Wilcenski, Chairman William J. Cremers, Member Martin H. Sidor, Member Heather Lanza, Planning Director Good afternoon ladies and gentlemen. Welcome to the Special Meeting of July 28, 2014. This Special Meeting is for the Site Plan Determination of the Greenport Harbor Brewery. This proposed Amended Site Plan is for the renovation of three (3) existing buildings, formerly an auto dealership, into a micro-brewery. Buildings 1 & 2 total ±13,000 sq. ft. and contain a micro-brewery production facility; Building 3 is 2,560 sq. ft. with a 2,100 sq. ft. addition and contains a tasting room and brew pub; Building 4 is a new 1,200 sq. ft. equipment storage building, all on 2.89 acres in the General Business (B) Zoning District. The property is located at 42155 Route 25, on the corner of Peconic Lane and NYS Rt. 25, Peconic. SCTM#1000-75-1-14 Member Martin Sidor: Mr. Chairman, I offer the following resolutions: WHEREAS, this proposed Amended Site Plan is for the renovation of three (3) existing buildings, formerly an auto dealership, into a micro-brewery. Buildings 1 & 2 total ±13,000 sq. ft. and contain a micro-brewery production facility; Building 3 is 2,560 sq. ft. with a 2,100 sq. ft. addition and contains a tasting room and brew pub pursuant to ZBA File #6759; Building 4 is a new 1,200 sq. ft. equipment storage building, all on 2.89 acres in the General Business (B) Zoning District, Peconic; and WHEREAS, on April 8, 2014, Richard Vandenburgh, owner, submitted an Amended Site Plan Application for review; and Southold Town Planning Board Page Two July 28, 2014 WHEREAS, at a Work Session held on April 21, 2014, the Planning Board reviewed the application and accepted it as complete with further information and revisions to the Site Plan to be done immediately; and WHEREAS, on April 25, 2014, Richard Vandenburgh submitted the required materials and information to the Planning Department for review; and WHEREAS, on April 30, 2014, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and WHEREAS, the Southold Town Planning Board, pursuant to State Environmental Quality Review (SEQR) 6 NYCRR, Part 617.5, has determined that the proposed action is a Type II Action as it falls within the following description for 6 NYCRR, Part 617.5 (c) (7) "construction or expansion of a primary or accessory/appurtenant, non-residential structure or facility involving less than 4,000 square feet of gross floor area and not involving a change in zoning or a Use Variance and consistent with local land use controls, but not radio communication or microwave transmission facilities", therefore, not subject to SEQRA review; and WHEREAS, on May 15, 2014, the Southold Town Fire Inspector reviewed and determined that there was adequate fire protection and emergency access for the site; and WHEREAS, on May 15, 2014, the Southold Fire District determined there was adequate fire protection for the site; and WHEREAS, on May 28, 2014, the applicant submitted a revised Notice of Disapproval to the Planning Board for a permit to construct a 1,200 sq. ft. storage building requiring an Area Variance from the ZBA; and WHEREAS, on June 2, 2014, a public hearing was held and subsequently closed; and WHEREAS, on June 6, 2014, the Southold Town Architectural Review Committee reviewed the application and provided recommendations to the Planning Board which the Board implemented within the Site Plan design; and WHEREAS, on June 10, 2014, the Town of Southold LWRP Coordinator reviewed the above-referenced project and determined the proposed project to be consistent with Southold Town LWRP policies; and WHEREAS, on June 12, 2014, the Southold Town Engineer reviewed the above- referenced application and required additional information and revisions to the Site Plan; and WHEREAS, on June 19, 2014, the Southold Town Zoning Board of Appeals (ZBA) reviewed the request for Special Exception for a drinking establishment in the General Southold Town Planning Board Page Three July 28, 2014 Business (B) Zoning District. The ZBA subsequently granted the Special Exception as applied for as recorded in their File #6759 subject to the following one (1) condition: The applicant must obtain Site Plan Approval from the Southold Town Planning Board. Failure to do so will render this Special Exception Permit null and void; and WHEREAS, on July 17, 2014, the New York State Department of Transportation (NYSDOT) issued Highway Work Permit#20141039728 to "construct and permanently maintain access & other incidental work on the N/S/O NY 25 between MMS 1591-1592 as per attached plans and specifications. All work shall be in accordance with all current NYSDOT standards/specifications and shall be to the satisfaction of the resident engineer" and expires December 1, 2014; and WHEREAS, on July 21, 2014, the Southold Town Engineer reviewed the above- referenced application and determined that the proposed drainage meets the minimum requirements of Chapter 236 for Storm Water Management; and WHEREAS, at their Work Session on July 21, 2014, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan Approval of the Town of Southold, have been met; and WHEREAS, on July 23, 2014, the Suffolk County Department of Health Services (SCDHS) granted Approval Reference #C10-11-0009 for a Mixed Use at 1,726 gallons per day; and WHEREAS, on July 24, 2014, the Southold Town Zoning Board of Appeals (ZBA) reviewed the Area Variance request for a 1,200 sq. ft. accessory storage building not located in the rear yard in the General Business (B) Zoning District. The ZBA subsequently granted the Area Variance as applied for as recorded in their File #6770; and WHEREAS, on July 24, 2014, Richard Vandenburgh, owner, filed a Covenant and Restriction with the Office of the Suffolk County Clerk as required by the Planning Board under Liber D00012782 Page 099, stating "(1) In the event that the adjacent parcel to the east (SCTM#1000-75-1-15.3) is developed, the Declarant shall construct a connecting sidewalk within 12 months in order to facilitate safe pedestrian access along NYS Rt. 25. The sidewalk shall be constructed in compliance with all pertinent New York State Department of Transportation (NYSDOT) rules and regulations. (2) In the event that the adjacent parcel to the east (SCTM#1000-75-1-15.3) is developed with a commercial and/or retail use, the Declarant shall file a Cross Access Easement in order to facilitate safe interconnectivity of the developed lots along NYS Rt. 25"; be it therefore RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program. Member Martin Sidor: and be it further RESOLVED, that the Southold Town Planning Board grants Approval to the Site Plan entitled "Renovations and Additions for Mmmm Beer, LLC', prepared by Robert I. Brown, R.A., dated July 12, 2014 and issued July 14, 2014, with one condition. Upon fulfillment of the condition listed below, the Board authorizes the Chairman to endorse the Site Plan and the following eleven (11) plans: 1. S1 — Site Plan 2. S2 — Site Plan Landscape and Lighting 3. S3 — Site Plan Drainage and Septic System 4. T1 NYDOT — Peconic Brewery 5. T2 NYSDOT— Site Plan Curb Cut 6. Al — First Floor Plan 7. A2 — Brewpub Plan 8. A3 —West & South Elevations 9. A4 — East & North Elevations 10.A5 — Brewpub Elevations 11.Separate Photometric Plan — (sheets 1-5) dated July 17, 2014 Condition: 1.
