HomeMy WebLinkAboutLL-1986 #16LOCAL LAW NO. 16 , 1986 A Local Law in Relation to Board of Appeals Fees BE IT ENACTED by the Town Board of the Town of Southold as follows: Chapter 100 (Zoning) of the Code of the Town of $outhold is hereby amended as follows: 1. Section 100-124 thereof is amended to read as follows: 100-124. Fees All applications to the Board of Appeals for any relief herein shall be accompanied by a fee of one hundred fifty ($150.) dollars. 2. This Local Law shall take effect upon its filing with the Secretary of State. (Please Use this Form for Filing your Local Law with the Secretary of State) Text of law should be $iven as amended. Tasker SUPERVISOR MURPHY: I'd like to open the first public hearing, and it's on a proposed "Local Law in Relation to Board of Appeals Fees," and I'd like to ask Councilman Schondebare to read the official meeting notice. COUNCILMAN SCHONDEBARE: "Public Notice is hereby given that there has been presented to the Town Board of the Town of Southold, Suffolk County, New York, on the 6th day of November, 1986, a Local Law entitled, "A Local Law in Relation to Board of Appeals Fees." Notice is further given that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at the Southold Town Hall, Main Road, Southold, New York, on the 2nd day of December, 1986, at 8:00 o'clock P.M., at which time all interested persons will be heard. This proposed "Local Law in Relation to Board of Appeals Fees" reads as follows: BE IT ENACTED by the Town Board of the Town of Southold as follows: Chapter 100 (Zoning) of the Code of the Town of Southold is hereby amended as follows: 1. Section 100-124 thereof is amended to read as follows: 100-124. This Local Law shall take effect upon its filing with the Secretary of State. Copies of said Local Law are available in the Office of the Town Clerk to any interested persons during business hours. An affidavit of publication of same from The Suffolk Times. I have an affidavit from the Town Clerk indicating she posted same on the Town Clerk's Bulletin Board. I have a communication by letter from Bennett Orlowski, Chairman of the Planning Board, dated November 12, 1986 in which in sum and substance they say: "Resolved that the Southold Town Planning Board recommend to the Southold Town Board that the proposed Local Law entitled "A Local Law in Relation to Board of Appeals Fees" be adopted. I have a communication from the County of Suffolk, dated November 12, 1986, from Lee E. Koppelman, which says that this is a local determination and tha~s neither approval nor disapproval by them. That ends the reading of that. Very simply we're increasing it to $150.00 from $75.00. SUPERVISOR MURPHY: Okay, you've heard the official reading. Is there anyone here would like to speak in favor of this Local Law? On my left? The middle? The right? (No response.) JUSTICE EDWARDS: Frank, I think we can probably tell the public here, unless they've heard it before, that in setting up the budget for 1987 we tried to get each one of the various departments to more or less carry their own weight, and in other words, that the Zoning Board of Appeals, their fees, should pay for the time that they spend in there--their salaries and so forth. So that's the reason that we're increasing these fees. Also we did the Trustee fees last meeting, and only today I went in and applied for a Dock Permit for a house on Fishers Island, and they hit me with $150.00 fee. There it is.
