HomeMy WebLinkAboutLL-1987 #05LOCAL LAW NO. 5 , 1987 A Local Law in relation to boat operators, boat equipment and anchoring in West Harbor BE IT ENACTED by the Town Board of the Town of Southold, as follows: (additions indicated by underline; deletions by [brackets]) II. Article III (Boats) of Chapter 32 of the Code of the Town of Southold, Section 32.31. DefinitiOns. is amended as follows: BOATS - Every vessel propelled in any manner. [,except vessels having a valid marine document issued by the Federal Bureau of Customs or any foreign government. ] Articlelll; Chapter 32 is amended by adding two new sections thereto, to be Section 32-36.1 and Section 32-36.2, to provide as follows: Section 32-36.1 Equipment All pleasure vessels and uninspected commercial vessels shall be equipped and licohted while under way or at anchor with any person aboard, as required under the Federal Boat Safety Act of 1971, as amended, and the regulations adopted pursuant thereto and contained in Title 46 of th~ Code of Federal Rules, Subchapter C, Parts 24, 25 and 26, and pursuant to the provisions of Section 40 of the Navigation Law of the State of New York. Failure to comply with the equipment and lighting requirements as set forth above shall be a violation of this Chapter. B. The provisions of this section shall not apply to vessels competing in. duly authorized regattas and trials preceding such regattas. Section 32-36.2 Boat Operators. A. No person under the age of sixteen (16) years shall operate a mechanically propelled vessel unless: (1) The operator, who is under the ac3e of sixteen (16) years, is accompanied therein by a person who is 'sixteen (16) years of age or older; or (2) The operator is ten (10) years of a~3e or older and is the holder of a boating safety certificate issued to him by the Commissioner of the Office of Parks and Recreation of the State of New York, pursuant to Section 78 of the New York State Navicdation Law. The failure of a person specified in Section 32-36.2(2) hereof to exhibit a boating safety certificate upon demand to any peace officer or other officer havint3 authority to enforce the provisions of this Chapter shall I?e presumptive evidence that such person is not the holder of such certi fi cate. C. No person who is the owner of a motorboat shall knowinC31y authorize or i~ermit the operation thereof unless: (I) The operator is sixteen (16) years of a.c]e or older; (2) (3) The operator, who is under the age of sixteen (16) years, is accompanied therein by a person sixteen (16) years or older; or The operator is ten (10) years of age or older and is the holder of a boating safety certificate issued to him by the Commissioner of the Office of Parks and Recreation of the State of New York. No person shall operate a vessel while in an intoxicated condition or while his ability to operate such a vessel is impaired by the consumption of alcohol or by the use of a druc3. -2- 111. Section 32-39.2A (anchoring in West Harbor) of Article III (Boats) of Chapter 32 of the Code of the Town of Southold is amended as follows: All boats temporarilY anchored in West Harbor at Fishers Island shall anchor [north of Goose Island.] in an area assicjned by the Harbor Master or Bay Constable. (1) Anchorincj shall not be permitted for a continuous period of mor~ than three (3) days unless authorized by the Harbor Master or ~ay Constable, which authorization may only be 9ranted for emergency situations.
