Since the sand to be removed is a result of the littoral drift, the Southold Town Board of Trustees would suggest that the applied for 375 c.y. placed on the north side of the channel, where it can continue to function as beach nourishment. A detailed description and plans of the applicant's activity are enclosed to assist ir.your review. The decision whether to issue a permit will be based on an evaluation of the probable impact, including cumulative impacts, of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands,historical properties, fish and wildlife values, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, consideration of property ownership and,in general the needs and welfare of the people. The Corps of Engineers is soliciting comments from the public;Federal, state, and local agencies and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision,comments aroused to assess H'mpacts on endangered species,historic properties,water quality, general environmental effects, and the other public interest factors listed above. Comments are used in preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Our preliminary determination is that the activity for which authorization is sought herein is not likely to atlect any Federally endangered or threatened species or their critical habitat. However, pursuant iib Section 7 of the Endangered Species Act (16 11.S C 1531), the District Engineer is COilsu►ting euith the appropriate Federal agency to determine the presence of and potentiat impacts it) listed specie,. in the project area or their critical habitat. Based upon a review of the latest published version of the National Register of Historic Places, there are no known sites eligible for, or included in, the Register within the permit area. Presently unknown archeological, scientific, prehistorical, or historical data may be lost by work accomplished under the required permit. Pursuant to Section 307 (c) of the Coastal Zone Management Act of 1972 as amended [16 U.S.C. 1456 (c)], for activities under consideration that are located within the coastal zone of a state which has a federally approved coastal zone management program, the applicant has certified in the permit application that the activity complies with, and will be conducted in a manner that is consistent with, the approved state coastal zone management program. By this public notice, we are requesting the state's concurrence with, objection to, or waiver of the applicant's certification. NoIperrnit decision will be made until one of these actions occur. Seebode ,�f.r , Regulatory Branch Enclosures 2 CENAN-OP-RE PUBLIC NOTICE NO. 94-07120-L2 WORK DESCRIPTION The applicant, Wunneweta Pond Association, has requested Department of the Army authorization to dredge material with ten years maintenance from Wunneweta Pond, Little Peconic Bay at Cutchogue, Town of Southold, Suffolk County, New York with subsequent upland disposal. The work would involve dredging material from an approximate 20 foot by 170 foot area in the channel to Wunneweta Pond to a maximum depth of 4 feet below mean low water. Approximately 3,775 cubic; yards of sand and gravel would be removed and spread evenly over a 200 foot x 200 foot area to the west of the dredge site. The material would be removed from the channel by backhoe and a bulldozer would be used to spread it and regrade the disposal site. One to two additional dredging events are anticipated during the ten-year life of the permit, depending on the severity of storm or hurricane conditions, during the 10 year duration of the requested permit. Removal of approximately 100 cubic yards of material from the channel is anticipated during each period of subsequent dredging. The applicant asserts that the disposal site, which has been used previously for such activity, would be able to hold twice as much material as is anticipated. The owner of the disposal site has given his permission for its use in this project. Pursuant to 15 CFR Section 930.63, and based upon the project information submitted, the Department of State concurs with your consistency certification subject to the condition that all dredged material from initial and subsequent dredging activities shall be placed on the west (downdrift) side of the inlet, unless an easement to place the dredged material on the downdrift beach is not granted by the affected upland property owner. This concurrence is without prejudice to, and does not obviate the need to obtain all other applicable licenses, permits, and approvals required under existing State statutes. The inlet to Wunneweta Pond has been partially filled with sand as a result of the recent storms. We will be able to accomplish the removal of this with the use of a back- hoe. No other work is anticipated. The result will be a restoration of normal tidal flow into the pond and the ability to navigate boats in and out of the inlet as we have been able to do in prior years . It is estimated that only approximately 200 cubic yards of sand have to be removed and as you will note, the approval of the property owner has already been sent. I cannot stress enough that until this work is completed, the 30 to 40 boat owners in the pond will be unable to get in and out of the inlet . For this reason I respectfully request that to whatever degree possible , this application be expedited. I shall call you during the beginning of the week .
