SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 19, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject property consists of 2.8765 acres and is zoned general business. The property is a corner lot with 368.97 frontage on the Main Road (Rout 25) and 382.63 feet of frontage on Peconic Ave. The property runs 310.3 feet on the East side and 361.77 feet on the North side. There is a one story brick, stucco, and concrete block building on the property, a one story concrete block and frame building, a concrete foundation and a 30'X40' pole barn under construction. All is shown on a survey by John T. Metzger L.L.S. dated November 29, 2011 and last updated June 24, 2014. BASIS OF APPLICATION: Request for Variance from Article III Section 280-15 and the Building Inspector's May 28, 2014 Notice of Disapproval based on an application for building permit for an `as built' accessory storage building, at; 1) location other than the code required rear yard. RELIEF REQUESTED: The applicant requests a variance to locate a (partially as-built) 30' x 40' Proposed Pole Barn in a front and side yard location, where the code requires that accessory structures be located in a rear yard location. As shown on the Survey of Property prepared by John T. Metzger, L.S. dated November 29, 2011, last revised June 24, 2014 (revisions), and the architectural drawings prepared by James A. Koppenhaver, RE, sheets A.1, A.2, A.3 and A.4 all dated 3/17/14. ADDITIONAL INFORMATION: The Planning Board is presently reviewing a Site Plan application of the subject parcel. In a memorandum to the ZBA dated July 9, 2014, the Planning Board indicated that it has no objection to the proposed location of the subject Pole Barn. Subject parcel had prior variances before this Board. In 1964 under Page 2 of 3—July 24,2014 ZBA#6770—MMMM Beer,LLC SCTM#1000-75-1-14 appeal #673 the property owner was granted a variance to install a parking lot and sell new and used cars. In 2013 under file #6621, the current owner was granted a variance to demolish and re-construct a portion of the commercial building. Additionally, the current owner under file #6759 was granted a special exception permit to create a drinking establishment. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July10,2014, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The area is zoned for business and the proposed as-built location of the Pole Barn and its use is in keeping with the business zone. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The subject parcel has two front yards which creates a unique rear yard area where it is not functionally practical to locate a storage building for actively used supplies associated with the operation of the adjacent brewery building. Furthermore, the rear yard location is required for additional on-site parking. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, the proposed as-built location will have a conforming front yard and side yard setback. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this business community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and must receive Site Plan approval. 5. Town Law X267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory storage Pole Barn, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Weisman (Chairperson), and duly carried,to GRANT, the variance as applied for, and shown on the Survey of Property prepared by John T. Metzger, L.S. dated November 29, 2011, last revised June 24, 2014 (revisions), and the architectural drawings prepared by James A. Koppenhaver, RE, sheets A.1, A.2, A.3 and AA all dated 3/17/14. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated January 8, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject property is improved with two one story brick, stucco, concrete block buildings in the General Business `B" Zone and contains 2.8765 acres. It has 382.63 feet of frontage on Peconic Lane, 368.97 feet on Main Road (aka State Route 25) 310.07 feet along the eastern property line and 361.77 feet on the southern property as shown on the site plan dated June 12, 2012, revised 12/14/12 prepared by Robert I.Brown, RA. BASIS OF APPLICATION: Request for Variance from Article Xi Section 280-47 and the Building Inspector's December 12, 2012 Notice of Disapproval based on an application for building permit for demolition and reconstruction of a portion of an existing commercial building at: 1) less than the code required front yard setback of 100 feet. RELIEF REQUESTED: The applicant requests a variance to demolish and reconstruct a portion of the existing building located at 80 feet 8 inches from Peconic Lane where the code requires a 100 foot front yard setback. ADDITIONAL INFORMATION: The Zoning Board request comments on this application from the Planning Board. In a memo dated February 7, 2013, the Planning Board,"stated no objection to the requested area variance on the basis the building is existing,not expanding its footprint and is appropriate for the overall use of the site and building." They further stated, "the proposed construction appears to be well screened by the existing buildings and accessible by large vehicles from Peconic Lane." FINDINGS OF FACT/REASONS FOR BOARD ACTION: EIVED 10 JUN 1 x"2014 Page 2 of 3—February 28,2013 ZBA File#6621—MMMM Beer,LLC CTM: 1000.75-1.14 BOARD OF APPEALS The Zoning Board of Appeals held a public hearing on this application on February 7,2013 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The area is zoned for business and this proposal is in keeping with the business zone. The building on the subject property is currently an abandoned car dealership in disrepair and an eye sore. This proposal will be a positive improvement to the neighborhood 2. Town Law 6267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The buildings exist in their non-conforming location and the applicant is proposing to add an addition on top of a 39 ft. x 48 ft. section of the existing structure to create a new cold room (38 ft. x 48 ft. x 28 ft.) for their business operation within the existing footprint, and a small 12'X14' (approx.)addition. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 19.2% relief from the code. However,the area of the proposed construction is on the rear of the building. 4. Town Law 6267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 6267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 6267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an improved business building while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Schneider, and duly carried,to GRANT, the variance as applied for, and shown on the site plan dated June 12, 2012, revised 12/14/12 prepared by Robert I. Brown,RA. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
