Y. The findings of the Board are that for zoning purposes the applicant has three front yards, the house is located running lengthwise with the lot and facing Cedar Drive. The depth of the lot inhibits. locating a swimming pool in the rear yard. The size of this lot and others in the surrounding area was established before the passage of a zoning ordinance. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and thevariance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. BASIS OF APPLICATION: Request for Variances from Article III Code Section 280-15 and the Building Inspector's September 5, 2013 Notice of Disapproval based on an application for building permit for"as Built" in- ground swimming pool and `as Built' shed, at; 1) in-ground swimming pool in location other than code required rear yard,2)accessory shed in location other than the code required rear yard. RELIEF REQUESTED: The applicant requests variances for an as built in-ground swimming pool with raised patio located in the front yard and not in the location granted under ZBA#2128 and the building permit and "as built"accessory shed in the front yard. ADDITIONAL INFORMATION: This property was the subject of two ZBA variance hearings. The first on January 12, 1972 file#1491 granted front and rear yard setbacks for the dwelling. The second on May 2, 1976 file 42128 granted the location of an in-ground swimming pool in the front yard on the south side of the dwelling and in-line with the dwelling. It was also noted at the hearing that the second shed on the subject property is in a non-conforming front yard location. The applicant stated he would relocate the shed to the south side of the dwelling, in the architectural rear yard and within the boundaries of the pool fence, so it would be in a more conforming location,albeit still technically a front yard. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 5,2013 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law&267-b(3)(b)(1). Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The swimming pool was constructed in the wrong location and has been there since 1976 without any negative impacts. The accessory shed can be reduced in size and become more conforming. The pool area is visually enclosed by landscaping and most of the property is surrounded by lavender fields rather than dwellings. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The subject property has three front yards and a very narrow and non-functional rear yard making conforming locations for accessory structures virtually impossible. The swimming pool is existing and would be a costly hardship to relocate. The sheds on the property by alternative relief can be relocated and reduced in size to be more conforming to the code. 3. Town Law.267-b(3)(b)(3)The variances requested therein are mathematically significant representing a 100% relief from present code requirements. The applicant was granted a variance for the front yard location of the swimming pool. However, it was placed in the wrong location by error. The shed will be reduced to a conforming small sound deadening structure and the other shed will be re-located to a more conforming location. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. It was the applicant's responsibility to oversee that the placement of the swimming pool was done in accordance to the variance that was granted. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate is the minimum action necessary to enable the applicant to enjoy the benefit of the existing in-ground swimming pool with raised patio and the reduced shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variance as applied for the in-ground swimming pool with raised patio and DENY as applied for the shed, and GRANT ALTERNATIVE RELIEF as noted below: The shed closest to Cedar Lane shall be replaced with a sound deadening structure to cover the pool equipment, not to exceed four feet in height above grade.
