HomeMy WebLinkAboutLL-1990 #10LOCAL LAW NO. 10 - 1990 A LOCAL LAW IN RELATION TO CERTIFICATES OF OCCUPANCY BE IT ENACTED by the Town Board of the Town of Southold as follows: I. Chapter 100 (Zoning) of the Code of the Town of Southold is hereby amended as follows: Article XXVIII, Section 100-284 (Certificates of Occupancy) is amended by changing the lettering of subsection "1" to subsection "H" and by deleting, in its entirety, sub-subsection (1)(e) of that subsection. Terry Town Attorney Harvey A. Arnoff SUPERVISOR HARRIS: The second public hearing of the evening is a proposed "Local Law in Relation to Zoning", amending Article 27, Section 100-284. Tom, would you like to read the publications and notice. COUNCILMAN WICKHAM: "Public Notice is hereby given that there has been presented to the Town Board of the Town of Southold, Suffolk County, New York, on the 10th day of April, 1990, a Local Law entitled, "A Local Law in Relation to Zoning". Notice is further given that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at the Southold Town Hall, Main Road, Southold, New York, on the 8th day of May, 1990, at 8:02 o'clock P.M., at which time all interested persons will be heard. This proposed "Local Law in Relation to Zoning" reads as follows: BE IT ENACTED by the Town Board of the Town of Southold as follows: I. Chapter 100 (Zoning) of the Code of the Town of Southold is hereby amended as follows: I. Section 100-284 (Certificates of Occupancy) is amended by changing the lettering of subsection "l" to subsection "H" and by deleting, in its entirety, sub-section (1)(e) of that subsection. Il. I have here certificates, that this has been published, this official notice has been published with the Suffolk Times, and with the Traveler-Watchman. In addition there's been a certification, that it's been posted here at the Bulletin Board here in Town Hall. I have two pieces of correspondance on it. One from the County of Suffolk. Gentlemen: Pursuant to the requirements of Sections A 14-14 to 23 of the Suffolk County Administrative Code, the above referenced application which has been submitted to the Suffolk County Planning Commission is considered to be a matter for local determination. A decision of local determination should not be construed as either an approval or disapproval. Very truly yours, Arthur H. Kunz, Director of Planning, County of Suffolk. In addition, we have a letter from the Planning Board in the Town of Southold, and I can just summarize, dated April 27, 1990, the Planning Board Pg 2 - PH LL in relation to Zoning has reviewed the proposed amendment and finds it satisfactory. That's all the communications we have, and that's all the points that I'll raise at this time. SUPERVISOR HARRIS: Thank you, Tom. TOWN ATTORNEY ARNOFF: No, I don't have it in front of me. COUNCILMAN PENNY: When we eliminated the vacant land C of O, we left a section in the Code Book, which related to a fee, that we were charging for the vacant land C of O's, and we inadvertantly forgot to remove that section, so we are now removing the section from the fee for something that you can't get even if you pay the fee, and relettering the other sections subsequently.
