office Dated May 22, 2014 pursuant to which Trustees Wetland Permit #8455 Dated
June 18, 2014, was issued and conforms to all of the
requirements and conditions of the applicable provisions of law. The project
for which this certificate is being issued is

I have reviewed the Declaration of Covenants draft you submitted to this, office with
respect to the above referenced application concerning the ten foot wide non -turf buffer
area located along the landward edge of the bulkhead to be established and subsequently
maintained, as depicted on the site plan prepared by En -Consultants, last dated May 18,
2014 and stamped approved June 18, 2014.
The covenants and restrictions document must be executed and filed with the County
pursuant to §275-10(K) of the Southold Town Code. Please note that a copy of this
document or, in the alternative, a sworn statement attesting to the filing is to be presented
to the Office of the Board of Trustees within 90 days of issuance of the permit.

DECLARATION OF COVENANTS
THIS DECLARATION made this 25th day of August, 2014, by Jay P. Quartararo and Karen Quartararo,
residing at 570 Duck Pond Road, Cutchogue, NY 11935 hereinafter referred to as "DECLARANTS":
WITNESSETH:
WHEREAS, DECLARANTS are the owners of certain real property located at 4294 Wunneweta Road,
Cutchogue, Town of Southold, County of Suffolk, State of New York, described in the Suffolk County Tax Map
as District 1000, Section 111, Block 14, Lot 27. 1, which is more particularly bounded and described as set forth
in Schedule "A" annexed hereto, hereinafter referred to as the "Property;"
WHEREAS, the Property is situated on lands within the jurisdiction of the Board of Trustees of the
Town of Southold (hereinafter the "Trustees") pursuant to Chapter 275 of the Town Code of the Town of
Southold or its successor, and various activities conducted upon the property may thus be subject to the
regulation and approval of the Trustees prior to being conducted;
WHEREAS, the DECLARANTS therefore made application to the Trustees for a permit pursuant to the
Wetlands Law of the Town of Southold to undertake certain regulated activities; and
WHEREAS, as a condition of the granting of a Wetlands Permit to undertake such regulated activities,
the Trustees required that a ten foot wide "nonturf buffer" be established and maintained landward of the
bulkhead,
NOW, THEREFORE, the DECLARANTS do hereby covenant and agree as follows:
1) Upon the substantial completion of the aforementioned permitted activities there shall be
established and subsequently maintained along the landward edge of the bulkhead on the subject
premises a ten foot wide "nonturf buffer" as defined by Chapter 275 of the Town Code; and
2) These covenants shall run with the land and shall be binding on the DECLARANTS, their assigns,
purchasers, or successors in interest and may be modified only upon resolution of the Trustees.

AUTHORIZATION
Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on June 18, 2014, and in
consideration of application fee in the sum of $250.00 paid by En -Consultants and subject to the Terms and
Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits the
following:
Wetland Permit to remove and replace in-place +/-182' of timber bulkhead forming
boat basin and +/-33' of timber bulkhead outside boat basin with vinyl bulkhead; remove and
backfill (2) existing dilapidated step-down platforms and bulkhead on seaward side of
platforms to be raised to same elevation as adjoining walls; remove and replace in-place +/-27'
timber jetty with low -sill vinyl jetty (+/-24" lower than existing); dredge up to 10' off boat basin
bulkheading and east side of jetty to a maximum depth of -36" ALW and use approximately 75

IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.

TERMS AND CONDITIONS
The Permittee, Jay P & Karen Quartararo residing at 4294 Wunneweta Road, Cutchogue, New York as part
of the consideration for the issuance of the Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all damages, or
claims for damages, of suits arising directly or indirectly as a result of any operation performed
pursuant to this permit, and the said Pennittee will, at his or her own expense, defend any and all
such suits initiated by third parties, and the said Pennittee assumes full liability with respect thereto,
to the complete exclusion of the Board of Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated time
required to complete the work involved, but should circumstances warrant, request for an extension
may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain
the structure or project involved, to provide evidence to anyone concerned that authorization was
originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its agents, and
non-compliance with the provisions of the originating application may be cause for revocation of
this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the beach
between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall
cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due
notice, to remove or alter this work project herein stated without expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded
with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the
subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this
permit.
9. That the said Board will be notified by the Permittee of the completion of the work authorized.
10. That the Pennittee will obtain all other pen -nits and consents that may be required supplemental to
this pennit, which may be subject to revoke upon failure to obtain same.
11. This permit does not convey to the permittee any right to trespass upon the lands or interfere with
the riparian rights of others in order to perform the permitted work nor does it authorize the
impairment of any rights, title, or interest in real or personal property held or vested in a person not
a party to the permit.

The Board of Town Trustees took the following action during its regular meetings held
on Wednesday, June 18, 2014 regarding the above matter:
WHEREAS, En -Consultants on behalf of JAY P. & KAREN QUARTARARO applied to
the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated May 22, 2014, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application to remove and replace in-
place +/-182' of timber bulkhead forming boat basin and +/-33' of timber bulkhead
outside boat basin with vinyl bulkhead; remove and backfill (2) existing dilapidated step-
down platforms and bulkhead on seaward side of platforms to be raised to same
elevation as adjoining walls; and remove and replace in-place +/-27' timber jetty with
low -sill vinyl jetty (+/-24" lower than existing) was found to be Exempt from the Local
Waterfront Revitalization Program policy standards, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application to
dredge up to 10' off boat basin bulkheading and east side of jetty to a maximum depth

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of JAY P. & KAREN
QUARTARARO to remove and replace in-place +/-182' of timber bulkhead forming boat
basin and +/-33' of timber bulkhead outside boat basin with vinyl bulkhead; remove and
backfill (2) existing dilapidated step-down platforms and bulkhead on seaward side of
platforms to be raised to same elevation as adjoining walls; remove and replace in-
place +/-27' timber jetty with low -sill vinyl jetty (+/-24" lower than existing); dredge up to
10' off boat basin bulkheading and east side of jetty to a maximum depth of -36" ALW
and use approximately 75 cubic yards spoil as backfill together with approximately 25
cubic yards of clean sand/loam to be trucked in from an approved upland source; install
a 3'x14' hinged ramp, and 5'x24' floating dock, and 4'x52' wood boardwalk landward of
bulkhead in northeast corner of boat basin; provide water and electricity to dock; with
the condition to establish and subsequently maintain a 10' wide non -turf buffer landward
of the bulkhead; and as depicted on the site plan prepared by En -Consultants, last
dated May 18, 2014, and stamped approved on June 18, 2014.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Approximately 75 cubic yards of sand/silt spoil will be incidentally dredged via excavator and retained on site to be
reused as backfill together with approximately 25 cubic yards sand/loam spoil to be trucked in from an approved upland

Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by
reason of such proposed operations (use attachments if appropriate):
The project seeks to maintain the function and use of a historically existing boat basin through a) the in-place replacement of the bulkheading that forms
the basin and the jetty that both maintains the shoreline and vegetated wetlands on the west side of the boat basin and prevents the in -filling of the basin;
b) incidental dredging within 10 feet of the bulkheading and east side of the jetty to recover lost upland soils and maintain navigable water depths; and c)
installation of a ramp and floating dock inside the basin. The adjacent upland has been improved with and supported and protected from flooding and
erosion by the boat basin bulkheading since at least 1960, and the jetty that stabilizes the adjacent vegetated marsh has been in place since prior to 1977.
Without maintaining these structures, the upland soils adjacent to the boat basin would erode into the basin, causing it to lose its form, function, and use;
and the vegetated marsh adjacent to the west side of the jetty would likely be lost to erosion. Thus, it would be beneficial to the adjacent tidal wetlands
and waters of the Town for the historically existing conditions to be maintained with the additional benefits of the existing chemically treated sheathing
being replaced with untreated vinyl sheathing and the height of the jetty being lowered by 2 feet to an elevation just below average high water. Further,
the spoil from the proposed incidental dredging, which is intended to restore sufficient, navigable water depths along the bulkhead, will consist primarily
of sandy, upland soils lost to the basin through the aging bulkhead; the effects of turbidity associated with the dredging will be ephemeral, localized, and
contained in the marina basin with a silt curtain deployed across the mouth of the basin; and although the dredging will temporarily disturb the bottom by
physically removing shoaled sand and silt, the surrounding habitat will not be permanently impacted or otherwise significantly adversely affected. And
the proposed ramp and float will be constructed with untreated decking and will be removed seasonally.

Policy 6.
The project seeks to maintain the function and use of a historically existing boat basin through a) the in-
place replacement of the bulkheading that forms the basin and the jetty that both maintains the
shoreline and vegetated wetlands on the west side of the boat basin and prevents the in -filling of the
basin; b) incidental dredging within 10 feet of the bulkheading and east side of the jetty to recover lost
upland soils and maintain navigable water depths; and c) installation of a ramp and floating dock inside
the basin. Although the in-place replacement of the bulkheading and jetty should be deemed exempt
from waterfront consistency review as described in connection with Policy 4 above, the project in its
entirety is nonetheless consistent with Policy 4 and Policy 6. Specifically, the adjacent upland has been
improved with and supported and protected from flooding and erosion by the boat basin bulkheading
since at least 1960, and the jetty that stabilizes the adjacent vegetated marsh has been in place since
prior to 1977. Without maintaining these structures, the upland soils adjacent to the boat basin would
erode into the basin, causing it to lose its form, function, and use; and the vegetated marsh adjacent to
the west side of the jetty would likely be lost to erosion. Thus, it would be beneficial to the adjacent
ecosystem for the historically existing conditions to be maintained with the additional benefits of the
existing chemically treated sheathing being replaced with untreated vinyl sheathing and the height of
the jetty being lowered by 2 feet to an elevation just below average high water. Further, the spoil from
the proposed incidental dredging, which is intended to restore sufficient, navigable water depths along
the bulkhead, will consist primarily of sandy, upland soils lost to the basin through the aging bulkhead;
the effects of turbidity associated with the dredging will be ephemeral, localized, and contained in the
marina basin with a silt curtain deployed across the mouth of the basin during construction and
dredging; and although the dredging will temporarily disturb the bottom by physically removing shoaled
sand and silt, the surrounding habitat will not be permanently impacted or otherwise significantly
adversely affected. And the proposed ramp and float will be constructed with untreated decking and
will be removed seasonally. The project will conform in all ways to the rules and regulations of the
Town Wetlands Law, Chapter 275, and the New York State Tidal Wetlands Act, Article 25.
