was causing the problem.
SUPERVISOR RUSSELL: Part of their study is going to have to include some of their earlier
work and evaluate some of their earlier work.
MS. GEITZ: Okay. The other thing I would like to mention to you, you have appropriated
money for the eradication of the phragmites, it's a lost cause. We had that done on Lake Drive,
maybe five or six years ago. It might even be longer. They pulled them all up or did something
to kill them all so that the natural vegetation could come back, well, we got a few ferns and we
got all the phragmites. So I would look into whether they have some new method of getting rid
of them before you spend your money on that.
SUPERVISOR RUSSELL: We actually, we have success stories out here. I will let Jill speak to
the success of Marion Lake. The one thing about phragmite eradication is it is not a one shot
deal. You have to commit yourself to it year in and year out. Every year you have to be out
there because they will come back. They will come roaring back if you don't. but I think Jill
can speak to the success they have seen in East Marion.
MS. GEITZ: No, I mean, we had cattails there but there's no more cattails.

COUNCILWOMAN DOHERTY: The town has planted cattails in other spots and they haven't
stayed for whatever reason but over the years, in recent years, they find it's best to eradicate the
phragmites in the fall when the rhizomes go dormant for the winter and then you have to do

another application in the spring before they come up and you have to constantly keep up with it
and if you constantly plant native species in between, eventually the native species will take over
but it's not a one shot deal. You have to keep up with it.
