SCHWARTZ, residing at 2425 Mill Creek Drive, Southold, New York 11971, party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of`land.,with the buildings and improvements thereon erected, situate. lying and being itrvket at Southold', Town of Southold, County of Suffolk and State of New York, bounded and described as follows : BEGINNING at a monument on the southerly side of Mill Creek Drive West distant westerly 2.98 . 56 feet from a point where the westerly side of Richmond Avenue if prolonged southerly would intersect the southerly side of Mill Creek Drive West; from said point of begin- ning running thence South 2$° `32 ' 10" East, a distance of 212 feet more or less along land of 'Ulrich to the northerly line of Arsha- momoque Pond; thence Southwesterly along the northerly line of Arshamomoque Pond 120 feet more or less to the easterly side of the cove; thence along the easterly side of the cove on a course having a tie line bearing North 210 43 ' 00" West 185 . 55 feet a dis- tance of 185 feet more or less to the southerly side of Mill Creek Drive West; thence along the southerly side of Mill Creek Drive West, North 43 ° 57 , 5011 East a distance of 100 feet to a monument at the point or place of beginning. SAID premises being known as and by street number 2425 Mill Creek Drive, Southold, New York . BEING the same premises conveyed to the grantors herein by deed from PETER NEU surviving spouse of BETTY NEU, dated July, 1981 , and recorded July 31, 1981, in the office of the Clerk of Suffolk County, in Liber 9045, page 263 . This conveyance is made without any monetary consideration, for love and affection by ALBERT SCHWARTZ and MURIEL SCHWARTZ, who are husband and wife, in order to convey the husband ' s interest in the property to his wife, MURIEL A. SCHWARTZ, said MURIEL A. SCHWARTZ, the grantee herein, being the same person as MURIEL SCHWARTZ, one of the grantors herein. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part. the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part,in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
