HomeMy WebLinkAboutLP-05/27/2014 LAND PRESERVATION COMMITTEE MEETING Minutes & Discussion Notes from Meeting held Tuesday, May 27, 2014 at 7:00 p.m. Town Hall Annex Executive Board Room Members Present: John Sepenoski, Chairman Anne Murray Maureen Cullinane Sam McCullough Lillian Ball Members Absent: Peggy Dickerson Eric Keil Also present: Melissa Spiro, Land Preservation Coordinator Melanie Doroski, Land Preservation Secretary Bob Ghosio, Town Board Liaison Luke McKay, Peconic Land Trust Commencement:  The meeting began at 7:04 p.m. with five LPC members present. Adoption of Meeting Minutes:  Acceptance of LPC meeting minutes from March 18, 2014, April 15, 2014 and May 13, 2014 MOTION made by Sam McCullough, seconded by Anne Murray, to accept the 3/18/2014 LPC meeting minutes. Motion carried: 4/0/1 (John Sepenoski abstained as not present for 3/18/14 LPC meeting) HOLD acceptance of 4/15/2014 LPC meeting minutes as no quorum for vote. MOTION made by Maureen Cullinane, seconded by Lillian Ball, to accept the 5/13/2014 LPC meeting minutes. Motion carried: 4/0/1 (Anne Murray abstained as not present for 5/13/14 LPC meeting) Land Preservation Applications and Inquiries:  SCTM #1000-97.-1-12.8 (CALABRESE) Update re: status. Review potential for grant RFP Appraisal previously authorized by LPC members will be ordered. Easement will include language to allow for legal access to Reserve Area. Exact location will not need to be defined. Appraiser to be instructed to value access to Reserve Area as an adjustment within the appraisal. Pond area considered unbuildable land and any per acre value for development rights will not include pond area.  UPDATE re: County PDR projects and SCTM #1000-68.-4-18: County request re: partnering LPC Chairman John Sepenoski absented himself from the meeting for any discussions on the Sepenoski proposed County project due to a family relationship to landowner, John B. Sepenoski, Jr. (cousin). SEPENOSKI – County has proposed to the Town that County is willing to make an offer to landowner, John B. Sepenoski, Jr., for a farmland development rights easement on SCTM #1000-68.- 4-18 provided Town will enter into a 50%/50% partnership for the purchase of said easement. LPC discussed conflicts between Town program and County program. LPC members in favor of partnering with County provided County is willing to work out mutually agreeable easement language that conforms to Southold Town Code. Melissa Spiro, Land Preservation Coordinator, to send letter of acceptance of partnership with conditions to Janet Longo, Suffolk County Planning – Division of Real Estate.  SCTM #1000-81.-1-24.3 (PARADISE POINT) Review new application There are several landowners, represented by an attorney, that made an offer to the Town for the purchase of property known as Paradise Point (SCTM #1000-81.-1-24.3). Property is located at the end of a private road and surrounded on three sides by water. Upland area is limited which includes the paved parking area. The residential structure and bulkheading were destroyed in Super Storm Sandy. EXECUTIVE SESSION. The LPC members entered into Landowners offered purchase price to the Town was discussed. END OF EXECUTIVE SESSION LPC members are not in favor of recommending purchase at substantial cost to Town. LPC favorable to re-reviewing if offered price is reduced to what may be considered a “token” consideration.  SCTM #1000-121.-7-14.1 (FARMVEU OPEN SPACE) Review inquiry Farmveu homeowners association has inquired to the Town about accepting a donation of its subdivision open space area being about 50± acres in the area around Laurel Lake Preserve. LPC members discussed donation of this property which is not on the CPF Project Plan List so may not be eligible for using CPF funds for closing expenses or future stewardship projects costs. LPC is favorable to accepting donation of subdivision open space (SCTM #1000-121.-7-14.1) and would recommend that the Town Board accept this property donation if it is formally offered to the Town since it would be a worthwhile addition to Laurel Lake Preserve and its ecological trail systems. Applications & Inquiries for Uses or Structures on Preserved Property: None Stewardship and Management:  SOUND VIEW DUNES PARK (f/k/a Bittner) – update re: NYS DOS grant status Town received notice that NYS-DOSgrant will not be extended beyond its expiration date of 12/31/2014. Mark Terry (Planning Dept) is working on RFP for phragmite eradication at Sound View Dunes Park. It is a three phase project; however, with grant expiration date, only Phase 1 of the intended project will be completed before grant deadline which would mean that the Town/CPF would have to fund Phase 2 & 3 to complete the eradication project beyond 2014. LPC members favorable to moving forward with Phase 1 in phragmite eradication at Sound View Dunes Park. Melissa instructed to inform Mark Terry to discuss situation with Town Board to seek approval for starting Phase 1 and the Town/CPF’s future funding of Phase 2 and Phase 3 if grant does not cover these expenses. Suggestion was made to see if RFP could include contractual prices for all three phases of project and then submitted to NYS-DOS for grant funding; however, it was felt that State grant would only cover each completed phase of the project and some phase would not be completed until after grant termination date. Addition to Agenda:  SOUND VIEW DUNES PARK – report from John Sepenoski, Chairman Piping Plover nesting in eastern roped-off section at Sound View Dunes Park. Eggs reported o being seen in the nests. More campfires noted within the park and it appears that live dune shrubbery is being o uprooted and burned. It appears that “kids” have somewhat gotten the message about cleaning up after themselves as party trash left behind has decreased. LPC member Lillian Ball suggested that Boy Scout groups be contacted via Jim McMahon (DPW) to see if they’d be willing to provide a trash clean-up crew at Sound View Dunes Park. LPC chairman, John Sepenoski, preferred clean-up crew start at Laurel Lake Preserve. Melissa will contact Jim McMahon with suggestions. General Land Preservation Items:  NYS DEPARTMENT OF AGRICULTURE & MARKETS Round 13 Farmland Protection Implementation Grants Request Review potential projects for RFP Deadline for submission of grant proposal is July 14, 2014. Melissa Spiro, Land Preservation Coordinator, suggested Calabrese farmland development rights easement project as a potential grant proposal submission. LPC favorable to submitting this project for grant and instructed Melissa to move forward if she finds that project meets grant submission requirements. Next Regular Meeting:  Tuesday, June 10, 2014. The next regular meeting will be on Adjournment:  The meeting was adjourned at 8:31 p.m. by the five attending LPC members.
