HomeMy WebLinkAboutLL-1990 #01LOCAL LAW NO. 1 - 1990 A Local Law in Relation to Taxation BE IT ENACTED by the Town Board of the Town of Southold as follows: Chapter 85 (Taxation) of the Code of the Town of Southold is amended as follows: 1. Section 85-2.A. is amended to read as follows: If the income of the owner or the combined income of the owners of the property for the income tax year immediately preceding the date of making application for exemption exceeds the sum of twelve thousand six hundred dollars ($12,600.00). "Income tax year" shall mean the twelve month period for which the owner or owners filed a personal income tax return or, if no return is filed, the calendar year. Where title is vested in either the husband or the wife, their combined income may not exceed such sum. Such income shall include social security and retirement benefits; interest; dividends; total gain from the sale or exchange of a capital asset, which may be offset by a loss from the sale or exchange of a capital asset in the same income tax year; net rental income; salary or earnings; and the net income from self-employment, but not including a return of capital, gifts or inheritances. In computing net rental income and net income from self employment, no depreciation deduction shall be allowed for the exhaustion, wear and tear of real or personal property held for the production of income. COUNCILWOMAN OLIVA: "Public Notice is hereby given that there has been presented to the Town Board of the Town of Southold, Suffolk County, New York, on the 23rd day of January, 1990, a Local Law entitled, "A Local Law in Relation to Taxation". Notice is further given that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at the Southold Town Hall, Main Road, Southold, New York, on the 6th day of February, 1990, at 8:10 o'clock P.M., at which time all interested persons will be heard. Terry. Thank you. SUPERVISOR HARRIS: Thank you, Ruth. At this time, we'll go out to the audience, and ask if anyone would like to comment on this public hearing? (No response.) Anybody on my left? Hearing none, I'll close this public hearing, and make one further comment, that this piece of legislation was needed in this town to keep up with the rising costs. This was mentioned tonight earlier. It's only equitable that this town keep up with the County of Suffolk, when they increased their age exemption. This was brought to me by one of the laisons to the senior citizen groups, that exist in Southold Town, and at his urging, asked if we could not consider this. I did consider this. We did consider this, and that's why we're having this public hearing. The State of New York obviously recognized that this legislation, which was passed by them, also, was needed. At this time, any comments from the Town Board members on this public hearing? (No response.) I'll close the public hearing. Judith T.
