Wrcl of Trustees Applicatice WETLAND/TRUSTEE LANDS APPLICATION DATA Purpose of the proposed operations: To maintain function and use of existing boat basin through replacement of existing bulkheading and jetty; dredging; and installation of floating dock for noncommercial boat dockage. Area of wetlands on lot: +/-2,800 square feet Percent coverage of lot: +/-3.8 Bio Closest distance between nearest existing structure and upland edge of wetlands: 51 feet Closest distance between nearest proposed structure and upland edge of wetlands: N/A feet Does the project involve excavation or filling? No X Yes If yes, how much material will be excavated? +/-75 cubic yards (dredge spoil from basin) How much material will be filled? +/-25 cubic yards (backfill in addition to spoil) Depth of which material will be removed or deposited: -3 feet ALW Proposed slope throughout the area of operations: 1:4 Manner in which material will be removed or deposited: Approximately 75 cubic yards of sand/silt spoil will be incidentally dredged via excavator and retained on site to be reused as backfill together with approximately 25 cubic yards sand/loam spoil to be trucked in from an approved upland source. Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by reason of such proposed operations (use attachments if appropriate): The project seeks to maintain the function and use of a historically existing boat basin through a) the in-place replacement of the bulkheading that forms the basin and the jetty that both maintains the shoreline and vegetated wetlands on the west side of the boat basin and prevents the in -filling of the basin; b) incidental dredging within 10 feet of the bulkheading and east side of the jetty to recover lost upland soils and maintain navigable water depths; and c) installation of a ramp and floating dock inside the basin. The adjacent upland has been improved with and supported and protected from flooding and erosion by the boat basin bulkheading since at least 1960, and the jetty that stabilizes the adjacent vegetated marsh has been in place since prior to 1977. Without maintaining these structures, the upland soils adjacent to the boat basin would erode into the basin, causing it to lose its form, function, and use; and the vegetated marsh adjacent to the west side of the jetty would likely be lost to erosion. Thus, it would be beneficial to the adjacent tidal wetlands and waters of the Town for the historically existing conditions to be maintained with the additional benefits of the existing chemically treated sheathing being replaced with untreated vinyl sheathing and the height of the jetty being lowered by 2 feet to an elevation just below average high water. Further, the spoil from the proposed incidental dredging, which is intended to restore sufficient, navigable water depths along the bulkhead, will consist primarily of sandy, upland soils lost to the basin through the aging bulkhead; the effects of turbidity associated with the dredging will be ephemeral, localized, and contained in the marina basin with a silt curtain deployed across the mouth of the basin; and although the dredging will temporarily disturb the bottom by physically removing shoaled sand and silt, the surrounding habitat will not be permanently impacted or otherwise significantly adversely affected. And the proposed ramp and float will be constructed with untreated decking and will be removed seasonally. 617.20 Appendix B Short Environmental Assessment Form Instructions for Comnletina Part I - Project Information. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria ❑ Yes ❑ No ® Not Applicable Pursuant to Town Code §268-5 ("Review of Actions") and the corresponding definitions of "action" and "minor action" by §286-3 ("Definitions"), the proposed project, i.e., maintenance of a historically existing boat basin through the in-place replacement of the bulkheading that forms the basin and the jetty that both maintains the shoreline and vegetated wetlands on the west side of the boat basin and prevents the in -filling of the basin, meets the following definitions of minor action and should thus be determined to be exempt from waterfront consistency review pursuant to Chapter 268: "B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site (in place)... except for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated, or reconstructed without a permit and shoreline erosion control structures...;" and "GG. Within all Town creeks, replacement of existing bulkhead on the applicant's property in the same location with a silt curtain deployed prior to and during construction." Attach additional sheets if necessary Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ® Yes ❑ No ❑ Not Applicable The proposed ramp and float will be constructed with untreated decking materials, as required by Chapter 275. The proposed incidental dredging within 10' of the bulkheading and east side of the jetty will not adversely impact water quality because the spoil will consist primarily of sandy, upland soils lost to the basin through the aging bulkhead, and the effects of turbidity will be ephemeral, localized, and contained in the marina basin with a silt curtain deployed across the mouth of the basin. Attach additional sheets if necessary Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY FORM Addendum for lay & Karen Quartararo 4294 Wunneweta Road, Cutchogue SCTM #1000-111-14-27.1 Policy 6. The project seeks to maintain the function and use of a historically existing boat basin through a) the in- place replacement of the bulkheading that forms the basin and the jetty that both maintains the shoreline and vegetated wetlands on the west side of the boat basin and prevents the in -filling of the basin; b) incidental dredging within 10 feet of the bulkheading and east side of the jetty to recover lost upland soils and maintain navigable water depths; and c) installation of a ramp and floating dock inside the basin. Although the in-place replacement of the bulkheading and jetty should be deemed exempt from waterfront consistency review as described in connection with Policy 4 above, the project in its entirety is nonetheless consistent with Policy 4 and Policy 6. Specifically, the adjacent upland has been improved with and supported and protected from flooding and erosion by the boat basin bulkheading since at least 1960, and the jetty that stabilizes the adjacent vegetated marsh has been in place since prior to 1977. Without maintaining these structures, the upland soils adjacent to the boat basin would erode into the basin, causing it to lose its form, function, and use; and the vegetated marsh adjacent to the west side of the jetty would likely be lost to erosion. Thus, it would be beneficial to the adjacent ecosystem for the historically existing conditions to be maintained with the additional benefits of the existing chemically treated sheathing being replaced with untreated vinyl sheathing and the height of the jetty being lowered by 2 feet to an elevation just below average high water. Further, the spoil from the proposed incidental dredging, which is intended to restore sufficient, navigable water depths along the bulkhead, will consist primarily of sandy, upland soils lost to the basin through the aging bulkhead; the effects of turbidity associated with the dredging will be ephemeral, localized, and contained in the marina basin with a silt curtain deployed across the mouth of the basin during construction and dredging; and although the dredging will temporarily disturb the bottom by physically removing shoaled sand and silt, the surrounding habitat will not be permanently impacted or otherwise significantly adversely affected. And the proposed ramp and float will be constructed with untreated decking and will be removed seasonally. The project will conform in all ways to the rules and regulations of the Town Wetlands Law, Chapter 275, and the New York State Tidal Wetlands Act, Article 25. See attached.
